    Abstract: Drawing on interview data collected in three projects exploring domestic abuse in LGB and/or T+ people’s intimate relationships, this chapter examines sexual consent in LGB and/or T+ people’s abusive relationships through a queer lens. Three themes are considered. First, Catherine Donovan and Marianne Hester’s two ‘relationship rules’ underpinning abusive relationships are applied. These determine that the relationship is for the abusive partner and on their terms; and that the victim/survivor is responsible for everything, including their partner’s abusive behaviour. Participants’ accounts show how these relationship rules can delegitimate victim/survivors’ attempts to exercise consent and conversely legitimate non-consensual sex. Second, Carole Pateman’s ‘sexual contract’ is drawn upon to demonstrate how abusive partners mandate sex whenever and however they wish, while victimised partners feel duty-bound to acquiesce. This, it is argued, reproduces cis-heteronormative sexual scripts based on public stories about love and intimacy and conventionally gendered binaries such as initiator/follower. Third, accounts demonstrating how more experienced LGB and/or T+ partners can exercise experiential power to instil norms about sex and intimacy are analysed. It is concluded that these abusive practices frame the context in which sexual victimisation occurs in LGB and/or T+ people’s intimate relationships and inhibit victims/survivors from recognising and naming sexual violence

    Abstract: The introduction focuses on the issues raised by the debate on animal sacrifice over the centuries, both in the West and in South Asia. Not only did the current Indian judicial system evolve from the British colonial legacy, but internationally, many current arguments on the protection of animals call upon Indian religious and philosophical concepts as well as Western notions and values. The recent judicialisation of these debates has led to the emergence of new questions, worldwide, concerning the legal status of animals and focusing particularly on animal sacrifice and ritual slaughter. In South Asia, animal sacrifice was criticized over the centuries by sectarian and devotional movements, but these criticisms gained new impetus from the actions of Christian missionaries who projected onto India the opposition between religio and superstitio used by the first Christian writers in rejecting animal sacrifices in ancient Rome. This had a profound impact on nineteenth-century Hindu reformist leaders who also took a stand against animal sacrifice. This aspect of the debate has been taken up by Indian judges, some of whom take a spiritualistic approach to religion and are pushing for Hindu religious reforms

    Abstract: Animal sacrifices are commonly practised in Himachal Pradesh on various occasions, including public festivals at the district level. Over recent years criticism of the practice has increased and some cases have been brought before the court. This chapter focuses on three court cases that were jointly decided in 2014 by the Himachal Pradesh High Court, where the judge ruled a total ban on animal sacrifice in the state of Himachal Pradesh. The case is still pending at the Supreme Court which means that it may potentially have an impact at national level. I first consider the context of this controversy, and the official and unofficial discourses of those involved in the case. Based on the court file, newspapers and ethnographic data, I then analyse the judicial handling of the case, which refers to legal, ritual, or reformist arguments or to animal welfare. The last section draws a comparison with a case concerning animal sacrifice in the Santeria religion, decided by the U.S. Supreme Court, in order to bring out differences in the legal approaches in the two cases despite being both grounded in common law. It shows how, contrary to the legal handling of this issue in the Santeria case where the main concern is to protect religious freedom, in the Himachal Pradesh case the judge explicitly and repeatedly appealed to the role of the court in defining religion (as opposed to superstition), and to the court’s responsibility in favouring ‘moral progress’ and promoting religious reforms

    Abstract: The five-yearly mass animal sacrifice offered at the festival of the goddess Gaḍhī Māī (Gaḍhī Māī Melā) temple in Bariyarpur, Bara District, in southern Nepal, drew local and international attention in 2009, when news and vivid pictures of the slaughter of thousands of animals circulated globally, giving rise to vehement protests from individuals and animal rights associations. In November 2014, three Public Interest Litigation (PIL) petitions against the sacrifices at the Gaḍhī Māī Melā were filed at the Supreme Court of Nepal. In a 52-page judgment published in August 2016 that dealt with these petitions together, the Supreme Court discussed and criticised the practice of animal sacrifice and ordered the Government of Nepal to implement policies that would lead to its eventual discontinuation. This paper is based on the analysis of legal documents and on interviews with the parties. We present the trajectory of this court case from 2014 to 2019, and we focus on the court’s decision, its call for social progress in the name of modernity, its reasoning on whether animal sacrifice is a valid expression of Hinduism, its consideration for this practice deeply rooted in Nepali society, and its call to the government to define and ensure the rights and welfare of animals, meeting the aspiration of the activists. The Court’s decision lays down principles that are applicable to sacrifices in other temples and ends up being a discussion of the place of animal sacrifice in Hinduism and in modern Nepal

