    Abstract: This volume contains the English translation of Felix Kaufmann's (1895-1945) main work Methodenlehre der Sozialwissenschaften (1936). In this book, Kaufmann develops a general theory of knowledge of the social sciences in his role as a cross-border commuter between Husserl's phenomenology, Kelsen's pure theory of law and the logical positivism of the Vienna Circle. This multilayered inquiry connects the value-oriented reflections of a general philosophy of science with the specificity of the methods and theories of the social sciences, as opposed to abstract natural science and psychology. The core focus of the study is the attempt to elucidate how and under what conditions scientific knowledge about social facts, empirically justified and theoretically embedded, can be obtained. The empirical basis of knowledge within the social sciences forms a phenomenological concept of experience. According to Kaufmann, this concept of experience exhibits a complex structure. Within the meaning-interpretation of human action as the core of knowledge in the social sciences, this structure reaches out across the isolated act of verification toward the synthesis of external and internal experiences. The book opens with a detailed and useful introduction by Ingeborg K. Helling, which introduces the historical and theoretical background of Kaufmann's study and specifically illuminates his relation to Alfred Schütz and John Dewey. Finally, it contains interviews with and letters to members of his family, colleagues and students

    Abstract: The present volume assembles a relevant set of studies of argument by analogy, which address this topic in a systematic fashion, either from an essentially theoretical perspective, or from the perspective of it being applied to different fields like politics, linguistics, literature, law, medicine, science in general, and philosophy. All result from original research conducted by their authors for this publication. Thus, broadly speaking, this is an exception which we find worthy of occupying a special place in the sphere of the bibliography on the argument by analogy. In effect, most of the contexts of the publications on this topic focus on specific areas, for example everyday discourse, science or law theory, while underestimating or sometimes even ignoring other interdisciplinary scopes, as is the case of literature, medicine or philosophy.     Abstract: This book is a collection of papers that address a fundamental question: What is the role of civil justice and civil procedure in the various national traditions in the contemporary world? The book presents striking differences among a range of countries and legal traditions, but also points to common trends and open issues. It brings together prominent experts, professionals and scholars from both civil and common law jurisdictions.     Abstract: This volume illustrates both theoretically and empirically the differences between religious diversity and religious pluralism. It highlights how the factual situation of cultural and religious diversity may lead to individual, social and political choices of organized and recognized pluralism. In the process, both individual and collective identities are redefined, incessantly moving along the continuum that ranges from exclusion to inclusion. The book starts by first detailing general issues related to religious pluralism. It makes the case for keeping the empirical, the normative, the regulatory and the interactive dimensions of religious pluralism analytically distinct while recognizing that, in practice, they often overlap. It also underlines the importance of seeking connections between religious pluralism and other pluralisms. Next, the book explores how religious diversity can operate to contribute to legal pluralism and examines the different types of church-state relations: eradication, monopoly, oligopoly and pluralism. The second half of the book features case studies that provide a more specific look at the general issues, from ways to map and assess the religious diversity of a whole country to a comparison between Belgian-French views of religious and philosophical diversity, from religious pluralism in Italy to the shifting approach to ethnic and religious diversity in America, and from a sociological and historical perspective of religious plurality in Japan to an exploration of Brazilian religions, old and new. The transition from religious diversity to religious pluralism is one of the most important challenges that will reshape the role of religion in contemporary society.     Abstract: This book covers two lesser known but important Italian Mafia groups: the ’Ndrangheta and the Sacra Corona Unita. Italian criminal organizations, in particular Mafia, are one of the most commonly researched organized crime groups, usually focusing on the Sicilian Mafia, Cosa Nostra, or the Neapolitan Mafia, Camorra. However, Italy has other two other Mafias, one in Apulia, Sacra Corona Unita, and the other in Calabria, ’Ndrangheta. Although an extensive literature is available on Cosa Nostra and Camorra, less is known about the other two organizations, particularly their operations in the United States. Territory is one of the most important elements in the Mafia because the criminal organization operates its signoria territoriale, controlling every illegal activity in its sphere of action. This territorial power goes beyond the Italian boundaries reaching the United States of America and other non-European countries, with the mere aim of developing their drug/weapon trafficking and money laundering businesses. Mafia, therefore, is not a uniquely Italian phenomenon as it might appear, but a worldwide one, affecting many societies and economies. This unique volume provides new information about the ’Ndrangheta and Sacra Corona Unita written by an interdisciplinary group of Italian scholars. It covers organizational, hierarchic, and operative aspects: that is, the role that they have in politics, in their own families, in business relations in Italy and abroad. It also highlights the particular role that Cosa Nostra and Camorra had in their development.     