Abstract: What is 'modern slavery' and who is responsible for it? What is the relevance of human rights law, which primarily regulates state conduct, for practices predominantly committed by private actors? Where can victims seek justice and redress when national authorities fail to protect them? These questions are the core focus of this book.Marija Jovanovich analyses the role and responsibility of states for addressing 'modern slavery' – a diverse set of practices usually perpetrated by non-state actors – against the backdrop of international human rights law. It explores the dynamic between criminal law and human rights law and reveals the different ways these legal domains work to secure justice for victims. The book considers the 'absolute' nature of the prohibition of modern slavery in human rights law, the range of practices covered by this umbrella term and their mutual relationships, the positive obligations of states established by international human rights tribunals owed to individuals subject to modern slavery, and the standards for assessing state responsibility in these situations. By engaging with the concept of exploitation in human rights law, Jovanovich glues together diverse practices of modern slavery, including servitude, forced labour, and human trafficking, into a coherent concept. The book elucidates the theoretical foundations of this fundamental human right and explains why human trafficking has an independent place within it. In addition to providing a comprehensive critique of the existing human rights jurisprudence, this book offers a roadmap for the future development of law on this subject emphasizing the limits of human rights law as a tool for addressing modern slavery.

Abstract: "Elgar Research Agendas outline the future of research in a given area. Leading scholars are given the space to explore their subject in provocative ways, and map out the potential directions of travel. They are relevant but also visionary. Forward-looking and innovative, Elgar Research Agendas are an essential resource for PhD students, scholars and anybody who wants to be at the forefront of research. This important book creatively explores and uncovers new ways of understanding the intersections between human rights and the environment, as well as introducing readers to the ways in which we can use new methodologies, case studies and approaches in human rights to address environmental issues. Interdisciplinary in nature, this Research Agenda recognises and engages with the short-comings and problematic framings of traditional approaches to human rights and environmental law. Keeping these limits and failings unflinchingly in view, it identifies potential opportunities to maximise the law's effectiveness, providing readers with a thought-provoking agenda for future research. Contributions also call for resistant, transformative and inclusive research and practice in the area of human rights and the environment, using human rights law to center the knowledge, practices, laws and priorities of marginalised groups in addressing environmental injustice. This dynamic Research Agenda will be an essential tool for PhD students and scholars in international law, environmental law and human rights, as well as providing a springboard for geographers and anthropologists to further their knowledge of the evolving interface between human rights and the environment"--

Abstract: "This book brings together prominent scholars in the fields of international cultural heritage law and heritage studies to scrutinise the various branches of international law and governance dealing with heritage destruction from human rights perspectives, both in times of armed conflict as well as in peace. Importantly, it also examines cases of heritage destruction that may not be intentional, but rather the consequence of large-scale infrastructural development or resource extraction. Chapters deal with high profile cases from Europe, North Africa, The Middle East, Latin America and the Caribbean, with a substantial afterword on heritage destruction in Ukraine"--

Abstract: The unmatched technological achievements in artificial intelligence (AI), robotics, computer science, and related fields over the last few decades can be considered a success story. The technological sophistication has been so groundbreaking in various types of applications that many experts believe that we will see, at some point or another, the emergence of general AI (AGI) and, eventually, superintelligence. This book examines the impact of AI on human rights by focusing on potential risks and human rights legislation and proposes creating a Universal Convention for the Rights of AI Systems (AI Convention). John-Stewart Gordon, PhD in Philosophy, serves as an adjunct full professor at LSMU and has held various academic roles. He's an associate editor at AI & Society, serves on multiple editorial boards, and is the general editor of Brill's Philosophy and Human Rights series. With over 90 publications, John is a prolific contributor to practical philosophy.

