    Abstract: Sterben und Tod stellen in der Gegenwartsgesellschaft einen komplexen Problembereich dar, der verschiedenste gesellschaftliche Bereiche und Diskurse – private wie öffentliche, theoretische wie praktische – betrifft. Im vorliegenden Band wird durch ein interdisziplinäres Spektrum der aktuelle Stand der medizinisch-ethischen und juristischen wie auch der geistes- und kulturwissenschaftlichen Diskussion und Forschung dargestellt. Zum anderen wird die grundsätzliche Haltung unserer auf menschliche und technische Leistung und Fortschrittsgläubigkeit ausgerichteten Gesellschaft gegenüber dem Phänomen Tod und die Problematik einer heute erschwerten sinnhaften Deutung des Todes erörtert. Zwei interkulturelle Fallbeispiele ergänzen die wissenschaftlichen Beiträge.     Abstract: Main description: Der Grundsatz der Gleichbehandlung der Gläubiger im Insolvenzverfahren wird seit je her als oberster Grundsatz des Insolvenzrechts angesehen. Dennoch wurde er in keinem deutschen Insolvenzrecht ausnahmslos verwirklicht, auch nicht in der neuen Insolvenzordnung. Der rechtlichen Erörterung bedürfen die Kriterien, nach welchen die Behandlung der Gläubiger im Insolvenzverfahren in zulässiger Weise zu differenzieren ist.

    Abstract: Grundbegriff des klassischen Liberalismus ist der Begriff der negativen Freiheit: Freiheit als Abwesenheit von Zwang. Doch was ist Zwang? Warum ist Zwang in der freiheitlichen Sicht ein Übel? Der liberale Nationalökonom und Sozialphilosoph Friedrich August von Hayek entwickelt in seiner Verfassung der Freiheiteine Bestimmung des Begriffspaars Freiheit und Zwang, die jedoch unvollständig bleibt und einige grundsätzliche Fragen an seine Moralphilosophie und Theorie der kulturellen Evolution aufwirft. Philipp Batthyány unternimmt den Versuch einer werkimmanenten Definition des Zwangsbegriffs Hayeks und einer Begründung für die Verwerflichkeit des Zwangs als Grundübel in der Gesellschaft. Unter Einbeziehung wesentlicher Teile des unveröffentlichten Nachlasses durchdringt der Autor Hayeks Gesamtwerk mit Blick auf die ihm zugrundeliegende Konzeption von Freiheit und Zwang und schließt damit eine wichtige Lücke in der Hayek-Forschung.

    Abstract: As Asian markets are now increasingly integrated in the world economy their domestic insolvency systems need to meet the expectations of international investors and lenders. Many Asian jurisdictions are responding by reforming insolvency laws, introducing new procedures and strengthening institutions, but others are much less active. This conference proceedings includes papers showing how far various Asian countries have come in building effective and predictable insolvency systems and shows to what extent their systems provide confidence to investors and lenders.

    Abstract: Inspired by developments mirroring shifts in the legal basis for compensating damage from civil law to public funding and vice versa, this book examines the developments in compensation systems for damage arising from work-related injuries and diseases. The shifts which have occurred in this area in Germany, England, Belgium and the Netherlands are the subject of this volume. The shifts in the legal doctrine, legislation and the case law of these countries will first be mapped from a historical and comparative perspective, with the aim of discovering the precise nature of the given shifts. Subsequently the shifts will be analysed and explained on the basis of the legal history so as to comprehend the reasons behind the shifts. Finally, the effects of the shifts will be examined. Did the shifts have the desired effects or did other, perhaps unexpected, effects arise and if so why and in what form? An economic analysis of law will be included to provide an answer to these questions.

    Abstract: Declining fish stocks and expanding fishing fleets have combined with growing competition from aquaculture to put increased pressure on the fishing sector to adjust the size and nature of its operations in many countries. In some fishing communities, almost sixty percent of jobs are linked to fishing and in many coastal areas there are few alternative employment opportunities for fishers. This conference proceedings analyses the social issues and policy challenges that arise from fisheries adjustment policies, and how OECD member countries are meeting those challenges.