Abstract: Most of the world’s redundant ships are scrapped on the beaches of the Indian sub-continent, largely by hand. As well as cargo residues and wastes, ships contain high levels of hazardous materials that are released into the surrounding ecology when scrapped. The scrapping process is labour-intensive and largely manual; injuries and death are commonplace. Shipbreaking was a relatively obscure industry until the late 1990s. In just 12 years, action by environmental NGOs has led to the ratification of an international treaty targeting the extensive harm to human and environmental health arising from this heavy, polluting industry; it has also produced important case law. Attempts to regulate the industry via the Basel Convention have resulted in a strong polarization of opinion as to its applicability, and various international guidelines have also failed because of their voluntary nature. The adoption of the Hong Kong Convention in 2009 was a serious attempt to introduce international controls to this industry

    Abstract: This is the first collection of essays in which European and American philosophers explicitly think out their respective contributions and identities as environmental thinkers in the analytic and continental traditions. The American/European, as well as Analytic/Continental collaboration here bears fruit helpful for further theorizing and research. The essays group around three well-defined areas of questioning all focusing on the amelioration/management of environmentally, historically and traditionally diminished landscapes. The first part deals with differences between New World and the Old World perspectives on nature and landscape restoration in general, the second focuses on the meaning of ecological restoration of cultural landscapes, and the third on the meaning of the wolf and of wildness. It does so in a way that the strengths of each philosophical school-continental and analytic-comes to the fore in order to supplement the other’s approach. This text is open to educated readers across all disciplines, particularly those interested in restoration/adaptation ecology, the cultural construction of place and landscape, the ongoing conversation about wilderness, the challenges posed to global environmental change. The text may also be a gold mine for doctoral students looking for dissertation projects in environmental philosophy that are inclusive of continental and analytic traditions. This text is rich in innovative approaches to the questions they raise that are reasonably well thought out. The fact that the essays in each section really do resonate with one another directly is also intellectually exciting and very helpful in working out the full dimensions of each question raised in the volume

    Abstract: This volume describes features of biological autonomy and integrates them into the recent discussion of factors in evolution. In recent years ideas about major transitions in evolution are undergoing a revolutionary change. They include questions about the origin of evolutionary innovation, their genetic and epigenetic background, the role of the phenotype, and of changes in ontogenetic pathways. In the present book, it is argued that it is likewise necessary to question the properties of these innovations and what was qualitatively generated during the macroevolutionary transitions. The author states that a recurring central aspect of macroevolutionary innovations is an increase in individual organismal autonomy whereby it is emancipated from the environment with changes in its capacity for flexibility, self-regulation and self-control of behavior. The first chapters define the concept of autonomy and examine its history and its epistemological context. Later chapters demonstrate how changes in autonomy took place during the major evolutionary transitions and investigate the generation of organs and physiological systems. They synthesize material from various disciplines including zoology, comparative physiology, morphology, molecular biology, neurobiology and ethology. It is argued that the concept is also relevant for understanding the relation of the biological evolution of man to his cultural abilities. Finally the relation of autonomy to adaptation, niche construction, phenotypic plasticity and other factors and patterns in evolution is discussed. The text has a clear perspective from the context of systems biology, arguing that the generation of biological autonomy must be interpreted within an integrative systems approach