Abstract: “This is an impressive and ground-breaking book on normalisation in prison. With great insight, De Vos compares prisons in Belgium and Norway and her critical and nuanced analyses raise several questions of what ‘normal’ in the prison context means. I am especially thrilled over how the discussion emphasises the prisoners’ understanding and experience which raises a fundamental debate about the ‘law in book and law in action’ on this topic.” -Berit Johnsen, Research Professor, University College of Norwegian Correctional Service “The normalization principle is an old and important concept in Penology about which amazingly little is written. With this interdisciplinary and comparative study, Helene De Vos makes an important start with filling this gap and creates a strong theoretical framework for further research. The empirical work the author has done is amazing and shines light on the many paradoxes and complexities which the normalization principle evokes in the reality of prison life”. -Miranda Boone, Professor of C riminology and Comparative Penology, Leiden University, the Netherlands This book explores how prison life is normalized in different countries, with a critical and detailed look at ‘Scandinavian exceptionalism’ — the idea that Scandinavian prisons have exceptionally humane conditions — and compares these prisons to ones in Belgium. It provides a more nuanced, systematic and contextualized comparison of normalization in two countries. Through analyzing policy and legislative documents, participant observation and interviews, it seeks to understand how normalization is implemented differently in prison legislation, policies and practices and compares the two societies for context. It also considers the material prison environment, security, the social environment and the use of time in prison. It provides insights into how normalization can be successfully and holistically implemented in both policy and practice, to contribute to a more ‘pure’ form of liberty deprivation as punishment without too many unintended effects. Helene De Vos is an affiliated senior researcher at KU Leuven, Belgium, and the executive director of RESCALED. She is particularly interested in comparative prison research and the relationship between prison policies, legislation and practice. .

Abstract: "Looking at two of the key paradigms of the post-Cold War era - national sovereignty, and human rights - this book examines the possibilities for their reconciliation from a global perspective. The real or imagined fear of a flood of immigrants has caused and fuelled the surge of an amalgam of populist political forces, anti-immigrant movements and exclusionist nationalism in many developed countries. In the last decade, we have witnessed the emergence of two phenomena in the political and legal spheres. On the one hand, there are liberal globalists asking for respect and the protection of the basic human rights of migrants and asylum seekers and arguing for their civic and social integration into host societies. On the other hand, there are growing calls for a tougher stance on immigration, and powerful populist politicians and governments have emerged in many developed countries. How can the idea of universal human rights survive exclusionist nationalism that uses a populist, unscrupulous approach to its advantage? The contributors to this book explore the meaning of, and possible solutions to, this dilemma using a wide range of approaches and seek appropriate ways of dealing with these normative predicaments shared by many developed societies. Scholars and students of human rights, migration, nationalism and multiculturalism will find this a very valuable resource"--

Geburtstages gewidmet. Die Herausgeber RR Dr. habil. Abstract: "This illuminating and invaluable collection draws together international and interdisciplinary contributors to explore the Green Criminology-Law nexus. Covering topics from plastics to policing, activism to ecocide, the chapters provide a survey of what we can learn and use as the basis for moving forward in education, politics and practice." —Nigel South, Professor of Sociology, University of Essex, UK. "Green Criminology and the Law is a fantastic collection of insightful chapters, all of which offer crucial theoretical and empirical insights on vitally important topics. A much needed intervention that will make the field even more relevant to students, scholars and the wider public in these times of ecological crisis." —Damien Short, Professor, University of London, UK This edited collection is grounded in a green criminological approach to understand whether the law, both in effect and implications, reflects, refracts, or sublimates the social, political and ecological conditions of our times. Since its initial proposal in the 1990s, green criminology has focused the criminological gaze on a wide array of harms and crimes affecting humans, animals other than humans, ecological systems, and the planet as a whole. As a continuously blossoming field of criminological inquiry, green criminology recognizes and examines behaviours that are both illegal and legal (yet detrimental), and in varying ways has made great efforts to provide insight into harms in a more fulsome manner. At the same time, there have been many significant legal instances, domestic, and international, including case law, legislation, regulation, treaties, agreements and executive directives which have troubled the law’s understanding of green harms, illegal and legal activity, pushing legal boundaries in the process. Recognizing that humanity and nature are inextricably integrated, Green Criminology and the Law reflects the range and depth of high-quality research and scholarship, combining contributions from established scholars willing to explore new topics and recent entrants who are breaking new scholarly ground. James Gacek is Assistant Professor in the Department of Justice Studies at the University of Regina, Canada. Richard Jochelson is Professor and Dean of Law at Robson Hall Law School, Faculty of Law at the University of Manitoba, Canada.

