    Abstract: All societies must deal with the possibility of violence, and they do so in different ways. This book integrates the problem of violence into a larger social science and historical framework, showing how economic and political behavior are closely linked. Most societies, which we call natural states, limit violence by political manipulation of the economy to create privileged interests. These privileges limit the use of violence by powerful individuals, but doing so hinders both economic and political development. In contrast, modern societies create open access to economic and political organizations, fostering political and economic competition. The book provides a framework for understanding the two types of social orders, why open access societies are both politically and economically more developed, and how some 25 countries have made the transition between the two types

    Abstract: Dienen politische Parteien dem Gemeinwohl oder vertreten sie nur Teil- oder Eigeninteressen? Dies war eine der Grundfragen, die auf der Tagung „Gemeinwohl und politische Parteien“ kontrovers diskutiert wurden. Der Band stellt die Erträge dar. In Hinblick auf die politischen Parteien wird die Gemeinwohlproblematik umfassend gewürdigt. Ausgangspunkt der Diskussion ist dabei der von alten Ressentiments getragene Vorwurf, die Tätigkeit der Parteien laufe dem Gemeinwohl zuwider. Die parteiengetragene Politik wird sowohl als Mitproduzent des Gemeinwohls als auch als Hindernis der Gemeinwohlrealisierung betrachtet. Nach einem Einführungsvortrag zum Begriff des Gemeinwohls, folgen ein juristischer und ein politikwissenschaftlicher Grundlagenvortrag. Im Anschluss werden spezielle Aspekte der Gemeinwohlproblematik behandelt und diskutiert. Ein weiterer Themenblock richtet den Blick auf unterschiedliche Formen der Entscheidungsfindung. Zum Abschluss wird ein Blick in andere Rechtskulturen der Gemeinwohlfindung gewagt

    Abstract: Die Beschwörung einer »Leitkultur« und die Warnungen vor den Gefahren einer Parallelgesellschaft sind für die Integration von Migranten mehr hinderlich als befördernd. Werner Schiffauer plädiert mit diesem Buch dagegen für einen neuen Realismus, für eine Kultur des genauen Hinsehens. Mit Blick auf die Lebensrealität in Einwanderervierteln und islamischen Gemeinden zeigt er, wie gesellschaftliche Solidarität auch in Situationen kultureller Differenz entstehen und behauptet werden kann. Es sind weniger gemeinsame Werte und Überzeugungen, die für den inneren Zusammenhalt einer Gesellschaft entscheidend sind, als vielmehr die Aufrechterhaltung von kulturellen Austauschprozessen. Mehr denn je ist daher eine kluge Politik der Differenz gefragt, die auf Anerkennung und kommunikative Einbindung setzt statt auf Eindeutigkeitszwänge. Die Perspektive verschärft sich im Zusammenhang mit der Diskussion um die Entstehung der Biopolitik bei Michel Foucault, der die Lager auf Praktiken der Produktion von Leben und die politische Kontrolle von Populationen seit dem 18. Jahrhundert zurückführt.     Abstract: The book provides a comprehensive analysis of the advisory role of the International Court of Justice in light of its jurisprudence and overall contribution over a period of more than 55 years. The author highlights the `organic connection` between UN organs and the Court and the Courts contribution as one of the UNs principal organs to the Organisation. The basic argument of this study is that the advisory function should be understood as a two-sided process involving the interplay between UN organs and the ICJ. The request for and the giving of an advisory opinion is a collective coordinated process, involving more than one organ or part of the Organisation. The author concludes that the Courts role as a participant in the UNs work is circumscribed by its duty to act judicially. In practice, the Court has succeeded in establishing a balance between its role as a principal organ of the UN and its position as a judicial institution with a duty to administer justice impartially.

    Abstract: This book contributes to the ongoing revision of early modern British history by examining the apocalyptic tradition through the life and writings of Joseph Mede (1586-1638). The history of the British apocalyptic tradition has yet to undergo a thorough revision. Past studies followed a historiographical paradigm which associated millenarianism with a revolutionary agenda. A careful study of Joseph Mede, one of the key individuals responsible for the rebirth of millenarianism in England, suggests a different picture of seventeenth-century apocalypticism. The roots of Mede's apocalyptic thought are not found in extreme activism, but in the detailed study of the Apocalypse with the aid of ancient Christian and Jewish sources. Mede's legacy illustrates the geographical prevalence and long-term sustainability of his interpretations. This volume shows that the continual discussion of millenarian ideas reveals a vibrant tradition that cannot be reconstructed to fit within one simple historiographical narrative.

