    Abstract: Comparative constitutional law has a long pedigree, but the comparative study of constitution-making has emerged and taken form only in the last quarter-century. While much of the initial impetus came from the study of the American and French constituent assemblies in the late eighteenth century, this volume exemplifies the large comparative scope of current research. The contributors discuss constituent assemblies in South East Asia, North Africa and the Middle East, Latin America, and in Nordic countries. Among the new insights they provide is a better understanding of how constituent assemblies may fail, either by not producing a document at all or by adopting a constitution that fails to serve as a neutral framework for ordinary politics. In a theoretical afterword, Jon Elster, an inspirational thinker on the current topic, offers an analysis of the micro-foundations of constitution-making, with special emphasis on the role of crises-generated passions.

Fighting the U.S. Youth Sex Trade: Race, Gender, and Politics examines how politically and ideologically diverse activists joined together to change perceptions and public policies on youth involvement in the sex trade over time, reframing "juvenile prostitution" of the 1970s as "commercial sexual exploitation of children" in the 1990s, and then as "domestic minor sex trafficking" in the 2000s. Based on organizational archives and interviews with activists, Baker shows that these campaigns were fundamentally shaped by the politics of gender, race and class, and global anti-trafficking campaigns. The author argues that the very frames that have made these movements so successful in achieving new laws and programs for youth have limited their ability to achieve systematic reforms that could decrease youth vulnerability to involvement in the sex trade"--

    Abstract: Since the turn of the century, South American governments and regional organisations have adopted the world's most open discourse on migration and citizenship. At a time when restrictive choices were becoming increasingly predominant around the world, South American policymakers presented their discourse as being both an innovative and exceptional 'new paradigm' and part of a morally superior, avant-garde path in policymaking. This book provides a critical examination of the South American legal framework through a historical and comparative analysis. Diego Acosta uses this analysis to assess whether the laws are truly innovative and exceptional, as well as evaluating their feasibility, strengths and weaknesses.     Abstract: This Companion provides a broad, historically informed introduction to the study of the US constitutional system. In place of the usual laundry lists of cases, doctrines, and theories, it presents a picture of the constitutional system in action, with separate sections devoted to constitutional principles, organizational structures, and the various legal and extra-legal 'actions' through which litigators and average citizens have attempted to bring about constitutional change. Finally, the volume covers a number of subjects that are rarely discussed in works aimed at a general audience, but which are critical to ensuring that constitutional rights are honored in the day-to-day lives of citizens. These include standing and causes of action, suits against officeholders, and the inner workings of the Foreign Intelligence Surveillance Court (FISC).     Abstract: As Europe deals with a so-called 'refugee crisis', Australia's harsh border control policies have been suggested as a possible model for Europe to copy. Key measures of this system such as long-term mandatory detention, intercepting and turning boats around at sea, and the extraterritorial processing of asylum claims were actually used in the United States long before they were adopted in Australia. The book examines the process through which these policies spread between the United States and Australia and the way the courts in each jurisdiction have dealt with the measures. Daniel Ghezelbash's innovative interdisciplinary analysis shows how policies and practices that 'work' in one country might not work in another. This timely book is a must-read for those interested in preserving the institution of asylum in a volatile international and domestic political climate.

    Abstract: In this innovative legal history of economic life in the Western Indian Ocean, Bishara examines the transformations of Islamic law and Islamicate commercial practices during the emergence of modern capitalism in the region. In this time of expanding commercial activity, a mélange of Arab, Indian, Swahili and Baloch merchants, planters, jurists, judges, soldiers and seamen forged the frontiers of a shared world. The interlinked worlds of trade and politics that these actors created, the shared commercial grammars and institutions that they developed and the spatial and socio-economic mobilities they engaged in endured until at least the middle of the twentieth century. This study examines the Indian Ocean from Oman to India and East Africa over an extended period of time, drawing together the histories of commerce, law and empire in a sophisticated, original and richly textured history of capitalism in the Islamic world