Abstract: This open access book focuses on the impact of Artificial Intelligence (AI) on individuals and society from a legal perspective, providing a comprehensive risk-based methodological framework to address it. Building on the limitations of data protection in dealing with the challenges of AI, the author proposes an integrated approach to risk assessment that focuses on human rights and encompasses contextual social and ethical values. The core of the analysis concerns the assessment methodology and the role of experts in steering the design of AI products and services by business and public bodies in the direction of human rights and societal values. Taking into account the ongoing debate on AI regulation, the proposed assessment model also bridges the gap between risk-based provisions and their real-world implementation. The central focus of the book on human rights and societal values in AI and the proposed solutions will make it of interest to legal scholars, AI developers and providers, policy makers and regulators. Alessandro Mantelero is Associate Professor of Private Law and Law & Technology in the Department of Management and Production Engineering at the Politecnico di Torino in Turin, Italy.

Abstract: "Intersex and/as/is/with disability. The connections between intersex and disability deserve nuanced attention if we are to strengthen intersex human rights claims and understand the experiences of intersex people living with the disabling consequences of medical intervention. Cripping Intersex explores three key themes: the medical management of people with intersex characteristics; the mainstream fascination with sport sex-testing policies; and the eugenic implications of preimplantation genetic diagnosis. This necessary work offers radical new understandings of intersex-with-disability by investigating how intersex and interphobia intersect with disability and ableism, and pushes analyses of intersex experience further than feminist or queer theory can do alone."

Abstract: "This handbook intends to offer a comprehensive and authoritative overview of the human rights implications of emerging technologies in the fields of life sciences and information and communication technologies (ICT). To this end, the volume brings together leading experts whose expertise encompasses several disciplinary domains (law, ethics, technology, basic science, medicine, business, etc.) with purposes of gathering extensive multidisciplinary knowledge about the evolutive transformation of the human rights framework in response to technological innovation. In particular, the aim of this volume is threefold. First, it aims to provide a comprehensive state-of-the-art report on emerging technologies that are likely to transform the human rights framework in the upcoming decades. Second, this collection of essays aims to raise awareness of the ethically and legally appropriate implementation of these technologies and to identify possible critical issues that arise or might arise in the context of their application. Third, and ultimately, the volume intends to contribute to the development of a robust, inclusive, and anticipatory human rights framework that can guide global societies across the ongoing digital transformation. In doing so, special attention is devoted to promoting policies and regulatory frameworks that foster the inalienable rights of individuals and the prevention of potential inappropriate uses or abuses of emerging technologies"--

Abstract: Hashtag Mütend: Eltern, sucht euch Verbündete! (Verlagswerbung)

Abstract: This book offers a distinctive approach to the key international instrument on indigenous rights, the United Nations Declaration on the Rights of Indigenous Peoples (Declaration) based on a new account of the political history of the international indigenous movement as it intersected with the Declaration's negotiation. The current orthodoxy is to read the Declaration as containing human rights adapted to the indigenous situation. However, this reading does not do full justice to the complexity and diversity of indigenous peoples' participation in the Declaration negotiations. Instead, I argue that the Declaration should be subject to a novel, mixed-model reading that views the Declaration as embodying two distinct normative strands that serve different types of indigenous peoples. Not only is this model supported by the Declaration's political history and legal argument, it provides a new and compelling theory of the bases of international indigenous rights while clarifying the vexed question of who qualifies as indigenous for the purposes of international law.

