    Abstract: This paper analyses institutional reforms and political participation, most notably indirect and direct elections of residential committees (RC), in China's urban neighbourhoods and communities (shequ). It shows that these elections at present are not meaningful to the majority of city dwellers as the RCs have little decision-making power and no revenues generated by a collective economy as in most of China's villages. RCs are primarily important to those weaker strata of society who depend on the state to be provided with social services and financial support - tasks that the RCs are forced to assume on behalf of higher government authorities. Nevertheless, the author finds that as limited the significance of - and knowledge about - RC elections in the daily lives of China's urban dwellers still are, they still have some influence on political awareness and participation. For instance, they make people voice more opinions in their shequ, which may be a good starting point for more direct interference in local political affairs soon to come. The paper emphasizes that RC elections have been introduced in order to enhance regime legitimacy but suggests that they may spur democratization by the rise of accountability as a conditioning factor of this legitimacy and by electoral 'habituation' as a transition to full democratic commitment. Whilst 'security first, participation second' seems to be the order of the day and the 'freedom of politics' is still more important than a concern for RC elections and shequ affairs, it remains to be seen if those elections may not soon trigger off a meaningful drive for political participation in China's cities.

    Abstract: Based on the expertise of thirty leading experts on confiscation in the EU, this is the first book to analyse the practice of proceeds from crime confiscation in the original fifteen EU Member States. It examines the implementation of confiscation provisions in all three (investigative, judicial and disposal) phases of confiscation proceedings. It quantifies the enforcement of confiscation provisions in the EU, using an innovative and unique methodology and thereby furnishes understanding of obstacles and best practices.     Abstract: Prior to the third century A.D., two broad Roman conceptions of frontiers proliferated and competed: an imperial ideology of rule without limit coexisted with very real and pragmatic attempts to define and defend imperial frontiers. But from about A.D. 250-500, there was a basic shift in mentality, as news from and about frontiers began to portray a more defined Roman world—a world with limits—allowing a new understanding of frontiers as territorial and not just as divisions of people. This concept, previously unknown in the ancient world, brought with it a new consciousness, which soon spread to cosmology, geography, myth, sacred texts, and prophecy. The “frontier consciousness” produced a unified sense of Roman identity that transcended local identities and social boundaries throughout the later Empire.

    Abstract: Rights language is a fundamental feature of the modern world. Virtually all significant social and political struggles are waged, and have been waged for over a century now, in terms of rights claims. In some ways, it is precisely the birth of modern rights language that ushers in modernity in terms of moral and political thought, and the struggle for a modern way of life seems for many synonymous with the fight for a universal recognition of equal, individual human rights. Where did modern rights language come from? What kinds of rights discourses is it rooted in? What is the specific nature of modern rights discourse, when and where were medieval and ancient notions of rights transformed into it? Can one in fact find any single such transformation of medieval into modern rights discourse? This book brings together some of the most central scholars in the history of medieval and early-modern rights discourse. Through the different angles taken by its authors, the volume brings to light the multifaceted nature of rights languages in the medieval and early modern world.

    Abstract: "Liberal theories have long insisted that cultural diversity in democratic societies can be accommodated through classical liberal tools, in particular through individual rights, and they have often rejected the claims of cultural minorities for group rights as illiberal. Group Rights as Human Rights argues that such a rejection is misguided. Based on a thorough analysis of the concept of group rights, it proposes to overcome the dominant dichotomy between ""individual"" human rights and ""collective"" group rights by recognizing that group rights also serve individual interests. It also challenges the claim that group rights, so understood, conflict with the liberal principle of neutrality, on the contrary, these rights help realize the neutrality ideal as they counter cultural biases that exist in Western states. Group rights deserve to be classified as human rights because they respond to fundamental, and morally important, human interests. Reading the theories of Will Kymlicka and Charles Taylor as complementary rather than opposed, Group Rights as Human Rights sees group rights as anchored both in the value of cultural belonging for the development of individual autonomy and in each person's need for a recognition of her identity. This double foundation has important consequences for the scope of group rights: it highlights their potential not only in dealing with national minorities but also with immigrant groups, and it allows to determine how far such rights should also benefit illiberal groups. Participation, not intervention, should here be the guiding principle if group rights are to realize the liberal promise."

    Abstract: This book analyses the interrelationship of recordkeeping, ethics and law in terms of existing regulatory models and their application to the Internet. It proposes an Internet model based on the notion of a legal and social relationship as a means of identifying the legal and ethical rights and obligations of recordkeeping participants in networked transactions. It also provides a unique approach to property, access, privacy and evidence for online records.
    Abstract: Distributed networks such as the Internet have altered the fundamental way a record is created, captured, accessed and managed over time. Law and ethics provide the major sources of regulatory controls over participants in such networks. This book analyses the interrelationship of recordkeeping, ethics and law in terms of existing regulatory models and their application to the Internet environment. It proposes an Internet model based on the notion of a legal and social relationship as a means of identifying the legal and ethical rights and obligations of recordkeeping participants in networked transactions. Medical, business and governmental relationships within communities of common interest based on trust illustrate the practical application of the model. As legal relationships have their basis in the law of obligations found in common and civil law systems, as well as archival science, the model has a broad-based application. The relationship model also provides a unique ethical and legal approach to property, access, privacy and evidence. Most importantly, the book provides an interdisciplinary approach to Internet regulation, which contributes to closer ties between those who research, teach and work in fields of ethics, law and archival science.