    Abstract: "It was 1878 when for the first time a Chinese and Japanese delegate attended a professional meeting of international lawyers. That year, Kuo-Taj-In (Songtao Guo) and Kagenori Wooyeno (Ueno), attended a session of the Association for the Reform and Codification of the Law of Nations, later renamed International Law Association. Founded in 1873 in Brussels by a group of liberal lawyers, reformist and philanthropists, the International Law Association exists until today as one of the profession's more important organisations. The founding, at the end of the nineteenth century, of this and other professional organisations like the Institut de Droit International marked the beginning of international law as a liberal reformist project.1 Advancing the rule of law in international relations, this project involved the enactment of international rules and the creation of international courts and organisations. It also involved the emergence of an autonomous international legal profession, progressively separated from diplomatic circles and from the representation of the interests of individual states"--
    Abstract: "The development of international law is conventionally understood as a history in which the main characters (states and international lawyers) and events (wars and peace conferences) are European. Arnulf Becker Lorca demonstrates how non-Western states and lawyers appropriated nineteenth-century classical thinking in order to defend new and better rules governing non-Western states' international relations. By internalizing the standard of civilization, for example, they argued for the abrogation of unequal treaties. These appropriations contributed to the globalization of international law. With the rise of modern legal thinking and a stronger international community governed by law, peripheral lawyers seized the opportunity and used the new discourse and institutions such as the League of Nations to dissolve the standard of civilization and codify non-intervention and self-determination. These stories suggest that the history of our contemporary international legal order is not purely European; instead they suggest a history of a mestizo international law"--

    Abstract: Hardly known twenty years ago, exclusion from public space has today become a standard tool of state intervention. Every year, tens of thousands of homeless individuals, drug addicts, teenagers, protesters and others are banned from parts of public space. The rise of exclusion measures is characteristic of two broader developments that have profoundly transformed public space in recent years: the privatisation of public space, and its increased control in the 'security society'. Despite the fundamental problems it raises, exclusion from public space has received hardly any attention from legal scholars. This book addresses this gap and comprehensively explores the implications that this new form of intervention has for the constitutional essentials of liberal democracy: the rule of law, fundamental rights, and democracy. To do so, it analyses legal developments in three liberal democracies that have been at the forefront of promoting exclusion measures: the United Kingdom, the United States, and Switzerland.

    Abstract: In recent decades, religion's traditional distinctiveness under the First Amendment has been challenged by courts and scholars. As America grows more secular and as religious and nonreligious convictions are increasingly seen as interchangeable, many have questioned whether special treatment is still fair. In its recent decisions, the Supreme Court has made clear that religion will continue to be treated differently, but we lack a persuasive account of religion's uniqueness that can justify this difference. This book aims to develop such an account. Drawing on founding era thought illumined by theology, philosophy of religion, and comparative religion, it describes what is at stake in our tradition of religious freedom in a way that can be appreciated by the religious and nonreligious alike.     Abstract: The concept of toleration plays a central role in pluralistic societies. It designates a stance which permits conflicts over beliefs and practices to persist while at the same time defusing them, because it is based on reasons for coexistence in conflict - that is, in continuing dissension. A critical examination of the concept makes clear, however, that its content and evaluation are profoundly contested matters and thus that the concept itself stands in conflict. For some, toleration was and is an expression of mutual respect in spite of far-reaching differences, for others, a condescending, potentially repressive attitude and practice. Rainer Forst analyses these conflicts by reconstructing the philosophical and political discourse of toleration since antiquity. He demonstrates the diversity of the justifications and practices of toleration from the Stoics and early Christians to the present day and develops a systematic theory which he tests in discussions of contemporary conflicts over toleration.

