    Abstract: Biographical note: Sebastian Günther, Ph.D. (1989) is Professor and Chair of Arabic and Islamic Studies at the University of Göttingen. Germany. He has published extensively on the intellectual history of Islam, including Representations and Visions of Homeland in Modern Arabic Literature (co-ed., Hildesheim 2016) and Ideas, Images, and Methods of Portrayal: Insights into Classical Arabic Literature and Islam (ed., Leiden 2005). Todd Lawson, Ph.D. (1989) is Professor Emeritus of Islamic Thought at the University of Toronto. He has published widely on Quranic exegesis, mysticism, Shi‘ism, and Quranic literary problems. Recent publications include articles such as Friendship, Illumination and the Water of Life (2016), Joycean Modernism in a 19th century Qur’an commentary (2015), The Qur’an and Epic (2014) and the monograph Gnostic Apocalypse in Islam (London 2012). Christian Mauder is a PhD student at the Institute of Arabic and Islamic Studies of the University of Göttingen, Germany. He has published several studies on the intellectual, cultural and religious history of Mamluk and Ottoman Egypt, including the monograph Gelehrte Krieger: Die Mamluken als Träger arabischsprachiger Bildung (Hildesheim 2012).

    Abstract: What is 'modern slavery' and who is responsible for it? What is the relevance of human rights law, which primarily regulates state conduct, for practices predominantly committed by private actors? Where can victims seek justice and redress when national authorities fail to protect them? These questions are the core focus of this book.Marija Jovanovich analyses the role and responsibility of states for addressing 'modern slavery' – a diverse set of practices usually perpetrated by non-state actors – against the backdrop of international human rights law. It explores the dynamic between criminal law and human rights law and reveals the different ways these legal domains work to secure justice for victims. The book considers the 'absolute' nature of the prohibition of modern slavery in human rights law, the range of practices covered by this umbrella term and their mutual relationships, the positive obligations of states established by international human rights tribunals owed to individuals subject to modern slavery, and the standards for assessing state responsibility in these situations. By engaging with the concept of exploitation in human rights law, Jovanovich glues together diverse practices of modern slavery, including servitude, forced labour, and human trafficking, into a coherent concept. The book elucidates the theoretical foundations of this fundamental human right and explains why human trafficking has an independent place within it. In addition to providing a comprehensive critique of the existing human rights jurisprudence, this book offers a roadmap for the future development of law on this subject emphasizing the limits of human rights law as a tool for addressing modern slavery.

    Abstract: Centering Pakistan in a story of transnational Islam stretching from South Asia to the Middle East, Simon Wolfgang Fuchs offers the first in-depth ethnographic history of the intellectual production of Shi'is and their religious competitors in this 'Land of the Pure.' The notion of Pakistan as the pinnacle of modern global Muslim aspiration forms a crucial component of this story.     Abstract: Constituent power is the power to create new constitutions. Since it is frequently exercised during or after political revolutions, it has been historically associated with extra-legality and violations of the established legal order. This book examines the relationship between constituent power and the law and the place of constituent power in constitutional history, focusing on the legal and institutional implications that theorists, politicians, and judges havederived from it. 0Since the 18th and 19th centuries, commentators and citizens have relied on the concept of constituent power to defend the idea that electors have the right to instruct representatives, and that the creation of new constitutions must take place through extra-legislative entities, such as primary assemblies open to all citizens. More recently, several Latin American constitutions explicitly incorporate the theory of constituent power and allow citizens, acting through popular initiative, totrigger constitution-making episodes that may result in the replacement of the entire constitutional order.0Constitutional courts have employed constituent power to justify their jurisdiction to invalidate constitutional amendments that alter the fundamental structure of the constitution and thus amount to a constitution-making exercise. Some governments have reverted to it to defend the legality of transforming the constitutional order through procedures not contemplated in the constitution's amendment rule, but considered participatory enough to be equivalent to 'the people in action', and these0attempts have sometimes been sanctioned by courts. 0

