    Abstract: Vom 19. Jahrhundert als einer Mediengesellschaft zu sprechen, erscheint als ein Anachronismus. Der Begriff sucht den Bedeutungsgewinn und die Diversifizierung der Medien in der Gegenwart zu erfassen und damit nicht zuletzt heutige von früheren Gesellschaften abzugrenzen. Die Annahme, dass Medien in früheren Gesellschaften nicht ebenfalls eine zentrale und spezifische Rolle zukam, wäre jedoch irrig. So war das 19. Jahrhundert nicht nur vom Aufstieg einer Vielzahl einstmals neuer Medien geprägt, sondern auch dadurch, dass sich die Gesellschaft über öffentliche und mediale Kommunikation erst konstituierte und ausdifferenzierte. Der Band macht es sich zur Aufgabe, ineinander greifende zentrale mediale und gesellschaftliche Entwicklungen für Deutschland und für Frankreich in einer übergreifenden wie vergleichenden Perspektive vorzustellen.

Im Verhältnis zu Dritten verläuft die Rechtsschutzproblematik aufgrund der Client-Server-Architektur virtueller Umgebungen parallel zu der extern gespeicherter Datenbestände. Das Projekt zielt auf eine systematische, trans- und interdisziplinäre Untersuchung des bestehenden Rechts hinsichtlich seiner förderlichen oder hemmenden Einflüsse auf technologische Innovationsprozesse und soll Ansatzpunkte für seine Weiterentwicklung aufzeigen. Der Begriff der Innovationsverantwortung bezieht sich auf Vorkehrungen zur Sicherung der Gemeinwohlverträglichkeit von Innovationen und ist damit Chiffre für eine normative Orientierungen und Vorgaben sichernde Begleitung von Innovationsprozessen. Einleitend werden die Aufgaben und Kapazitäten des Rechts zur Sicherung von Rechtsgütern und rechtlich geschützten oder nur gesellschaftlich anerkannten Interessen bei der Entwicklung von Innovationen ausgelotet. Aus soziologischer und ökonomischer Perspektive werden ferner die übergreifenden Bezugspunkte von Vorsorge und Folgenabschätzung innovationsbezogen konkretisiert. Anschließend werden Referenzgebiete von der Nanotechnologie über Neuroimplantate und grüne Gentechnik bis zum Chemikalienrecht (REACh) und dem Elektrogesetz auf die Verankerung und jeweilige Ausgestaltung einer Innovationsverantwortung hin untersucht.     Abstract: Are postcolonies haunted more by criminal violence than other nation-states? The usual answer is yes. In Law and Disorder in the Postcolony, Jean and John Comaroff and a group of respected theorists show that the question is misplaced: that the predicament of postcolonies arises from their place in a world order dominated by new modes of governance, new sorts of empires, new species of wealth-an order that criminalizes poverty and race, entraps the "south" in relations of corruption, and displaces politics into the realms of the market, criminal economies, and the courts.  As these essays make plain, however, there is another side to postcoloniality: while postcolonies live in states of endemic disorder, many of them fetishize the law, its ways and itsmeans. How is the coincidence of disorder with a fixation on legalities to be explained? Law and Disorder in the Postcolony addresses this question, entering into critical dialogue with such theorists as Benjamin, Agamben, and Bayart. In the process, it also demonstrates how postcolonies have become crucial sites for the production of contemporary theory, not least because they are harbingers of a global future under construction.

    Abstract: Is it time to take a break from feminism? In this pathbreaking book, Janet Halley reassesses the place of feminism in the law and politics of sexuality. She argues that sexuality involves deeply contested and clashing realities and interests, and that feminism helps us understand only some of them. To see crucial dimensions of sexuality that feminism does not reveal--the interests of gays and lesbians to be sure, but also those of men, and of constituencies and values beyond the realm of sex and gender--we might need to take a break from feminism. Halley also invites feminism to abandon its uncritical relationship to its own power. Feminists are, in many areas of social and political life, partners in governance. To govern responsibly, even on behalf of women, Halley urges, feminists should try taking a break from their own presuppositions. Halley offers a genealogy of various feminisms and of gay, queer, and trans theories as they split from each other in the United States during the 1980s and 1990s. All these incommensurate theories, she argues, enrich thinking on the left not despite their break from each other but because of it. She concludes by examining legal cases to show how taking a break from feminism can change your very perceptions of what's at stake in a decision and liberate you to decide it anew.

    Abstract: In dieser Monographie wird, beginnend mit einem biographischen und zeitgeschichtlichen Grundriss, zum ersten Mal das umfangreiche strafrechtliche, rechtsphilosophische und philosophische Gesamtwerk Arthur Baumgartens dargestellt. Baumgarten war im Jahr seiner bei Franz v. Liszt verteidigten Dissertation (1909) nach Genf berufen worden und lehrte in Köln, Basel, Frankfurt/M. und Berlin. Von der dreiteiligen "Wissenschaft vom Recht" (1922) urteilte Albrecht Mendelssohn Bartholdy im "Archiv des öffentlichen Rechts", hier sei die Jurisprudenz auf Philosophie gegründet, und die Lehre Baumgartens werde neben Stammler und Nelson die stärkste Wirkung aufs Rechtsdenken gewinnen. Mit seinen philosophischen Schriften wurde Baumgarten, beeinflusst von James und Dewey, in den zwanziger und dreißiger Jahren des vergangenen Jahrhunderts ein Vordenker des sozialliberalen Pragmatismus in der deutschen Philosophie und nahm deren Hinwendung zur angloamerikanischen philosophischen Tradition um Jahrzehnte vorweg. 1933 erklärte er, unterm NS-Regime nicht Rechtwissenschaft lehren zu können, und ging von Frankfurt in die Schweizer Emigration. Die Erfahrung von Faschismus und Krieg führte ihn in der Mitte der vierziger Jahre zu sozialistischen Überzeugungen und Erwartungen und zur Marxschen sozialwissenschaftlichen Methode, so dass er, nach Frankfurt nicht zurückberufen, gleich anderen antifaschistischen Intellektuellen in die Ostzone und spätere DDR zog. Gerd Irrlitz behandelt die Hauptwerke und die marxistisch orientierten Texte Baumgartens - wie überhaupt die sozialliberale und die späte sozialistische Periode - nicht als Gegensätze, sondern als aufeinander bezogene und einander bedingende Konzepte, überzeugt, dass das Werk des Rechtsphilosophen unterm Erfordernis der Erneuerung des sozialen Liberalismus in der hochindustriellen Zivilisation neue Aktualität gewinnen...