    Abstract: "The accession of eight post-communist countries of Central and Eastern Europe (and also of Malta and Cyprus) to the European Union in 2004 has been heralded as perhaps the most important development in the history of European integration so far. While the impact of the enlargement on the constitutional structures and practices of the EU has already generated a rich scholarly literature, the influence of the accession on constitutionalism, democracy, human rights and the rule of law among the new member states has been largely ignored. This book fills this gap, and addresses the question of the consequences of the ""external force"" of European enlargement upon the understanding and practice of democracy and the rule of law and among both the main legal-political actors and the general public in the new member-states. A number of leading legal scholars, sociologists and political scientists, both from Central and Eastern Europe and from outside, address these issues in a systematic and critical way. This comprehensive study analyses these issues and strives for reasonable and generally acceptable solutions.
    Abstract: The general international law regarding foreign merchant ships in internal waters has never been codified. Despite the codification efforts made by the League of Nations and the Geneva Convention on the Territorial Sea and the Contiguous Zone of 1958, the question of the breadth of the territorial sea was finally solved during the Third United Nations Conference on the Law of the Sea. In addition, the right of innocent passage of foreign ships has been regulated in the 1982 Convention in greater detail than ever before, whilst the new regime on the prevention of marine pollution in the Convention has also considerable impact on this right. In practice, potential conflicts between coastal States and foreign merchant ships in internal waters and the territorial sea may well arise. This comprehensive study analyses these issues and cautiously strives for reasonable and generally acceptable solutions.

    Abstract: Entgegen der heute üblichen Verengung der Sterbehilfediskussion auf die Selbstbestimmung am Lebensende fordert Eva Schumann ein Umdenken im Umgang mit schwerkranken und sterbenden Menschen. Um deren Bedürfnissen gerecht zu werden, ist nach ihrer Auffassung ein flächendeckender Zugang zu ambulanten und stationären Palliativeinrichtungen, eine Verbesserung der Betreuung in Alten- und Pflegeheimen sowie Angebote zur stärkeren Einbindung von Angehörigen in die Pflege erforderlich. Diese Forderungen stehen am Ende einer kritischen Würdigung der unter dem Begriff der Sterbehilfe diskutierten Fallgruppen der Hilfe im Sterben (indirekte Sterbehilfe) einerseits und der Hilfe zum Sterben (aktive und passive Sterbehilfe) andererseits. Unter Einbeziehung historischer, interdisziplinärer und rechtsvergleichender Aspekte wird eindringlich dargelegt, dass die formaljuristische Differenzierung zwischen den einzelnen Fallgruppen der Sterbehilfe nicht hinreichend die soziale Dimension des Sterbens berücksichtigt.
    Abstract: Contrary to the common constriction of the euthanasia-discussion on “self-determination at the end of life" Eva Schumann claims rethinking in dealing with seriously ill and dying people. To meet their needs in her view a comprehensive access to outpatient and inpatient palliative care facilities is recquired and also improvements of care in nursing homes as well as offers to improve the integration of members into care. These claims conclude the discussion between assistance in dying (indirect euthanasia), and assistance to die (active and passive euthanasia). Taking account historical, interdisciplinary and comparative law issues it is demonstrated that the formal legal distinction between the various case groups of euthanasia not sufficiently takes into account the social dimension of dying

Case Closed challenges the prevailing optimistic perception of the lives of Holocaust survivors in postwar America by scrutinizing their first years through the eyes of those who lived it. The facts brought forth in this book are supported by case files recorded by Jewish social service workers, letters and minutes from agency meetings, oral testimonies, and much more. Cohen explores how the Truman Directive allowed the American Jewish community to handle the financial and legal responsibility for survivors, and shows what assistance the community offered the refugees and what help was not available. She investigates the particularly difficult issues that orphan children and Orthodox Jews faced, and examines the subtleties of the resettlement process in New York and other locales. Cohen uncovers the truth of survivors' early years in America and reveals the complexity of their lives as "New Americans.".

    Abstract: Enlightenment thinkers such as Rousseau and Montesquieu are best known for their humanist theories and liberating influence on Western civilization. But as renowned French intellectual Louis Sala-Molins shows, Enlightenment discourses and scholars were also complicit in the Atlantic slave trade, becoming instruments of oppression and inequality.Translated into English for the first time, Dark Side of the Light scrutinizes Condorcet's Reflections on Negro Slavery and the works of Montesquieu, Rousseau, and Diderot side by side with the Code Noir (the royal document that codified the rules of French Caribbean slavery) in order to uncover attempts to uphold the humanist project of the Enlightenment while simultaneously justifying slavery. Wielding the pen of both the ironist and the moralist, Sala-Molins demonstrates the flawed nature of these attempts and the reasons given for this denial of rights, from the imperatives of public order to the incomplete humanity of the slave (and thus the need for his progressive humanization through slavery), to the economic prosperity that depended on his labor. At the same time, Sala-Molins uses the techniques of literature to give equal weight to the perspective of the "barefooted, the starving, and the slaves" through expository prose and scenes between slave and philosopher, giving moral agency and flesh-and-blood dimensions to issues most often treated as abstractions. Both an urgent critique and a measured analysis, Dark Side of the Light reveals the moral paradoxes of Enlightenment philosophies and their world-changing consequences.

    Abstract: Wie können irreguläre Migranten und Migrantinnen ihre Interessen vertreten, obgleich ihre Einreise und ihr Aufenthalt als unerwünscht gelten? Die Studie zeichnet die Spuren von Protest, Organisierung und Lobbying in der EU nach. Dabei wird der Blick an die Grenzen Europas wie auch auf das lobbypolitische Zentrum Brüssel gelenkt. Die Studie zeigt auf, inwiefern sich auf europäischer Ebene überraschende und unkonventionelle Ansatzpunkte ergeben - nicht zuletzt durch geschlechterpolitische Allianzen und eigensinnige Praxen der Migrierenden.