Most societies, which we call natural states, limit violence by political manipulation of the economy to create privileged interests. These privileges limit the use of violence by powerful individuals, but doing so hinders both economic and political development. In contrast, modern societies create open access to economic and political organizations, fostering political and economic competition. The book provides a framework for understanding the two types of social orders, why open access societies are both politically and economically more developed, and how some 25 countries have made the transition between the two types

Dabei werden die Einflüsse der Aufklärung und vor allem die Konstitutionalisierung des Staatswesens durch politische und gesellschaftliche Entwicklungen in den Blick genommen, Fragen der kollektiven Religionsfreiheit berührt und schließlich die späteren reichsrechtlichen Entwicklungen nachvollzogen.     Abstract: The Killing Trap, first published in 2005, offers a comparative analysis of the genocides, politicides and ethnic cleansings of the twentieth century, which are estimated to have cost upwards of forty million lives. The book seeks to understand both the occurrence and magnitude of genocide, based on the conviction that such comparative analysis may contribute towards prevention of genocide in the future. Manus Midlarsky compares socio-economic circumstances and international contexts and includes in his analysis the Jews of Europe, Armenians in the Ottoman Empire, Tutsi in Rwanda, black Africans in Darfur, Cambodians, Bosnians, and the victims of conflict in Ireland. The occurrence of genocide is explained by means of a framework that gives equal emphasis to the non-occurrence of genocide, a critical element not found in other comparisons, and victims are given a prominence equal to that of perpetrators in understanding the magnitude of genocide

    Abstract: In this book, Thomas Buoye examines the impact of large-scale economic change on social conflict in eighteenth-century China. He draws upon a large body of actual, documented homicide cases originating in property disputes to recreate the social tensions of rural China during the Qianlong reign (1736–1795). The development of property rights, a process that had begun in the Ming dynasty, was accompanied by other changes that fostered disruption and conflict, including an explosion in the population growth and the increasing strain on land and resources, and increasing commercialization in agriculture. Buoye challenges the 'markets' and 'moral economy' theories of economic behaviour. Applying the theories of Douglass North for the first time to this subject, he uses an institutional framework to explain seemingly irrational economic choices. Buoye examines demographic and technological factors, ideology, and political and economic institutions in rural China to understand the link between economic and social change

    Abstract: Die Arbeit beantwortet wissenschaftlich fundiert die Frage nach der verfassungsrechtlichen Notwendigkeit des Beamtenstatus für Universitätsprofessoren. Die Freiheit der Wissenschaft, die Freiheit von Forschung und Lehre verlangt für die Stellung der Universitätsprofessoren als "die Inhaber der Schlüsselfunktionen des wissenschaftlichen Lebens" ein Beamtenverhältnis. Für eine sachgerechte Interpretation des Art. 33 Abs. 4 des Grundgesetzes (Funktionsvorbehalt) ist daher eine Rückkoppelung an den Gehalt des Art. 5 Abs. 3 S. 1 des Grundgesetzes (Wissenschaftsfreiheit) und damit eine Gesamtschau der in den Verfassungsnormen niedergelegten spezifischen Garantiefunktionen erforderlich.     Abstract: The contributors to this book believe that something can be done to make life in American cities safer, to make growing up in the urban ghettos less risky, and to reduce the violence that so often permeates urban childhoods. They consider why there is so much violence, why some people become violent and others do not, and why violence is more prevalent in some areas. Both biological and psychological characteristics of individuals are considered. The authors also discuss how the urban environment, especially the street culture, affects childhood development. They review a variety of intervention strategies, considering when it would be appropriate to use them and towards whom they should be targeted. Drawing upon ethnographic commentary, laboratory experiments, historical reviews, and program descriptions, this book presents a variety of opinions on the causes of urban violence and the changes necessary to reduce it

