    Abstract: This book presents the results of an international comparative study on the causes of rule deviation in business and medical organizations. Based on document and interview analyses as well as experiments, the discrepancy between (state) regulations and organizational practice is elaborated and discussed in an interdisciplinary perspective. On the basis of the distinction between organizational and individual deviance, it could be shown across national boundaries that the unwritten rules of the organization make a decisive contribution in explaining organizational wrongdoing, as well as their containment. Implications for effective prevention derived from this are also pointed out.     Abstract: The Civil Rights Act of 1964 provides protections against discrimination based on race, color, religion, sex and national origin. Sexual orientation and gender identity, however, are excluded and LGBTQ citizens can be legally discriminated against in many fundamental areas that others take for granted as a legal right. The LGBTQ community in America comprises approximately 3.4 percent of the US population, or roughly 9 million citizens. Regardless of the size of the population, this book argues, all US citizens deserve the same rights granted under the US constitution - i.e. in addition to marriage equality, LGBTQ citizens deserve equal protection in employment, housing, medical decisions, military service, and adoption - to name but a few. Using social equity theory and intersectionality but written in an accessible style, this book demonstrates some of the ways in which LGBTQ citizens have been marginalized for their identity, and argues that the field of public administration has a unique responsibility to prioritize social equity. Discrete categories utilized by the US Census Bureau (male or female, heterosexual or homosexual), for example, must shift to a continuum to accurately capture demographic characteristics and citizen behavior. Evidenced based outcomes and disparities between heterosexual and LGBTQ populations are carefully delineated to provide a legal rationale for a compelling governmental interest, and policy recommendations are provided - including overdue federal legislation to prohibit discrimination based on sexual orientation.     Abstract: "Colonial rule distorts a colony's economy and its society, and British rule was no exception. British policies led to a stratified American colonial society with slaves on the bottom and white settlers on top. The divided society functioned through laws that imposed rules and defined roles of the respective races. This occurred in other colonies too, often leading to strife that continues today. Especially since World War II the United States seems finally to have been able to remove many laws and practices that had created barriers between races in the divided society. Appeals to legitimacy, such as by abolitionists and the Civil Rights Movement, were essential to change laws from support of the divided society to instruments for disestablishing it. Thanks to the rule of law - another important British legacy -- the U.S. is much farther along than many former colonies in making progress. By highlighting the history of the interplay of two fundamental concepts, the divided society and the rule of law, and briefly contrasting the experiences of other former colonies, this book shows how the United States has made significant long-term progress, although incomplete, and ways for this to continue today"--

    Abstract: "America's constitutional system evolves through the interplay between three cycles: the rise and fall of dominant political parties, the waxing and waning of political polarization, and alternating episodes of constitutional rot and constitutional renewal. America's politics seems especially fraught today because we are nearing the end of the Republican Party's long political dominance, at the height of a long cycle of political polarization, and suffering from an advanced case of "constitutional rot." Constitutional rot is the historical process through which republics become increasingly less representative and less devoted to the common good. Caused by increasing economic inequality and loss of trust, constitutional rot seriously threatens the constitutional system. But America has been through these cycles before, and will get through them again. America is in a Second Gilded Age slowly moving toward a second Progressive Era, during which polarization will eventually recede. The same cycles shape the work of the federal courts and theories about constitutional interpretation. They explain why political parties have switched sides on judicial review not once but twice in the twentieth century. Polarization and constitutional rot alter the political supports for judicial review, make fights over judicial appointments especially bitter, and encourage constitutional hardball. The Constitution ordinarily relies on the judiciary to protect democracy and to prevent political corruption and self-entrenching behavior. But when constitutional rot is advanced, the Supreme Court is likely to be ineffective and may even make matters worse. Courts cannot save the country from constitutional rot; only political mobilization can"--

    Abstract: Krisen werden regelmäßig als Ausnahmen wahrgenommen. Dies erklärt auch, warum sich die rechtliche Auseinandersetzung mit Krisen auf Notstandskonzepte konzentriert. Gleichzeitig hat der Ausnahmezustand im Sinne Carl Schmitts Konjunktur, um bestimmte Krisenphänomene zu erklären. Zu diesen Phänomenen gehört, dass sich das Verständnis und damit der Inhalt bestehender Rechtsnormen in Krisen wandelt. Diese Auslegungsänderungen, häufig auch als Rechtsbrüche angeprangert, werden vor allem durch nichtrechtliche Einflüsse erklärt. Jasper Finke hingegen versteht Auslegungsänderungen in Krisenzeiten als Teil des Rechts. Ausgangspunkt hierfür ist ein Krisenverständnis, für das der Begriff der Erwartung zentral ist. Bei Krisen handelt es sich um Anpassungsprozesse dieser zunächst enttäuschten Erwartungen. Als Normalitätserwartung sind sie aber auch Bestandteil der Auslegung einer Norm. Ändern sich die Erwartungen, spiegelt sich dies im Inhalt der Norm wider.
    Abstract: Conceptualizing crises as part of the normality-exception dichotomy turns a blind eye to the long-term effects of crises, especially the impact they have on the meaning of existing legislation. Jasper Finke reveals why changing interpretations in response to a crisis are to be understood as a process that is inherent to law and not something that is imposed on law.

