    Abstract: Law and economics are interdependent. Using a historical case analysis approach, this book demonstrates how the legal process relates to and is affected by economic circumstances. Glen Atkinson and Stephen P. Paschall examine this co-evolution in the context of the economic development that occurred in the nineteenth and early twentieth centuries as well as the impact of the law on that development. Specifically, the authors explore the development of a national market, the transformation of the corporation, and the conflict between state and federal control over businesses. Their focus on dynamic, integrated systems presents an alternative to mainstream law and economics. The authors apply John R. Commons's approach to three main law and economics issues: the changing relationship between corporations and the state, the application of the Commerce Clause and the Fourteenth Amendment of the US Constitution to state and federal regulation of business, and the relationship of antitrust law to industrialization. They provide a valuable linking of law with changing economic circumstances such as antitrust policy changes and the development of the corporate form.     Abstract: The fundamental goal of competition law is to support productivity and innovativeness; in fact, the short-term effect of enforcement actions is often a reduction in product prices. This comprehensive book reports the findings of consumer market studies into a range of goods and services in developing countries in Africa, Asia and Latin America. These country case studies demonstrate the important role that competition authorities can have in assessing the nature of markets and making recommendations to policymakers to improve them. When competition is weak or compromised, extra costs are imposed on consumers. The authors investigate this issue for a wide range of key markets serving consumers individually or collectively, looking also at the hinterland of the distribution chain behind retail sales. They find a pervasive lack of competition in those markets, which not only softens a firms' incentive to improve the efficiency of their operations and the quality of their products, but also reduces the standard of living of consumers, including poor and vulnerable groups.     Abstract: "Reforestation and avoiding deforestation are methods of harnessing nature to tackle global warming - the greatest challenge facing humankind. In this book, Colin Hunt deals comprehensively with the present and future role of forests in climate change policy and practice. The author provides signposts for the way ahead in climate change policy and offers practical examples of forestry's role in climate change mitigation in both developed and tropical developing countries. Chapters on measuring carbon in plantations, their biodiversity benefits and potential for biofuel production complement the analysis. He also discusses the potential for forestry in climate change policy in the United States and other countries where policies to limit greenhouse gas emissions have been foreshadowed. The author employs scientific and socio-economic analysis and lays bare the complexity of forestry markets. A review of the workings of carbon markets, based both on the Kyoto Protocol and voluntary participation, provides a foundation from which to explore forestry's role. Emphasis is placed on acknowledging how forests' idiosyncrasies affect the design of markets for sequestered carbon. The realization of forestry's potential in developed countries depends on the depth of cuts in greenhouse gas emissions, together with in-country rules on forestry. An increase in funding for carbon retention in tropical forests is an immediate imperative, but complexities dictate that the sources of finance will likely be dedicated funds rather than carbon markets."--Back cover

    Abstract: This book discusses the impact of taxation on economic growth, employment, investment, consumption and the environment. The public finance literature commonly distinguishes between three major functions of taxation: the traditional function of raising revenue to finance government expenditure; the distributional function as an instrument to alter the distribution of income and wealth amongst households; and the regulatory function that uses taxation at the benefit of stabilization and other economic policies. Especially after the Second World War, OECD countries have increasingly used taxation to achieve a variety of economic and social objectives. Today many governments use the tax system to stimulate economic growth and employment. Fiscal measures also play a role in creating a favourable climate for business investment and to promote a long-term sustainable environmental policy. Currently, in the debate on global warming, the use of tax instruments to tackle climate change is on the top of the international agenda. The authors aim to provide the reader with the necessary empirical information, while at the same time presenting an overview of the latest theory and best practices. In doing so, many relevant policy issues are touched upon. Based on theoretical and empirical studies and practical experiences in OECD countries, the book establishes guidelines for effective tax policy. The book offers tools for tax design in a globalising economy and the world of the internet with increasing tax competition and a growing battle for companies and brains between countries. The book also presents a 'carrot and stick' model to promote clean technologies, reduce pollution and combat climate change. The message from the authors is straightforward: broad, low, simple, and a shift from income to consumption taxation. These principles are illustrated in a concept proposal for a so-called Second Life Tax system

