Upon arrival at the station, he was directed by another officer to arrest Oscar Grant, who, along with other fight suspects, was sitting by the wall of the station. As Mehserle, who was joined by other officers, prepared to arrest Grant, Grant began to stand up, and Mehserle forced him to the ground face first. Ziel dabei ist es, Parallelen und Unterschiede aufzuzeigen und durch den Rechtsvergleich neue Aspekte für die rechtliche Beurteilung solcher Videoüberwachungen in Deutschland, auf der der Schwerpunkt der Untersuchung liegt, zu gewinnen. Beleuchtet werden zunächst u. a. die Entwicklung der Videoüberwachung im öffentlichen Raum in Deutschland und in den USA sowie Gründe für deren zunehmende Anwendung. Die Erörterung der rechtlichen Problematik hat die Darstellung des verfassungsrechtlichen Privatsphären- und Persönlichkeitsschutzes in Deutschland und in den USA zum Ausgangspunkt. Eingehend erläutert und verglichen werden die unterschiedlichen Ansätze zur verfassungsrechtlichen Bewertung von Videoüberwachungen in den beiden Ländern, und es werden die ersten Ansätze einer Normierung in den USA vorgestellt. Die durch die einzelnen deutschen Bundesländer geschaffenen Ermächtigungsnormen werden genauer betrachtet und auf ihre Verfassungsmäßigkeit hin untersucht. Hier wird zum einen der Frage der Gesetzgebungskompetenz betreffend der Videoüberwachung als doppelfunktionaler Polizeimaßnahme (insbesondere dem umstrittenen Problem der Gesetzgebungskompetenz im Rahmen der Strafverfolgungsvorsorge) nachgegangen.     Abstract: In this volume, Gregory Matoesian uses the notorious 1991 rape trial of William Kennedy Smith to provide an in-depth analysis of language use and its role in that specific trial as well as in the law in general. He draws on the fields of conversation analysis, ethnomethodology, linguistic anthropology and social theory to show how language practices shape--and are shaped by--culture and the law, particularly in the social construction of rape as a legal fact. This analysis examines linguistic strategies from both defense and prosecutorial viewpoints, and how they relate to issues of gender, sexual identity, and power.

    Abstract: Nineteenth-century American writers frequently cast the Mormon as a stock villain in such fictional genres as mysteries, westerns, and popular romances. The Mormons were depicted as a violent and perverse people--the "viper on the hearth"--who sought to violate the domestic sphere of the mainstream. While other critics have mined the socio-political sources of anti-Mormonism, Givens is the first to reveal how popular fiction, in its attempt to deal with the sources and nature of this conflict, constructed an image of the Mormon as a religious and social "Other.".
