    Abstract: The private international law of intellectual property is currently much debated both in Europe and abroad. Art. 8 of the Rome II Regulation of 2007, which codifies a territorial approach for the infringement of intellectual property, has provoked an intensive discussion in Europe as to whether the lex loci protection is still appropriate for intellectual property litigation in the age of worldwide networks. A condensed outcome of this debate is summarized in the »Principles for Conflict of Laws in Intellectual Property« (CLIP Principles) drafted by the European Max Planck Group on Conflict of Laws in Intellectual Property (CLIP), published recently in a second preliminary draft. On the international scale, the American Law Institute's »Intellectual Property: Principles Governing Jurisdiction, Choice of Law, and Judgments in Transnational Disputes« of 2007 (ALI Principles) are the focal point of the debate. A Japanese project (»Transparency Proposal«) was finalized in 2009. This volume provides a comparative analysis of the three proposals. It compiles papers presented at an international conference held in Tokyo in May 2009

In 1957, the renowned geographer Jean Gottman applied the term in his description of the densely populated area of the northeastern United States that includes the cities of Boston, New York, Philadelphia, Baltimore, and Washington.     Abstract: Leaders around the globe have long turned to the armed forces as a "school for the nation." Debates over who serves continue to arouse passion today because the military's participation policies are seen as shaping politics beyond the military, specifically the politics of identity and citizenship. Yet how and when do these policies transform patterns of citizenship? Military service, Ronald R. Krebs argues, can play a critical role in bolstering minorities' efforts to grasp full and unfettered rights. Minority groups have at times effectively contrasted their people's battlefield sacrifices to the reality of inequity, compelling state leaders to concede to their claims. At the same time, military service can shape when, for what, and how minorities have engaged in political activism in the quest for meaningful citizenship. Employing a range of rich primary materials, Krebs shows how the military's participation policies shaped Arab citizens' struggles for first-class citizenship in Israel from independence to the mid-1980s and African Americans' quest for civil rights, from World War I to the Korean War. Fighting for Rights helps us make sense of contemporary debates over gays in the military and over the virtues and dangers of liberal and communitarian visions for society. It suggests that rhetoric is more than just a weapon of the weak, that it is essential to political exchange, and that politics rests on a dual foundation of rationality and culture

Today's postmodern family is under enormous stress. And as a result, the needs of hurried children have been sacrificed to the needs of their harried parents. Childhood innocence has been supplanted by the illusion of childhood competence; teenage immaturity has given way to pseudo-sophistication; and parental intuition has been traded in for a mechanical reliance on technique. These changes and a host of others have undermined the well-being of children and adolescents. From Freud to Friedan to Foucault, Elkind traces the roots of the postmodern family back to the failure of the modern nuclear family and its supporting institutions - the media, the so-called helping professions, the legal system, and the schools - to meet the needs of parents. The new postmodern family is more flexible, more permeable, more urbane, but also out of balance because it fails to meet the needs of children. Treated like miniature adults, today's children and adolescents go without the protection and security they need, while their once-sheltered baby-boomer parents, facing new economic pressures for which they are unprepared, secretly wonder why they've never really felt like grown-ups. But all is not bleak. Elkind finds evidence of an emerging vital family that melds the best of the modern and postmodern, one in which the needs of all family members are held in a dynamic, if delicate, balance. Many books have decried the decline in family values, the negative impact of divorce, the increase in single-mother families, and impoverished prospects for our children. But none has pulled all these fragments together as Elkind's does and put them into a solid framework, one that finally makes sense of the way we were, and what we as families may become

    Abstract: "In this forcefully argued book, Eileen McDonagh and Laura Pappano show in vivid detail how women have been unfairly excluded from participating in sports on an equal footing with men. Using powerful examples from the world of contemporary American athletics - girls and women trying to break through in football, ice hockey, wrestling, and baseball to name just a few - the authors show that sex differences are not sufficient to warrant women's coercive exclusion from competing with men; that some sex-group difference actually confer a sports advantage to women; and that "special rules" for women in sports do not simply reflect the "differences" between the sexes, but actively create and reinforce a view that women as a group are inherently inferior to men - even when women clearly are not. For instance, women's bodies give them a physiological advantage in endurance sports like the ultra-marathon and distance swimming. So, why do many Olympic events - from swimming to skiing to running to bike racing - have shorter races for women than men? Likewise, why are women's tennis matches limited to three sets while men's are best-of-fives?     Abstract: Although Iraq remains hostile to the United States, Baghdad has repeatedly compromised, and at times caved, in response to U.S. pressure and threats. An analysis of attempts to coerce Iraq since Desert Storm reveals that military strikes and other forms of pressure that threatened Saddam Husayn's relationship with his power base proved effective at forcing concessions from the Iraqi regime. When coercing Saddam or other foes, U.S. policymakers should design a strategy around the adversary's "center of gravity" while seeking to neutralize adversary efforts to counter-coerce the United States and appreciating the policy constraints imposed by domestic politics and international alliances

    Abstract: This paper presents the writing of an inmate, Whispers, who participated in a writing project taught by the author at San Quentin State Prison. The inmate was a student in a class called Write Your Life and it was in that class that he wrote Storm on the Horizon, a story he would author/re-author three times. Through the process of re-authoring he creates a story situated in the real world that ultimately helps him in rendering new meaning from his lived experience. Re-authoring his story allowed Whispers to explore varying perspectives that succeed in making his experience comprehensible.

    Abstract: The roots of pragmatics reach back to Antiquity, especially to rhetoric as one of the three liberal arts. However, until the end of the 18th century proto-pragmatic insights tended to be consigned to the pragmatic, that is rhetoric, wastepaper basket and thus excluded from serious philosophical consideration. It can be said that pragmatics was conceived between 1780 and 1830 in Britain, but also in Germany and in France in post-Lockian and post-Kantian philosophies of language.     Abstract: This book takes an historical look at the sterilization movement in post-World War II America, a revolution in modern contraceptive behavior. Focusing on leaders of the sterilization movement from the 1930's through the turn of the century, this book explores the historic linkages between environment, civil liberties, eugenics, population control, sex education, marriage counseling, and birth control movements in the 20th-century United States. Sterilization has been variously advocated as a medical procedure for defusing the "population bomb," expanding individual rights, liberating women from the fear of pregnancy, strengthening marriage, improving the quality of life of the mentally disabled, or reducing the incidence of hereditary disorders. From an historical standpoint, support for free and unfettered access to sterilization services has aroused opposition in some circles, and was considered a "liberal cause" in post-World War II America. This story demonstrates how a small group of reformers helped to alter traditional notions of gender and sexuality. --From publisher's description

    Abstract: David Gere, who came of age as a dance critic at the height of the AIDS epidemic, offers the first book to examine in depth the interplay of AIDS and choreography in the United States, specifically in relation to gay men. The time he writes about is one of extremes. A life-threatening medical syndrome is spreading, its transmission linked to sex. Blame is settling on gay men. What is possible in such a highly charged moment, when art and politics coincide? Gere expands the definition of choreography to analyze not only theatrical dances but also the protests conceived by ACT-UP and the NAMES Project AIDS quilt. These exist on a continuum in which dance, protest, and wrenching emotional expression have become essentially indistinguishable. Gere offers a portrait of gay male choreographers struggling to cope with AIDS and its meanings.--Publisher description

    Abstract: This is the first major attempt to analyze the slave narratives in the Federal Writers' Project. Escott read nearly 2,400 narratives to establish 81 categories of information for computer analysis. Tables presenting this data are set within a well-organized text that includes many quotations.
