    Abstract: "The right of indigenous peoples to Free Prior and Informed Consent (FPIC) in relation to natural resource extraction in their territories is a principle that is increasingly recognised by intergovernmental organizations, international bodies, conventions and international human rights law as well as in the domestic law of some States. This book offers a comprehensive overview of the status of Free Prior and Informed Consent under international human rights law, considering the main controversies, obstacles and challenges associated with its recognition and implementation. The book examines the relationship between Free Prior and Informed Consent and territorial, resource and governance rights. The historical basis for FPIC is considered as well as the legitimacy of the dominant doctrines of exclusive State ownership of subsoil resources. The book argues that FPIC constitutes an emerging norm of international law with a tipping point having been reached in terms of the requirements recognition, both within and beyond the human rights regime. It draws on emerging jurisprudence from around the world, as well as evolving industry standards and policies, to illustrate the growing recognition of the fact that respect for the consent requirement is fundamental to securing indigenous peoples self-governance and territorial rights"--

    Abstract: "The adoption of the Convention on the Rights of People with Disabilities (CPRD) by the United Nations in 2006 marked a major watershed. The CRPD is the first comprehensive and binding treaty on the rights of people with disabilities. It establishes the right of people with disabilities to equality, dignity, autonomy, full participation as well as specific rights including the right to live in the community, supported decision-making and inclusive education. Prior to the CRPD, international law had provided only limited protections to people with disabilities, although some countries had begun to incorporate rights protections into their respective domestic legislation.This book analyses the development of disability rights as an international human rights movement, in selected countries in Asia, Africa, and the Middle East as well as the United States. The book begins with an examination of the status of people with disabilities under international law prior to the adoption of the CPRD and follows the development of human rights protections through the drafting process of the CRPD. People with disabilities, like women and children before them, waged a battle to enforce their rights on the international stage against a backdrop of changing international norms. The book highlights four areas the right to legal capacity (article 12), the right to liberty and freedom from torture (articles 14 and 15), the right to live in the community (article 19), and the right to inclusive education, in order to the transformation from the charity/deficit/medical model of disability to the human rights mode. These areas are analyzed from a comparative perspective including a discussion of the laws, policies, and practices in selected countries in order to show the success of the CRPD in achieving protections depends on the extent to which individual countries begin to enforce domestic laws and policies and the extent to which various societies change their attitudes about people with disabilities"--

Wie die praktische Rechtspflege eines Universitätsgerichts aussah, untersucht die Autorin an Hand von Gerichtsakten der Freiburger Universität aus dem 16. Jahrhundert. Neben der Gerichtsorganisation und der Kompetenzaufteilung zwischen den verschiedenen Gremien behandelt Bettina Bubach auf der Basis einer umfangreichen Quellenauswertung alle Bereiche der universitären Rechtspraxis: Zum einen die Straf- und Disziplinargewalt, die Rektor und Senat ausübten, zum anderen die Entscheidung privater Streitigkeiten durch das Consistorium, wobei Verfahrensablauf und Streitgegenstände untersucht werden. Insgesamt stellt die Verfasserin die universitäre Rechtspflege in den Kontext der frühneuzeitlichen Untergerichtsbarkeit und deren Formen der Konfliktbeilegung. Sie zeigt den umwälzenden Vorgang der Rezeption nicht aus Sicht der höchsten Reichsgerichte, sondern aus Perspektive eines Untergerichts. Die Kinder werden so zu Opfern, wenngleich in ganz unterschiedlicher Intensität. Freiwillige Hilfs- und Unterstützungsleistungen von Seiten des Staates stehen zwar zur Verfügung, erreichen aber oftmals die Kinder nicht rechtzeitig oder vollumfänglich. Gegen den Willen der Eltern kann der Staat bislang nur in eng begrenzten Ausnahmefällen eingreifen. Die traditionelle Verfassungsinterpretation geht von einer klaren Grenzziehung zwischen elterlichem Erziehungsgrundrecht (Art. 6 Abs. 2 S. 1 GG) und staatlichem Wächteramt, insbesondere im Vorschulalter, aus. Das Elterngrundrecht - als Garant des Kindeswohls gedacht - zwinge den Staat, sich weit möglichst vom Elternhaus fernzuhalten. Die Autorin fragt nach Modifikationen der Gefährdungs- und damit Eingriffsschwelle. Neben der argumentativen Aufarbeitung dieses verfassungsrechtlichen Spannungsfeldes zielt die vorliegende Arbeit darauf, den Eltern-Kind-Bereich aus öffentlich-rechtlicher Sicht zu beleuchten; denn bislang dominiert die zivilrechtliche Perspektive des Familienrechts. Die sich aus der verfassungsrechtlichen Beurteilung ergebende Defizitanalyse wirft unterschiedliche Fragen auf: Welche Wendepunkte kann der Staat nutzen, um gefährdete Kinder frühzeitiger als bisher zu erreichen? Wie kann der Ausbau staatlicher Präventions- und vorverlagerter Interventionsmöglichkeiten ins Werk gesetzt werden, um den aufgezeigten Erziehungsschwierigkeiten zu begegnen? Diese und weitere Fragen werden durch die erstmalige Erarbeitung eines gestuften Maßnahmenkonzepts als Nukleus eines Erziehungsverwaltungsrechts beantwortet und zudem erste Begründungsansätze für eine Fortschreibung des Rechtsdreiecks zwischen Eltern, Kindern und Staat geliefert.

