    Abstract: In Indonesia, the world's largest Muslim-majority country, Muslims struggle to reconcile radically different sets of social norms and laws, including those derived from Islam, local social norms, and contemporary ideas about gender equality and rule of law. In this 2003 study, John Bowen explores this struggle, through archival and ethnographic research in villages and courtrooms of the Aceh Province, Sumatra, and through interviews with national religious and legal figures. He analyses the social frameworks for disputes about land, inheritance, marriage, divorce, Islamic History and, more broadly, about the relationships between the state and Islam, and between Muslims and non-Muslims. The book speaks to debates carried out in all societies about how people can live together with their deep differences in values and ways of life. It will be welcomed by scholars and students across the social sciences, particularly those interested in anthropology, cultural sociology and political theory.

    Abstract: Andreas Wimmer argues that nationalist and ethnic politics have shaped modern societies to a far greater extent than has been acknowledged by social scientists. The modern state governs in the name of a people defined in ethnic and national terms. Democratic participation, equality before the law and protection from arbitrary violence were offered only to the ethnic group in a privileged relationship with the emerging nation-state. Depending on circumstances, the dynamics of exclusion took on different forms. Where nation building was 'successful', immigrants and 'ethnic minorities' are excluded from full participation; they risk being targets of xenophobia and racism. In weaker states, political closure proceeded along ethnic, rather than national lines and leads to corresponding forms of conflict and violence. In chapters on Mexico, Iraq and Switzerland, Wimmer provides extended case studies that support and contextualise this argument.

    Abstract: Does European integration influence national cultures and social policies? Is Europe's fabled cultural diversity diminishing? In this book, Paulette Kurzer examines these important and topical questions by comparing the Irish abortion ban, Finnish and Swedish drinking restrictions, and Dutch drug decriminalization. Employing a synthesis of constructivist and institutionalist theories, Kurzer demonstrates that domestic shifts in values and attitudes, spurred along by the impact of EC/EU market integration, are in fact bringing about a convergence in European morality norms. Alcohol control policies are forced to liberalize, the Irish abortion proscription is being redefined, and Dutch drug toleration is pushed into a more punitive direction. Markets and Moral Regulation argues that a crucial agency is European law and its role as a market regulator: as market forces invade these cultural and moral spheres, protective barriers disintegrate. The result is that cultural and social domains are increasingly exposed to the influence of market competition

    Abstract: There is widespread concern that the growth of the Internet is exacerbating inequalities between the information rich and poor. Digital Divide examines access and use of the Internet in 179 nations world-wide. A global divide is evident between industrialized and developing societies. A social divide is apparent between rich and poor within each nation. Within the online community, evidence for a democratic divide is emerging between those who do and do not use Internet resources to engage and participate in public life. Part I outlines the theoretical debate between cyber-optimists who see the Internet as the great leveler. Part II examines the virtual political system and the way that representative institutions have responded to new opportunities on the Internet. Part III analyzes how the public has responded to these opportunities in Europe and the United States and develops the civic engagement model to explain patterns of participation via the Internet.

    Abstract: In this book, Thomas Buoye examines the impact of large-scale economic change on social conflict in eighteenth-century China. He draws upon a large body of actual, documented homicide cases originating in property disputes to recreate the social tensions of rural China during the Qianlong reign (1736–1795). The development of property rights, a process that had begun in the Ming dynasty, was accompanied by other changes that fostered disruption and conflict, including an explosion in the population growth and the increasing strain on land and resources, and increasing commercialization in agriculture. Buoye challenges the 'markets' and 'moral economy' theories of economic behaviour. Applying the theories of Douglass North for the first time to this subject, he uses an institutional framework to explain seemingly irrational economic choices. Buoye examines demographic and technological factors, ideology, and political and economic institutions in rural China to understand the link between economic and social change.

    Abstract: Against the backdrop of South Africa's transition from apartheid, this provocative book explores the role of late twentieth century constitutionalism in facilitating political change. Using South Africa as a case study, Klug's larger project is to investigate why there has been renewed faith in justiciable constitutions and democratic constitutionalism despite the widespread recognition that courts are institutionally weak, lack adequate resources and are largely inaccessible to most citizens. He places this question in a broader context, evaluating the appeal of different constitutional models and illustrating how globalized institutions can be adapted to serve local domestic needs. Incorporating constitutional law, politics and legal history, this examination of South Africa's constitution-making process provides important insights into the role of law in the transition to democracy

    Abstract: In order to distinguish between those who may and may not enter or leave, states everywhere have developed extensive systems of identification, central to which is the passport. This innovative book argues that documents such as passports, internal passports and related mechanisms have been crucial in making distinctions between citizens and non-citizens.     Abstract: Justice, equity, and fairness are central concerns of everyday life, whether we are assessing the fairness of individual acts, social programmes, or institutional policies. This book explores how the distribution of costs and benefits determine our intuition about fairness and why individual behaviour sometimes deviates from normative theories of justice. To make any comparison, one must first state how fair distributions of resources or burdens should be made. Here, competing theories, such as utilitarianism and economic efficiency, are discussed. The chapters cover many topics including an investigation of various rules and heuristics that people use to make fair distributions; the motivation for people to conform to rules of fairness even when they conflict with self-interest; differences between the views of liberals and conservatives; societal rules for the distribution or allocation of critical or scarce resources; and implications for public policy. This mixture of theoretical and applied perspectives provides a balanced look at the psychology of justice.

    Abstract: Francisco Vitoria was the earliest and arguably the most important of the Thomist political philosophers of the Counter-Reformation. Not only did he write important essays on civil and ecclesiastical power, but he became celebrated for his defence of the new world Indians against the imperialism of his own master, the King of Spain. Vitoria's political works are thus of great importance for an understanding both of the rise of modern absolutism, and the debate about the emergent imperialism of the European powers. His works are also unusually accessible, since they survive mainly in the form of 'relectiones', or summaries delivered at the end of his lecture courses on law and theology at the University of Salamanca.     Abstract: This book is a 1990 account of the ways in which young Aborigines were at a disadvantage before laws and legislation had been introduced, intended to improve their position. Aboriginal Youth and the Criminal Justice System focuses on South Australia, where detailed statistics are available, in a sophisticated analysis of the exact nature of the discrimination experienced by young Aborigines. Fay Gale, Rebecca Bailey-Harris and Joy Wundersitz examine the criminal justice system in operation; from the initial intervention by a police officer, through the process of screening and assessment to the final outcome - which all too often is a criminal record. The research clearly shows that at every point where discretion was exercised within this system, Aboriginal youths received the harsher option. Thus disadvantage is heaped on disadvantage until young Aboriginals were imprisoned at 23 times the rate of other young Australians. Even for those who escaped detention, participation in the criminal justice system was often such an ordeal that it became a form of punishment in itself. Discretion, though preferable to inflexible rules could operate against a group whose lifestyle and values differed from mainstream society.
