Abstract: In this book, the author attempts to debunk some myths about Western exceptionalism and to evaluate critically the characteristics that make the West superior to the Rest. The author suggests that the West does not represent a homogenous group of countries and that the most common characteristic of the core Western countries is imperialism. The author goes on to provide a detailed critique of the proclaimed characteristics of Western countries, including democracy, human rights, judicial independence, transparency, the rule of law, and exclusive contribution to science and technology. A critique is presented of the views expressed by Samuel Huntington, Francis Fukuyama, and Niall Ferguson, arguing that they do not recognize the historical fact that civilizations rise and fall. It is argued that the Western economic system, which is based on neoliberalism, has adverse consequences for democracy, morality, and peace, as well as inequality, poverty, and homelessness. Written in a simple but powerful language, this book is a must read for those interested in international relations and anyone interested in current affairs. Abstract: In October 1967, Pier Paolo Pasolini travelled to Venice to interview Ezra Pound for broadcast on national television. One a lifelong Marxist, the other a former propagandist for the Fascist regime, their encounter was billed as a clash of opposites. But what do these poets share? And what can they tell us about the poetics and politics of the twentieth century? This book reads one by way of the other, aligning their engagement with different temporalities and traditions, polities and geographies, languages and forms, evoked as utopian alternatives to the cultural and political crises of capitalist modernity. Part literary history, part comparative study, it offers a new and provocative perspective on these poets and the critical debates around them – in particular, on Pound’s Italian years and Pasolini’s use of Pound in his work. Their connection helps to understand the implications and legacies of their work today. .

Abstract: “This is a masterful examination of fantasy films and television series, and the ways that they illustrate political themes. The book effectively employs constructivist theory to show how fantasy franchise norms, values, and institutions have changed over time. Looking in detail at Game of Thrones, Lord of the Rings, the Harry Potter movies, along with fairytales and children’s tales, readers gain a sense of the usefulness of these stories as vehicles for understanding politics. They also come to appreciate these movies and TV shows as allegories of contemporary politics and international relations.” —Hieyeon Keum, University of Seoul, South Korea “Fantasy movies create…a broad canvas on which authors and filmmakers weave amazing yarns that express our fondest hopes and greatest fears. This book is one of the best studies of fantasy films and television and their expression of political ideas. I was particularly struck by the author’s illustration of the changing roles of women and girls in many of these stories, as female empowerment recently has become a major theme of fantasy projects. You can learn much about both fantasy stories and politics. Buy this book.” —Barry Pollick, Okinawa University, Japan This book uses several fantasy movies or movie series and television series to explain political and international relations (IR) concepts and theories. It indicates the importance of fantasy in literature, film and television, and its increasing impact on politics and International Relations. It then presents the political, IR, and social issues in each franchise, and in five chapters uses these tales’ key story arcs or plot points to illustrate major political and IR themes. The volume pays particular attention to such fantasy franchises as Lord of the Rings, Game of Thrones, the Harry Potter films, recent fairytale and children’s stories, and female-led fantasy projects. Abstract: This handbook brings together expertise from a range of disciplinary perspectives and geographical contexts to address a key question facing prison policymakers, architects and designers – what kind of carceral environments foster wellbeing, i.e. deliver a rehabilitative, therapeutic environment, or other ‘positive’ outcomes? The Palgrave Handbook of Prison Design offers insights into the construction of custodial facilities, alongside consideration of the critical questions any policymaker should ask in commissioning the building of a site for human containment. Chapters present experience from Australia, Chile, Estonia, Ireland, New Zealand, Norway, Russia, the United Kingdom, and the United States – jurisdictions which vary widely in terms of the history and development of their prison systems, their punitive philosophies, and the nature of their public discourse about the role and purpose of imprisonment, to offer readers theories, frameworks, historical accounts, design approaches, methodological strategies, empirical research, and practical approaches. Abstract: This book describes the findings from a study that aimed to contribute to current knowledge about intimate partner violence (IPV) desistance processes. More specifically, the study examined: The role of female victims/survivors of IPV in male abuser desistance pathways Factors associated with desistance and persistence patterns of IPV The applicability of current desistance theories for explaining the cessation or reduction of IPV Featuring a number of case studies, this book not only identifies key learnings for the design and delivery of IPV prevention initiatives, but points to areas where desistance frameworks may be enhanced or adapted to improve their relevance to IPV, as well as other offending behaviors. One of the first of its kind in Australia and internationally, this volume targets domestic, family and sexual violence researchers, criminal careers/desistance researchers and domestic and family violence practitioners and policy-makers. .

