Abstract: 'Racial Reconciliation and the Healing of a Nation' is a collection of works that invites readers to think beyond law and rights and to examine the social, political, cultural, and psychological factors that fuel racial antagonism as well as other factors that might facilitate racial reconciliation. In doing so, this work offers varying ideas about the meaning of racial reconciliation and differing visions of what it would look like were it to be achieved. In those ideas and visions it calls attention to questions of power and the limits of the nation state. The work offers both a critical analysis of the barriers to progress and an examination of strategies beyond law and rights for moving America down the road toward racial reconciliation.

Abstract: The work at hand for bridging the racial divide in the United States From Baltimore and Ferguson to Flint and Charleston, the dream of a post-racial era in America has run up against the continuing reality of racial antagonism. Current debates about affirmative action, multiculturalism, and racial hate speech reveal persistent uncertainty and ambivalence about the place and meaning of race - and especially the black/white divide - in American culture. They also suggest that the work of racial reconciliation remains incomplete. Racial Reconciliation and the Healing of a Nation seeks to assess where we are in that work, examining sources of continuing racial antagonism among blacks and whites. It also highlights strategies that promise to promote racial reconciliation in the future. Rather than revisit arguments about the importance of integration, assimilation, and reparations, the contributors explore previously unconsidered perspectives on reconciliation between blacks and whites. Chapters connect identity politics, the rhetoric of race and difference, the work of institutions and actors in those institutions, and structural inequities in the lives of blacks and whites to our thinking about tolerance and respect. Going beyond an assessment of the capacity of law to facilitate racial reconciliation, Racial Reconciliation and the Healing of a Nation challenges readers to examine social, political, cultural, and psychological issues that fuel racial antagonism, as well as the factors that might facilitate racial reconciliation

Abstract: The work at hand for bridging the racial divide in the United States From Baltimore and Ferguson to Flint and Charleston, the dream of a post-racial era in America has run up against the continuing reality of racial antagonism. Current debates about affirmative action, multiculturalism, and racial hate speech reveal persistent uncertainty and ambivalence about the place and meaning of race – and especially the black/white divide – in American culture. Going beyond an assessment of the capacity of law to facilitate racial reconciliation, Racial Reconciliation and the Healing of a Nation challenges readers to examine social, political, cultural, and psychological issues that fuel racial antagonism, as well as the factors that might facilitate racial reconciliation.

Abstract: The scholars who contribute to this issue utilize diverse research methods to examine the lived experiences of people engaged in prostitution and the people and institutions that process them. They look at the production of knowledge about prostitution and trafficking by institutional stakeholders, and how legal responses to prostitution and trafficking are affected by class, race, ethnicity, and migration. Drawing on data derived from innovative research methods including auto-ethnography, re-calculation of historical data, and participatory methods, the authors challenge us to re-examine the pro-sex/abolitionist divide, the historical theories of prostitution and ethical concerns around research with people engaged in prostitution. Instead our authors offer new configurations of sex, gender, and prostitution to better inform future scholarship, policy, and programming

Abstract: "Over the last several decades legal scholars have plumbed law's rhetorical life. Scholars have done so under various rubrics, with law and literature being among the most fruitful venues for the exploration of law's rhetoric and the way rhetoric shapes law. Today, new approaches are shaping this exploration. Among the most important of these approaches is the turn toward history and toward what might be called an 'embedded' analysis of rhetoric in law. Historical and embedded approaches locate that analysis in particular contexts, seeking to draw our attention to how the rhetorical dimensions of legal life works in those contexts. Rhetorical Processes and Legal Judgments seeks to advance that mode of analysis and also to contribute to the understanding of the rhetorical structure of judicial arguments and opinions"--

Abstract: "Deception and Truth-Telling in the American Legal System Law has a strangely complicated relationship to deception. Though it sometimes takes a hard line on behalf of truth - "the truth, the whole truth, and nothing but the truth," - competing values often cause law to look the other way. How and why is lying alternately accepted, condemned, or prosecuted? What are the government's interests in allowing or disallowing lying? Law and Lies is the first book to thematically address the role of lying in the American legal system. Undercover police agents are permitted to lie in the name of catching criminals, and government officials are permitted to lie in service of national security. In the case of the military's "Don't Ask, Don't Tell" policy, lying was not only permitted, but actively encouraged. A range of illuminating case studies reveal that the government's tolerance of deception is rarely as simple as the "whole truth.""--

