    Abstract: What is 'modern slavery' and who is responsible for it? What is the relevance of human rights law, which primarily regulates state conduct, for practices predominantly committed by private actors? Where can victims seek justice and redress when national authorities fail to protect them? These questions are the core focus of this book.Marija Jovanovich analyses the role and responsibility of states for addressing 'modern slavery' – a diverse set of practices usually perpetrated by non-state actors – against the backdrop of international human rights law. It explores the dynamic between criminal law and human rights law and reveals the different ways these legal domains work to secure justice for victims. The book considers the 'absolute' nature of the prohibition of modern slavery in human rights law, the range of practices covered by this umbrella term and their mutual relationships, the positive obligations of states established by international human rights tribunals owed to individuals subject to modern slavery, and the standards for assessing state responsibility in these situations. By engaging with the concept of exploitation in human rights law, Jovanovich glues together diverse practices of modern slavery, including servitude, forced labour, and human trafficking, into a coherent concept. The book elucidates the theoretical foundations of this fundamental human right and explains why human trafficking has an independent place within it. In addition to providing a comprehensive critique of the existing human rights jurisprudence, this book offers a roadmap for the future development of law on this subject emphasizing the limits of human rights law as a tool for addressing modern slavery.

    Abstract: This book examines the socio-economic rights challenges of refugees and asylum seekers in Africa.     Abstract: Professor Zhiping Liang offers a new understanding of Chinese legal tradition in this profoundly influential book. Unlike the available literature using the usual method of legal history research, this book attempts to illustrate ancient Chinese legal tradition through cultural interpretation. The author holds that both the concept and practice of law are meaningful cultural symbols. The law reveals not only the life pattern in a specific time and space but also the world of the mind of a specific group of people. Therefore, just as cultures have different types, laws embedded in different societies and cultures also have different characters and spirits. Believing that human experience is often condensed into concepts, categories, and classifications, the author begins his discussion with the analysis of relevant terms and then seeks to understand history by interpreting the interaction and interconnectedness of the words, ideas, and practices. Based on the same understanding, the author uses modern concepts reflectively and critically, consciously exploiting the differences between ancient and contemporary Chinese and Western concepts to achieve a more realistic understanding of history while avoiding the ethnocentrism and modern-centrism common in historical studies.

