    Abstract: "Looking at two of the key paradigms of the post-Cold War era - national sovereignty, and human rights - this book examines the possibilities for their reconciliation from a global perspective. The real or imagined fear of a flood of immigrants has caused and fuelled the surge of an amalgam of populist political forces, anti-immigrant movements and exclusionist nationalism in many developed countries.     Abstract: The coronavirus pandemic has hit Latin America particularly hard. In no other region of the world have so many people been infected with the virus as here. Influenced by the pandemic, poverty and inequality have increased, the economic crisis has worsened and, in some countries, authoritarian and repressive tendencies have grown, all of which poses enormous challenges for the region. This anthology is dedicated to the consequences of the coronavirus pandemic and pandemic policies in Latin America and the Caribbean. The articles it contains examine the consequences of the pandemic in terms of social inequalities, gender relations, violence against women, democracy, human rights, labour, the mobilisation of protest and environmental policy. They discuss what social and political lessons can be drawn from the pandemic experience in Latin America at the end of 2021, when the region is far from a post-pandemic era. Das von den UN anerkannte Konzept der Responsibility to Protect (R2P) sieht vor, dass Staaten und internationale Organisationen Verantwortung für diesen Schutz übernehmen. Spätestens die Kontroversen um die Militärintervention in Libyen 2011 haben allerdings gezeigt, dass über Art und Ausübung jener Verantwortung keine Einigkeit besteht. Dabei geht es nicht nur um das Was und Wie, sondern auch um das Warum: Gibt es kulturübergreifend akzeptable Gründe für eine staatliche und internationale Schutzverantwortung? Das Buch gibt einen Überblick über Entstehung und Entwicklung der R2P, analysiert die darin vorgenommenen Zuschreibungen von Verantwortung und sucht nach einer interkulturell tragfähigen ethischen Begründung. Es ergänzt damit die friedensethische Diskussion, die sich bislang vor allem auf die Frage der Gewaltanwendung im Rahmen der R2P konzentriert hat.

The book deploys an innovative human rights-based capabilities approach to address fundamental questions relating to law, power, governance, responsibility and accountability in refugee camps. Adopting an original theoretical framework, the author demonstrates that legal empowerment can change the distribution of power in a given refugee situation, facilitating the exercise of individual agency and assisting in the reform of the opportunity structure available to the individual. Thus, by helping to increase the capability of refugees to participate actively in the decisions that most affect their core rights and interests, participatory approaches to legal empowerment can also assist in securing other capabilities, ultimately ensuring that refugees are able to live dignified lives while in protracted exile. Ultimately, the book demonstrates that legal empowerment for refugees can bring lasting benefits in establishing trust between refugees, the state, and local communities. It will be of interest to researchers within the fields of refugee studies, international law, development studies, and political science, as well as to policy makers and practitioners working in the fields of refugee assistance and humanitarian intervention"--

    Abstract: Durch die Analyse der Beziehungen zwischen NGOs, dem UN-Sicherheitsrat und den Menschenrechten wird in diesem Buch argumentiert, dass sowohl NGOs als auch der UN-Sicherheitsrat die Menschenrechtssemantik selektiv in Bezug auf die Orte und Akteure, die sie betreffen, anwenden. Es beobachtet Wissen und Macht als Kräfte, die sich gegenseitig beeinflussen, was eine Erklärung dafür sein kann, wie Global Governance funktioniert. Darüber hinaus untersucht das Buch die Idee, dass Recht, abgesehen von der Durchdringung traditioneller Strukturen, von der Basis der Gesellschaft in Richtung institutioneller Bereiche aufsteigen kann. In diesem Zusammenhang schlägt der Autor vor, dass das Zusammenspiel zwischen nichtstaatlichen Akteuren und politischen Institutionen die Bottom-up-Prozesse im Zusammenhang mit der Gesetzgebung und der Gestaltung politischer Entscheidungen fördert. In Anbetracht der kritischen Probleme, die sowohl die NRO als auch der UN-Sicherheitsrat in Bezug auf Repräsentation und Reaktionsfähigkeit haben, stellt die Arbeit fest, dass die Beziehung zwischen ihnen auf eine ausschließende, technokratische und arkane Weise stattfindet.

    Abstract: The contributors of the volume analyse the effect of the ECHR and international human rights on the national and European legal order from different angles. Special emphasis is given on the Union’s accession to the ECHR and the scrutiny of ECJ’s opinion 2/13. The impact of the human rights provisions of the accession agreement with Ukraine is shown besides some more general issues of human rights protection in national jurisdictions, namely Germany, Poland, Slovenia and Turkey for providing a comparative overview of the various challenges countries with different backgrounds face in the implementation of human rights, including social human rights.     Abstract: "Cosmopolitanism, as an intellectual and political project, has failed. The portrayal of human rights, especially European, as evidence of cosmopolitanism in practice is misguided. Cosmopolitan theorists point to the rise of claims-making to the European Court of Human Rights (ECtHR) among Europe's Muslims to protect their right to religious freedom, mainly concerning the hijab, as evidence of cosmopolitan justice. However, the outcomes of such claims-making show that far from signifying a cosmopolitan moment, European human rights law has failed Europe's Muslims. Human Rights, Islam and the Failure of Cosmopolitanism provides an empirical examination of claims-making and government policy in Western Europe focusing mainly on developments in the UK, Germany, France, Italy and the Netherlands. A consideration of public debates and European law of conduct in the public sphere shows that cosmopolitan optimism has misjudged the magnitude of the impact claims-making among Europe's Muslims. To overcome this cul-de-sac, European Muslims should turn to a new 'politics of rights' to pursue their right to religious expression.     Abstract: This book proposes a new theoretical framework for agency thinking by examining the ethical, discursive and practical engagements of a group of women development workers in north-west India with developmentalism and individual rights. Rethinking Agency asks an underexplored question, tracks the entry, encounter, experience and practice of developmentalism and individual rights, and examines their normative and political trajectory. Through an ethnography of a moral encounter with developmentalism, it raises a critical question: how do we think of agency in oppressive contexts? Further, how do issues of risk, injury, coercion and oppression alter the conceptual mechanics of agency itself?

    Abstract: Der Verweis auf die globale Bedeutung von Menschenrechten ist heute ein gängiges Argumentationsmuster in der internationalen Politik als auch in der völkerrechtlichen Debatte. Die Aufwertung der Menschenrechtsidee ist allerdings nicht ohne Ambivalenz, denn gerade im Kontext globaler Auseinandersetzungen wird sie allzu gerne zur hegemonialen Selbstermächtigung missbraucht. Das Buch widmet sich diesem Problem und fragt nach einer interkulturell sensiblen Begründung und institutionellen Ausgestaltung des menschenrechtsbezogenen Völkerrechts. Es wird einerseits in rechtssoziologischer Perspektive argumentiert, dass die zunehmend transnational organisierte Menschenrechtsbewegung Ausdruck eines die Evolution des Rechts vorantreibenden Konfliktlernens ist, indem Unrechtserfahrungen in Autonomieansprüche transformiert und auf die Struktur des Rechts bezogen werden. Andererseits ist die Genese und Durchsetzung von Menschenrechten in rechtssystematischer Perspektive als eine von hegemonialen Missbräuchen bedrohte Herrschaftspraxis zu beschreiben, weshalb befürwortet wird, Menschenrechtspolitiken nicht nur zu konstitutionalisieren, sondern sie auch zu demokratisieren.
