    Abstract: This book deals with all the cases that came before the Permanent Court of International Justice (PCIJ) from 1922 to 1946, as well as those that were heard by its successor, the International Court of Justice (ICJ) from 1946 to 2020 in which interim measures of protection were either indicated or refused. The monograph shows how cases in which injunctive relief was sought were handled and how the PCIJ and the ICJ have undergone certain reforms over the years. The new approach taken by the author is to present all the matters brought before both the PCIJ and ICJ in full and to present the new requirements on the part of the ICJ that have been formulated in recent years. The book is aimed at law students, lecturers and those working in the field of international law. Ewa Sałkiewicz-Munnerlyn was a Polish diplomat working for the Ministry of Foreign Affairs from 1991 to 2018. She was appointed charge d’affaires at the Polish Embassy to the Holy See from 1993-1994, after which she served as the Polish consul at the Consular Division of the Polish Embassy in Washington D.C. from 1995-1999. She then held the position of Human Rights Officer of the OSCE in Macedonia (Skopje and Ohrid) and Bosnia and Hercegovina (Pale in Republika Srbska) from 2001-2005 and has also several times worked as a short-term observer of the OSCE during parliamentary and presidential elections in Ukraine, Russia, Moldova and Belarus. She attained a Ph.D. at the Jagiellonian University in Krakow, Poland and a post-graduate diploma at the Institut des Hautes Etudes Internationales in Geneva, Switzerland. .

    Abstract: This work deals with the exclusion of illicitly obtained evidence at the International Criminal Court. At the level of domestic law, the so-called exclusionary rule has always been a very prominent topic. The reason for this is that the way a court of law deals with tainted evidence pertains to a key aspect of procedural fairness. It concerns the balancing of the right to a fair trial with the interest of society in effective law enforcement. At the international level, however, the subject has not yet been discussed in detail. The present research intends to fill this gap. It provides an overview of the approaches of a number of domestic legal systems as well as of the approaches of the UN ad hoc tribunals and the European Court of Human Rights and uses the different perspectives to develop a version of the exclusionary rule which fits the International Criminal Court. The book is highly recommended for practitioners and researchers in the field of international criminal law and especially the law of international criminal evidence. He is also the former head of the research division on Crime, Law Enforcement and Sanctions of the research center (WODC) of the Ministry of Security and Justice in the Netherlands. His research interests include discrimination and privacy issues of new technologies, particularly data mining and profiling, and technology in policing. His research in the area of criminal law is focused on technologies that may contribute to law enforcement, criminal investigation and prosecution. Examples of such technologies are Automated Number Plate Recognition (ANPR), wiretapping, fingerprints, forensic DNA research, database coupling, data mining and profiling, camera surveillance, network analyses and the use of drones.Dr. Custers has published two books on discrimination and privacy in the context of Big Data. In 2015 he co-authored (in Dutch) a book on the use of drones. On a regular basis he gives lectures on profiling and privacy issues of new technological developments.     Abstract: This book is the first comprehensive study on the work and functioning of the Extraordinary Chambers in the Courts of Cambodia (ECCC). The ECCC were established in 2006 to bring to trial senior leaders and those most responsible for serious crimes committed under the notorious Khmer Rouge regime. Established by domestic law following an agreement in 2003 between the Kingdom of Cambodia and the UN, the ECCC’s hybrid features provide a unique approach of accountability for mass atrocities. The book entails an analysis of the work and jurisprudence of the ECCC, providing a detailed assessment of their legacies and contribution to international criminal law. The collection, containing 20 chapters from leading scholars and practitioners with inside knowledge of the ECCC, discuss the most pressing topics and its implications for international criminal law. These include the establishment of the ECCC, subject matter crimes, joint criminal enterprise and procedural aspects, including questions regarding the trying of frail accused persons and the admission of torture statements into evidence.     