    Abstract: Das 20. Jahrhundert ist oft als das Jahrhundert der Gewalt bezeichnet worden. Daher mangelt es nicht an Gewaltphänomenen, die es genauer zu untersuchen gilt, als dies bislang geschehen ist. In diesem Band werden deswegen Gewalttaten aus neuen Perspektiven untersucht, neue Interpretationen ihrer Entstehung vorgestellt und neue Herausforderungen der sozialwissenschaftlichen Gewaltforschung debattiert. Folgende Fragen werden unter anderem in diesem gesellschaftspolitisch folgenreichen Buch behandelt: Kann der lange dominierende Begriff der physischen Gewalt überhaupt noch leitend sein, und muß die Gewaltanalyse sich nicht wieder stärker der strukturellen Gewalt zuwenden, da zunehmend eine »Gewalt ohne Gesicht« auftritt? Stecken die Ursachen im Gewalthandeln selbst, so daß Hinweise auf soziale Hintergründe etwa in die Irre führen? Verlieren sozialwissenschaftliche Forschungen aufgrund neuer biologischer Ansätze völlig an Relevanz? It looks at their place in the constitutional order of the country and the political and administrative system. Their organization and administration are fully covered, as is their financing. Parties and elections in the Länder and the controversial roles of parliaments and deputies are also examined. Because of their role in the Bundesrat, the second legislative chamber, the Länder are clearly an important part of the national legislative process. They participate in policy-making with regard to the European Union, and have limited influence on Germany's foreign affairs outside of Europe.     Abstract: Sexuality, motherhood and marriage were matters of public policy throughout the nineteenth and early twentieth centuries. They were prominent areas in the regulation of women, but the idea that the law merely reflected what was normal and natural obscured the extent of this regulation. Regulating Womanhood poses historically and culturally specific questions about the mechanisms that have controlled and restricted women. It shows not merely how laws and policies have set boundaries to the lives of women but also how the category of 'woman' has been constructed as a specific object for legal and social policy, and how women came to be seen as needing 'special' regulation. In addition, Regulating Womanhood explores how children and the organisation of reproduction and sexuality operated to normalise and make acceptable the degree of regulation to which women were subjected. Yet this is not a catalogue of the unmitigated subjection of women in history. The contributors focus on women's resistance and activity, and on the shift in modes of regulation, to challenge the idea of an unchanging history of the legal oppression of women

    Abstract: The Environment Ministers of OECD member countries endorsed the Guidelines for moving towards Environmentally Sustainable Transport (EST) at their meeting in May 2001. These Guidelines are based on the results and conclusions of the EST project involving many OECD and non-OECD countries and provide a solution to making transport policy more sustainable and enhancing quality of life. They have been developed to enable economic development and individual welfare without causing undue health and environmental impacts and depletion of finite resources. The EST Guidelines will assist governments at all levels in the development and implementation of strategies towards EST. Effective implementation of the EST Guidelines requires strategies that accommodate the particular geographic and socio-economic conditions of countries or regions.These guidelines guidelines represent a desirable and feasible approach for the transport sector that may also be of value in the sustainable development of other sectors.

    Abstract: Netwar-like cyberwar-describes a new spectrum of conflict that is emerging in the wake of the information revolution. Netwar includes conflicts waged, on the one hand, by terrorists, criminals, gangs, and ethnic extremists; and by civil-society activists (such as cyber activists or WTO protestors) on the other. What distinguishes netwar is the networked organizational structure of its practitioners-with many groups actually being leaderless-and their quickness in coming together in swarming attacks. To confront this new type of conflict, it is crucial for governments, military, and law enforcement to begin networking themselves.

    Abstract: Since the 1970s there has been a dramatic rise in the Indian population in Brazil as increasing numbers of pardos (individuals of mixed African, European, and indigenous descent) have chosen to identify themselves as Indians. In Racial Revolutions-the first book-length study of racial formation in Brazil that centers on Indianness-Jonathan W. Warren draws on extensive fieldwork and numerous interviews to illuminate the discursive and material forces responsible for this resurgence in the population.The growing number of pardos who claim Indian identity represents a radical shift in the direction of Brazilian racial formation. For centuries, the predominant trend had been for Indians to shed tribal identities in favor of non-Indian ones. Warren argues that many factors-including the reduction of state-sponsored anti-Indian violence, intervention from the Catholic church, and shifts in anthropological thinking about ethnicity-have prompted a reversal of racial aspirations and reimaginings of Indianness. Challenging the current emphasis on blackness in Brazilian antiracist scholarship and activism, Warren demonstrates that Indians in Brazil recognize and oppose racism far more than any other ethnic group.Racial Revolutions fills a number of voids in Latin American scholarship on the politics of race, cultural geography, ethnography, social movements, nation building, and state violence.Designated a John Hope Franklin Center book by the John Hope Franklin Seminar Group on Race, Religion, and Globalization.

Their function was to transform delinquents into useful citizens. But how should the buildings be designed to achieve that aim? Which new technologies could be used? The birth of modern prisons was long-lasting, covering three generations. The author outlines this process and shows parallels to the developments in England and the United States.

Mit ihrer Hilfe hofften die Zeitgenossen, den Delinquenten in einen nützlichen Staatsbürger umschaffen zu können. Doch welches Design mußte diese Institution haben? Mit welchen Techniken war die Besserung des Delinquenten zu erreichen? Und wie sollte diese neue Straftechnologie in das bestehende Anstaltssystem implementiert werden? Die Geburt des Gefängnisses war ein langwieriger Erfindungsprozeß, der sich über drei Generationen hinzog. Thomas Nutz zeichnet nach, wie sich im ausgehenden 18. Jahrhundert ein spezifischer Diskurs über die Reform der Haftanstalten formierte und ein internationales Fachwissen herausbildete. Eine Entwicklung, die schließlich Mitte des 19. Jahrhunderts in der Entstehung einer eigenständigen Disziplin der "Gefängniskunde" mündete. Am Beispiel Preußens demonstriert der Autor, wie eng die staatlichen Bürokratien bei der Durchführung der Reformen des Vollzugswesens mit den gefängniskundlichen Experten zusammenarbeiteten.

    Abstract: Class action lawsuits--allowing one or a few plaintiffs to represent many who seek redress--have long been controversial. The current controversy, centered on lawsuits for money damages, is characterized by sharp disagreement among stakeholders about the kinds of suits being filed, whether plaintiffs' claims are meritorious, and whether resolutions to class actions are fair or socially desirable. Ultimately, these concerns lead many to wonder, "Are class actions worth their costs to society and to business? Do they do more harm than good?" To describe the landscape of current damage class action litigation, elucidate problems, and identify solutions, the RAND Institute for Civil Justice conducted a study using qualitative and quantitative research methods. The researchers concluded that the controversy over damage class actions has proven intractable because it implicates deeply held but sharply contested ideological views among stakeholders. Nevertheless, many of the political antagonists agree that class action practices merit improvement. The authors argue that both practices and outcomes could be substantially improved if more judges would supervise class action litigation more actively and scrutinize proposed settlements and fee awards more carefully. Educating and empowering judges to take more responsibility for case outcomes--and ensuring that they have the resources to do so--can help the civil justice system achieve a better balance between the public goals of class actions and the private interests that drive them
