    Abstract: Started in the wake of George Zimmerman's 2013 acquittal in the death of Trayvon Martin, the #BlackLivesMatter movement has become a powerful and incendiary campaign demanding redress for the brutal and unjustified treatment of black bodies by law enforcement in the United States. The movement is only a few years old, but as Christopher J. Lebron argues in this book, the sentiment behind it is not; the plea and demand that 〈"Black Lives Matter〉" comes out of a much older and richer tradition arguing for the equal dignity-and not just equal rights-of black people. The Making of Black Lives Matter presents a condensed and accessible intellectual history that traces the genesis of the ideas that have built into the #BlackLivesMatter movement. Drawing on the work of revolutionary black public intellectuals, including Frederick Douglass, Ida B. Wells, Langston Hughes, Zora Neal Hurston, Anna Julia Cooper, Audre Lorde, James Baldwin, and Martin Luther King Jr., Lebron clarifies what it means to assert that 〈"Black Lives Matter〉" when faced with contemporary instances of anti-black law enforcement. He also illuminates the crucial difference between the problem signaled by the social media hashtag and how we think that we ought to address the problem. As Lebron states, police body cameras, or even the exhortation for civil rights mean nothing in the absence of equality and dignity. To upset dominant practices of abuse, oppression and disregard, we must reach instead for radical sensibility. Radical sensibility requires that we become cognizant of the history of black thought and activism in order to make sense of the emotions, demands, and argument of present-day activists and public thinkers.     Abstract: The study provides an extensive legal, geopolitical and historical analysis of all controversial issues making up the Greek-Turkish maritime dispute: the delimitation of territorial waters, the national airspace, the delineation of exclusive economic zones and continental shelf as well as the issue of military presence on the Eastern Aegean islands and its relation to the Greek sovereignty over them. By immersing thoroughly into international jurisprudence, international treaties and historical facts, the book offers a detailed survey of legal precedents and legal regimes over similar issues worldwide. In this way, the reader has the opportunity to ascertain where every single legal and historical argument has been drawn from and its relevance in the international jurisprudence. Consequently, it follows the evolution of the dispute together with all its twists from 1973 to 2022 that saw a new low in the historically tense Greek-Turkish relationship. The book finally re-examines the dispute in the light of the new green energy geopolitics and the ongoing climate crisis and comes up with some suggestions for an alternative paradigm of co-existence in the Aegean Sea which in the author’s view is urgent and inevitable. .

    Abstract: How do memory and remembrance relate to the specific mode of transitional justice that lays emphasis on restoration? What is captured and what is obliterated in individual and collective efforts to come to terms with a violent past? Across this volume consisting of twelve in-depth contributions, the politics of memory in various countries are related to restorative justice under four headings: restoring trust, restoring truth, restoring land and restoring law. While the primary focus is a philosophical one, authors also engage in incisive analyses of historical, political and/or legal developments in their chosen countries. Examples of these include South Africa, Colombia, Rwanda, Israel and the land of Palestine, which they know all too well on a personal basis and from daily experience.     Abstract: Over the last two decades, fighting modern slavery and human trafficking has become a cause célèbre. Yet large numbers of researchers, non-governmental organizations, trade unions, workers, and others who would seem like natural allies in the fight against modern slavery and trafficking are hugely skeptical of these movements. They object to how the problems are framed, and are skeptical of the "new abolitionist" movement. Why? This book tackles key controversies surrounding the anti-slavery and anti-trafficking movements head on. Champions and skeptics explore the fissures and fault lines that surround efforts to fight modern slavery and human trafficking today. These include: whether efforts to fight modern slavery displace or crowd out support for labor and migrant rights; whether and to what extent efforts to fight modern slavery mask, naturalize, and distract from racial, gendered, and economic inequality; and whether contemporary anti-slavery and anti-trafficking crusaders' use of history are accurate and appropriate

Emmanuel Ndahayo liefert mit seiner Studie einen wichtigen Beitrag zur Erforschung sozialer Ungleichheit und gesellschaftlicher Teilhabe im Kontext von Migration und Eingliederungsprozessen, die in besonderem Maße von Rassismus, (post-)kolonialistischen Ansichten und fragilen Inklusionsformen betroffen sind. Die Analyse der sozialen Lage von eingebürgerten Deutschen afrikanischer Herkunft schließt eine Forschungslücke. Die empirische Untersuchung mit Hilfe qualitativer Interviews bietet daher wichtige Erkenntnisse nicht nur für die Sozialwissenschaft, sondern auch für Praktiker*innen in der Integrationspolitik.