    Abstract: This volume provides one of the first comprehensive feminist readings of international statebuilding, with a specific focus on the case of Kosovo. Rather than simply showing how the state in Kosovo is being built by and through women and feminist encounters, this volume is interested to problematise women and feminist subjectivities vis-à-vis the state and statebuilding. The book challenges three main arguments related to the processes and subjects of statebuilding in Kosovo. First, the academic literature on Kosovo has a tendency to take the international intervention of 1999 as the originary point of statebuilding processes in Kosovo. Second, and relatedly, given Kosovo's unprecedented exposure to Western intervention and statebuilding, the majority of works start from the presumption that liberal interventionism in Kosovo (and elsewhere) is normatively more progressive than the previous system, and that the liberal interventionism and statebuilding are naturally gender progressive and gender-equal. The third argument has to do with the existing legal architecture on gender and women’s rights in contemporary Kosovo. The aim of the volume is to, on the one hand, problematise the evidence against the backdrop of everyday manifestations and/or performances of statebuilding and on the other hand interrogate the co-constitutive gender aspect. In terms of methodology, the volume brings together contributions that rely on traditional and multi-sited ethnography, and narrative research rooted in projects and initiatives in Kosovo. This allows the contributors to unearth new and silenced actors, entry points, subjects and subjectivities in processes of and related to statebuilding in Kosovo; feminist frictions and challenges to statebuilding in Kosovo; as well as encounters of heteronormative statebuilding. Filling this lacuna, Joanna Flavell interrogates the political strategies of the Women and Gender Constituency (WGC) in the UNFCCC (The United Nations Framework Convention on Climate Change). Through a conceptual framework that integrates climate change with intersectional critical inquiry and political practice, Flavell analyses hundreds of historical documents, coupled with interviews and observations from two UNFCCC conferences. This research uncovers a so-far untold story about the history of the UNFCCC that foregrounds gender and feminist advocacy, highlighting the importance of the WGC in shaping dominant narratives of global climate governance through a series of rhetorical and procedural strategies. Overall, the book draws important conclusions around power in global climate governance and opens up new avenues for advancing a feminist green politics. How then do incarcerated men negotiate masculinities when gender relations in society-at-large, power relations inside prisons, and masculine ideas and ideals continue to change? Drawing on a semi-ethnographic study in a men's prison in Ukraine, I detail how the dynamic nature of gender normative ideals coexist with the more constant features of gender order: masculine surveillance, censure, and stratification. I highlight that notwithstanding the existence of alternative and subordinate masculinities, the power of hegemonic masculinities in prison is far from waning despite continuously shifting normative expectations and evolving masculine ideals.     Abstract: The hijab has triggered affects for centuries. It has sparked narratives of “saving” Muslim women from the shackles of Muslim men and Islam. In recent years, we have seen several examples of individuals and collectives who experience the mere sighting of the hijab as intolerable. Here, I take a closer look at the affects of “awayness” that move through the hijab in contemporary Western contexts, and how these affects are performed, heightened, and intensified online. Drawing on a decolonial approach to affect and extensive ethnographic research, I argue that collectives who are deeply immersed in the heightened and intensified affective engagement against the hijab, spell out their own symbolic death. By continuously affectively witnessing the hijab, and triggering affects such as despair, anger, outrage, sorrow, and grief, it becomes a self-inflicted trauma, perceived as unbearable. Thus, affective witnessing shifts the focus from ascribed-victimization of Muslim women to self-victimization. And, the affective witnesses of hijab emerge as the “true victims” of hijab

    Abstract: This book explores the role of feminist activists in The United Nations Framework Convention on Climate Change and highlights the progress they have made in mainstreaming gender as a key issue in global climate governance. It is now commonplace for gender to be framed as a political issue in global climate politics within academic scholarship, but there is typically a lack of robust empirical analysis of existing advocacy approaches. Filling this lacuna, Joanna Flavell interrogates the political strategies of the Women and Gender Constituency (WGC) in the UNFCCC (The United Nations Framework Convention on Climate Change). Through a conceptual framework that integrates climate change with intersectional critical inquiry and political practice, Flavell analyses hundreds of historical documents, coupled with interviews and observations from two UNFCCC conferences. This research uncovers a so-far untold story about the history of the UNFCCC that foregrounds gender and feminist advocacy, highlighting the importance of the WGC in shaping dominant narratives of global climate governance through a series of rhetorical and procedural strategies. Overall, the book draws important conclusions around power in global climate governance and opens up new avenues for advancing a feminist green politics.     Abstract: The election on 9 May 2018 ended six decades of rule by the ruling coalition in Malaysia (Barisan Nasional or BN, formerly the Alliance). Despite this result, the BN’s longevity and resilience to competition is remarkable. This book explores the mechanisms behind the emergence, endurance, fight for survival and decline of the party’s dominance. Using a systematic analysis of key resources (budgets, posts, and seats), Washida challenges the conventional argument that a punitive threat to exclude opposition supporters from distributive benefits sustained the loyalty of the masses as well as the elites. He also calls into question whether the mere existence of party organization in and of itself enables leaders to credibly commit to power-sharing. Instead he posits a theory of mobilization agency, in which a party leader needs to design an effective incentive mechanism. In addition, he explains how the BN had anufactured legislative dominance by tactical gerrymandering and malapportionment. The insights drawn from the Malaysian case can help deepen our understanding of the rise and fall of authoritarian parties and distributive politics in general

