    Abstract: Intellectual property law has been harmonized by EU law to a considerable extent. At the same time intellectual property rights have converged. The academic discussion has not kept pace with this development. European intellectual property law is often seen through the spectacles of national law; pan-European discussions about issues of Community law seem to be the exception rather than the rule. The contributors to this volume investigate if and to what extent European rules and principles applicable to all intellectual property rights already exist or whether they can be found on the basis of the acquis communautaire and comparative law. In particular, they discuss the merits and the methodology of common principles before turning to several areas of substantive intellectual property law such as grounds of protection, secondary liability and exceptions, to enforcement and finally to the relationship between intellectual property and neighbouring areas of EU law

Balancing a vast geographic and chronological scope with careful attention to the lives of enslaved individuals, this book gives voice to those who lived through the ordeal of slavery and, along the way, shaped French and Native societies. Rather than telling a simple story of colonial domination and Native victimization, Rushforth argues that Indian slavery in New France emerged at the nexus of two very different forms of slavery: one indigenous to North America and the other rooted in the Atlantic world.     Abstract: The more citizens trust their government, the better democracy functions. However, African Americans have long suffered from the lack of equal protection by their government, and the racial discrimination they have faced breaks down their trust in democracy. Rather than promoting democracy, the United States government has, from its inception, racially discriminated against African American citizens and other racial groups, denying them equal access to citizenship and to protection of the law. Civil rights violations by ordinary citizens have also tainted social relationships between racial groups-social relationships that should be meaningful for enhancing relations between citizens and the government at large. Thus, trust and democracy do not function in American politics the way they should, in part because trust is not color blind. Based on the premise that racial discrimination breaks down trust in a democracy, Trust in Black America examines the effect of race on African Americans' lives. Shayla Nunnally analyzes public opinion data from two national surveys to provide an updated and contemporary analysis of African Americans' political socialization, and to explore how African Americans learn about race. She argues that the uncertainty, risk, and unfairness of institutionalized racial discrimination has led African Americans to have a fundamentally different understanding of American race relations, so much so that distrust has been the basis for which race relations have been understood by African Americans. Nunnally empirically demonstrates that race and racial discrimination have broken down trust in American democracy.

    Abstract: Though it is now discredited, totemism once captured the imagination of Sigmund Freud, Émile Durkheim, James Frazer, and other prominent Victorian thinkers. In this lively intellectual history, Robert Alun Jones considers the construction of a theory and the divergent ways religious scholars, anthropologists, psychoanalysts, and cultural theorists drew on totemism to explore and define primitive and modern societies' religious, cultural, and sexual norms. Combining innovative readings of individual scholars' work and a rich portrait of Victorian intellectual life, Jones brilliantly traces the rise and fall of a powerful idea. First used to describe the belief systems of Native American tribes, totemism ultimately encompassed a range of characteristics. Its features included belief in a guardian spirit that assumed the form of an a particular animal; a prohibition against marrying outside the clan combined with a powerful incest taboo; a sacrament in which members of the totemic clan slaughtered a representative of the totemic species; and the tracing of descent through the female rather than the male. These attributes struck a chord with the late Victorian mentality and its obsession with inappropriate sexual relations, evolutionary theory, and gender roles. Totemism represented a set of beliefs that, though utterly primitive and at a great evolutionary distance, reassured Victorians of their own more civilized values and practices.Totemism's attraction to Victorian thinkers reflects the ways in which the social sciences construct their objects of study rather than discovering them. In discussing works such as Freud's Totem and Taboo or Frazer's The Golden Bough, Jones considers how theorists used the vocabulary of totemism to suit their intellectual interests and goals.     Abstract: "The more citizens trust their government, the better democracy functions. However, African Americans have long suffered from the lack of protection by their government, and the racial discrimination they have faced breaks down their trust in democracy. Rather than promoting democracy, the United States government has, from its inception, racially discriminated against African American citizens and other racial groups, denying them equal access to citizenship and to protection of the law. Civil rights violations by ordinary citizens have also tainted social relationships between racial groups -- social relationships that should be meaningful for enhancing relations between citizens and the government at large. Thus, trust and democracy do not function in American politics in the way that they should, in large part because trust is not colour blind. Based on the premise that racial discrimination breaks down trust in a democracy, Trust in Black America examines the effect of race on African Americans' lives. Shayla Nunnally analyzes public opinion data from two national surveys to provide an updated and contemporary analysis of African Americans' political socialization, and to explore how African Americans learn about race. She argues that the uncertainty, risk, and unfairness of institutionalized racial discrimination has led African Americans to have a fundamentally different understanding of American race relations, so much so that distrust has been the basis for which race relations have been understood by African Americans. Nunnally empirically demonstrates that race and racial discrimination have broken down trust in American democracy. Shayla C.     Abstract: Die Potenziale des Alters in der Arbeitswelt sind in der fachöffentlichen Diskussion in Deutschland eng mit der abhängigen Beschäftigung Älterer verknüpft. Das Thema Selbstständigkeit wird bisher vor allem im Hinblick auf Abweichungen vom Normalarbeitsverhältnis eruiert, während Gründungsaktivitäten von Menschen in der zweiten Lebenshälfte in den gerontologischen, soziologischen und demographischen Diskursen weitestgehend außer Acht gelassen werden. Annette Franke untersucht anhand einer empirischen Studie die Identifikation von Dimensionen, Möglichkeiten, Grenzen und Voraussetzungen von Gründungsaktivitäten 50plus in einer alternden Wohlfahrtsgesellschaft. Anschließend werden konkrete Konklusionen – insbesondere für die Soziale Gerontologie und sozialwissenschaftliche Altersforschung – entwickelt und Handlungsempfehlungen für die Sozialpolitik sowie Vorschläge für die Gründungspraxis formuliert.