    Abstract: Die ›freiheitliche demokratische Grundordnung‹ (fdGO) ist Kern der ›wehrhaften Demokratie‹ der Bundesrepublik. Als zu schützendes Rechtsgut ist sie in den Art. 18 und 21 GG benannt. Sie legitimiert exekutive und judikative sowie Abwehr- und Überwachungsmaßnahmen gegen politische Akteur/innen. Die vorliegende Arbeit vollzieht die Genese der fdGO als überpositives Rechtsgut nach, das heißt, wie sie vom unklaren Begriff im Verfassungstext zu einer verallgemeinerten Formel geworden ist. Als Quellen dienen Verfassungs- und Gesetzgebungsprozesse sowie juristische Kommentarliteratur und Gerichtsurteile. Methodisch wird die juristische Argumentationsweise politikwissenschaftlich kontextualisiert – auch um einen politikwissenschaftlichen Zugang zu Rechtstexten zu entwickeln. Im Fokus stehen die Debatten im Parlamentarischen Rat, der Gesetzgebungsprozess des 1. Strafrechtsänderungsgesetzes von 1951, die Parteiverbotsurteile des Bundesverfassungsgerichts und die ersten Kommentare zum Grundgesetz. Zudem stehen das Konzept der ›wehrhaften Demokratie‹ und die dazugehörigen geschichtspolitischen Legitimationen mit Bezug zu Weimarer Republik und Nationalsozialismus auf dem Prüfstand. Die Autorin gleicht die verschiedenen Positionen im staatsrechtstheoretischen »Weimarer Methodenstreit« mit nationalsozialistischen Rechtsauffassungen ab und zeigt so Traditionslinien auf, die sich auch in den Begründungen des Konzepts der ›wehrhaften Demokratie‹ wiederfinden. Deutlich wird dabei, dass die Narrative von der ›wehrlosen‹ Weimarer Republik und der ›legalen‹ Machtübernahme des Nationalsozialismus juristisch- zeitgeschichtlich überprüft werden müssen. Nach der historischen Kontextualisierung der fdGO werden ihre Ausbreitung und Anwendung in verschiedene Rechts- und Politikbereiche beleuchtet. Abschließend fragt die Studie nach den Konsequenzen des juristischen Blicks für politisches Handeln.

    Abstract: "Campaigns against prostitution of young people in the United States have surged and ebbed multiple times over the last fifty years. Fighting the U.S. Youth Sex Trade: Race, Gender, and Politics examines how politically and ideologically diverse activists joined together to change perceptions and public policies on youth involvement in the sex trade over time, reframing "juvenile prostitution" of the 1970s as "commercial sexual exploitation of children" in the 1990s, and then as "domestic minor sex trafficking" in the 2000s. Based on organizational archives and interviews with activists, Baker shows that these campaigns were fundamentally shaped by the politics of gender, race and class, and global anti-trafficking campaigns. The author argues that the very frames that have made these movements so successful in achieving new laws and programs for youth have limited their ability to achieve systematic reforms that could decrease youth vulnerability to involvement in the sex trade"--

    Abstract: "This is a study into how the public discourse on migrant integration in the UK changed from 2000-2010. The book shows that the discursive construction of integration in the British public sphere shifted from one of cultural pluralism to one of neo-assimilation, informed by a wider spread of neo-liberalism that necessitates self-sufficiency and discourages state assistance. Situated within the Critical Discourse Studies tradition, the book employs a Discourse Historical approach to the data and includes innovative analysis combining 'top-down' (policy documents and media texts) and 'bottom-up' (focus groups with migrants and new citizens) sites of discourse production. In doing so, it provides a broad and detailed perspective of public discourse on integration in the UK. The book shows that understandings of 'integration' are diachronically and synchronically fluid and as such, the term plays an important role as a 'consensus concept' that different actors can support whilst construing it in different ways. Analysis of the data further reveals that integration is interdiscursively linked to other social fields, such as the economy, terrorism and public spending. The book also argues that integration policy has become directed not just at new migrants, but also long-term British citizens and that this has the potential to have considerable impact on community cohesion."--Bloomsbury Publishing