Abstract: The Global IR research programme promulgates a borderless ecology of cultures that has only an inside without an outside. This borderless ecology of cultures reinvents the human condition (including the condition of ‘the international’) as perpetually interconnected at the level of consciousness. While Western-centric IR theories depend on (neo-)Kantian philosophies to emphasize the time-space bounded identities of human beings living in visibly divided phenomenal worlds, the de-Kantian philosophies of the Global IR research programme – exemplified by the Tianxia, Advaita, and Nishida Kitaro’s Buddhism-inspired theories – recuperate the temporally-spatially indivisible phenomenal-noumenal flow of human life, thereby facilitating back-and-forth movement between the Westdominated ‘one world’ and the non-West-embodied ‘many worlds’. The central objective of the book is to demonstrate how this back-and-forth movement offers opportunities to conceive of and found a new world order that recognizes the temporally-spatially indivisible human condition on earth. The book delineates a set of guiding principles to promote an innovative practice of theory-building and policy-making that transcends the geo-centric limitations of knowledgeproduction and knowledge-application, thereby establishing the futuristic foundation of the Global IR research programme. Abstract: This book is about Mozambicans and Angolans who migrated in state-sponsored schemes to East Germany in the late 1970s and throughout the 1980s. They went to work and to be trained as a vanguard labor force for the intended African industrial revolutions. While they were there, they contributed their labor power to the East German economy. This book draws on more than 260 life history interviews and uncovers complex and contradictory experiences and transnational encounters. What emerges is a series of dualities that exist side by side in the memories of the former migrants: the state and the individual, work and consumption, integration and exclusion, loss and gain, and the past in the past and the past in the present and future. By uncovering these dualities, the book explores the lives of African migrants moving between the Third and Second worlds.

Abstract: This book analyzes two Romanian villages – 2 Mai and Vama Veche – as spaces of relative freedom during the last decades of socialist rule. This microhistorical study refutes simplistic views of the communist past which focus on political figures and events, and instead explores ordinary people and everyday life. Taking a multidisciplinary approach, it considers a broad range of sources, including official Communist Party documents, secret police files, personal memoirs, oral history interviews, ethnographic films, songs, and artistic performances. This book intertwines three narrative threads: that of the visitors (mainly members of the Romanian intelligentsia, young people, and hippies); that of the local inhabitants; and that of 'authority' (local and central state agents actively engaged in surveillance and supervision). In doing so, it interrogates the spectrum of consent/dissent and resistance/collaboration hitherto neglected in scholarship. Ruxandra Petrinca is a postdoctoral fellow at the Research Institute of the University of Bucharest and a researcher at the Museum of Communist Horrors in Romania.

Abstract: This book ties restorative justice into the exercise of patriarchal power. It is focused on the individual narratives of 15 girls and young women who have participated in a victim-offender restorative justice (RJ) conference and the perspectives of youth justice practitioners. Gender, Power and Restorative Justice expands feminist engagement with RJ by focusing critical attention on the importance of the social construction of gender, the exercise of power, shame, stigma, muting and resistance to girls’ experiences of RJ conferencing. Drawing upon recent developments to the sociology of stigma and feminist perspectives on shame, the book contends that RJ conferencing can produce harmful implications for girls and young women who participate. Ultimately it is argued that anti-carceral, social policy alternatives, underpinned by feminist praxis, should replace a youth justice jurisprudence for girls. This book will be of particular use and interest to those studying modules on criminology, youth justice, criminal justice and social work courses. Jodie Hodgson is a lecturer in Criminology at Manchester Metropolitan University, UK. Jodie has previously worked as a lecturer at Leeds Beckett University and the University of Liverpool. She completed her PhD at Liverpool John Moores University. Her research interests are situated within the areas of youth justice, feminism and critical criminology.