Abstract: This book offers a legal understanding regarding the core elements of SGEI (Services of General Interest), and of how the post-Lisbon constitutional framework on SGEI affects the application of the EU market rules by the EU Court of Justice, including procurement rules, to public services. It is built up of three parts, namely Part I: No Exit from EU Market Law for Public Services, Part II: SGEI as a Constitutional Voice for Public Services in EU Law, and Part III: The cost of loyalty, the relationship between EU procurement and state aid legislation on social services and the Treaty rules on SGEI, ending with a case study of Swedish systems of choice. Analyses are also provided on how the EU legislator engages in the Europeanisation of social services through EU procurement and state aid rules that have an ambiguous relationship to the Treaty framework on SGEI. Some explanation to this ambiguity is proposed by studying how the application of EU state aid rules could hinder the development of Swedish systems of choice liberalizing publicly-funded elderly care and school education. Included are propositions on crucial but yet unsettled legal questions, in particular what the legal meaning and relevance of the notion of economic activity in EU market law are and which core elements characterize SGEI. This book is therefore mainly aimed at legal academics and practitioners but may also be of interest to political scientists.     Abstract: Since the historic Nuremberg Trial of 1945 an international customary law principle has developed that commission of a core crime under international law - war crimes, genocide, crimes against humanity and aggression - should not go unpunished. History shows, that when in Africa such violations occurred, especially as a result of election disputes, national and regional actors, including the African Union, resorted to political rather than legal responses. However, when crimes against humanity were alleged to have been committed in Kenya during the 2007-2008 post-election violence, a promising road map for criminal accountability was agreed upon alongside a political solution. In the spirit of this road map, the author analyzes the post-election violence in Kenya from a legal point of view. He extensively examines legal options for domestic criminal accountability and discusses both retributive (prosecutions) and restorative justice (mainly truth commission) mechanisms, being the main legal responses to the gross violations of human rights. Furthermore, he thoroughly investigates the Kenya situation before the ICC and the legal-cum-political responses to the ICC intervention in Kenya. Practitioners and academics in the field of international criminal law and related disciplines, as well as political sciences and (legal) history will find in this book highly relevant information about alternative legal approaches of the fight against and punishment of crimes against humanity, as defined under the ICC Statute. Sosteness Francis Materu is a lecturer in the Faculty of Law of the University of Dar es Salaam (Tanzania).     Abstract: This book looks at the relevance of conspiracy in international criminal law. It establishes that conspiracy was introduced into international criminal law for purposes of prevention and to combat the collective nature of participation in commission of international crimes. Its use as a tool of accountability has, however, been affected by conflicting conceptual perceptions of conspiracy from common law and civil law countries. This conflict is displayed in the decisions on conspiracy by the international criminal tribunals, and finally culminates into the exclusion of punishment of conspiracy in the Rome Statute. It is questionable whether this latest development on the law of conspiracy was a prudent decision. While the function of conspiracy as a mode of liability is satisfactorily covered by the modes of participation in the Rome Statute, its function as a purely inchoate crime used to punish incomplete crimes is missing. This book creates a case for inclusion in the Rome Statute, punishment of conspiracies involving international crimes that do not extend beyond the conceptual stage, to reinforce the Statute's purpose of prevention. The conspiracy concept proposed is one that reflects the characteristics acceptable under both common law and civil law systems.