It explores the origins of one-party regimes in China, Czechoslovakia, Korea, the Soviet Union, Turkey, Yugoslavia, and beyond, the roles of socialism and nationalism in the parties’ approaches to development and state-building, as well the pedagogical aspirations of the ruling elites. Hence, by revisiting the dynamics of the transition from the earlier imperial formations via constitutionalism to one-party governments, and by assessing the internal and external dynamics of one-party regimes after their establishment, the book more precisely locates this type of regime within the contemporary world’s political landscape. The book traces the hagiographical and biographical process by which Ramalinga Swamigal is shifted from being considered an exemplary poet-saint of the Tamil Śaivite bhakti tradition to a Dravidian nationalist social reformer. Taking as a starting point Ramalinga's own writing, the book presents him as inhabiting a border zone between early modernity and modernity, between Hinduism and Christianity, between colonialism and regional nationalism, highlighting the influence of his teachings on politics, particularly within Dravidian cultural and political nationalism. Simultaneously, the book considers the implication of such an hagiographical process for the transformation of Tamil religion in the period between the 19th -mid-20th centuries. The author demonstrates that Ramalinga Swamigal's ideology of compassion, cīvakāruṇyam, had not only a long genealogy in pre-modern Tamil Śaivism but also that it functioned as a potentially emancipatory ethics of salvation and caste critique not just for him but also for other Tamil and Dalit intellectuals of the 19th century. This book is a path-breaking study that also traces the common grounds between the religious visions of two of the most prominent subaltern figures of Tamil modernity - Iyothee Thass and Ramalingar. It argues that these transformations are one meaningful way for a religious tradition to cope with and come to terms with the implications of historicization and the demands of colonial modernity.     Abstract: The book investigates how the United Nations, governments, and aid agencies mobilise and instrumentalise migration policies and programmes through a discourse of safe migration. Since the early 2000s, numerous non-governmental organizations (NGOs), UN agencies, and governments have warmed to the concept of safe migration, often within a context of anti-trafficking interventions. Yet, both the policy-enthusiasm for safety, as well as how safe migration comes into being through policies and programs remain unexplored. Based on seven years of ethnographic fieldwork in the Mekong region, this is the first book that traces the emergence of safe migration, why certain aid actors gravitate towards the concept, as well as how safe migration policies and programmes unfold through aid agencies and government bodies. The book argues that safe migration is best understood as brokered safety. Although safe migration policy interventions attempt to formalize pre-emptive and protective measures to enhance labour migrants’ well-being, the book shows through vivid ethnographic details how formal migration assistance in itself depends on – and produces – informal asnd mediated practices. The book offers unprecedented insights into what safe migration policies look like in practice.     Abstract: Jain Rāmāyaṇa Narratives: Moral Vision and Literary Innovation traces how and why Jain authors at different points in history rewrote the story of Rāma and situates these texts within larger frameworks of South Asian religious history and literature. The book argues that the plot, characters, and the very history of Jain Rāma composition itself served as a continual font of inspiration for authors to create and express novel visions of moral personhood. In making this argument, the book examines three versions of the Rāma story composed by two authors, separated in time and space by over 800 years and thousands of miles. The first is Raviṣeṇa, who composed the Sanskrit Padmapurāṇa (“The Deeds of Padma”), and the second is Brahma Jinadāsa, author of both a Sanskrit Padmapurāṇa and a vernacular (bhāṣā) version of the story titled Rām Rās (“The Story of Rām”). While the three compositions narrate the same basic story and work to shape ethical subjects, they do so in different ways and with different visions of what a moral person actually is. A close comparative reading focused on the differences between these three texts reveals the diverse visions of moral personhood held by Jains in premodernity and demonstrates the innovative narrative strategies authors utilized in order to actualize those visions. The book is thus a valuable contribution to the fields of Jain studies and religion and literature in premodern South Asia