Ces dernières années ont été parmi les plus chaudes des cinq siècles écoulés, et les projections des modèles climatiques annoncent des changements encore plus nets dans la région au cours des décennies à venir. Conjuguée au recul des glaciers et à la fonte du permafrost en altitude, la diminution de la quantité de neige, plus bas, aura un impact non négligeable sur les activités touristiques tributaires de la neige et sur la gestion des risques naturels. Au-delà des Alpes, les implications de cette évaluation peuvent être extrapolées à d’autres chaînes de montagnes susceptibles d’être confrontées à des problèmes climatiques et contextuels similaires, par exemple en Amérique du Nord, en Australie et en Nouvelle-Zélande.

    Abstract: Recent developments in the European integration process have raised, amongst many other things, the issue of linguistic diversity, for some a stumbling block to the creation of a European democratic polity and its legal and social institutions. The solution to the 'question of language', involves an understanding of the role played by natural languages and the consequent design of policies and institutional mechanisms to facilitate inter-linguistic and intercultural communication. This is not an exclusively European problem, and nor is it entirely new, for it is also the problem of linguistic majorities and minorities within unitary nation-states. However, the effects of globalization and the diffusion of multiculturalism within nation-states have given renewed emphasis to the question of language in diverse societies. Facing the question anew involves reconsidering traditional ideas about social communication and the public sphere, about opinion-formation and diffusion, about the protection of cultural and linguistic minorities, and about the role that language plays in the process of formation of political and legal cultures. This volume is intended as a multidisciplinary contribution towards studying and assessing the range of problems that form the 'language question' in Europe and diverse societies

    Abstract: Main description: Die Frage, ob jüdische Sammler oder deren Erben ihr Restitutionsbegehren auf § 985 BGB stützen können, stellt die Kernfrage der vorliegenden Untersuchung dar. Daneben werden weitere Fragen untersucht: Hat ein Sammler das Eigentum an einem Kunstwerk dadurch verloren, dass er es etwa in einer sogenannten "Judenauktion" veräußert hat oder dass es ihm vom Deutschen Reich weggenommen worden ist? Besonderes Augenmerk gilt dabei der in den alliierten Rückerstattungsgesetzen normierten Entziehungsvermutung. Erörtert wird auch, ob ein Eigentumsverlust dadurch eingetreten ist, dass eine dritte Person das Eigentum daran gutgläubig erworben hat. Schließlich wird untersucht, ob die seit der Entziehung verstrichene Zeit von mehr als einem halben Jahrhundert das Bestehen des Herausgabeanspruchs nach § 985 BGB ausschließt oder seine erfolgreiche Geltendmachung hindert.

    Abstract: Mit der fortschreitenden Verbreitung und Weiterentwicklung des Internet, wird auch die öffentliche Verwaltung mit einer zunehmenden Veränderung der Informations- und Kommunikationsprozesse in den Institutionen konfrontiert. Dadurch ergeben sich grosse Potentiale für die Erhöhung der Wirtschaftlichkeit und der Dienstleistungsorientierung der administrativen Geschäfts- und Verwaltungsvorgänge. Jedoch auch die Herausforderung, alle betroffenen Prozesse in Einklang mit den gegebenen datenschutzrechtlichen Bestimmungen zu bringen. Die zunehmende Digitalisierung der öffentlichen Verwaltung erleichtert die Erstellung von Persönlichkeitsprofilen, da die bisher auf viele Fachämter oder verschiedene Stellen verstreuten Angaben zu einer Person zusammengeführt werden können. Es stellt sich die Frage, ob das aktuelle Datenschutzrecht vor der Gefahr, dass der Mensch zum "Gläsernen Bürger" wird, schützen kann, oder ob die Bestimmungen ihre Aktualität verloren haben und letztendlich überarbeitet werden müssen, um den Risiken der Online-Welt wirkungsvoll entgegentreten zu können. Die vorliegende Arbeit untersucht die Relevanz von Datenschutz im und für das Electronic Government in Deutschland. Neben einer ausführlichen Begriffsbestimmung sowie einer Zusammenfassung der geschichtlichen Entwicklung des Electronic Government, beinhaltet sie weiterhin die Beschreibung der historischen Entwicklung des Datenschutzrechts bis hin zum heutigen Stand der Gesetze und die Anwendbarkeit des deutschen Datenschutzrechts in Deutschland. Abschliessend werden die gegenwärtigen Risiken für den Datenschutz im Electronic Government erarbeitet und entsprechende Lösungsansätze aufgezeigt.