    Abstract: This edited volume critically examines the Responsibility to Protect (R2P) as a guiding norm in international politics. After NATO’s intervention in Libya, against the backdrop of civil wars in Syria and Yemen, and because of the cynical support for R2P by states such as Saudi Arabia, this norm is the subject of heavy criticism. It seems that the R2P is just political rhetoric, an instrument exploited by the powerful states. Hence, the R2P is being challenged. At the same time, however, institutional settings, normative discourses and contestation practices are making it more robust. New understandings of responsibility and the politics of protection are creating new normative spaces, patterns of legitimacy, and norm entrepreneurs, thereby reinforcing the R2P. This book’s goals are to discuss the R2P’s roots, institutional framework, and evolution; to reveal its shortcomings and pitfalls; and to explore how it is exploited by certain states. Further, it elaborates on the R2P’s strength as a norm. Accordingly, the contributions presented here discuss various ways in which the R2P is being challenged or confirmed, or both at once. As the authors demonstrate, these developments concern not only diplomatic communication and political practices within international institutions, but also to normative discourses. Furthermore, the book includes chapters that reevaluate the R2P from a normative standpoint, e.g. by proposing cosmopolitan standards as a guide for states’ external behavior. Other contributors reassess the historical evidence from U.N. negotiations on the R2P principle, and the productive or restrictive role of institutions. Discussing new issues relating to the R2P such as global and regional power shifts or foreign policy, as well as the phenomenon of authoritarian interventionism under the R2P umbrella, this book will appeal to all IR scholars and students interested in humanitarianism, norms, and power. In recent years, however, critical scholars have investigated the deep linkages between the concept of development, the doctrines and institutions of international law, and broader projects of ordering at the international level. They have shown how the leading models de-radicalise, if not derail, initiatives to redefine development and pursue other forms of global well-being. Bringing together scholars from both the Global South and the Global North, the contributions in this Handbook invite readers to consider the limits of common normative and developmentalist assumptions. At the same time, the Handbook demonstrates how disparate but still identifiable set of ideas, imaginaries, norms, and institutional practices - related to law, development and international governance - shape today's profoundly unequal material conditions, threatening the future of human and nonhuman life on the planet. Jahrhunderts anhand des Beispiels Kongo (heutige Demokratische Republik Kongo) aufgearbeitet. Hierbei wird die Geschichte des ressourcenreichen Landes mit der Völkerrechtsgeschichte der Dekolonialisierung verbunden. In den Vordergrund rückt dabei die sog. Dependenztheorie. Diese aus den sechziger und siebziger Jahren stammende Theorie, wonach aus dem Kolonialismus hervorgegangene hierarchische Abhängigkeitsstrukturen eine Entwicklung der neuerdings unabhängigen Entwicklungsländer auch in der postkolonialen Ära begrenzen, wurde im letzten Jahrzehnt in der Völkerrechtsgeschichte aus postkolonialer Perspektive wiederentdeckt. Das Buch zeigt auf, dass die Dependenztheorie als Erklärung für die weiterhin bestehenden vielschichtigen Probleme im Kongo relevant bleibt.     Abstract: This book examines the geostrategic alliances in the Eastern Mediterranean and MENA regions. It analyzes how these alliances transcend stereotyped political and cultural prototypes throughout western Eurasia as the outcome of shifting regional power balances. The authors explain how this development has its foundation mostly in the United States' ‘Pivot to Asia’ policy, resulting in a lower priority ranking of the Middle East for Washington, but also in the emergence of China’s economic incursion on the wider region. The book looks into and presents different reasons for this paradigm shift: First and foremost, the historical ambitions and conflicting assertions of sovereignty in the region. Then, competition over control of hydrocarbons reserves and pipeline politics, civil wars, and political chaos in certain littoral states. US retrenchment and Russia’s naval base expansion in Syria, as well as Turkish expansion in Libya, NATO allies divisions and, not to reckon with, waves of migration and refugees. Yet some internal and external factors could lead to some changes in these trends, including the need to engage in energy transitions due to climate change consequences in the region.     Abstract: In the last decades, violent non-state actors (VNSAs) such as rebel and terrorist organizations have proved their capacity to break international law. The international community, particularly the United Nations (UN), has reacted to this development by redirecting its conflict resolution efforts to these non-state entities. This has turned targeted sanctions into one of the most vital and indispensable foreign policy tools available to the UN Security Council in combating terrorism and contributing to the peaceful resolution of (intra-state) conflicts. Despite the UN Security Council’s growing tendency to sanction VNSAs, there has been little research analyzing the effects of UN targeted sanctions on these non-government actors. This book seeks to fill this gap and shifts the focus on non-state actors by ascertaining the general mechanisms through and conditions under which UN targeted sanctions imposed on VNSAs tend to be effective. The tripartite empirical analysis combining quantitative and qualitative research methods demonstrates that the state-centric understanding of how sanctions work is not simply applicable to the effective sanctioning of violent non-state actors such as rebel and terrorist movements. About the author Christopher Huber is a Research Fellow associated with the GIGA German Institute for Global and Area Studies in Hamburg. His research focuses on international sanctions, counterterrorism and religious conflicts.

    Abstract: This book examines the ongoing power transition and its ramifications for world order from an international society perspective. In that perspective, the outcome of big changes in the distribution of power is a matter of socialization rather than structural determination or the resilience of the so-called Liberal world order. Consequently, the key question of this book is how the ongoing power transition affects, and is affected by, the social institutions of world order including sovereignty, the balance of power, international law, diplomacy, trade, humanitarian intervention, national self-determination, and environmental stewardship. The guiding theoretical assumption of the book is that power transition stimulates fundamental institutional change rather than major conflict or a breakdown of international order, while international organizations are key arenas for the realization and negotiation of such changes, not the victims of hegemonic retreat. The argument is pursued in sections on rising and declining powers (Anglo-America, Russia, China and the EU, among others), consequences for the fundamental social institutions and changes in international organizations, globally and regionally. In combination, the chapters reveal the contours of the coming world order. Tonny Brems Knudsen is Associate Professor of International Relations at the Department of Political Science, Aarhus University, Denmark. Cornelia Navari is Visiting Professor of International Affairs at the University of Buckingham and Emeritus Senior Lecturer at the University of Birmingham, UK.

