This approach will help the human rights movement succeed in a multipolar era.

    Abstract: The regulation of civil society provides the framework under which those organisations can most effectively provide services in education, health, social services, housing, development aid and so on. Civil Society in Europe identifies common principles of civil society law in two ways. First, the approaches of the Council of Europe and the European Union are explored. Next civil society regulation in twelve domestic legal systems are investigated on a broad range of substantive areas of law including internal organisation, registration, external supervision, public benefit organisations and international activities.     Abstract: Nations often turn to international courts to help with overcoming collective-action problems associated with international relations. However, these courts generally cannot enforce their rulings, which begs the question: how effective are international courts? This book proposes a general theory of international courts that assumes a court has no direct power over national governments. Member states are free to ignore both the international agreement and the rulings by the court created to enforce that agreement. The theory demonstrates that such a court can, in fact, facilitate cooperation with international law, but only within important political constraints. The authors examine the theoretical argument in the context of the European Union. Using an original data set of rulings by the European Court of Justice, they find that the disposition of court rulings and government compliance with those rulings comport with the theory's predictions--

That year, Kuo-Taj-In (Songtao Guo) and Kagenori Wooyeno (Ueno), attended a session of the Association for the Reform and Codification of the Law of Nations, later renamed International Law Association. Founded in 1873 in Brussels by a group of liberal lawyers, reformist and philanthropists, the International Law Association exists until today as one of the profession's more important organisations. The founding, at the end of the nineteenth century, of this and other professional organisations like the Institut de Droit International marked the beginning of international law as a liberal reformist project.1 Advancing the rule of law in international relations, this project involved the enactment of international rules and the creation of international courts and organisations. It also involved the emergence of an autonomous international legal profession, progressively separated from diplomatic circles and from the representation of the interests of individual states"--
    Abstract: "The development of international law is conventionally understood as a history in which the main characters (states and international lawyers) and events (wars and peace conferences) are European. Arnulf Becker Lorca demonstrates how non-Western states and lawyers appropriated nineteenth-century classical thinking in order to defend new and better rules governing non-Western states' international relations. By internalizing the standard of civilization, for example, they argued for the abrogation of unequal treaties. These appropriations contributed to the globalization of international law. With the rise of modern legal thinking and a stronger international community governed by law, peripheral lawyers seized the opportunity and used the new discourse and institutions such as the League of Nations to dissolve the standard of civilization and codify non-intervention and self-determination. These stories suggest that the history of our contemporary international legal order is not purely European; instead they suggest a history of a mestizo international law"--

    Abstract: Does European integration influence national cultures and social policies? Is Europe's fabled cultural diversity diminishing? In this book, Paulette Kurzer examines these important and topical questions by comparing the Irish abortion ban, Finnish and Swedish drinking restrictions, and Dutch drug decriminalization. Employing a synthesis of constructivist and institutionalist theories, Kurzer demonstrates that domestic shifts in values and attitudes, spurred along by the impact of EC/EU market integration, are in fact bringing about a convergence in European morality norms. Alcohol control policies are forced to liberalize, the Irish abortion proscription is being redefined, and Dutch drug toleration is pushed into a more punitive direction. Markets and Moral Regulation argues that a crucial agency is European law and its role as a market regulator: as market forces invade these cultural and moral spheres, protective barriers disintegrate. The result is that cultural and social domains are increasingly exposed to the influence of market competition