    Abstract: Hauptbeschreibung In den vergangenen Jahrzehnten hat die deutsche Asylrechtsprechung ein festes Gerüst asylrechtlicher Rechtsfiguren und Auslegungsgrundsätze geschaffen, dessen tragende Pfeiler auf einer in weiten Teilen völlig eigenständigen Interpretation maßgeblicher Vorschriften der Genfer Flüchtlingskonvention beruhen. Der Prozess der Harmonisierung des Flüchtlingsrechts auf europäischer Ebene und vor allem die Richtlinie 2004/83/EG des Rates vom 29.04.2004 (Qualifikationsrichtlinie) als eines der zentralen Elemente dieser Asylrechtsharmonisierung verlangen der deutschen Asylrechtsprechung eine grundlegende Revision und Neuorientierung ab. Vor diesem Hintergrund geht die Autorin, selbst Richterin am Verwaltungsgericht, am Beispiel des Widerrufs von Flüchtlingsanerkennungen im Einzelnen der Frage der Völkerrechts- und Europarechtskonformität der deutschen Rechtsprechung nach. Annegret Titze legt dabei besonderes Gewicht auf die dogmatische Entfaltung der für alle Auslegungsfragen im materiellen Asylrecht nunmehr maßgeblichen methodischen Grundlagen, die bei der Auslegung von Völkervertragsrecht einerseits und der Auslegung von EG-Recht andererseits sowie bei der Verzahnung beider Rechtskreise im Bereich der Qualifikationsrichtlinie zu beachten sind. Most have been driven from their homes by armed strife, displacing people into settings that fail to meet standards for even basic human dignity. But those working in the field are so pressed by urgent crises that they can rarely analyze the requirements of advocacy systematically. Yet advocacy must go beyond international law to human rights as an ethical standard to prevent displaced people from falling through the cracks of our conflicted world.Refugee Rights: Ethics, Advocacy, and Africa draws upon David Hollenbach, SJ's work as founder and director of the Center for Human Rights and International Justice at Boston College to provide an analytical framework for vigorous advocacy on behalf of refugees and internally displaced people. Representing both religious and secular perspectives, the contributors are scholars, practitioners, and refugee advocatesùall of whom have spent time on the ground in Africa. The book begins with the poignant narrative of Abebe Feyissa, an Ethiopian refugee who has spent over fifteen years in a refugee camp from hell.     Abstract: Hauptbeschreibung Pascale Cancik untersucht die Offizialisierung und Professionalisierung von Verwaltungskommunikation im Preußen des frühen 19. Jahrhunderts. Zu dieser Zeit erreichte der aufklärerische Öffentlichkeitsdiskurs der 'Sattelzeit' verschiedene Bereiche von Gesellschaft und Recht (Parlamente, Gerichte, Presse). Die Verwaltung indessen, die damals ihre modern-bürokratische Form entwickelte, wird von der historischen Forschung kaum mit jenen liberalen Öffentlichkeitsforderungen in Verbindung gebracht. Ist das gegenwärtig wieder viel untersuchte Thema Verwaltung und Öffentlichkeit zu Recht kein Thema (rechts-)historischer Forschung? Die Autorin zeigt zunächst, dass es durchaus einen zeitgenössischen Publizitätsdiskurs gab, der sich gerade auch auf Verwaltung bezog. Aber kam dieser auch in der Praxis von Recht und Verwaltung an? Da Öffentlichkeiten sich in Kommunikationen manifestieren, werden zwei Felder von Verwaltungskommunikation genauer untersucht: die Publikation staatlichen Handelns durch die Verwaltung sowie die Entwicklung konkreter Verwaltungsverfahren, innerhalb derer die Verwaltung mit Bürgern kommuniziert. Im Zentrum stehen dabei jeweils die Rolle von Recht und Rechtspraxis. Es ergibt sich ein komplexes Bild von Motiven und Intensitäten der Einbeziehung oder gar Beteiligung von Bürgern. Bis heute genutzte Techniken, Medien und Verfahren wurden damals mit Hilfe von Recht konzipiert und eingeübt. Sie sind nicht, wie manchmal behauptet, ausschließlich mit Demokratie verbunden.

    Abstract: Illicit Flows and Criminal Things offers a new perspective on illegal transnational linkages, international relations, and the transnational. The contributors argue for a nuanced approach that recognizes the difference between "organized" crime and the thousands of illicit acts that take place across national borders every day. They distinguish between the illegal (prohibited by law) and the illicit (socially perceived as unacceptable), which are historically changeable and contested. Detailed case studies of arms smuggling, illegal transnational migration, the global diamond trade, borderland practices, and the transnational consumption of drugs take us to Asia, Africa, Latin America, Europe, and North America. They allow us to understand how states, borders, and the language of law enforcement produce criminality, and how people and goods which are labeled "illegal" move across regulatory spaces.