    Abstract: The space occupied by international law in shaping political action is subject to continuing debate and controversy. This book aims to answer the question of how and why international law impacts the behaviour of actors on the international stage in the absence of central authority and faced with asymmetric power. At a time when the role of normative restraints in international relations, and international law in particular, has come under renewed questioning, it advances an analytical framework for understanding the effect of norms on behaviour that is not contingent on material restraints or a given political constellation, while being informed by the practical realities and practice of international organisation. In doing so, this book draws on an interdisciplinary range of sources, including international law, political theory, cognitive psychology and behavioural economics to explore a communicative action-based approach of how norms and ideas persuade actors to engage in a course of action consonant with international law to achieve a particular outcome. In probing the role of norms on questions such as the use of force and accountability, and issues of equity and justice, it examines the challenges international law faces and what the way forward may look like. Alain Germeaux joined the diplomatic service after working as Research Fellow at the Research Centre on Normative Orders, the University of California, Los Angeles, USA, and the University of Cambridge, UK. He is legal adviser to the Luxembourg foreign ministry and served on the UN Security Council, the European Union, and as agent to the Court of Justice of the European Union and head of delegation to the International Criminal Court. He holds degrees in Public International Law and European Law from Université Paris I (Panthéon-Sorbonne) and the University of Hamburg, and a PhD from the University of Frankfurt am Main.

    Abstract: This book focuses on the enforcement aspect of tobacco control policy, and argues that the intense regulation of the tobacco market will never be successful as long as it can be circumvented by the availability of illicit tobacco products. Yet, current efforts to combat illicit tobacco trade are insufficient, suffering from several flaws and gaps at the regulatory and operational levels. The aim of this book is to provide an analysis of the legal framework and practice of enforcement with regard to illicit tobacco products. Combining criminological and legal perspectives, it presents and critically analyses the phenomenon of illicit tobacco trade, as well as the policies, legal frameworks and practices in six EU countries with regard to combatting this phenomenon, assessing the strengths and weaknesses of their approaches. Furthermore, it studies the relationship between the EU and third countries (e.g. Ukraine) in terms of how the EU can influence policy and enforcement in these countries in order to counter illicit tobacco trafficking. Not exclusively focusing on the EU, the book also includes an analysis of enforcement against illicit tobacco products in the US. The EU Member States analysed in the book (Belgium, Germany, Italy, Latvia, the Netherlands and Poland) reflect the range of currently available approaches. Some of them have ratified the WHO Protocol against tobacco smuggling; others have not. They belong to different legal traditions and face different challenges due to their respective border situations. While Belgium and the Netherlands are key entry ports to the EU, Poland and Latvia represent the Eastern land border of the EU, with various regional challenges. Italy has a long maritime border, where trafficking is possible from Northern Africa and from the Middle East. It also has significant experience in fighting organised crime. Lastly, Germany is the largest market in Europe and situated in the middle of these trafficking routes.

    Abstract: This book offers a distinctive approach to the key international instrument on indigenous rights, the United Nations Declaration on the Rights of Indigenous Peoples (Declaration) based on a new account of the political history of the international indigenous movement as it intersected with the Declaration's negotiation. The current orthodoxy is to read the Declaration as containing human rights adapted to the indigenous situation. However, this reading does not do full justice to the complexity and diversity of indigenous peoples' participation in the Declaration negotiations. Instead, I argue that the Declaration should be subject to a novel, mixed-model reading that views the Declaration as embodying two distinct normative strands that serve different types of indigenous peoples. Not only is this model supported by the Declaration's political history and legal argument, it provides a new and compelling theory of the bases of international indigenous rights while clarifying the vexed question of who qualifies as indigenous for the purposes of international law.

Challenging conventional thinking that understands war as a problem to be solved and law as an antidote to organized but unruly violence, this book situates the promotion and protection of human rights within the wider context of the modernist project, particularly during the epoch of the Anthropocene. Taking a critical perspective that draws on concepts found in the work of Michel Foucault, Pierre Bourdieu and Bruno Latour, this book casts new light on the ways in which the politics of war, law and rights produces profound insecurities for the human species as well as for other life forms and life systems on this planet. Damien Rogers is Senior Lecturer in Politics and International Relations at Massey University, Auckland. A graduate of four universities, he holds a PhD in Political Science and International Relations from the Australian National University and a PhD in Law from the University of Waikato.

    Abstract: The issue of nuclear justice has recently gained prominence in international debates about nuclear weapons. In this report, Jana Baldus, Caroline Fehl and Sascha Hach present a systematic review of the global progress in achieving nuclear justice as well as persisting shortcomings. The authors propose an analytical framework distinguishing four different dimensions: (1) criminal liability (2) redress for victims (3) truth-telling and apologies and (4) legal reforms to ensure non-recurrence. The report applies the framework to analyze efforts to deal with the legacy of the 1945 Hiroshima and Nagasaki bombings, responses to the suffering caused by nuclear testing, as well as past and ongoing legal and political reforms that would influence assessments of the legality and legitimacy of future nuclear uses and tests and/or that have been put in place specifically to prevent the recurrence of nuclear uses and tests. Furthermore, this report provides policy recommendations for both state and non-state actors to advance the nuclear justice agenda.