    Abstract: This book examines the distinction between principles and rules so that they can be better understood and applied. It structures the distinction between principles and rules on different foundations than those jurisprudence ordinarily employs. It also proposes a new model to explain the normative species, which includes structured weighing on the application process while encompassing substantive criteria of justice in its argument.
    Abstract: This book intends to help understand and apply principles and rules better. Its target is to keep the distinction between principles and rules whereas structuring it on different foundations than those jurisprudence ordinarily employs. The first object of investigation is the phenomenon of interpretation in Law in order to understand that the classification of certain normative species as either principles or rules depends in the first place on axiological connections that are not ready prior to the interpretation process that unveils them. Then, a definition of principles is proposed, aiming to understand what their unique characteristics are when compared to other norms of the legal order. Thirdly, the conditions for the application of principles and rules are examined, which are the normative applicative postulates. It will be shown, on one hand, that principles not only explicit values, but also set forth precise species of behaviors, though indirectly, on the other hand, the creation of conducts by rules is also to be weighed, even though the behavior set forth in advance may be overcome, depending on the accomplishment of a few requirements. That will surpass both the mere praise of values, which does not create behaviors, and the automatic application of rules. A model is proposed to explain the normative species, which includes structured weighing on the application process while encompassing substantive criteria of justice in its argument, through the analytical reconstruction of the concrete use of normative postulates, especially those of reasonableness and proportionality. All of that is done with a focus on the ability of intersubjective control of the argumentation, which often degenerates into capricious decisionism.

    Abstract: Although it is commonly asserted that enhanced citizen participation results in better environmental policy and improved enforcement of environmental standards, this hypothesis has rarely been subject to testing on a comparative basis. The contributors to this book set out to study the extent to which citizens can and do exert influence over their urban environments through the legal (and extra-legal) 'gateways' in eleven countries spanning several continents as well as different climates, levels and type of economic development, and national legal and constitutional systems, as well as exhibiting a different set of environmental problems. One interviewee questioned about access to environmental justice, dryly remarked that in his city there was no environment, no justice and no access to either. Yet this view, as will be seen, requires to be nuanced. While few people will be surprised by the finding that legal gateways to environmental justice are largely ineffective, the reasons for this are revealing; but also the richness of detail and the comparisons between the different countries, and also the positive aspects which surfaced in several instances, were indeed both encouraging and sometimes surprising. This book presents the first comparative survey of access to environmental justice, and will be of considerable use to lawyers, policy-makers, activists and scholars who are concerned with the environmental issues which so profoundly affect and afflict our habitat and conditions of social justice throughout the world

    Abstract: This collection offers an overview of the issues involved concerning the interface between human rights and intellectual property rights (IPRs). It makes clear that two schools of thought have developed. The first school maintains that human rights and IPRs are in fundamental conflict.     Abstract: The author examines the practice of video interrogation for children witnesses. Starting point for their empirical investigation is the question of whether the law reform is not only meant well, but can be implemented practically. Here the author builds on the regulations of the 1998 established law for witness protection, to its feasibility in terms of the intended effective protection of victims, particularly the avoidance of so-called secondary victimization (trauma), experts from the federal state of Lower Saxony - prosecutors, police and courts - report by their own experiencees. In five selected district courts of Lower Saxony, the author has also conducted an extensive document analysis on the use of video testimony, and concluded that the video technology in criminal proceedings is used rarely. In specific reform proposals „de lege ferenda“ also the recent regulations of the Law Reform Act of 2003 victims are included in the evaluative study