Abstract: This book describes the nature of trafficking in persons in West Africa, focusing on labor and sexual exploitation in the region, and recommends tailor-made solutions established by the Catholic Church in light of governmental authorities’ failure to effectively combat this scourge of humanity. While states’ efforts to fulfill their international obligations in developing anti-trafficking legislations are recognized, their failure to carry out prosecutions of offenders and ensure protection of the victims reveals that law alone is not a sufficient instrument for realizing human rights and improving people’s lives. Faced with the sobering background of less than successful efforts by governmental entities to end the trade in humans, this research study recommends adopting essential elements of Catholic social teaching, which rests on the inherent dignity of human beings allowing the development of political, socio-cultural, and religious reforms that will increase the effectiveness of existing legislation designed to combat trafficking. This faith-based approach highlights the role that religion may play in fulfilling the discretionary provisions of the Palermo Protocol by promoting the welfare and protecting the life and dignity of the victims. Additionally, religion is composed of sound moral ethics that determine people's behavior to refrain from the sinful conduct of trafficking. It also creates a sense of ethical responsibility that promotes supply chain transparency and ethical purchasing as well as advocating social reforms and anti-trafficking legislations initiatives. In fact, the author's approach, may be a model for other regions in the world and will be of interest to scholars, law and policy makers, human rights advocates and law enforcement agents working in the field of trafficking in persons. .

Abstract: 'Douglas Janoff draws from his wide-ranging diplomatic career, extensive research and rigorous scholarship to provide a highly engaging and accessible exploration of the mainstreaming, complexities and contradictions of LGBTQ+ advocacy in contemporary Western diplomacy. Janoff's book is a much-needed addition to the expanding field of queer international relations and is a thoughtful and useful contribution both for academic scholars and diplomatic practitioners' —Daniel Conway is Senior Lecturer in Politics and International Relations, University of Westminster, UK This book is the first study of multilateral LGBT human rights diplomacy viewed from the perspective of its practitioners: diplomats, LGBT activists, human rights experts and multilateral specialists. It demonstrates how diplomats and advocates work to promote LGBT rights on the world stage, often using Western constructs of sexual and gender identity. In turn, these efforts have triggered conflict and polarization: opposing states often deploy cultural, religious and moral discourses to minimize LGBT rights as a “legitimate” human right. The author, a seasoned Canadian foreign service officer, human rights negotiator and former community activist and researcher, uses insider perspectives to critically assess both bilateral and multilateral diplomatic engagement on LGBT human rights issues. Janoff’s research involved participation in UN meetings in Geneva and New York and 29 interviews with diplomats, human rights advocates and experts, and representatives from the UN and other inter-governmental organizations. Although LGBT issues have been mainstreamed into many areas of bilateral and multilateral human rights policy, his research found a considerable gap: a coordinated diplomatic and civil society approach is needed to more effectively address ongoing human rights violations against LGBT people around the world. Douglas Victor Janoff was appointed to Canada’s Foreign Service in 2009: his career has included diplomatic postings to Washington, D.C., Afghanistan and Pakistan. He is the author of Pink Blood: Homophobic Violence in Canada (2005) and has a PhD in Canadian Studies from Carleton University, Canada.