    Abstract: "In spite of its reputation as a "classical" human right, freedom of religion or belief continues to evoke political controversies and ambivalent reactions, ranging from enthusiastic support to a certain unease or even open opposition. Obviously, the struggle for religious freedom is far from over. There is not only the challenge of its effective implementation, but its content, significance, meaning, and justification also deserve critical scrutiny. The purpose of this book is to contribute to more conceptual clarity in this ongoing struggle. The authors summarize their position in two closely interrelated hypotheses. The first hypothesis is that freedom of religion or belief is a human right, which displays the same normative structure that defines the human rights approach in general. With the second hypothesis, they go a step further by claiming that freedom of religion or belief has an indispensable role to play within the framework of human rights. Without taking freedom of religion or belief seriously, human rights would not be able to do justice to the complex needs, yearnings, and vulnerabilities of human beings.     Abstract: "This book examines the interpretation and application of the right to freedom of religion and belief of new minorities formed by recent migration by the European Court of Human Rights (ECtHR) and the United Nations Human Rights Committee (HRC). New minorities are increasingly confronted with restrictions of their religious practices and have addressed their rights claims both to the ECtHR and the HRC through their individual complaint procedures, which resulted in several contradicting decisions. Based on a quantitative and qualitative empirical analysis of the relevant case law, focusing in particular on the reasoning adopted by the two bodies, this book finds that the HRC in its practice offers a significantly higher level of protection to new minorities than the ECtHR. Such divergence may be explained by various institutional and conceptual differences, of which the concept of the margin of appreciation is the most influential. It is contended that the extensive use of the concept of the margin of appreciation by the ECtHR in the case law regarding new minorities' right to freedom of religion and belief, and the absence of such concept in the HRC's case law, could be explained by different understandings of the role of an international human rights body in conflicts between the majority and minorities. This book argues that such divergence could be mitigated with various tools, such as the inclusion of cross-references to the case law of other relevant bodies as well as to instruments specifically established for the protection of minorities"--

    Abstract: This book is the first systematic scientific study of global quasi-legislation. Taking public opinion and multilateral agreements as the international equivalent to national election and passing laws on the national scale, and extending nation-state concepts to a global society, it analyzes citizens' preferences and the state's willingness to enter into 120 multilateral treaties. After identifying the links as a first step toward conceptualizing quasi-legislative global politics, the book examines how each of the 193 states manifests quasi-legislative behavior by factor-analyzing six instrumental variables such as treaty participation index and six policy domains of multilateral treaties, including peace and trade. It then discusses global change between 1989 and 2008, and conceptually and empirically examines the three theories of global politics that originated during that period: the theory of power transition, theory of civilizational clash and theory of global legislative politics. Lastly, it proposes a theory of global legislative politics.     Abstract: The very concept of human rights implies governmental accountability. To ensure that governments are indeed held accountable for their treatment of citizens and others the United Nations has established a wide range of mechanisms to monitor compliance, and to seek to prevent as well as respond to violations. The panoply of implementation measures that the UN has taken since 1945 has resulted in a diverse and complex set of institutional arrangements, the effectiveness of which varies widely. Indeed, there is much doubt as to the effectiveness of much of the UN's human rights efforts but also about what direction it should take. Inevitable instances of politicization and the hostile, or at best ambivalent, attitude of most governments, has at times endangered the fragile progress made on the more technical fronts. At the same time, technical efforts cannot dispense with the complex politics of actualizing the promise of human rights at and through the UN. In addition to significant actual and potential problems of duplication, overlapping and inconsistent approaches, there are major problems of under-funding and insufficient expertise. The complexity of these arrangements and the difficulty in evaluating their impact makes a comprehensive guide of the type provided here all the more indispensable. These essays critically examine the functions, procedures, and performance of each of the major UN organs dealing with human rights, including the Security Council and the International Court of Justice as well as the more specialized bodies monitoring the implementation of human rights treaties. Significant attention is devoted to the considerable efforts at reforming the UN's human rights machinery, as illustrated most notably by the creation of the Human Rights Council to replace the Commission on Human Rights. The book also looks at the relationship between the various bodies and the potential for major reforms and restructuring.

Today, sixty years later, we still ask what role transnational law can play in a deeply divided, post-colonial world, where multinationals hold more power and more assets than many Nation States.