    Abstract: "To survive, let alone flourish, we need to be sure of - securely tied to - at least one other person. We also need to be sure of our general acceptance within the wider social world. This book explores the normative implications of taking our core social needs seriously. Chapter 1 sketches out what those needs are, and Chapter 2 shows that they ground a fundamental, but largely neglected human right against social deprivation. Chapter 3 then argues that this human right includes a right to sustain the people we care about, and that often, when we are denied the resources to sustain others, we endure social contribution injustice. Chapters 4 - 6 explore the tension between our needs for social inclusion and our needs for interactive and associative freedom, showing that social inclusion must take priority. While Chapters 5 and 6 defend a narrow account of freedom of association, Chapter 7 shows that the moral ballgame changes once we have made morally messy associative decisions. Sometimes we have rights remain in associations that we had no right to form. Finally, Chapter 8 exposes the distinct social injustices that we do to people whom we deem to be socially threatening. Overall, the book identifies ways to change our social and political practices, and our personal perspectives, to better honour the fact that we are fundamentally social beings."

To ensure that governments are indeed held accountable for their treatment of citizens and others the United Nations has established a wide range of mechanisms to monitor compliance, and to seek to prevent as well as respond to violations. The panoply of implementation measures that the UN has taken since 1945 has resulted in a diverse and complex set of institutional arrangements, the effectiveness of which varies widely. Indeed, there is much doubt as to the effectiveness of much of the UN's human rights efforts but also about what direction it should take. Inevitable instances of politicization and the hostile, or at best ambivalent, attitude of most governments, has at times endangered the fragile progress made on the more technical fronts. At the same time, technical efforts cannot dispense with the complex politics of actualizing the promise of human rights at and through the UN. In addition to significant actual and potential problems of duplication, overlapping and inconsistent approaches, there are major problems of under-funding and insufficient expertise. The complexity of these arrangements and the difficulty in evaluating their impact makes a comprehensive guide of the type provided here all the more indispensable. These essays critically examine the functions, procedures, and performance of each of the major UN organs dealing with human rights, including the Security Council and the International Court of Justice as well as the more specialized bodies monitoring the implementation of human rights treaties. Significant attention is devoted to the considerable efforts at reforming the UN's human rights machinery, as illustrated most notably by the creation of the Human Rights Council to replace the Commission on Human Rights. The book also looks at the relationship between the various bodies and the potential for major reforms and restructuring.

    Abstract: "Postcolonialism refers not only to the historical epoch after the end of the colonial era, but also to a theoretical concept for the analysis of power relations. In German-speaking theology, this concept has so far received little attention. In the bilingual volume Postcolonialism, theology and the construction of the other, scholars of all theological disciplines, including religious studies, explore the heuristic possibilities that postcolonialism provides for their subject. In particular, the question is how "the other" is constructed as the counterpart of a "we." In times of global migration and growing right-wing extremism, theology must remain capable to offer answers to the urgent questions of the present.
    Abstract: Postkolonialismus bezeichnet nicht nur die historische Epoche nach dem Ende der Kolonialzeit, sondern auch ein theoretisches Konzept zur Analyse von Herrschaftsverhältnissen. In der deutschsprachigen Theologie wurde dieses Konzept bisher wenig beachtet. Im zweisprachigen Sammelband Postkolonialismus, Theologie und die Konstruktion des Anderen erkunden Vertreter aller theologischen Disziplinen einschließlich der Religionswissenschaft die heuristischen Möglichkeiten, die der Postkolonialismus für ihr Fach bietet. Es geht dabei insbesondere um die Frage, wie „der Andere“ als Gegenüber eines „Wir“ konstruiert wird. Gerade in Zeiten globaler Migration und erstarkenden Rechtsextremismus muss Theologie sprachfähig bleiben, um den drängenden Fragen der Gegenwart Antwortangebote bieten zu können.