    Abstract: Hauptbeschreibung Pascale Cancik untersucht die Offizialisierung und Professionalisierung von Verwaltungskommunikation im Preußen des frühen 19. Jahrhunderts. Zu dieser Zeit erreichte der aufklärerische Öffentlichkeitsdiskurs der 'Sattelzeit' verschiedene Bereiche von Gesellschaft und Recht (Parlamente, Gerichte, Presse). Die Verwaltung indessen, die damals ihre modern-bürokratische Form entwickelte, wird von der historischen Forschung kaum mit jenen liberalen Öffentlichkeitsforderungen in Verbindung gebracht. Ist das gegenwärtig wieder viel untersuchte Thema Verwaltung und Öffentlichkeit zu Recht kein Thema (rechts-)historischer Forschung? Die Autorin zeigt zunächst, dass es durchaus einen zeitgenössischen Publizitätsdiskurs gab, der sich gerade auch auf Verwaltung bezog. Aber kam dieser auch in der Praxis von Recht und Verwaltung an? Da Öffentlichkeiten sich in Kommunikationen manifestieren, werden zwei Felder von Verwaltungskommunikation genauer untersucht: die Publikation staatlichen Handelns durch die Verwaltung sowie die Entwicklung konkreter Verwaltungsverfahren, innerhalb derer die Verwaltung mit Bürgern kommuniziert. Im Zentrum stehen dabei jeweils die Rolle von Recht und Rechtspraxis. Es ergibt sich ein komplexes Bild von Motiven und Intensitäten der Einbeziehung oder gar Beteiligung von Bürgern. Bis heute genutzte Techniken, Medien und Verfahren wurden damals mit Hilfe von Recht konzipiert und eingeübt. Sie sind nicht, wie manchmal behauptet, ausschließlich mit Demokratie verbunden.

    Abstract: In the West we frequently pay lip service to universal notions of human rights. But do we ever consider how these work in local contexts and across diverse cultural and ethical structures? Do human rights agendas address the problems many people face, or are they more often the imposition of Western values onto largely non-Western communities? Human Rights in a Global Perspective develops a social critique of rights agendas. It provides an understanding of how rights discussions and institutions can construct certain types of subjects such as victims and perpetrators, and certain types of act, such as common crimes and crimes against humanity. Using examples from the United States, Europe, India and South Africa, the authors restore the social dimension to rights processes and suggest some ethical alternatives to current practice.