    Abstract: This book explores the interconnections and differentiations between artisanal workshops and alchemical laboratories and between the arts and alchemy from Antiquity to the eighteenth century. In particular, it scrutinizes epistemic exchanges between producers of the arts and alchemists. In the fifteenth and sixteenth centuries the term laboratorium uniquely referred to workplaces in which ‘chemical’ operations were performed: smelting, combustion, distillation, dissolution, and precipitation. Artisanal workshops equipped with furnaces and fire in which ‘chemical’ operations were performed were also known as laboratories. Transmutational alchemy (the transmutation of all base metals into more noble ones, especially gold) was only one aspect of alchemy in the early modern period. The practice of alchemy was also about the chemical production of things--medicines, porcelain, dyes, and other products as well as precious metals--and about the knowledge of how to produce them. This book uses examples such as the Uffizi to discuss how Renaissance courts established spaces where artisanal workshops and laboratories were brought together, thus facilitating the circulation of materials, people and knowledge between the worlds of craft (today’s decorative arts) and alchemy. Artisans became involved in alchemical pursuits beyond a shared material culture and some crafts relied on chemical expertise offered by scholars trained as alchemists. Above all, texts and books, products and symbols of scholarly culture played an increasingly important role in artisanal workshops. In these workplaces a sort of hybrid figure was at work. With one foot in artisanal and the other in scholarly culture this hybrid practitioner is impossible to categorize in the mutually exclusive categories of scholar and craftsman. By the seventeenth century the expertise of some glassmakers, silver- and goldsmiths and producers of porcelain was just as based in the worlds of alchemical and bookish learning as it was grounded in hands-on work in the laboratory. This book suggests that this shift in workshop culture facilitated the epistemic exchanges between alchemists and producers of the decorative arts

    Abstract: This volume presents current thoughts, research, and findings that were presented at a summit focusing on energy as a cross-cutting concept in education, involving scientists, science education researchers and science educators from across the world. The chapters cover four key questions: what should students know about energy, what can we learn from research on teaching and learning about energy, what are the challenges we are currently facing in teaching students this knowledge, and what needs be done to meet these challenges in the future?     Abstract: This book explores the development of the influential worldwide Hizmet movement inspired by the Turkish scholar Fethullah Gülen, known for his moderate Islamic emphasis on peaceful relations among diverse people. It provides a detailed study of Gülen’s account of the virtues and argues that they provide the key to understanding this thinker and the movement he inspired, from its initial establishment of hospitality houses through the growth of worldwide schools, hospitals, media outlets, charitable associations and dialogue centers. The book analyzes the distinctive virtues that shaped the Hizmet movement’s ethos as well as continue to sustain its expansive energy, from the core virtues of tolerance, hospitality, compassion and charity to a host of related virtues, including wisdom, humility, mildness, patience, mercy, integrity and hope. It also examines the Islamic and Sufi roots of Gülen’s understanding of the virtues as well as presents a comparative study of Gülen’s account of the virtues in dialogue with prominent thinkers of the Western philosophical tradition and the religious traditions of Christianity, Judaism and Buddhism. The Hizmet movement provides living witness to the power and efficacy of tolerance, dialogue and peaceful relations among diverse people. This book offers an insightful portrait of the core virtues of this movement and the scholar who fully explored them within his writing.     Abstract: Reports on joint work by researchers from different theoretical and linguistic backgrounds offer new insights on the interaction of linguistic code and context in language production and comprehension. This volume takes a genuinely cross-linguistic approach integrating theoretically well-founded contrastive descriptions with thorough empirical investigations. Authors answer questions on the topic of how we ‘encode’ complex thoughts into linguistic signals and how we interpret such signals in appropriate ways. Chapters combine on- and off-line empirical methods varying from large-scale corpus analyses over acceptability judgements, sentence completion studies, and reading time experiments. The authors shed new light on the central questions related to our everyday use of language, especially the problem of how we construe meaning in and through language in general as well as through the means provided by particular languages. “Language is there to construct meaning. But languages are different -- in their lexicon, in their morphosyntax, also in their ways of constructing discourse and in the extent to which they rely on implicit knowledge and on conversational rules. So, what does this tell us about the meanings constructed by language? Are they the same (as, for example, the two number expressions "1989" and "MCMLXXXIX" mean the same) -- or are they different, due to the way how meanings are constructed? This edited volume provides an ingenious way to discuss differences how meanings are constructed, by focusing on narrowly described phenomena and contrasting two languages per article. It seeks evidence for these differences not only from intuition of speakers and from linguistic corpora, but primarily from experimental studies.     