Abstract: The coronavirus pandemic has hit Latin America particularly hard. In no other region of the world have so many people been infected with the virus as here. Influenced by the pandemic, poverty and inequality have increased, the economic crisis has worsened and, in some countries, authoritarian and repressive tendencies have grown, all of which poses enormous challenges for the region. This anthology is dedicated to the consequences of the coronavirus pandemic and pandemic policies in Latin America and the Caribbean. The articles it contains examine the consequences of the pandemic in terms of social inequalities, gender relations, violence against women, democracy, human rights, labour, the mobilisation of protest and environmental policy. They discuss what social and political lessons can be drawn from the pandemic experience in Latin America at the end of 2021, when the region is far from a post-pandemic era. With contributions by Carolina Alves Vestena, Hans-Jürgen Burchardt, Alba Carosio, Kristina Dietz, Patrick Eser, Caroline Kim, Moritz Krawinckel, Stefan Peters, Axel Rojas, Christiane Schulte, Jürgen Weller, Andréa Zhouri and Claudia Zilla.

Abstract: Die Würde des Menschen ist unantastbar. Die Menschenrechte gelten universell. Doch was bedeutet das? Zu Wort kommen u. a.

Abstract: "As of 2019, there were over 70 million people displaced from their homes, the most displaced persons since the Second World War. This number continues to rise as solutions to stem large-scale violence and subsequent displacement continue to fail. Today, twenty-four people are displaced from their homes and communities every minute. The likelihood of the displaced returning to their homes is become increasingly unlikely as their homes may have been destroyed as a result of conflict and war. What are the impacts of loss of home upon children, adults, families, communities, and societies? If having a home is a basic human right, then why is the destruction of one's home not viewed as a violation of human rights and prosecuted accordingly? This book answers these questions and more by focusing on domicide, or the intentional destruction of the home, as a human rights issue"--

Abstract: Klappentext: Die Klimakrise wird Millionen die Lebensgrundlage entziehen. Abstract: This book considers contested responsibilities between the public and private sectors over the use of online data, detailing exactly how digital human rights evolved in specific European states and gradually became a part of the European Union framework of legal protections. The author uniquely examines why and how European lawmakers linked digital data protection to fundamental human rights, something heretofore not explained in other works on general data governance and data privacy. In particular, this work examines the utilization of national and European Union institutional arrangements as a location for activism by legal and academic consultants and by first-mover states who legislated digital human rights beginning in the 1970s. By tracing the way that EU Member States and non-state actors utilized the structure of EU bodies to create the new norm of digital human rights, readers will learn about the process of expanding the scope of human rights protections within multiple dimensions of European political space. The project will be informative to scholar, student, and layperson, as it examines a new and evolving area of technology governance – the human rights of digital data use by the public and private sectors. Rebekah Dowd is an Assistant Professor of Political Science at Midwestern University in Texas. Rebekah’s research focuses on human rights within data policy, the online behavior of individuals and states, and policy decision-making by European politicians. Dr. Dowd teaches courses in global studies, international relations, comparative and foundational politics, European politics, and international political economy.

Abstract: This book provides an in-depth overview of what is currently happening in the field of Law and Artificial Intelligence (AI). From deep fakes and disinformation to killer robots, surgical robots, and AI lawmaking, the many and varied contributors to this volume discuss how AI could and should be regulated in the areas of public law, including constitutional law, human rights law, criminal law, and tax law, as well as areas of private law, including liability law, competition law, and consumer law. Aimed at an audience without a background in technology, this book covers how AI changes these areas of law as well as legal practice itself. This scholarship should prove of value to academics in several disciplines (e.g., law, ethics, sociology, politics, and public administration) and those who may find themselves confronted with AI in the course of their work, particularly people working within the legal domain (e.g., lawyers, judges, law enforcement officers, public prosecutors, lawmakers, and policy advisors). Bart Custers is Professor of Law and Data Science at eLaw - Center for Law and Digital Technologies at Leiden University in the Netherlands. Eduard Fosch-Villaronga is Assistant Professor at eLaw - Center for Law and Digital Technologies at Leiden University in the Netherlands.