Abstract: “The Programmatic Action Framework (PAF) is the newcomer in the pluralistic set of the theories of the policy process." -Giliberto Capano, Professor of Political Science and Public Policy, University of Bologna, Italy “The book presents empirical cross-country evidence for the PAF's idea that overlapping biographies of policy actors and resulting social identities often drive collective action.” -Tanya Heikkila, Professor of Public Affairs, University of Colorado Denver, USA “This work advances knowledge of programmatic actors comparatively.” -Michael Howlett, Burnaby Mountain Professor, Simon Fraser University, Canada “Johanna Hornung shows that policy change is irrevocably linked to the programmatic group, framed by two specific institutions - the recruitment processes and career paths of administrative actors.” -Sabine Saurugger, Professor of Political Science, Science Po Grenoble, France. This open access book is the first monograph to systematically apply the Programmatic Action Framework (PAF) in a comparative analysis of public policy in two institutionally different countries. The PAF seeks to explain long-term policy change by examining the shared biographies of policy actors who, to foster their careers, coalesce around policy programs which they promote throughout the policy process. Comparing health policy-making in France and Germany between 1990 and 2020, the book sheds light on the institutional settings that are necessary for programmatic action to occur. It will appeal to scholars and students of public policy, public administration, and health policy. Johanna Hornung is a Research Associate at the Institute of Comparative Politics and Public Policy, TU Braunschweig, Germany.

Abstract: This book provides a comprehensive analysis of how EU state aid law is shaping the future of EU investment policy in a global context. It examines in detail how EU state aid policy and practice interact with the EU investment regime on the internal market and affect the external trade relations of the Member States and the EU alike. The debate this book engages in concerns competence, i.e., which body delineates the scope of state aid law and policy (now and in the future) when and where it intersects and collides with another distinct legal field: investment protection. Pursuing a doctrinal approach to the topic in the light of EU law and international law, the book analyses the interaction of the EU’s trade, state aid and investment policy. This is done by posing the following research question: How is EU state aid law shaping the future of EU investment policy in a global context? Further, the book puts forward three corresponding arguments. First, this influence can be seen in the EU’s incorporation of clauses promoting fair competition and state aid policy in international trade agreements. Second, EU state aid law and policy contributed to recent internal developments which led the Member States to terminate their bilateral agreements with each other (intra-EU BITs) by the end of 2019. Third, the EU has been working to replace the BITs between its Member States and third countries (extra-EU BITs) with its own trade agreements, which are aligned with EU legislation. This combined analysis of EU law and international law yields a number of interesting conclusions. The book addresses a highly topical and rapidly evolving area of EU law and international investment law. It is also the first book to provide a comprehensive approach to the interplay of state aid rules and EU investment policy internally and externally, i.e., within the EU and on a global scale. As such, it closes an important gap in the extant literature on international and EU law. .

Abstract: "Not only is this the first book to offer a forensic examination of Clare’s Law, but it is also currently the only text to offer a comparative analysis of the various domestic abuse disclosure schemes emerging internationally." - Dr. Marian Duggan, School of Social Policy, Sociology and Social Research, University of Kent, UK "Amidst growing attention to domestic abuse, this original and expert study illuminates the Domestic Abuse Disclosure Schemes. The sentiment behind this instrument is laudable, but, as the author expertly demonstrates, confusing policy spirals have been created by the urge to act against perceived risk rather than to analyse options and consequences. Sounder understandings and solutions can be found in this book." - Professor Emeritus Clive Walker, School of Law, University of Leeds, UK This book examines Domestic Abuse Disclosure Schemes, in the form of 'Clare's Law' policies, that have spread from England and Wales to an increasing proportion of the common law world: Scotland and Northern Ireland, New Zealand, parts of Australia, some provinces in Canada, and more. These policies are predicated on police forces warning the partners of abusers about domestic violence perpetrated in the past of those abusive partners. This book explores why the evidence that these Schemes actually prevent serious harm is overall patchy, and currently unconvincing. This book makes an argument for the evaluation and reappraisal of a piece of public protection policy which might currently be serving as sticking plaster on the shortcomings of wider public policy aimed at preventing violence against women. This book draws on the emerging body of research on Domestic Abuse Disclosure Schemes, and contributes original insights and analysis of its own. Abstract: This book provides a concise introduction into twenty-one trends that are transforming the role of religion and spirituality in “re-globalizing” societies. In referring to processes of “re-globalization”, the book draws attention to profound ongoing changes in the patterns and mechanisms of contemporary globalization. Inter- and transdisciplinary in its approach, clearly structured, and easy to read, the book analyzes the impact of religious self-understanding, rhetoric, and practice on five core fields: economics, politics, culture, demography, and technology. In turn, it describes the effects of these five fields on religion and spirituality themselves. This book represents a broad, encompassing overview of the main transformations that religion is undergoing today. Roland Benedikter combines a “big picture” approach with a keen attention to the details of specific case studies. With its clear and accessible structure and timely examples, this book is ideally suited for students of international relations and religious studies, and will also appeal to researchers engaged in those fields and to interested general readers. The book is also apt to serve as an encompassing basis for contemporary debates in civil society, including both grassroots and expert discussions. Roland Benedikter is Co-Head of the Center for Advanced Studies at Eurac Research in Bolzano, Italy; Research Professor of Multidisciplinary Political Analysis in residence at the Willy Brandt Centre at Wroclaw University, Poland; and Member of the Future Circle of the German Federal Ministry of Education and Research for the German Federal Government.

