Abstract: "Friedrich Kratochwil's book explores the role of law in the international arena and the key discourses surrounding it. It explains the increased importance of law for politics, from law-fare to the judicialization of politics, to human rights, and why traditional expectations of progress through law have led to disappointment. Providing an overview of the debates in legal theory, philosophy, international law and international organizations, Kratochwil reflects on the need to break down disciplinary boundaries and address important issues in both international relations and international law, including deformalization, fragmentation, the role of legal pluralism, the emergence of autonomous autopoietic systems and the appearance of non-territorial forms of empire. He argues that the pretensions of a positivist theory in social science and of positivism in law are inappropriate for understanding practical problems and formulates an approach for the analysis of praxis based on constructivism and pragmatism"--

Abstract: "This edited volume offers original scholarship on economic and social human rights from leading and new cutting-edge scholars in the fields of economics, law, political science, sociology and anthropology. It analyzes the core economic and social rights and the crucial topic of non-discrimination, and includes an innovative section on 'meta' rights. The main chapters answer important questions about economic and social rights performance around the world by emphasizing the obstacles that prevent governments from fulfilling their obligations. The interdisciplinary analysis offers a detailed and up-to-date discussion to help scholars and policy makers find the best ways to instantiate economic and social rights. The authors examine the role of the associated obligations, and especially the obstacles to respect, protect and fulfil those obligations. The book's introductory and concluding chapters address conceptual issues and correct mistakes often made by critics of economic and social rights"--

Abstract: Written by one of the world's leading international lawyers, this is a landmark publication in the teaching of international law. International law can be defined as 'the rules governing the legal relationship between nations and states', but reality is much more complex, with political, diplomatic and socio-economic factors shaping the law and its application. This refreshingly clear, concise textbook encourages students to view international law as a dynamic system of organizing the world. Bringing international law back to its first principles, the book is organized around four questions: where does it come from? to whom does it apply? how does it resolve conflict? what does it say? Building on these questions with both academic rigour and clarity of expression, Professor Klabbers breathes life and energy into the subject. Footnotes point students to the wider academic debate while chapter introductions and final remarks reinforce learning.

Abstract: "In this evaluation of the international legal standing of the right to reparation and its practical implementation at the national level, Christine Evans outlines State responsibility and examines the jurisprudence of the International Court of Justice, the Articles on State Responsibility of the International Law Commission and the convergence of norms in different branches of international law, notably human rights law, humanitarian law and international criminal law. Case studies of countries in which the United Nations has played a significant role in peace negotiations and post-conflict processes allow her to analyse to what extent transitional justice measures have promoted State responsibility for reparations, interacted with human rights mechanisms and prompted subsequent elaboration of domestic legislation and reparations policies. In conclusion, she argues for an emerging customary right for individuals to receive reparations for serious violations of human rights and a corresponding responsibility of States"--

Abstract: "Merciful Judgments in Contemporary Society: Legal Problems/Legal Possibilities explores the tension between law's need for and dependence on merciful judgments and suspicions that regularly accompany them. Rather than focusing primarily on definitional questions or the longstanding debate about the moral worth and importance of mercy, this book focuses on mercy as a part of, and problem, for law. Whether one starts from a worry about rules and discretion, about the attitudes of citizens and their leaders, or ways to undo the past, merciful judgments challenge and perplex, just as they help to sustain, our legal system. Charting these possibilities and problems is the work that this book seeks to do. Here we ask what challenges merciful judgments pose for law? When and why do those judgments encourage and nurture legal ingenuity and resourcefulness? When and why do they precipitate crises and breakdowns in legal authority? This book is a product of The University of Alabama School of Law symposia series on "Law, Knowledge & Imagination." This series explores the ways law is known and imagined in a diverse array of disciplines, including political science, history, cultural studies, philosophy, and science. In addition, books produced through the Alabama symposia explore various conjunctions of law, knowledge, and imagination as they play out in debates about theory and policy and speak to venerable questions as well as contemporary issues"--

