    Abstract: In dem vorliegenden Buch werden die Interessenkonflikte der betrieblichen und behördlichen Datenschutzbeauftragten analysiert. Im Mittelpunkt steht eine ausführliche praxisbezogene Analyse der möglichen Interessenkonflikte der Datenschutzbeauftragten. Es wird herausgearbeitet, wie sich diese Interessenkonflikte auf die Praxis der betrieblichen und behördlichen Datenschutzbeauftragten auswirken und welche Unterschiede sich bei einer internen oder externen Benennung des Datenschutzbeauftragten ergeben. Art. 38 Abs. 6 S. 1 DSGVO sieht ein Verbot der Zuweisung konfligierender Aufgaben vor – die Möglichkeiten eines Interessenkonflikts des Datenschutzbeauftragten gehen jedoch weit über diese normierte Konfliktmöglichkeit hinaus. Konkret werden in der Arbeit Interessenkonflikte in Bezug auf die unabhängige Stellung, die Aufgaben, die Pflichten und die Rechtsbeziehungen des Datenschutzbeauftragten betrachtet. Bei der Analyse der Interessenkonflikte wird berücksichtigt, dass der Datenschutzbeauftragte zugleich dem Verantwortlichen, den Betroffenen, den Aufsichtsbehörden und dem Datenschutz als abstraktes Schutzgut verpflichtet ist. Schließlich wird in der Arbeit aufgezeigt, welchen Verbundenheiten sich der Datenschutzbeauftragte ausgesetzt sieht und welche Antworten des Rechts den Interessenkonflikten gegenüberstehen.

    Abstract: Dieses Buch analysiert eine 2017 angestoßene Tendenz der höchstrichterlichen Rechtsprechung, wonach die aus dem Arzthaftungsrecht stammende Beweisregel der Beweislastumkehr beim groben Behandlungsfehler auf andere Berufsgruppen ausgeweitet wird. In einem ersten Hauptteil werden umfangreich die Grundlagen zur Regelung des § 630h Abs. 5 S. 1 BGB dargestellt; deren rechtsgeschichtliche Entwicklung, deren Stärken und Schwächen, sowie Alternativlösungen für das Beweisproblem bei der Kausalität im Arzthaftungsrecht. Im darauffolgenden Hauptteil wird sodann die Entwicklung zur Anwendung der Vorschrift außerhalb des Arzthaftungsrechts beleuchtet, beginnend mit einer umfassenden Auswertung von Entscheidungen seit dem Jahr 1962, die eine entsprechende Anwendung der Beweislastregel in Erwägung gezogen haben. Im Anschluss wird diese Entwicklung nach einer Festlegung der methodischen Bewertungsgrundlagen nach Fallgruppen differenziert beurteilt. So wird im Ergebnis eine subsumtionsfähige Formel für künftige Fälle erarbeitet, die über die Zulässigkeit einer Analogie zu § 630h Abs. 5 S. 1 BGB entscheidet. Schlussendlich wird ein rechtspolitischer Vorschlag für eine Alternativregelung unterbreitet, die nicht an die viel kritisierte Beweislastumkehr anknüpft. Der Leser erhält so einen umfassenden Überblick zu der sich aktuell vollziehenden Rechtsfortbildung. Das Ergebnis ist ein Kompromiss aus den unübersehbaren Beweisnöten in den gegenständlichen Fällen auf der einen Seite, sowie dem Anliegen auf der anderen Seite, den Anwendungsbereich der Regelung zu begrenzen, um nicht das gesamte Haftungsrecht damit zu infiltrieren.