    Abstract: The practice of using children to participate in conflict has become a defining characteristic of 21st century warfare and is the most recent addition to the canon of international war crimes. This book follows the development of this crime of recruiting, conscripting or using children for participation in armed conflict, from human rights principle to fully fledged war crime, prosecuted at the International Criminal Court. The background and reasons for the growing use of children in armed conflict are analysed, before discussing the origins of the crime in international humanitarian law and human rights law treaties, including the Convention on the Rights of the Child and its Optional Protocol. Specific focus is paid to the jurisprudence of the Special Court for Sierra Leone and the International Criminal Court in developing and expanding the elements of the crime, the modes of ascribing liability to perpetrators and the defences of mistake and negligence. The question of how the courts addressed issues of cultural sensitivity, notably in terms of the liability of children, is also addressed. The book is a useful guide for practitioners dealing with the crime: the available defences and the ICC’s prosecutorial strategy.     Abstract: This book contains a collection of essays by leading experts linked to the outstanding characteristics of the scholar in honour of whom it is published, Tullio Treves, who combines his academic background with his practical experiences of a negotiator of international treaties and a judge of an international tribunal. It covers international public and private law related to international courts and the development of international law.Under Article 38 of its Statute, the International Court of Justice can apply judicial decisions only as a "subsidiary means for the determination of rules of law. However, there are many reasons to believe that international courts and tribunals do play quite an important role in the progressive development of international law. There are a number of decisions which are inevitably recalled as the first step, or a decisive step, in the process of the formation of a new rule of customary international law. In these cases, can the judge be considered as a subsidiary of others? Are these cases compatible with the common belief that a judge cannot create law? Is this a peculiarity of international law, which is characterized by the existence of several courts but the lack of a legislator? Do decisions by different courts lead to the consequence of a fragmented international law? This volume provides the reader with an elaboration of various questions linked to the legislative role of courts.In their choices of subjects, some contributors have taken into account the general aspects of the development of international rules through court decisions or specific sectors of international law, such as human rights, international crimes, international economic law, environmental law and the law of the sea. Others have chosen the subject of the rules on jurisdiction and procedure of international courts. The question of the courts role in the development of areas of law different from public international law, namely private international law and European Union law, has also been considered.The information and views contained in this book will be of great value to academics, students, judges, practitioners and all others interested in the public and private international law aspects of the link between international courts and the development of international law.

    Abstract: This book addresses fundamental aspects of the concept of public international law in both theory and practice. The argument developed by the author is that, underlying the traditional, horizontal, structure of public international law, a vertical structure of the concept of law may be discerned. This vertical structure is seen unfolding into two, mutually exclusive, frameworks: a framework of obligation, accounting for obligations, and a framework of authorization, accounting for rights. The problem then arising is that a concept of public international law which only admits either rights or obligations cannot be regarded as coherent. The author, however, takes and substantiates the position that coherence can be achieved by suppressing the mutual exclusivity of both frameworks. This move paves the way to formulating the function of public international law in terms of the constituting of international society.Since in public international law the theoretical aspects profoundly affect practice, this book is not only of interest to academics, but also for practitioners, such as officials of foreign offices and international institutions.