Abstract: "This volume of essays contributes to the understanding of global law reform by questioning the assumption in law and development theory that laws fail to transfer because of shortcomings in project design and implementation. It brings together leading scholars who demonstrate that a synthesis of law and development, comparative law and regulatory perspectives (disciplines which to date have remained intellectually isolated from each other) can produce a more nuanced understanding about development failures. Arguing for a refocusing of the analysis onto the social demand for legal transfers, and drawing on empirically rich case studies, contributors explore what recipients in developing countries think about global legal reforms. This analytical focus generates insights into how key actors in developing countries understand global law reforms and how to better predict how legal reforms are likely to play out in recipient countries"--

Abstract: A timely analysis of State complicity in international law, which takes an innovative rule-of-law perspective.
Abstract: This systematic analysis of State complicity in international law focuses on the rules of State responsibility. Combining a theoretical perspective on complicity based on the concept of the international rule of law with a thorough analysis of international practice, Helmut Philip Aust establishes what forms of support for wrongful conduct entail responsibility of complicit States and sheds light on the consequences of complicity in terms of reparation and implementation. Furthermore, he highlights how international law provides for varying degrees of responsibility in cases of complicity, depending on whether peremptory norms have been violated or special subject areas such as the law of collective security are involved. The book shows that the concept of State complicity is firmly grounded in international law, and that the international rule of law may serve as a conceptual paradigm for today's international legal order.

Abstract: "Through an analysis of UN operations including international territorial administration, refugee camps, peacekeeping, the implementation of sanctions and the provision of humanitarian aid, Guglielmo Verdirame shows that the powers exercised by the UN carry a serious risk of human rights abuse. The International Law Commission has codified and developed the law of institutional responsibility, but, while indispensable, these principles and rules cannot on their own ensure compliance and accountability. The 'liberty deficit' of the UN and of other international organisations, thus remains an urgent legal and political problem. Some solutions may be available; indeed, recent state and institutional practice offers interesting examples in this respect. But at a fundamental level we need to ask ourselves whether, judged on the basis of the principle of liberty, the power shift from states to international organisations is always beneficial"--

Note: Includes bibliographical references (p. 287-308) and index , "As countries in Asia try to create unified polities, many face challenges from minority groups within their own borders seeking independence. This volume brings together international experts on countries in all regions of Asia to debate how differently they have responded to this problem. Why have some Asian countries, for example, clamped down on their national minorities in favour of homogeneity, whereas others have been willing to accommodate statehood or at least some form of political autonomy? Together they suggest broad patterns and explanatory factors that are rooted in the domestic arena, including state structure and regime type, as well as historical trajectories. In particular, they find that the paths to independence, as well as the cultural elements that have been selected to define post-colonial identities, have decisively influenced state strategies. This is a global phenomenon - and the book explains the broader theoretical and political implications - but violence and ethnic unrest have been particularly prevalent in Asia, and this is as true of China in its relationship to Tibet, as of Burma and Sri Lanka in relation to their national minorities. As the first book to analyse this phenomenon across Asia, it will attract a readership of students and scholars across a broad range of disciplines"--Provided by publisher

Abstract: "This book examines to what extent the right of self-defence, as laid down in Article 51 of the Charter of the United Nations, permits States to launch military operations against other States. In particular, it focuses on the occurrence of an 'armed attack' - the crucial trigger for the activation of this right. In light of the developments since 9/11, the author analyses relevant physical and verbal customary practice, ranging from the 1974 Definition of Aggression to recent incidents such as the 2001 US intervention in Afghanistan and the 2006 Israeli intervention in Lebanon. The notion of 'armed attack' is examined from a threefold perspective. What acts can be regarded as an 'armed attack'? When can an 'armed attack' be considered to take place? And from whom must an 'armed attack' emanate? By way of conclusion, the different findings are brought together in a draft 'Definition of Armed Attack'"--
Description / Table of Contents: The methodological debate and the quest for custom -- Conditions of self-defence -- The armed attack requirement ratione materiae -- The armed attack requirement ratione temporis -- The armed attack requirement ratione personae -- What future for the armed attack criterion?

Abstract: "Just when I thought America could never have a civilized discussion about immigration, along came this wonderful book. Thomas Jefferson would be so proud that many knowledgeable people spent time together wrestling with this highly charged political issue and sharing their thoughts in writing. I wish I could mandate that NO ONE could debate about immigration untill they read this book and passed the test!" Pat Schroeder, Former Congresswoman from Colorado. From the bookjacket.