Abstract: Die Sichtbarkeit der globalen »Boykott, Desinvestitionen und Sanktionen«-Kampagne (BDS) gegen Israel nimmt weltweit zu.

Abstract: “Can I choose to die?” As the number of requests for euthanasia and physician-assisted suicide continues to rise, human rights law faces a new conflict: the right to die vs. the right to life… The right to die or, in other words, ‘the right to choose the time and manner of one’s own death’ is a question of personal autonomy and its limits. This book provides a comprehensive understanding of the right to die and sheds light on its possible future under the European Convention on Human Rights. After setting a clear framework by defining the key terminology, the book takes a two-part approach to achieving its aim. The first part focuses on the right to die in practice by examining selected jurisdictions. Switzerland, which is famous for its assisted suicide organizations, and the Netherlands, which was the first country to legalize euthanasia, are examined in detail. Belgium, Germany, the United Kingdom, and -as an exception to the Convention perspective - Canada are also included. While this examination offers a better understanding of what the right to die looks like in practice, it also provides insights on the slippery slope argument, which serves as a counterweight to personal autonomy, without making a definitive statement on its validity. This part also illustrates the different paths that led or did not lead to the right to die in practice. The second part is an analysis of the European Court of Human Rights case law on the right to die. The Court has made important statements in only very cases, while its caution when approaching such a delicate and controversial topic among its 47 members is understandably emphasized. This analysis of the Court’s approach to the balancing of personal autonomy against other interests allows us to take a look back at the practice in more permissive jurisdictions through the lens of the Convention. Taken together, the book’s two parts provide valuable lessons for countries that decide to practice assisted dying, which are outlined in the conclusion. In addition, given that a purely legal approach can only offer a partial picture, the book argues that an interdisciplinary approach would be much more favorable in terms of providing the necessary basis for the right to die debate.

Abstract: "French and Irish societies have been characterised in recent times by major upheavals brought about by the threat of terrorism, the collapse of economic and social structures, mass migration, the diminished role of organised religion, the ghettoization of minorities, increased homelessness and a general distrust of institutions. As a result of all these changes, the margins are now beginning to attract more and more people who find themselves placed in disadvantaged circumstances through political upheaval and/or economic or cultural necessity. In this volume, the sociocultural perspective theory which has emerged in the field of social psychology (as put forward by Catherine Sanderson) is extended to the study of life on the edge in France and Ireland. The effects of sociocultural factors on individual and collective identities are assessed in two societies that share a large number of characteristics as members of the European Union, but still retain specificities resulting from the impact of distinct historically shaped sociocultural forces. Three test research areas appear particularly significant to assess change: human rights, marginalisation and exclusion; food and drink on the margins; the links between diaspora and marginality. These areas are examined from an interdisciplinary perspective in the hope of proposing ground-breaking hypotheses that might assist us to understand the world we live in"--

Abstract: Each year, millions of people die from poverty-related causes. In this groundbreaking and thought-provoking book, Gwilym David Blunt argues that the only people who will end this injustice are its victims, and that the global poor have the right to resist the causes of poverty. He explores how the right of resistance is used to reframe urgent political questions: is illegal immigration a form of resistance? Can transnational social movements, such as the indigenous rights movement, provide the foundations for civil resistance to global poverty? If peaceful resistance fails, is armed struggle justified? Do people living in affluent states have a responsibility to help even if it requires them to break the law? Giving clear historical examples and engaging with fields including philosophy, international law, history, and international political studies, this volume addresses real-world issues from terrorism to activism. It will be important for anyone interested in applied philosophy and global injustice.