    Abstract: Long description: Diese Publikation zur Erforschung der historischen Entwicklung einer „Wissenschaft Soziale Arbeit" am Beispiel des in Vergessenheit geratenen (Armenpflege)Konzeptes „De subventione pauperum" (1526) des spanischen Humanisten, Voraufklärers, Europäers und Sozialreformers jüdischer Herkunft, Juan Luis Vives (1492-1540), möchte eine Lücke schließen. Vives war Vertreter einer dramatischen Übergangsepoche vom Mittelalter zur frühen Neuzeit. Hier ergeben sich vergleichbare schwierige Herausforderungen, wie sie Übergangszeiten immer charakterisieren, und wie wir sie auch heute unter dem Umbau des Sozialstaates (wieder) zu bewältigen haben. Die frühneuzeitliche Armenpflege war gekennzeichnet durch eine Form der „Sozialdisziplinierung", die durch „Individualisierung", „Kommunalisierung", „Pädagogisierung" und „Bürokratisierung" die Masse entwurzelter Menschen zu grundlegenden Verhaltensveränderungen und Anpassungen zu bringen suchte. Dies bedeutet(e) bis in die heutige Zeit hinein für Empfänger öffentlicher Leistungen, sich rechtfertigen zu müssen, warum sie diese Leistungen beanspruch(t)en. Vives hat auf dem Fundament der abendländisch jüdisch-christlichen Gerechtigkeits- und Verpflichtungsethik eine kritische Gesellschaftsanalyse seiner Epoche vorgenommen. Der historische Rahmen seiner anrührenden Biographie im Schatten der Inquisition und die sozialpolitische Konzeption dieses Humanisten stehen im Mittelpunkt der Untersuchung.

    Abstract: The Killing Trap, first published in 2005, offers a comparative analysis of the genocides, politicides and ethnic cleansings of the twentieth century, which are estimated to have cost upwards of forty million lives. The book seeks to understand both the occurrence and magnitude of genocide, based on the conviction that such comparative analysis may contribute towards prevention of genocide in the future. Manus Midlarsky compares socio-economic circumstances and international contexts and includes in his analysis the Jews of Europe, Armenians in the Ottoman Empire, Tutsi in Rwanda, black Africans in Darfur, Cambodians, Bosnians, and the victims of conflict in Ireland. The occurrence of genocide is explained by means of a framework that gives equal emphasis to the non-occurrence of genocide, a critical element not found in other comparisons, and victims are given a prominence equal to that of perpetrators in understanding the magnitude of genocide

    Abstract: Liberal defences of nationalism have become prevalent since the mid-1980's. Curiously, they have largely neglected the fact that nationalism is primarily about land. Should liberals throw up their hands in despair when confronting conflicting claims stemming from incommensurable national narratives and holy texts? Should they dismiss conflicting demands that stem solely from particular cultures, religions and mythologies in favour of a supposedly neutral set of guidelines? Does history matter? Should ancient injustices interest us today? Should we care who reached the territory first and who were its prior inhabitants? Should principles of utility play a part in resolving territorial disputes? Was John Locke right to argue that the utilisation of land counts in favour of its acquisition? And should western style settlement projects work in favour or against a nation's territorial demands? When and how should principles of equality and equal distribution come into play? Territorial Rights examines the generic types of territorial claims customarily put forward by national groups as justification for their territorial demands, within the framework of what has come to be known as 'liberal nationalism'. The final outcome is a multifarious theory on the ethics of territorial boundaries that supplies a workable set of guidelines for evaluating territorial disputes from a liberal-national perspective, and offers a common ground for discussion (including disagreement) and for the mediation of claims.

    Abstract: A new theory of ethnic cleansing based on the most terrible cases (colonial genocides, Armenia, the Nazi Holocaust, Cambodia, Yugoslavia, Rwanda) and cases of lesser violence (early modern Europe, contemporary India, and Indonesia). Murderous cleansing is modern, 'the dark side of democracy'. It results where the demos (democracy) is confused with the ethnos (the ethnic group). Danger arises where two rival ethno-national movements each claims 'its own' state over the same territory. Conflict escalates where either the weaker side fights because of aid from outside, or the stronger side believes it can deploy sudden, overwhelming force. Escalation is not simply the work of 'evil elites' or 'primitive peoples'. It results from complex interactions between leaders, militants, and 'core constituencies' of ethno-nationalism. Understanding this complex process helps us devise policies to avoid ethnic cleansing in the future