Abstract: Introduction: the Great Migration and Hukou -- Theorising migration and crime in China -- Researching Legal Elites and Power in China -- Policing -- Prosecution and Sentencing -- Prison -- Contesting Crimmigration in Post-hukou China -- Governing mobility in the post-hukou era.
Abstract: This book focuses on the criminalization trend and process regarding the internal migration in contemporary China from the perspective Law-in-Action. In Chinese society today, internal migrants are commonly perceived as criminals. Crimmigration, a global term that communicated the convergence of the criminal legal system and the immigration enforcement system, manifest itself in China’s hukou-based (also known as the household registration system) criminal legal system. How hukou has been constructed into the concept of Crimmigration in China strikes at the core of the ultimate questions of this book: who is being criminalized, how does the political-economic-cultural institution known as ‘hukou’ shape the criminal justice process, and how has the role of hukou changed over time in the ever-changing process? Drawing on interviews with migrant leaders, police, prosecutors, criminal lawyers & judges, and prison staff in Yangtze River Delta, China, this book reflects on a historical development on hukou and its function in social control. Each chapter contributes to an extended analysis of pragmatic aspects of decision-making moments in the criminal justice system. This book will appeal to criminology researchers and students with in interest in law, politics, migration, and citizenship in contemporary China. Newly challenges parallels between hukou-based criminal justice system and Crimmigration in the developed countries; First systematic and holistic picture of Law-in-Action in urban China from unique access to government staff; Little scholarship on internal migration, particularly in the North, thus will contribute to growing the scope of Chinese migration studies.

Abstract: This book, based on field research in the West African country of The Gambia, explores how domestic gun control is shaped by international efforts and how local actors interact with international organizations or opt not to do so. The book also shows how the question of who can have what kind of gun under what circumstances is an intrinsic question to modern societies across the world, but it is seldom one that is addressed in sub-Saharan Africa except in cases of post-conflict countries. Small arms control and gun control are often treated as separate efforts, with the former the domain of international actors such as the United Nations and the latter being of concern to the domestic politics of countries such as the United States. By focusing on a country that has never seen the outbreak of a civil war, the book is able to disentangle the complex roots of gun control in Africa, its origins in colonial era legislation, its reverberations across social life, and how it shapes contemporary understandings of groups ranging for security guards to hunters. Niklas Hultin is Assistant Professor in the Global Affairs Program at George Mason University, USA.