    Abstract: Until the late 1960s, most Western scholars studying the history, culture, social and political life and economy of Russia and the Soviet Union, paid scant attention to the participation and experience of women. The multifarious ways in which gender roles and perceptions of gender were influenced by and in turn influenced the heterogeneous cultures of the Soviet empire were largely ignored. However, this neglect has slowly been rectified and now the study of women and gender relations has become one of the most productive fields of research into Russian and Soviet society. This volume demonstrates the originality and diversity of this recent research. Written by leading Western scholars, it spans the last decade of tsarist Russia, the 1917 revolutions and the Soviet period.     Abstract: This book investigates the ways in which literacy was important in early mediaeval Europe, and examines the context of literacy, its uses, levels, and distribution, in a number of different early mediaeval societies between c. 400 and c. 1000. The studies, by leading scholars in the field, set out to provide the factual basis from which assessments of the significance of literacy in the early mediaeval world can be made, as well as analysing the significance of literacy, its implications, and its consequences for the societies in which we observe it. In all cases, the studies represent recent research and bring evidence such as the recent archaeological discoveries at San Vincenzo al Volturno to the subject. They provide fascinating insight into the attitudes of early mediaeval societies towards the written word and the degree to which these attitudes were formed. This period is shown as fundamental for the subsequent uses of literacy in mediaeval and modern Europe

    Abstract: This is the first English translation of the first work of Otto von Gierke, arguably the greatest historian of ideas of the nineteenth century. Community in Historical Perspective includes much of the first volume of Das Deutsche Genossenschaftsrecht, originally published in 1868, and the texts translated here have become essential reading for anyone interested not only in the history of ideas and alternatives to conventional socialism and liberalism, but also, as recent experience has shown, contemporary European affairs. Von Gierke's represented an unparalleled attempt to justify a political programme of structural pluralism, and to interpret the entire course of European history from the Dark Ages onwards as a progressive interaction between 'fellowship' (or 'comradeship') and 'lordship' (or 'sovereignty'). This interaction was to generate a polity of autonomous associations within a constitutional state based upon consent and federal unity, and von Gierke here laid the basis for a distinctively Germanic programme of federalism and quasi-pluralism, with a strongly nationalist emphasis upon the unique capacity of Germans, despite long periods of absolute rule, for corporate self-management

    Abstract: In the seventeenth and eighteenth centuries, widespread fear of criminal assault motivated the publication of hundreds of pamphlets tracing the lives and misdeeds of London's most notorious rogues. Turned to Account is a study that focuses on the popular genre of criminal biography, examining how it played upon and reflected English society's fears and interest in aberrant behaviour. The author has not produced a criminal history, but an intriguing distillation of some 2,000 separate narratives describing the lives, deeds, and dying words of thieves, murderers, and various scoundrels. Lincoln Faller examines ways in which ordinary Englishmen read, wrote, and presumably thought on the subject of criminal actions and character. He completes his treatment by showing how the pamphlets served to delineate the lines of socially acceptable behaviour. Faller has chosen his examples with skill and economy to produce a comprehensive and interesting work

    Abstract: Adultery, fornication, breach of marriage contract, sexual slander - these, along with religious offences of various kinds, were typical of the cases dealt with by the ecclesiastical courts in Elizabethan and early Stuart England. What was it like to live in a society in which personal morality was regulated by law in this fashion? How far-reaching was such surveillance in actual practice? How did ordinary people view the courts - as useful institutions upholding accepted standards, or as an alien system purveying unwanted values? How effective were the church courts in influencing attitudes and behaviour? Previous assessments of ecclesiastical justice, coloured by contemporary puritan and common law criticisms, have mostly been unfavourable.     Abstract: This book examines in detail the process of change in 240 city, county and state public bureaucracies responsible for local finance administration. Using the longitudinal method of analysis, the data show organizational structures to be much less stable than conventional stereotypes have suggested. Variables such as organizational leadership, claims to domain, and survival (as opposed to replacement or reorganization) were found to mediate environmental effects on bureaucracies. The book also discusses traditional theories of bureaucracy, theories emphasizing the importance of environment for organizational theory is possible. The concluding chapter draws extensive theoretical implications from the empirical findings of the study
