    Abstract: Das Buch stellt das aktuelle nationale Tierversuchsrecht ausführlich dar. Berücksichtigt werden dabei vor allem die Umsetzung der Richtlinie 2010/63/EU in das deutsche Tierschutzgesetz und die Neuerungen, die das nationale Tierversuchsrecht hierdurch erfahren hat. Aufgezeigt werden neben der Beurteilung vormals bestehender rechtlicher Streitpunkte, beispielsweise des Umfangs der Prüfungskompetenz der Genehmigungsbehörden, auch Fälle der unzureichenden sowie der mangelnden Umsetzung der Vorgaben der Richtlinie 2010/63/EU. Insofern werden sowohl die richtlinienkonforme Auslegung nationaler Regelungen, als auch eine unmittelbare Wirkung einzelner Richtlinienvorschriften untersucht. Schließlich wird die Verfassungsmäßigkeit bestimmter nationaler Regelungen analysiert, dies betrifft insbesondere das relative Verbot schwerst belastender Tierversuche sowie Verwendungsverbote- und beschränkungen in Bezug auf Primaten und Menschenaffen

    Abstract: The book examines the phenomenon of immigration federalism: its main characteristics, why and how it has developed, its implications for immigration systems (in general) and non-citizens' rights (in particular). The book introduces the reader to theoretical perspectives on immigration federalism through three sets of literature - federalism, governance and non-citizens' rights - that provide a necessary framework for understanding immigration federalism's multiple facets and impacts. It also offers an analysis of immigration federalism through case studies of six jurisdictions: Australia, Canada, Germany, Switzerland, the EU and the US. Despite increased sub-national activity in immigration regulation in several federal states, very little research has been dedicated so far to comparing how federal states deal with immigration federalism. Comparative studies on the human rights implications of immigration federalism have received even less attention. This book seeks to fill the gap in this area and is an important contribution to the field, providing the reader with a better understanding of the complex issues surrounding immigration federalism and its impact on non-citizens

This book traces the origins of the German welfare state. The author, formerly director at the Max-Planck-Institute for European Legal History, Frankfurt, provides a perceptive overview of the history of social security and social welfare in Germany from early modern times to the end of World War II, including Bismarck’s pioneering introduction of social insurance in the 1880s. The author unravels “layers” of social security that have piled up in the course of history and, so he argues, still linger in the present-day welfare state. The account begins with the first efforts by public authorities to regulate poverty and then proceeds to the “social question” that arose during the 19th-century Industrial Revolution. World War I had a major impact on the development of social security, both during the war and after, through the exigencies of the war economy, inflation and unemployment. The ruptures as well as the continuities of social policy under National Socialism and World War II are also investigated.

Schmidt’s analysis of the GDR also depicts commonalities and differences between the welfare state in East and West Germany as well as in other East European and Western countries. He concludes that the GDR was unable to cope with the trade-off between ambitious social policy goals and a deteriorating economic performance. Ritter embeds his analysis of the Social Union in a general study of German unification, its international circumstances and its domestic repercussions (1989-1994). He argues that social policy played a pivotal role in German unification, and that there was no alternative to extending the West German welfare state to the East. Ritter, a distinguished historian, bases his contribution on an award-winning study for which he drew on archival sources and interviews with key actors. Kaufmann, the doyen of the sociology of social policy in Germany, emphasizes norms, culture and history, in contrast to political economy approaches. Comparing Britain, Sweden, France and Germany, Kaufmann highlights the „idiosyncrasy” of each welfare state: countries are compared with regard to their state traditions and the relationship between state and civil society; their national “social questions”; their economic systems, including the unions and labour law; social security and redistribution; and their personal social services and education. The socio-cultural approach enables Kaufmann to show that not all modern states are welfare states. Some are just „capitalism“ (the USA), others are „socialism“ (the former Soviet Union). The book traces the political history of the concept of social policy. „Social policy“ originated in Germany in the mid 19th century as a scholarly term that made a career in politics. The term became more prominent only after World War II. Kaufmann, the doyen of the sociology of social policy in Germany, argues that „social policy“ responds to the modern disjunction between “state” and “society” diagnosed by the German philosopher Hegel. Hegel’s disciple Lorenz von Stein saw social policy as a means to pacify the capitalist class conflict. After World War II, social policy expanded in an unprecedented way, changing its character in the process. Social policy turned from class politics into a policy for the whole population, with new concepts - like "social security", "redistribution" and "quality of life" - and new overarching formulas, "social market economy" and "social state" (the German version of “welfare state”). Both formulas have remained indeterminate and contested, indicating the inherent openness of the idea of the “social”