Abstract: “This groundbreaking book analyses European Integration in new theoretical and methodological terms. The insightful combination of Critical Discourse Studies, communication and media studies and political sciences is truly impressive, tracing in systematic detail the transformation of EU polity in recent years. A must-read for graduate students and scholars alike.”-- Ruth Wodak, Emeritus Distinguished Professor and Chair in Discourse Studies, Lancaster University, UK This book offers a transdisciplinary perspective on the question of how political legitimacy is constructed in the increasingly contested postnational setting of the European Union. Drawing on the example of the controversy about the EU constitution and the use of ‘EU constitution speak’ in commentaries published by Polish and French broadsheets, it reveals the transformation that constructions of political authority and association undergo when they are being transposed from the discourse field of multilateral negotiation to that of national news media. Through an original combination of the linguistic theory of discourse developed in Critical Discourse Analysis, Bourdieu’s field theory and notion of symbolic power, and political thought on polity-building, it develops a framework for the discourse study of legitimation and Europeanisation, which suggests itself for application beyond the case studies in the book. To students of European integration, it demonstrates the potential these concepts have for unravelling the implicit practices of postnational polity building. Discourse researchers, on the other hand, will discover how detailed text analyses gain significance in debates related to the macro level of political organisation when guided by sociological and political theory. Amelie Kutter is a Lecturer and Researcher in European Studies at European University Viadrina Frankfurt (Oder), Germany.

Abstract: This book offers support for interdisciplinary research on the interactions of nature and society. It is based on the hypothesis that a science of coevolution is needed to explore paths to a sustainable future. Jens Jetzkowitz initially discusses why social science knowledge only rarely finds its way into sustainability discourse. One significant issue is a view of science that separates knowing and acting, and the book illustrates current problems in conceptualising interdisciplinary knowledge production. It then goes one step further and introduces a workable alternative concept, taking philosophical pragmatism as a point of departure. Sustainable development goals and transdisciplinarity are currently subject to widespread discussions and Jetzkowitz takes a stance on the debates from the perspective of coevolutionary science. This book will appeal to scholars and students interested in environmental and sustainability discourses and to anyone willing to think outside the box
Abstract: Part I: What is the problem? -- Part II: Where do we stand? -- Part III: Coevolutionary Science -- Part IV: Perspectives of coevolutionary science in sustainability discourse
Note: "The book is a condensed and abridged version of my habilitation thesis on social science knowledge for the discourse of sustainability, which I submitted at the Helmut Schmidt University/University of the Bundeswehr Hamburg in April 2014"

Abstract: This book focuses on the most important implications of the "fair hearing" right for conducting civil proceedings. It provides a thorough and critical analysis of the case law of the European Court of Human Rights (the Strasbourg Court) regarding Article 6 of the European Convention on Human Rights. It puts forward a generally applicable framework for the analysis of the various procedural issues to which the "fair hearing" right may give rise, then applies that framework to discuss a selection of specific procedural issues. The book investigates several important questions of general scope in the context of ECHR Article 6, such as: What is the relevance of case law regarding criminal proceedings when the "fair hearing" right is applied to civil proceedings? How does the Strasbourg Court actually proceed when evaluating whether specific court proceedings have been "fair"? What are the roles of fundamental concepts such as the "margin of appreciation" and proportionality in this regard? In the subsequent discussion of specific procedural issues, the focus is on the balance that must be struck between procedural safeguards and the objectives of efficiency and economy. The book considers specific procedural issues such as: When must an oral hearing be held in order for civil proceedings to be "fair"? When will a refusal of specific evidence render civil proceedings unfair? When is a civil litigant entitled to l egal aid? As such, the book not only presents current case law; it also compares various strands of the case law regarding the "fair hearing" right, and argues that the Strasbourg Court's approach to various pertinent issues needs to become more consistent. Offering an in-depth examination of the Strasbourg Court's case law regarding ECHR Article 6, this book should be consulted by anyone interested in fundamental fair trial rights.

Abstract: This book investigates how human rights law can be applied to corporate entities. To date there have been insufficient international legal mechanisms to bring corporations to justice for their misconduct abroad. The book argues that rather than trying to solve the problem locally, an international approach to corporate human rights compliance needs to be sought to prevent future corporate human rights abuses. Implementing effective and enforceable human rights compliance policies at corporate level allows businesses to prevent negative human rights impacts such as loss of revenue, high litigation costs and damage to reputation. By considering human rights to be an inherent part of their business strategy, corporations will be well equipped to meet national and regional business and human rights standards, which will inevitably be implemented in the next few years. This approach, in turn, also furthers the fundamental aim of international human rights law.