Abstract: Regional human rights mechanism are now in place covering nearly all five continents with the notable exception of Australia. Regional and international human rights protection are not meant to thwart each other. On the contrary, the regional protection of human rights is intended to back up and strengthen the international one by translating human rights into local languages and supporting them with additional protective mechanisms like commissions and courts that enforce regional human rights documents. In this volume, five experts from various continents will introduce regional human rights protection systems in Europe, Africa, Asia, Latin America and Australia providing an overview of the regional protections vis-à-vis the international one and then contextualising it in specific country context.

Abstract: "Genocide is a problem: not only the terrible fact of mass death, but also how the relatively new idea and law of genocide organises and distorts our thinking about civilian destruction. Taking the normative perspective of civilian immunity from military attack, this book argues that the implicit hierarchy of international law, atop which sits genocide as the "crime of crimes," blinds us to other types of humanly caused civilian death, like bombing cities, the "collateral damage" of missile and drone strikes, blockades, and sanctions. In other words, talk of genocide functions ideologically to detract from systematic violence against civilians perpetrated by governments. The Problems of Genocide also contends that this violence is the consequence of "permanent security" imperatives: the striving of states, and armed groups seeking to found states, to make themselves invulnerable to threats. To solve the problems of genocide, this book proposes replacing it with permanent security, which should be criminalized"--

Abstract: "The premise of this book is that, like everything else in life and human experience since the beginning of time, evolution is the key for understanding how the world works. For me as a Muslim only God is the permanent reality, while everything else evolves with time and in response to changing circumstances. Since human rights are rendered in the service of human beings, they must evolve with the life experience of their subject, namely, human beings on the ground everywhere, for each person and community on their own terms. If that is not the concept of human rights for the people in question, with its content emerging out of their human experience in its context. By the principle of the concept itself, no other person, group or entity can impose his or their view in defining, interpreting or elaborating human rights norms and institutions for others. The way remains open for respectful debate and contestation, suggestions and recommendation, but never in violation of the human dignity and freedom of the human subject. This is what we all know as the Golden Rule, or the principle of reciprocity. If in doubt as to whether a debate or challenge is in violation of this fundamental principle, imagine the situation with you as the subject of violation of human dignity and freedom"--

Abstract: Gender equality rights are fundamental human rights that are recognized in international human rights treaties, which bind states to eliminate gender discrimination formally and in practice. Islam is recognized as the official religion in the constitutional law of Islamic countries; religious scholars have the competence to interpret Islamic law, resulting in creating a series of unequal rights for women based on Islamic law, which often continues in legal structures. Nevertheless, a majority of Islamic countries have ratified the international human rights treaties but have put reservations in place based on Sharia concerning articles on gender equality rights. Therefore, this dissertation addressed that the degree to which international law has accepted gender discrimination for religious reasons.

Abstract: "The dissolution of the Ottoman Empire, through the British mandate and the establishment of the state of Israel, created a reality in which no Muslim legislator existed in the country. Thus, the chief judge—Qadi al Qudat, due to the dire need for reforms in the Sharia' family law and in order to minimize the intervention of the non-Muslim—Israeli legislator in the divine family law, took it upon himself to initiate the reforms. As such, this experience is considered the world-wide pioneerand unique in its scope. The reforms were done in accordance with the Islamic rules of renewal and are derived from the Islamic jurisprudence—sharia' itself. This process was done in two tracks: first, decisions of the High Court of Appeals would be followed by the lower courts as binding precedents. Second, the president of the High Sharia' court issued judicial decrees guidelines to the lower courts, driven by the Maslaha - the public interest - in various matters of Islamic law such as promoting women status, children's rights and the preservation of Islamic sites and cemeteries sanctity."