    Abstract: "Where does one situate business and human rights? From the perspective of law alone, business falls within the general sphere of private law, further broken down into discrete sub-spheres, particularly corporate law and commercial law. The human rights component is situated in constitutional and international law. Prima facie, 'business' and 'human rights' fall into distinct spheres of regulation and differ in their primary sources. If law were simply approached from a compartmentalized perspective, business would be of no relevance to human rights and vice versa. This, however, is artificial and is antithetical to holistic approaches to problem solving, not to mention the inter-connectivity of law.1 It is unfortunate that in simplifying the study of law through the creation of sub-disciplines, the emergence of sub-discipline expertise (e.g. labor law) has magnified the differences between them"-- ECIP Introduction

    Abstract: Dieser Open Access Band bietet sowohl deutsch- als auch italienischsprachige Beiträge zu wesentlichen Bereichen des gewerblichen Rechtsschutzes und des Urheberrechts aus der Sicht des deutschen, italienischen und österreichischen Rechts sowie zum TRIPS-Abkommen samt einem Blick auf das vorläufig in Kraft getretene Handelsabkommen zwischen Kanada und der Europäischen Union (CETA). Ein Schwerpunkt ist Schadenersatzansprüchen aus der Verletzung von Immaterialgüterrechten gewidmet, wobei die bei grenzüberschreitenden Sachverhalten auftretenden Fragen der internationalen Gerichtszuständigkeit und des Kollisionsrechts speziell behandelt werden. Die Ergebnisse sowie Lösungen tragen der besonderen Behandlungssituation vulnerabler Palliativmedizinpatienten Rechnung. Das Buch schließt mit einer Aufarbeitung zweier besonderer Konstellationen der Palliativmedizin: den Entscheidungen unmittelbar am Lebensende sowie der Neugeboreneneuthanasie.

    Abstract: "Genocide is a problem: not only the terrible fact of mass death, but also how the relatively new idea and law of genocide organises and distorts our thinking about civilian destruction. Taking the normative perspective of civilian immunity from military attack, this book argues that the implicit hierarchy of international law, atop which sits genocide as the "crime of crimes," blinds us to other types of humanly caused civilian death, like bombing cities, the "collateral damage" of missile and drone strikes, blockades, and sanctions. In other words, talk of genocide functions ideologically to detract from systematic violence against civilians perpetrated by governments. The Problems of Genocide also contends that this violence is the consequence of "permanent security" imperatives: the striving of states, and armed groups seeking to found states, to make themselves invulnerable to threats. To solve the problems of genocide, this book proposes replacing it with permanent security, which should be criminalized"--

    Abstract: This collection explores some of the many ways in which constitutional orders engage with, and are shaped by, their exteriors. Constitutional and legal theory often marginalize 'foreign' elements, such as norms originating in other legal systems, the movement of individuals across borders, or the application of domestic law to foreign affairs. In The Double-Facing Constitution, these instances of boundary crossing lie at the heart of an alternative understanding of constitutions as permeable membranes, through which norms can and sometimes must travel. Constitutional orders are facing both inwards and outwards - and the outside world influences their interiors just as much as their internal orders help shape their surroundings.     Abstract: The 1947 Partition had a major impact on issues of citizenship and rights in India and Pakistan in the decades that followed. Boundaries of Belonging shows how citizenship evolves at a time of political transition and what this meant for ordinary people, by directing attention away from South Asia's Partition 'hotspots' - Bengal and Punjab - to Partition's 'hinterlands' of Uttar Pradesh and Sindh. The analysis, based on rich archival research and fieldwork, brings out commonalities, differences, and the mutual co-construction of the 'citizen' in both places. It also reveals the way in which developments across the border, such as communal violence, could directly impact on minority rights in its neighbour. Questioning stereotypes of an increasingly 'authoritarian' Pakistan and 'democratic' India, Sarah Ansari and William Gould make a major contribution to recent scholarship that suggests the differences between India and Pakistan are overstated

In this liberal egalitarian account, religious liberty claims are often rejected when faced with competing individual interests - the neutral secular state must protect us against the liberty-constraining acts of religions. Joel Harrison challenges this account. He argues that it is rooted in a theologically derived narrative of secularisation: rather than being neutral, it rests on a specific construction of 'secular' and 'religious' spheres. This challenge makes space for an alternative theological, political, and legal vision.