Abstract: This work focuses on a specific aspect of the enforcement of maritime claims, namely judicial sales of ships, a procedure creditors typically resort to in the event of an irreversible default situation. A substantial part of the book approaches the topic from a comparative perspective, the goal being to assess the similarities and differences of the judicial sale procedure between three specific jurisdictions: Belgium, the Netherlands, and England & Wales. In this study, the comparison is used to further analyse the impacts of these differences on the effectiveness and reliability of the judicial sale procedure in each jurisdiction and also forms the basis for assessing the feasibility of harmonising judicial sale procedures and fostering their acceptance. Considering the international character typical of judicial sales of ships, conflict-of-law questions are very likely to arise during these procedures. Accordingly, the comparative study, where appropriate, is viewed against a private international law background.

Abstract: This book offers a comprehensive study of the views of ancient philosophers on mental disorders. Relying on the original Greek and Latin textual sources, the author describes and analyses how the ancient philosophers explained mental illness and its symptoms, including hallucinations, delusions, strange fears and inappropriate moods, and how they accounted for the respective roles of body and mind in such disorders. Also considered are ethical questions relating to mental illness, approaches to treatment and the position of mentally ill people in societies of the times. The volume opens with a historical overview that examines ancient medical accounts of mental illness, from Hippocrates' famous Sacred Disease to late antiquity medical authors. Separate chapters interpret in detail the writings of Plato, Aristotle, Galen and the Stoics, and a final chapter summarises the views of various strains of Scepticism, the Epicurean school and the Middle and Neo-Platonists. Offering an important and useful contribution to the study of ancient philosophy, psychology and medicine, This volume sheds new light on the history of mental illness, and presents a new angle on ancient philosophical psychology

Abstract: The book provides in depth studies of two epistemological aspects of Jewish Law (Halakhah) as the?Word of God?? the question of legal reasoning and the problem of knowing and remembering. - How different are the epistemological concerns of religious-law in comparison to other legal systems? - In what ways are jurisprudential attitudes prescribed and dependent on theological presumptions? - What specifies legal reasoning and legal knowledge in a religious framework? The author outlines the rabbinic jurisprudential thought rooted in Talmudic literature which underwent systemization and enhancement by the Babylonian Geonim and the Andalusian Rabbis up until the twelfth century. The book develops a synoptic view on the growth of rabbinic legal thought against the background of Christian theological motifs on the one hand, and Karaite and Islamic systemized jurisprudence on the other hand. It advances a perspective of legal-theology that combines analysis of jurisprudential reflections and theological views within a broad historical and intellectual framework. The book advocates two approaches to the study of the legal history of the Halakhah: comparative jurisprudence and legal-theology, based on the understanding that jurisprudence and theology are indispensable and inseparable pillars of legal praxis

Abstract: Language and the Right to Fair Hearing in International Criminal Trials explores the influence of the dynamic factor of language on trial fairness in international criminal proceedings. By means of empirical research and jurisprudential analysis, this book explores the implications that conducting a trial in more than one language can have for the right to fair trial. It reveals that the language debate is as old as international criminal justice, but due to misrepresentation of the status of language fair trial rights in international law, the debate has not yielded concrete reforms. Language is the core foundation for justice. It is the means through which the rights of the accused are secured and exercised. Linguistic complexities such as misunderstandings, translation errors and cultural distance among participants in international criminal trials affect courtroom communication, the presentation and the perception of the evidence, hence jeopardizing the foundations of a fair trial. The author concludes that language fair trial rights are priority rights situated in the minimum guarantees of fair criminal trial; the obligation of the court to ensure fair trial or accord the accused person a fair hearing also includes the duty to ensure they can understand and be understood