Abstract: "Where does one situate business and human rights? From the perspective of law alone, business falls within the general sphere of private law, further broken down into discrete sub-spheres, particularly corporate law and commercial law. The human rights component is situated in constitutional and international law. Prima facie, 'business' and 'human rights' fall into distinct spheres of regulation and differ in their primary sources. If law were simply approached from a compartmentalized perspective, business would be of no relevance to human rights and vice versa. This, however, is artificial and is antithetical to holistic approaches to problem solving, not to mention the inter-connectivity of law.1 It is unfortunate that in simplifying the study of law through the creation of sub-disciplines, the emergence of sub-discipline expertise (e.g. labor law) has magnified the differences between them"-- ECIP Introduction

Abstract: This book explores the main challenges against multiculturalism. It aims to examine whether liberalism and multiculturalism are reconcilable, and what are the limits of liberal democratic interventions in illiberal affairs of minority cultures within democracy. In the process, this book addresses three questions: whether multiculturalism is bad for democracy, whether multiculturalism is bad for women, and whether multiculturalism contributes to terrorism. Just, Reasonable Multiculturalism argues that liberalism and multiculturalism are reconcilable if a fair balance is struck between individual rights and group rights. Raphael Cohen-Almagor contends that reasonable multiculturalism can be achieved via mechanisms of deliberate democracy, compromise and, when necessary, coercion. Placing necessary checks on groups that discriminate against vulnerable third parties, the approach insists on the protection of basic human rights as well as on exit rights for individuals if and when they wish to leave their cultural groups

Abstract: Human Rights and Space Law -- Practical use of satellite data in support of human rights -- Use of satellite data at Courts -- Use of space based assets to provide critical infrastructure for developing countries -- Conclusion.
Abstract: This book stems from the worrying scale and intensity of conflicts, humanitarian crises, and human rights violations around the world, which can be seen in a wide range of global hotspots including Venezuela, Yemen, Syria, Myanmar, Sudan, Eritrea, and numerous others. These developments are also relevant for Europe, given the large-scale migrations they can produce. In order to effectively respond to them, it has become imperative to analyse ways in which space data and technologies can be used to uphold human rights and monitor violations. Various international tribunals, such as the International Court of Justice (ICJ) and the International Criminal Court (ICC), are increasingly relying on satellite data and especially images when considering human rights violations cases. This use of space-related technologies represents a trend that promises to continue as the range and accuracy of space-derived data improves. Further, satellite data has important legal implications because it allows the fulfilment of international obligations to be monitored, and offers a powerful tool for dispute resolution. Accordingly, this book examines the use of satellite images for cases concerning human rights violations, since the multitude of humanitarian crises worldwide demonstrate that it is of the utmost importance to analyse how space law, policies and space-related applications could further support the implementation and monitoring of the observance of human rights, thus contributing to enhanced security and sustainable development. A range of relevant areas, such as migration, refugees (including settlements and whether they are adequately supplied with basic necessities), water distribution and quality, housing and settlement monitoring are crucial aspects addressed in this book. In closing, the use of satellite data for legal purposes is not without its fair share of problems and concerns, which are also considered to guide the evolution of this emerging field.

Abstract: "The UN Convention on the Rights of the Child is the most widely ratified human rights treaty in the world, yet everyday children still face poverty, violence, war, disease and disaster. Are the rights we currently afford to children enough? Combining historical analysis with international human rights law, Michael Freeman considers early legal and philosophical theories on children's rights before exploring the impact and limitations of the Convention itself. He also suggests the ways we may rethink children's rights in the future as well as identifying key areas for reform. This book will appeal to an interdisciplinary audience who are interested in children's rights, children's studies, the history of childhood, international human rights and comparative family law. It is a crucial restatement of the importance of law, policy and rights in improving children's lives"--

Abstract: "Two sentiments governed the post-war world: fear and hope. Fear of slipping into an unimaginable, worldwide atomic confrontation even more violent and destructive than the Second World War; and hope that, if the people of world could only acknowledge their common dignity, nations might find a way to perpetuate peace for the foreseeable future. These two feelings dominated the debates that gave birth to both the Charter of the United Nations and the Universal Declaration of Human Rights. In late April 1946, shrouded in the shadow of a horrific world war, nine delegates, selected for their individual expertise, gathered in New York at Hunter College to discuss what action the four-month old United Nations should take to advance "universal respect for, and observance of, human rights and fundamental freedoms," as set forth in the UN Charter (Art. 55). It was"--