    Abstract: Following in the footsteps of the book Fish for Life - Interactive Governance for Fisheries (Kooiman et al., 2005), and the interdisciplinary approach it presents, this volume illustrates the contribution of interactive governance theory to understanding core fisheries and aquaculture challenges. These challenges are invariably linked to broader concerns such as ecosystem health, social justice, sustainable livelihoods and food security. The central concept in this perspective is governability - the varied capacity to govern fisheries and aquaculture systems sustainably. Many of these systems are characterized by problems that are inherently 'wicked' and therefore difficult to address. The authors of this edited volume argue that responses to such problems must consider context; specifically the character of the fisheries and aquaculture systems themselves, their institutional conditions, and the internal and external interactions that affect them.     Abstract: The papers in this collection, written by a cross-regional group of experts, provide insights into the causes of declining levels of citizen participation and other distinct forms of civic activism in Europe and explore a range of factors contributing to apathy and eventually disengagement from vital political processes and institutions. At the same time, this volume examines informal or unconventional types of civic engagement and political participation corresponding to the rapid advances in culture, technology and social networking. The volume is divided into three interrelated parts: Part I consists of critical essays in the form of theoretical approaches to analysing weakening political participation and citizen estrangement; Part II is dedicated to an exploration of the role and deployment of technologically advanced media, such as the internet, as determinants of changing patterns of political participationist behaviour. Finally, Part III presents findings of empirical research on the issue of political participation. Combining theoretical and empirical perspectives, the book contributes towards a better understanding of the disquieting trend of voter apathy and disenchantment with politics in the context of the ongoing process of European integration, and offers a variety of analytical tools for decoding both the emergence of alternative conceptualizations of citizenship and other forms of meaningful civic and political engagement.

    Abstract: Vitalism is understood as impacting the history of the life sciences, medicine and philosophy, representing an epistemological challenge to the dominance of mechanism over the last 200 years, and partly revived with organicism in early theoretical biology. The contributions in this volume portray the history of vitalism from the end of the Enlightenment to the modern day, suggesting some reassessment of what it means both historically and conceptually. This book analyzes the National Popular Vote plan and shows that this plan may violate the Supreme Court decisions on the equality of votes cast in statewide popular elections held to choose state electors. Thus, the National Popular Vote plan may violate the Equal Protection Clause of the Fourteenth Amendment. The book proposes a new election system in which the will of the states and the will of the nation as a whole are determined by direct popular elections for President and Vice President in the 50 states and in D.C. This system a) would elect President a candidate who is the choice of both the nation as a whole and of the states as equal members of the Union, b) would let the current system elect a President only if no such candidate exists, and c) would encourage the candidates to campaign nationwide

    Abstract: This book examines the notion of children having full citizenship. It does so historically, through intellectual discourse, beliefs, and moral and ideological positions on children. In Part 1, this book provides an analytical comparison of the public sector Ombudsman Institutions in Australia (the Commonwealth Ombudsman and the state/territory Ombudsmen of all Australian states as well as of the Northern Territory and the ACT), the Cook Islands, Hong Kong, New Zealand, Papua New Guinea, Samoa, Taiwan, Tonga and Vanuatu. In addition to a comparative analysis showing the partial heterogeneity of the Institutions, a comprehensive overview of common features, and explorations of the specifics and peculiarities of the Institutions, Part 2 presents separate reports on the 16 different jurisdictions featuring their main functions as follows: - Legal basis, legal status and organisation, - Mandate, object of control and standard of control, - Powers, including legal quality and impact of the outcomes of investigative procedures, - Relationship to the administration, the judiciary and the legislator, and - Special characteristics. Part 2 is based on information provided by the Institutions themselves in questionnaires sent out at the outset of the study, an analysis of the respective establishing acts and other relevant laws, and on relevant scientific publications and the Institutions’ Annual Reports. The reports also refer to relevant legal provisions and include websites addresses for ease of reference