    Abstract: This is the first comprehensive account of the modern international law of treaty interpretation expressed in 1969 Vienna Convention, Articles 31-33. As stated by the anonymous referee, it is the most theoretically advanced and analytically refined work yet accomplished on this topic. The style of writing is clear and concise, and the organisation of the book meets the demands of scholars and practitioners alike.
    Abstract: In the practice of modern international law, disputes as to the meaning of specific treaty provisions are a frequent occurrence. It is the assumption underlying any such dispute that in a process of interpretation a distinction has to be made between the legally correct and incorrect interpretation result. The legal correctness of an interpretation result is determined by reference to the relevant international law, as reflected in the 1969 Vienna Convention on the Law of Treaties (VCLT), Articles 31-33. The result of an interpretation process is correct when it can be successfully defended as being in accordance with the provisions of VCLT Articles 31-33. The result is incorrect when it cannot be so defended. Traditionally, the substance of Articles 31-33 has been described by reference to the various means of interpretation enumerated in said provisions, and little more than that. As argued in this book, more detail is required. On closer inspection, not only does the Vienna Convention provide information on the interpretation data (or means of interpretation) to be used by appliers when interpreting a treaty provision. It also instructs the appliers how, by using each datum, they shall argue to arrive at a conclusion about the meaning of the interpreted provision, and, to some extent, it determines the weight that different data of interpretation shall be afforded when appliers discover that, depending on the specific datum they bring to bear on the interpretation process, the conclusion arrived at will be different. Hence, the regime laid down in VCLT Articles 31-33 will have to be described as a system of rules. This book investigates the contents and structure of this system. By importing knowledge from linguistics, and pragmatics in particular, a model is established giving representation to the concept of a rule of interpretation. Drawing on this model, the book then proceeds to reconstruct the contents of the various rules of interpretation. To facilitate reference, the conclusions suggest a list of 44 rules, all of which can be invoked by appliers citing VCLT Articles 31-33.

    Abstract: Costa and Zolo share the conviction that a proper understanding of the rule of law today requires referring to a global problematic horizon. It seems unavoidable to investigate into the relationship between Europe and the United States, on the one hand, and the rest of the world, on the other. Over the last centuries this relationship developed in terms of conquest and colonisation, on the widespread view that Western civilisation should be opposed as a whole to barbaric others. Today, however, the notion of rule of law is still rousing a debate that cannot be said to have come to an end. The reason is quite simple: if the origins of the rule of law are in Western societies and cultures, and if until recently the West took the lion s share in the debate on our subject matter, it remains true that today other societies and other cultures take an active and creative part into a sustained philosophical-political debate. This is by no means a merely intellectual or academic question: the Arab-Islamic world, India, China, are not far away planets whose orbits never crossed the European and American West. On the contrary, in fairly recent times the encounters have been close and traumatic. In sum, the book intends to offer some relevant guides for orienting the reader through a political and legal debate where the rule of law (and the doctrine of human rights ) is a concept both controversial and significant at the national and international levels.

    Abstract: This book describes the rule of law as the reign of persuasion rather than the reign of force, and democracy as the reign by persuasion rather than the reign by force. It synthesizes a vast amount of current Cassirer-literature and makes a contribution to jurisprudence. The book is the first systematic elaboration on law as a symbolic form and it sheds new light on a still dark area of intellectual and jurisprudential thought.
    Abstract: Jurisprudence, according to Cassirer, is not merely the systematic, conceptual pursuance of ethics. They are separate domains for Cassirer, and both direct their claims differently on the individual. Whereas ethics concerns the motives of the individual, law ultimately achieves a cosmos for our world of outward actions. However, they are not separated by a neutral line or a vacuum. For law to have effect as a symbolic form it is necessary that it reflects the law in the mind of people i.e., that one could and ought to have assented to it out of ethical principles and maxims. The conceptual analysis of law goes hand to hand with its genetic account. Both ethics and law are products of, spring forth from the formative or symbolic powers of man, and although, as any other symbolism, they might confront us as something objective, i.e., as part of reality that is beyond our immediate reach, ultimately we must always bring them to account to their very source: our independent and individual moral judgment. In this book we describe the rule of law as the reign of persuasion rather than the reign of force, and democracy as the reign by persuasion rather than the reign by force.