    Abstract: Hauptbeschreibung Das Erkenntnisinteresse, das dieses Buch anleitet, gilt dem Begriff der moralischen Wahrheit, der Frage, ob und, wenn ja, warum moralische Urteile Wahrheitsansprüche erheben dürfen. Mitunter weckt die Rede von moralischer Wahrheit das Gefühl, dass mit ihr etwas eingeengt wird, das zu groß ist. Diesem Unbehagen wird am wirkungsvollsten entgegentreten durch ein besseres Verständnis, was Wahrheit in der Ethik bedeutet. Unter welchen Bedingungen sind moralische Urteile wahr? Welche Rolle spielt die Frage nach moralischer Wahrheit für die Verbindlichkeit eines moralischen Sollens? Weshalb ist der Wahrheitsbegriff von Bedeutung für unsere Orientierung in moralischen Handlungssituationen? Tilo Wesche berücksichtigt zur Beantwortung dieser Fragen die Einsichten der zeitgenössischen Wahrheitstheorien und Metaethik ebenso wie die klassischen Entwürfe des Wahrheitsbegriffs, insbesondere bei Hegel und Heidegger. Er stellt zunächst die Frage nach einem einheitlichen Begriff der Wahrheit, der zugleich durchlässig für die bereichsspezifischen Unterschiede von Wissenschaft, Technik und Ethik ist. Dann unterbreitet er mit den Mitteln der Korrespondenz- und der Evidenztheorie der Wahrheit den Vorschlag, dass moralische Urteile ihre Wahrheit rationalen Standards verdanken. Die wahrheitsgarantierenden Rationalitätsstandards werden zwei Grundmodellen der Rationalität zugeordnet. Zentral für das favorisierte Modell ist die Analyse des Phänomens der Selbsttäuschung in moralischen Urteilen. Im Rückgriff auf sprachphilosophische Überlegungen werden schließlich die wahrheitsverbürgenden Standards als Praxisformen der Sprache in Kunst, Kultur und Kommunikation bestimmt

    Abstract: This book presents the results of research project financed by the Hague Institute for the Internationalization of Law (HiiL) and carried out at the Tilburg Law and Economics Center (TILEC) of Tilburg University. The project team shows that globalization, instead of threatening national legal systems, put them in a new role and gives them continuing relevance. First of all, once one takes a more functional view of the law, based on law and economics and comparative law literature, harmonization or unification of national legal systems is no longer a foregone conclusion. Secondly, fundamental constitutional principles continue to bear in the era of multi-level and transnational governance: they become governance principles, divorced from specific institutional settings. Finally, looking beyond regulatory competition and comparative law, legal emulation provides a rich and fruitful model to explain the interplay between legal systems. This book explores these three themes, both at a theoretical level and in the light of specific examples.

    Abstract: Der demographische Wandel und die damit einhergehenden Finanzierungsschwierigkeiten der sozialen Sicherungssysteme haben in den letzten Jahren die Frage nach der Gerechtigkeit zwischen den Generationen in das Zentrum der öffentlichen Diskussion gerückt. Die ausgewogene finanzielle Belastung zwischen jetzt lebenden und künftigen Generationen wie auch die Sorge um die Zukunftschancen unserer Kinder sind dabei die zentralen Grundfragen der Debatte. So sieht sich auch die sozialwissenschaftliche Forschung vor die Herausforderung gestellt, klassische Konzepte intragenerationeller Gerechtigkeit daraufhin zu überprüfen, inwiefern sie Forderungen nach intergenerationeller Gerechtigkeit standhalten. Neben den empirischen und philosophischen Grundfragen analysieren die Beiträger dieses Bandes das Thema Generationengerechtigkeit aus einer ordnungsökonomischen Perspektive. Es geht zum einen um eine Begründung dafür, warum überhaupt heutige Gesellschaftsmitglieder die Interessen zukünftiger Generationen berücksichtigen sollen. Zum anderen werden solche gesellschaftlichen Regeln gesucht, die im besten Falle geeignet sind, die Interessen der kommenden Generationen langfristig zu sichern und dabei zugleich für die heute Lebenden akzeptabel sind. Eine tragfähige ordnungsökonomische Konzeption der Generationengerechtigkeit muss sich dann auch als Leitfaden für einzelne Felder der praktischen Politik bewähren.     Abstract: Grundbegriff des klassischen Liberalismus ist der Begriff der negativen Freiheit: Freiheit als Abwesenheit von Zwang. Doch was ist Zwang? Warum ist Zwang in der freiheitlichen Sicht ein Übel? Der liberale Nationalökonom und Sozialphilosoph Friedrich August von Hayek entwickelt in seiner Verfassung der Freiheiteine Bestimmung des Begriffspaars Freiheit und Zwang, die jedoch unvollständig bleibt und einige grundsätzliche Fragen an seine Moralphilosophie und Theorie der kulturellen Evolution aufwirft. Philipp Batthyány unternimmt den Versuch einer werkimmanenten Definition des Zwangsbegriffs Hayeks und einer Begründung für die Verwerflichkeit des Zwangs als Grundübel in der Gesellschaft. Unter Einbeziehung wesentlicher Teile des unveröffentlichten Nachlasses durchdringt der Autor Hayeks Gesamtwerk mit Blick auf die ihm zugrundeliegende Konzeption von Freiheit und Zwang und schließt damit eine wichtige Lücke in der Hayek-Forschung.

