    Abstract: Accidents are a forcing function for change in the nuclear industry. While these events can shed light on needed technical safety reforms, they can also shine a light on needed regulatory system reforms. The TEPCO Fukushima Daiichi nuclear power plant (NPP) accident in Japan is the most recent example of this phenomenon, but it is not the only one.

    Abstract: L’accident tragique survenu à la centrale nucléaire de Fukushima Daiichi restera longtemps l’un des événements marquants de l’histoire de l’exploitation commerciale de l’énergie nucléaire. Aux États-Unis, la Nuclear Regulatory Commission (NRC) n’avait pas été confrontée à tant de questions importantes, touchant au coeur même de sa mission, depuis l’accident de Three Mile Island en 1979. Comme sa priorité a été, à juste titre, d’évaluer les mérites techniques des recommandations énoncées dans le rapport de sa Near-Term Task Force (NTTF)1, elle n’a pas accordé autant d’attention aux répercussions réglementaires à long terme de ses actions post-Fukushima. Maintenant qu’il s’est écoulé suffisamment de temps, il me semble utile de prendre le maximum de recul possible pour évaluer l’incidence que la mise en oeuvre de toutes ces actions aura sur notre cadre réglementaire et sur notre approche de la « protection suffisante ».

    Abstract: The tragic accident at the Fukushima Daiichi nuclear power plant (NPP) will long be seen as a seminal event in the history of commercial nuclear power. Within the United States, not since the accident at Three Mile Island in 1979 has the US Nuclear Regulatory Commission (NRC) been confronted with as many important issues, so central to the core of its mission, as have arisen following the Fukushima Daiichi accident. While much of the agency’s attention has rightfully been on the technical merits of the NRC’s Near-Term Task Force (NTTF)1 Report recommendations, the long-term regulatory implications of our post-Fukushima Daiichi actions have not always received similar scrutiny. Now that sufficient time has passed, I believe it is appropriate to take a step back and at a high level see what impact implementation of all these actions will have on our regulatory framework and our approach to adequate protection.     Abstract: Prior to 2004, the map of the European Union seemed to be basically identical to the map of the contracting parties to the Paris Convention on Third Party Liability in the Field of Nuclear Energy of 1960 (thereinafter “the Paris Convention”).1 The 2004 and 2007 enlargements were mainly composed of the contracting parties to the Vienna Convention on Civil Liability for Nuclear Damage of 1963 (thereinafter “the Vienna Convention”).2 In various discussions, the term “nuclear liability patchwork” is used to describe this existing situation.3 One of the problems arising from this “patchwork” is that, while a uniform legal framework was established for matters of jurisdiction and the enforcement of decisions under the authority given to the European Union (“EU”) by the Council Regulation on jurisdiction and the recognition and enforcement of judgements in civil and commercial matters (hereinafter “Brussels Regulation”),4 this overall framework does not apply to particular matters governed by the special conventions to which member states may be contracting parties, see Article 71 of the Brussels Regulation.

    Abstract: Avant 2004, la carte de l’Union européenne coïncidait presque avec celle des parties contractantes à la Convention de Paris de 1960 sur la responsabilité civile dans le domaine de l’énergie nucléaire (ci-après dénommée « Convention de Paris »)1. Les pays qui ont rejoint l’Union européenne (UE) en 2004 et 2007 étaient pour la plupart parties contractantes à la Convention de Vienne de 1963 relative à la responsabilité civile en matière de dommages nucléaires (ci-après dénommée « Convention de Vienne »)2. Plusieurs textes portant sur cette question parlent de patchwork de responsabilité nucléaire » pour décrire cette situation3. L’un des problèmes qui résultent du patchwork est que, même si l’UE dispose d’un cadre juridique uniforme en matière de compétence judiciaire et d’exécution des décisions de justice en vertu du règlement du Conseil concernant la compétence judiciaire, la reconnaissance et l’exécution des décisions en matière civile et commerciale (ci-après dénommé « Règlement de Bruxelles »)4, ce cadre général ne s’applique pas aux matières particulières régies par les conventions spéciales auxquelles les États membres sont parties (cf.