Abstract: More and more people are turning to human rights courts to seek protection against prejudice, disadvantage or exclusion on account of their cultural and economic particularities. Human rights courts are thus increasingly faced with the difficult task of deciding these cases, which raise a number of complex and contested legal questions. 0To what extent can courts accommodate cultural diversity, protect all kinds of groups or interfere in socio-economic policy? This book argues that one of the problems encountered in dealing with such cases is the courts? tendency to assess them from a compartmentalised or fragmentary perspective. 0To counterbalance this tendency, an innovative, integrated and person-centered approach to adjudicating claims of cultural difference and economic disadvantage is put forward. Drawing on the concepts of intersectionality, indivisibility and normative interdependence, the book presents specific notions and methods for approaching the appreciation of rights holders, harms and norms in a holistic manner. A wide selection of case law from both the European and the Inter-American courts of human rights supports the normative framework developed in this book. The sample mostly includes cases brought by Muslims, Roma, Travelers, indigenous peoples, afro-descendants and people living in poverty

Abstract: "This book investigates how effective human rights and the inherent dignity of refugees can be secured in situations of protracted exile and encampment. The book deploys an innovative human rights-based capabilities approach to address fundamental questions relating to law, power, governance, responsibility and accountability in refugee camps. Adopting an original theoretical framework, the author demonstrates that legal empowerment can change the distribution of power in a given refugee situation, facilitating the exercise of individual agency and assisting in the reform of the opportunity structure available to the individual. Thus, by helping to increase the capability of refugees to participate actively in the decisions that most affect their core rights and interests, participatory approaches to legal empowerment can also assist in securing other capabilities, ultimately ensuring that refugees are able to live dignified lives while in protracted exile. Ultimately, the book demonstrates that legal empowerment for refugees can bring lasting benefits in establishing trust between refugees, the state, and local communities. It will be of interest to researchers within the fields of refugee studies, international law, development studies, and political science, as well as to policy makers and practitioners working in the fields of refugee assistance and humanitarian intervention"--

Abstract: "Social justice claims, and the human rights movement in particular, are entering a new phase. Social media, algorithms, and artificial intelligence (AI) are reshaping the practices of advocacy and compliance. In this new era, technicians, lawmakers and advocates, sometimes in collaboration with the private sector, have increasingly gravitated toward the possibilities and dangers inherent in the non-human. Algorithms and automated data processing are unpredictable and opaque. The use of algorithms and artificial intelligence may be advancing the protection of human rights in some ways, but new technologically-enhanced forms of human rights abuse have emerged alongside these new protections. Ronald Niezen entreats readers not to be distracted by the shiny new innovations, and to instead consider how new tech interacts with the older models of rights claiming and communication, arguing that the key to understanding the new era of social justice is not in an exclusive focus on sophisticated, expert-driven forms of data management, but in considering how these technologies are interacting with other forms of communication to produce new avenues of expression, public sympathy, redress of grievances, and sources of the self. To do this, Niezen investigates various case studies of the pursuit of justice via technology, including Twitter-faciliated mobilizations, WhatsApp activist networks, and the news prioritization or "filter bubbles" fed through Google and Facebook algorithms to uncover how emerging technologies of data management and social media influence the ways that human rights claimants and their allies pursue justice, and the "new victimology" that prioritizes and represents strategic lives and types of violence over others"--

Abstract: As multilateral development banks increasingly gained influence in shaping global development, transnational social movements pushed to hold them accountable for their human rights impact towards communities. Leon Valentin Schettler presents a novel causal mechanism of movement advocacy towards MDBs, combining disruptive and conventional tactics. Systematically comparing the evolution of human rights standards and complaint mechanisms over the last three decades, he reveals how the combination of 1) declining US hegemony, 2) counter-mobilization by China and 3) movement cooptation by the World Bank bureaucracy led to a dilution of human rights accountability in the 2010s.