    Abstract: "In recent times there has been a dramatic change in the nature and scope of constitutional justice systems in the global south. New or reformed constitutions have proliferated, protecting social, economic, and political rights. While constitutional courts in Latin America have traditionally been used as ways to limit power and preserve the status quo, the evidence shows that they are evolving into a functioning part of contemporary politics and a central component of a system of constitutional justice. This book lays bare the political roots of this transformation, outlining a new way to understand judicial design and the very purpose of constitutional justice. Authors Daniel M. Brinks and Abby Blass use case studies drawn from nineteen Latin American countries over forty years to reveal the ideas behind the new systems of constitutional justice. They show how constitutional designers entrust their hopes and fears to dynamic governance systems, in hopes of directing the development of constitutional meaning over time"--
    Abstract: "This project started many years ago, as an article-length project on the apparent diffusion of new models of courts throughout Latin America. A paper Dan Brinks was writing for APSA dovetailed with a paper Abby Blass was writing for a graduate seminar, and the project evolved through conversations between the two authors after that. Both Abby and Dan had other projects to attend to, so the collaboration moved slowly, but we both felt it was intellectually productive. In its early stages in particular, each of the authors contributed important elements and carried out a mutual back and forth that makes it difficult to separate each author's contributions to the initial conceptualization and measurement exercises. Similarly, the basic argument evolved out of conversations between the authors, with each pushing the other to clarify and specify the argument further. Through conceiving and writing the pieces we have called "Conceptualization" (now an article in the International Journal of Constitutional Law, and largely contained in chapter 2 and the Appendix) and "Determinants" (the theory and quantitative analysis that underpins chapters 3 and 4), we collaborated fully. This is the core of the intellectual contribution of the book, and our joint work on these pieces is the principal, though not the only, reason Abby is credited as a co-author"--

    Abstract: Memory is as central to modern politics as politics is central to modern memory. We are so accustomed to living in a forest of monuments, to having the past represented to us through museums, historic sites, and public sculpture, that we easily lose sight of the recent origins and diverse meanings of these uniquely modern phenomena. In this volume, leading historians, anthropologists, and ethnographers explore the relationship between collective memory and national identity in diverse cultures throughout history. Placing commemorations in their historical settings, the contributors disclose the contested nature of these monuments by showing how groups and individuals struggle to shape the past to their own ends. The volume is introduced by John Gillis's broad overview of the development of public memory in relation to the history of the nation-state. Other contributions address the usefulness of identity as a cross-cultural concept (Richard Handler), the connection between identity, heritage, and history (David Lowenthal), national memory in early modern England (David Cressy), commemoration in Cleveland (John Bodnar), the museum and the politics of social control in modern Iraq (Eric Davis), invented tradition and collective memory in Israel (Yael Zerubavel), black emancipation and the civil war monument (Kirk Savage), memory and naming in the Great War (Thomas Laqueur), American commemoration of World War I (Kurt Piehler), art, commerce, and the production of memory in France after World War I (Daniel Sherman), historic preservation in twentieth-century Germany (Rudy Koshar), the struggle over French identity in the early twentieth century (Herman Lebovics), and the commemoration of concentration camps in the new Germany (Claudia Koonz)

    Abstract: An account of all the new and surprising evidence now available for the beginnings of the earliest civilizations that contradict the standard narrative. Why did humans abandon hunting and gathering for sedentary communities dependent on livestock and cereal grains, and governed by precursors of today's states? Most people believe that plant and animal domestication allowed humans, finally, to settle down and form agricultural villages, towns, and states, which made possible civilization, law, public order, and a presumably secure way of living. But archaeological and historical evidence challenges this narrative. The first agrarian states, says James C. Scott, were born of accumulations of domestications: first fire, then plants, livestock, subjects of the state, captives, and finally women in the patriarchal family-all of which can be viewed as a way of gaining control over reproduction. Scott explores why we avoided sedentism and plow agriculture, the advantages of mobile subsistence, the unforeseeable disease epidemics arising from crowding plants, animals, and grain, and why all early states are based on millets and cereal grains and unfree labor. He also discusses the "barbarians" who long evaded state control, as a way of understanding continuing tension between states and nonsubject peoples