    Abstract: Agriculture in the New Global Economy examines the extent to which the political economy of agriculture and the food chain is being transformed by globalisation. This book highlights the important changes that have taken place in the agriculture and food system with the spread of globalisation to this traditionally local sector. Structural change and emerging technologies have contributed to this transformation, which has extended to the political environment in which agriculture operates. The authors identify four paradigms that have characterised the governance of agriculture: a traditional dependent-agriculture paradigm; a neo-liberal competitive paradigm; a multifunctional paradigm; and an emergent globalised-production paradigm. The tensions among these paradigms are developed with reference to evidence from the United States and Canada, the EU, Australia, Japan and the Global South. The book analyses the controversy over genetic modification of foodcrops, developments in agricultural trade policy at the multilateral and regional levels, changing national food policy systems, and emerging global governance arrangements for the sector.     Abstract: Although the history of the Common Agricultural Policy (CAP) is dominated by a process of centralisation, growing pressures to integrate agri-environmental problems into the CAP have revealed the need to embrace decentralised approaches in an efficient federal structure. Indeed, in recent years it has become increasingly evident that the agricultural sector must undergo fundamental changes in order to enter an era of sustainable development. The authors do not believe that this will be an easy process, not only because agricultural policies in Europe are dominated by specific interest groups, but primarily because integrating environmental aspects into the CAP requires difficult institutional change at different levels. Centralised decision making at the EU level has characterised recent agricultural policy and the authors argue that centralised and hierarchical governance structures may fail to produce adequate solutions if they are not linked to regional and more diverse institutional arrangements. They demonstrate how these new institutional arrangements should be designed and how this change can be organised. In particular, they highlight the need for cooperation, and the participation of farmers, as a strategy to cope with agri-environmental issues and resource management problems. Addressing the value of co-operative strategies to achieve sustainable development and cope with agri-environmental problems, this book will be of great interest to agricultural economists and those with an interest in ecological reforms of agricultural policies. It will also be particularly relevant to policymakers within EU nations, as well as policymakers within the countries of Eastern and Central Europe who will be amongst the first to be admitted to the EU in the next wave of expansion

    Abstract: This book aims to extend the current research and debate in constitutional economics by using a positive economics approach. Born out of discontent with the current state in constitutional economics, this book presents an inquiry in the possibilities of a positive constitutional economics, and how societies choose their constitutional rules. Drawing on economics, the book examines the emergence of constitutions and how and why they change over time. The author proposes that model constitutions are based on, and backed by institutions which have developed spontaneously. He presents some predictions on the scope of constitutional change under various constitutional settings and factors which cause constitutional change. Stefan Voigt concludes that constitutional change is reconceptualized as the outcome of a bargaining game, in which changes reflect the altered bargaining power of the actors.     Abstract: Global Environmental Change and Agriculture offers a comprehensive perspective on the causes, consequences and possible policy solutions for climatic change as we move into the twenty-first century. It assesses the impact of potential future global climate change on agriculture and the need to sustain agricultural growth for economic development. The book begins by examining the role of international research institutions in overcoming environmental constraints on sustainable agricultural growth and economic development. The authors then discuss how agricultural research systems may be restructured to respond to global environmental problems such as climate change and loss of genetic diversity. The discussion then extends to consider environmental accounting and indexing, to illustrate how environmental quality can be included formally in measures of national income, social welfare and sustainability. The third part of the book focuses on the effects of and policy responses to climate change. Chapters examine the effect of climate change on production, trade, land use patterns and livelihoods. They consider impacts on the distribution of income between developed and developing countries and between different social classes within the developing world, where agriculture remains a major economic activity.     Abstract: This timely book focuses on the liberalization of agricultural policy and questions whether it is compatible with the goal of achieving economic and environmental sustainability in the European Union. It presents an invaluable contribution to the growing literature on the sustainability and policy aspects of trade liberalization, focusing on European agriculture. Agriculture, Trade and the Environment discusses quantitative methods for the assessment of agriculture-environment trade-offs for policy analysis at the firm, regional or national levels. It also presents the experience of countries in Europe, with particular regard to the impact of the reform of the Common Agricultural Policy and the repercussions of the Uruguay Round. Using a wide range of analytical and quantitative tools, country case studies examine agricultural areas in Austria, Scotland, Italy, Spain, Greece and Estonia. The authors then go on to look at future developments in an enlarged EU context. They conclude that efficient policies for environmental management in the EU need to be tailored to fit local conditions. Any attempt to impose uniform policies across a region as environmentally and economically diverse as Europe will have widely divergent and unintended consequences.