Abstract: This book examines the interface between religion, charity law and human rights. It does so by treating the Church of England and its current circumstances as a timely case study providing an opportunity to examine the tensions that have now become such a characteristic feature of that interface. Firstly, it suggests that the Church is the primary source of canon law principles that have played a formative role in shaping civic morality throughout the common law jurisdictions: the history of their emergence and enforcement by the State in post-Reformation England is recorded and assessed. Secondly, it reveals that of such principles those of greatest weight were associated with matters of sexuality: in particular, for centuries, family law was formulated and applied with regard for the sanctity of the heterosexual marital family which provided the only legally permissible context for any form of sexual relationship. Thirdly, given that history, it identifies and assesses the particular implications that now arise for the Church as a consequence of recent charity law reform outcomes and human rights case law developments: a comparative analysis of religion related case law is provided. Finally, following an outline of the structure and organizational functions of the Church, a detailed analysis is undertaken of its success in engaging with these issues in the context of the Lambeth Conferences, the wider Anglican Communion and in the ill-fated Covenant initiative. From the perspective of the dilemmas currently challenging the moral authority of the Church of England, this book identifies and explores the contemporary ‘moral imperatives’ or red line issues that now threaten the coherence of Christian religions in most leading common law nations. Gay marriage and abortion are among the host of morally charged and deeply divisive topics demanding a reasoned response and leadership from religious bodies. Attention is given to the judicial interpretation and evaluation of these and other issues that now undermine the traditional role of the Church of England. As the interface between religion, charity law and human rights becomes steadily more fractious, with religious fundamentalism and discrimination acquiring a higher profile, there is now a pressing need for a more balanced relationship between those with and those without religious beliefs.     Abstract: The first part of this book is of an epistemological nature and develops an original theory of scientific objectivity, understood in a weak sense (as intersubjective agreement among the specialists) and a strong sense (as having precise concrete referents). In both cases it relies upon the adoption of operational criteria designed within the particular perspective under which any single science considers reality. The “object” so attained has a proper ontological status, dependent on the specific character of the criteria of reference (regional ontologies). This justifies a form of scientific realism. Such perspectives are also the result of a complex cultural-historical situation. The awareness of such a “historical determinacy” of science justifies including in the philosophy of science the problems of ethics of science, relations of science with metaphysics, and social dimensions of science that overstep the traditional restriction of the philosophy of science to an epistemology of science.     Abstract: This book develops a naturalistic aesthetic theory that accounts for aesthetic phenomena in mathematics in the same terms as it accounts for more traditional aesthetic phenomena. Building upon a view advanced by James McAllister, the assertion is that beauty in science does not confine itself to anecdotes or personal idiosyncrasies, but rather that it had played a role in shaping the development of science. Mathematicians often evaluate certain pieces of mathematics using words like beautiful, elegant, or even ugly. Such evaluations are prevalent, however, rigorous investigation of them, of mathematical beauty, is much less common. The volume integrates the basic elements of aesthetics, as it has been developed over the last 200 years, with recent findings in neuropsychology as well as a good knowledge of mathematics. The volume begins with a discussion of the reasons to interpret mathematical beauty in a literal or non-literal fashion, which also serves to survey historical and contemporary approaches to mathematical beauty. The author concludes that literal approaches are much more coherent and fruitful, however, much is yet to be done. In this respect two chapters are devoted to the revision and improvement of McAllister’s theory of the role of beauty in science. These antecedents are used as a foundation to formulate a naturalistic aesthetic theory. The central idea of the theory is that aesthetic phenomena should be seen as constituting a complex dynamical system which the author calls the aesthetic as process theory. The theory comprises explications of three central topics: aesthetic experience (in mathematics), aesthetic value and aesthetic judgment. The theory is applied in the final part of the volume and is used to account for the three most salient and often used aesthetic terms often used in mathematics: beautiful, elegant and ugly. This application of the theory serves to illustrate the theory in action, but also to further discuss and develop some details and to showcase the theory’s explanatory capabilities