    Abstract: Die Autorin analysiert und vergleicht die verfassungsrechtlichen und einfachgesetzlichen materiell-rechtlichen und verfahrensrechtlichen Vorgaben zur Familienzusammenführung in Deutschland und den USA. Ein Schwerpunkt der Untersuchung liegt auf dem Schnittpunkt von Einwanderung und dem Schutz der nationalen Sicherheit. Bei der Ausbalancierung der hier vorzufindenden gegenläufigen Interessen spielen Verfahrensrechte eine erhebliche Rolle. Die Autorin geht daher der Frage nach, ob bzw. welche materiellen und prozessualen Rechte einer einreisewilligen Person in einem Konsulat des Zielstaates auf ausländischem Territorium im Visumverfahren zustehen und welche Rechte der stammberechtigten Person in dem Zielstaat selbst zukommen. Die Beantwortung der Frage wird maßgeblich durch die Einbindung eines Staates in eine internationale bzw. supranationale Rechtsordnung bestimmt, weshalb ein besonderer Fokus auf dem Völkerrecht, dem Unionsrecht und dem europäischen Menschenrechtsregime liegt.

    Abstract: American foreign policy in Asia has long been preoccupied with mainland China. But the end of the Cold War and the 1989 Tiananmen massacre have forced the U.S. to think in new ways about the "other" Chinese in Hong Kong and Taiwan. The events at Tiananmen dramatize the human rights dilemma inherent in Hong Kong's scheduled 1997 return to Beijing. And they highlight Taiwan's rapid transformation, initiated in the 1980s, into a freer, democratic society. At the end of the Cold War, Nancy Bernkopf Tucker asserts, these developments challenge the United States to take more seriously than ever its relations with Taiwan and Hong Kong - to approach both not as strategic players in the game of dominoes but as significant forces in their own right
    Abstract: No other study so clearly focuses American thinking on relations with Hong Kong and Taiwan. Surveying post-1945 U.S. ties with both areas in the context of earlier historical interaction, Tucker explores commerce and trade, military imperatives and political priorities, as well as cultural controversies over Westernization and tradition, bringing to light trends and events in the first comprehensive analysis of these relationships. Tucker reexamines Washington's continual efforts to sustain its uncertain friends through economic assistance and military protection in spite of their sometimes divergent goals and antagonistic policies. The U.S. was not above using its Asian clients to further selfish national interests or cold war strategies but in its dealings with the Nationalist Chinese frequently found itself manipulated rather than dominant
    Abstract: In Hong Kong, Tucker probes the changing dimensions of American support for British control of its Crown Colony, the pivotal role of the United States in Hong Kong's burgeoning economy, and Washington's use of Hong Kong as a strategic foothold and a base for espionage. Tucker also investigates the impact of immigrants from Taiwan and Hong Kong in the U.S., ranging from achievements in art and scholarship to gang violence tied to drugs, illegal immigration and politics. The cast of characters in this drama includes political figures - Truman, McCarthy, Eisenhower, Zhou Enlai, Kennedy, Nixon, Deng Xiaoping, Lee Teng-hui, Chiang Kai-shek, and his son and successor Chiang Ching-kuo - but also artists, writers, economists, and soldiers, who enliven the tale as Tucker gracefully and crisply moves through war, revolution, economic dislocation, political upheaval, and cultural confrontation

    Abstract: "Childhood is ideally a time of safety, marked by freedom from the economic, sexual, and political demands that later become part of adult life. For many children, however, particularly those who live in our inner cities, childhood is increasingly a time of danger. The urban war zones of Los Angeles, Chicago, and Washington. D.C., are not unlike the war zones of Beirut, Belfast, and Mozambique. In both worlds, children grow up with firsthand knowledge of terror and violence. This book examines the threat to childhood development posed by living amid chronic community violence. It shows caregiving adults such as teachers, psychologists, social workers, and counselors how they can work together to help children while they are still children--before they become angry, aggressive adults." "Drawing on their extensive fieldwork in war zones around the world, the authors explore the link between a child's response to growing up in an atmosphere of violence and danger, and the social context established for that child by community and caregivers. They reveal the need for establishing predictable, structured, safe environments for children and they show how school-based programs, by providing children with the continuity and regularity that is otherwise lacking in their lives, can enhance children's natural resilience and help ameliorate some of the long-term developmental consequences of living in danger. In addition to providing firsthand accounts of how children growing up in an atmosphere of violence address their situations, the authors also examine the special concerns that relate to the training and support of teachers who deal not only with the violence in the lives of the children they teach, but also with their own personal safety and emotional response to their students' traumas."--BOOK JACKET.