Abstract: "Throughout American history, the discourse of civility has proven quite resilient, and concern for a perceived lack of civility has ebbed and flowed in recognizable patterns. Today we are in another era in which political leaders and commentators bemoan a crisis of incivility and warn of civility's demise. Civility, Legality, and the Limits of Justice charts the uses of civility in American legal and political discourse. How important is civility as a legal and political virtue? How does it fare when it is juxtaposed with the claim that it masks injustice? Who advocates civility and to what effect? How are battles over civility played out in legal and political arenas? This book brings the work of several distinguished scholars together to critically assess the relative claims of civility and justice and the way law weighs those virtues"--

Abstract: Throughout American history, the discourse of civility has proven quite resilient, and concern for a perceived lack of civility has ebbed and flowed in recognizable patterns. Today we are in another era in which political leaders and commentators bemoan a crisis of incivility and warn of civility's demise. Civility, Legality, and Justice in America charts the uses of civility in American legal and political discourse. How important is civility as a legal and political virtue? How does it fare when it is juxtaposed with the claim that it masks injustice? Who advocates civility and to what effect? How are battles over civility played out in legal and political arenas? This book brings the work of several distinguished scholars together to critically assess the relative claims of civility and justice and the way law the weighs those virtues

Abstract: "Merciful Judgments in Contemporary Society: Legal Problems/Legal Possibilities explores the tension between law's need for and dependence on merciful judgments and suspicions that regularly accompany them. Rather than focusing primarily on definitional questions or the longstanding debate about the moral worth and importance of mercy, this book focuses on mercy as a part of, and problem, for law. Whether one starts from a worry about rules and discretion, about the attitudes of citizens and their leaders, or ways to undo the past, merciful judgments challenge and perplex, just as they help to sustain, our legal system. Charting these possibilities and problems is the work that this book seeks to do. Here we ask what challenges merciful judgments pose for law? When and why do those judgments encourage and nurture legal ingenuity and resourcefulness? When and why do they precipitate crises and breakdowns in legal authority? This book is a product of The University of Alabama School of Law symposia series on "Law, Knowledge & Imagination." This series explores the ways law is known and imagined in a diverse array of disciplines, including political science, history, cultural studies, philosophy, and science. In addition, books produced through the Alabama symposia explore various conjunctions of law, knowledge, and imagination as they play out in debates about theory and policy and speak to venerable questions as well as contemporary issues"--

Abstract: "There is an enormous scholarly literature on law's treatment of religion. Most scholars now recognize that although the U.S. Supreme Court has not offered a consistent interpretation of what 'non-establishment' or religious freedom means, as a general matter it can be said that the First Amendment requires that government not give preference to one religion over another or, although this is more controversial, to religion over non-belief. But these rules raise questions that will be addressed in Legal Responses to Religious Practices in the United States: namely, what practices constitute a 'religious activity' such that it cannot be supported or funded by government? And what is a religion, anyway? How should law understand matters of faith and accommodate religious practices?"--

Abstract: How and why has the concept of responsibility come to pervade the fabric of American public and private life? How are ideas of responsibility instantiated in, and constituted by, the workings of social and political institutions? What place do liberal discourses of responsibility, based on the individual, have in todayGs biopolitical world, where responsibility is so often a matter of risk assessment, founded in statistical probabilities? Bringing together the work of scholars in anthropology, law, literary studies, philosophy, and political theory, the essays in this volume show how state and private bureaucracies play crucial roles in fashioning forms of responsibility, which they then enjoin on populations. How do government and market constitute subjects of responsibility in a culture so enamored of individuality? In what ways can those entitiesGcentrally, in modern culture, those engaged in ensuring individuals against loss or harmGthemselves be held responsible, and by whom?.

Abstract: This volume of "Studies in Law, Politics, and Society" presents a diverse array of articles by an interdisciplinary group of scholars. Their work covers several social science disciplines as well as law. Some of the articles published in this issue examine the interactions of law and "vulnerable" populations. Here research illustrates the complex ways law can be used by those groups, as well as the impact of law on their lives. Other articles focus on indigenous groups and particular legal controversies in which they are involved. Taken together they exemplify the exciting and innovative work now being done in interdisciplinary legal scholarship

Their work covers political science, policy studies, and law. Some of the articles published in this issue focus on the sources of conflict and violence as well as law's response to both. Taken together they exemplify the exciting and innovative work now being done in interdisciplinary legal scholarship. An interdisciplinary volume that discusses political science, policy science and law, this book is divided into two parts: conflict, violence, and legal processes; and deciding cases, charting progress. It uses case law examples to examine issues