    Abstract: This book features the contributions of a distinguished group of experts in the field of the law of armed conflicts that gathered in Berlin in June 2005. The goal of the colloquium, which marked the 70th birthday of Knut Ipsen, was to find operable solutions for problems and challenges that confront the contemporary law of armed conflict.
    Abstract: Recent armed conflicts, whether international or non-international in character, are in many respects characterized by a variety of asymmetries. These asymmetries may be overstressed, sometime even abused, and ultimately virtually meaningless. Still, either as such or in conjunction with other developments, they seem to challenge the law of armed conflicts or: international humanitarian law. These challenges may very well compromise the very function of that body of law, which is to mitigate as far as possible the calamities of war. Thus, the law of armed conflict may be deprived of its fundamental function as an order of necessity because its legally binding directives will increasingly be disregarded for the sake of allegedly superior values. In order to discuss these and other questions a most distinguished group of experts in the field of the law of armed conflicts gathered in Berlin in June 2005. The goal of that colloquium, which marked the 70th birthday of Knut Ipsen, was to find operable solutions for problems and challenges the contemporary law of armed conflict is confronted with.     Abstract: An International Expert Workshop on the Right to Social Security was held in April 2005 at the German Institute for Human Rights, whose purpose was to highlight specific issues of the right to social security which should be addressed by the Committee when drafting a General Comment on article 9. The results of this workshop are published in this volume providing an insight into the current challenges on social security as a human right.
    Abstract: Article 9 of the International Covenant on Economic Social and Cultural Rights on the right to social security is the shortest article in the entire Covenant and for that reason alone highly abstract and vague. A comprehensive analysis of the article 9 is still lacking, not least because it is widely regarded as a Pandora's box better not to be opened. Experience has shown that the quality of the state reporting procedure is greatly improved once the Committee on Economic Social and Cultural Rights has adopted a General Comment. Thus, it seems very desirable to close this gap. For the reason, an International Expert Workshop on the Right to Social Security was held in April 2005 at the German Institute for Human Rights, whose purpose was to highlight specific issues of the right to social security which should be addressed by the Committee when drafting a General Comment on article 9. The results of this workshop are published in this volume providing an insight into the current challenges on social security as a human right.

    Abstract: The book explores recent developments in the international and national prosecution of persons accused of committing war crimes and crimes against humanity. It considers the relationship between national and international law, science and practice, with emphasis on the emerging principle of universial jurisdiction and the effect of 'the war on terror' on legal norms.
    Abstract: The demand for accountability for human rights violations is heard throughout the world as never before. This volume explores current developments in the prosecution of human rights crimes on the national and international level. Experts from several countries discuss relevant topics from the academic debate, describe the practice in different countries, and analyze problems which have arisen in this new and exciting field of law. They strike a balance after the first years of the International Criminal Court and a growing universal jurisdiction practice and give the reader a present-day overview of attempts to bring to justice major figures like Augusto Pinochet and Donald Rumsfeld as well as lesser known ones. Emphasis is put on the emerging principle of universal jurisdiction and the effect of the `war on terror` on legal norms. While the latter threatens to weaken and, in some respect, destroy long standing principles of international law, the developing practice of universal jurisdiction offers new resources for dealing with international crimes. The book examines the tension between these two phenomena and its meaning for international criminal law and the implementation of human rights.     Abstract: Oil tankers are not solely to blame for pollution at sea. Non-tankers have released numerous spills. The International Convention on Civil Liability for Bunker Oil Pollution Damage has been adopted, but has not yet come into force. This timely and comprehensive book studies compulsory insurance, its main purpose of ensuring compensation and its interrelations with other features such as the rule of strict liability, the limitation of liability of that convention.
    Abstract: Oil tankers are not the only vessels that have caused oil pollution at sea. Numerous spills in the past have been of heavy fuel oil from non-tankers. However, the international liability and compensation regime covered only oil pollution damage caused by oil tankers. There was thus a need to bring the law on marine oil pollution responsive to oil pollution damage caused by non-tankers. In March 2001, the International Convention on Civil Liability for Bunker Oil Pollution Damage was adopted following a diplomatic conference at the International Maritime Organization. Though this convention has not yet come into force, its various aspects should already be considered as they will surely affect the maritime industry as a whole and the non-tanker sector, in particular. This book provides a timely and comprehensive study on the concept of compulsory insurance, its main purpose of ensuring compensation and its interrelations with other features such as the rule of strict liability and the limitation of liability under the convention.