    Abstract: Hauptbeschreibung Pascale Cancik untersucht die Offizialisierung und Professionalisierung von Verwaltungskommunikation im Preußen des frühen 19. Jahrhunderts. Zu dieser Zeit erreichte der aufklärerische Öffentlichkeitsdiskurs der 'Sattelzeit' verschiedene Bereiche von Gesellschaft und Recht (Parlamente, Gerichte, Presse). Die Verwaltung indessen, die damals ihre modern-bürokratische Form entwickelte, wird von der historischen Forschung kaum mit jenen liberalen Öffentlichkeitsforderungen in Verbindung gebracht. Ist das gegenwärtig wieder viel untersuchte Thema Verwaltung und Öffentlichkeit zu Recht kein Thema (rechts-)historischer Forschung? Die Autorin zeigt zunächst, dass es durchaus einen zeitgenössischen Publizitätsdiskurs gab, der sich gerade auch auf Verwaltung bezog. Aber kam dieser auch in der Praxis von Recht und Verwaltung an? Da Öffentlichkeiten sich in Kommunikationen manifestieren, werden zwei Felder von Verwaltungskommunikation genauer untersucht: die Publikation staatlichen Handelns durch die Verwaltung sowie die Entwicklung konkreter Verwaltungsverfahren, innerhalb derer die Verwaltung mit Bürgern kommuniziert. Im Zentrum stehen dabei jeweils die Rolle von Recht und Rechtspraxis. Es ergibt sich ein komplexes Bild von Motiven und Intensitäten der Einbeziehung oder gar Beteiligung von Bürgern. Bis heute genutzte Techniken, Medien und Verfahren wurden damals mit Hilfe von Recht konzipiert und eingeübt. Sie sind nicht, wie manchmal behauptet, ausschließlich mit Demokratie verbunden.

    Abstract: Arnd Uhle untersucht das Verhältnis von freiheitlichem Verfassungsstaat und kultureller Identität, das bislang kaum – wenn, dann lediglich partiell – erforscht wurde. Der Autor beleuchtet die Relevanz der kulturellen Identität für Entstehung, Gestalt und Fortbestand des freiheitlichen Verfassungsstaates aus verfassungstheoretischer, aus verfassungsrechtlicher und schließlich aus europarechtlicher Perspektive.Bereits aus verfassungstheoretischer Sicht ergibt sich dabei, daß die kulturelle Identität gleichermaßen Entstehungs- wie auch Geltungsbedingung freiheitlicher Verfassungsstaatlichkeit ist, weil der freiheitliche Staat in vielfältiger Weise an die kulturelle Identität anknüpft. Eine Betrachtung aus verfassungsrechtlicher Perspektive unterstreicht diesen Befund und belegt, daß namentlich das deutsche Grundgesetz in einer prima facie zwar komplex und unüberschaubar erscheinenden, letztlich aber systematisch geordneten und differenzierenden Weise an die kulturelle Identität anknüpft – und diese angesichts ihrer Bedeutung für den dauerhaften Fortbestand des freiheitlichen Verfassungsstaates überdies durch das in der Habilitationsschrift erstmals entfaltete grundgesetzliche Staatsziel der Vitalität und Dauerhaftigkeit der freiheitlichen Verfassungsordnung mit verfassungsrechtlichem Schutz umhegt. In der Konsequenz dieses Staatsziels ist der grundgesetzgebundene Staat zur Pflege und zum Schutz der kulturellen Identität verpflichtet. Eine abschließende europarechtliche Betrachtung verdeutlicht, daß die grundgesetzliche Anknüpfung an die kulturelle Identität wie auch deren verfassungsrechtliche Sicherung den Schutz des Art. 6 Abs.3 EUV genießen, der die Achtung der nationalen Identität anordnet.