    Abstract: This volume seeks to explain why democratization and military reforms stagnate in newly democratizing countries. The contributions blend historical, ideational, cultural and structural explanatory factors to analyze the trajectories of military reform in Indonesia and Nigeria, two major regional powers that share many structural commonalities. In the tradition of the literature on security sector reform (SSR), the book not only scrutinizes executive initiatives toward military reform, but also provides ample coverage of societal actors. Findings show that while military reform is stagnating in both countries, societal forces ought to be taken into account more as major driving forces in explaining military reform. Several chapters study how legislatures, non-governmental organizations and the civilian defence epistemic community contribute to the transformation of military institutions. The last part of the book tackles another aspect rarely studied in the literature on military reform, namely, the role of militias in military reform.

    Abstract: " This volume is the result of a research project entitled ""Evolutionary Continuity - Human Specifics - The Possibility of Objective Knowledge"" that was carried out by representatives of six academic disciplines (evolutionary biology, evolutionary anthropology, brain research, cognitive neuroscience, cognitive psychology and philosophy) over a period of three and a half years.The starting point for the project was the newly emerging riddle of human uniqueness: though the uniqueness of human beings is undisputable, all explanations for this fact have successively been discarded or refuted in recent decades. There is no special factor that could explain the particularities of human existence. Rather, all human skills derive from a continuous relation to pre-human skills, that is to say, to elements that were developed earlier in the phylogeny and were later inherited. But starting from abilities that are anything but special, how could the particularity of human beings have evolved?This was the guiding question of the project. In this work we try to answer it by addressing the following problems: How strong is evolutionary continuity in human beings? How can we understand that it gave way to cultural discontinuity? Which aspect of cultural existence is really unique to humans? Can the possibility of objective knowledge be seen as a (admittedly extreme) case in point? - The answers are meant to help clarify the central issue of contemporary scientific anthropology."

    Abstract: This book presents the findings of a study into the social shaping of reproductive genetics in Germany and Israel. The study reveals dramatic differences between German and Israeli societies in addressing the question of a life (un)worthy of living. A close analysis of the ways that these two societies handle the balance between the quality and sanctity of life illuminates controversies over reproductive genetics in an original and provocative way.
    Abstract: Based on a variety of empirical materials the study reveals dramatic differences between the way that the German and Israeli societies address the question of a life (un)worthy of living: while in Germany, social, cultural, religious and legal conditions restrict the selection of embryos based on prenatal diagnosis, in Israel they strongly encourage it. A close comparative analysis of the ways that these two societies handle the delicate balance between the quality and sanctity of life illuminates the controversy around reproductive genetics in an original and provocative way. The study is also innovative in its use of contemporary social theory concerning the politics of life in comprehending the differences between two societies positioned at opposite extremes in their adoption of reproductive genetics. It thus offers an original cross-cultural discussion concerning present-day techno-medical manipulations of life itself.

    Abstract: "This collection develops insight into the relation which Hobbes describes between his theory of government and the three-part division he draws with respect to religion. Pursuing the chain of causes that proves God's existence as first cause, Hobbes identifies and defines both ""true religion"" and such superstition as he found in the theology and practices of the Roman Catholic Church of his era. He then emphasizes the difference between natural religion and revealed religion in order to extinguish the claim of contemporary theologians to an authority in the state greater than that of the political sovereign.     Abstract: This book originated as a Festschrift to mark the publication of Volume 50 of the journal `Acta Biotheoretica' in 2002 and the journal's 70th anniversary in 2005. In it, eleven previously unpublished research papers have been collected that reflect the entire scope of topics on which `Acta Biotheoretica' publishes. `Acta Biotheoretica' is a journal on theoretical biology, published by Kluwer Academic Publishers, that has its roots in the Dutch tradition of theoretical biology. From the perspective of this tradition, theoretical biology is understood as encompassing a broad spectrum of disciplines ranging from mathematical biology to philosophy of biology. To reflect the Dutch roots of the journal, all papers have been invited from authors that work in The Netherlands.     Abstract: "'Scientific advice to politics', the 'nature of expertise', and the 'relation between experts, policy makers, and the public' are variations of a topic that currently attracts the attention of social scientists, philosophers of science as well as practitioners in the public sphere and the media. This renewed interest in a persistent theme is initiated by the call for a democratization of expertise that has become the order of the day in the legitimation of research funding.
