    Kurzfassung: Verlagsinfo: Since the Second World War more than 1,000 black independent congregations in around 300 different organizations have sprung up all over Britain. The immigration of Afro-Caribbeans and West Africans has led to the emergence and growth of many churches, which flourish in the cities and attract a growing number of members. They now play an increasingly active role in the social and ecumenical life of the nation, which is reflected in cooperation with the "New Instrument" of the British churches. They comprise a rich diversity of theological traditions and cultural inheritance, some in an interesting blend, some in a struggle with white elements. Existence and growth of these communities have often been explained by factors inherent in British society, such as social deprivation and English racism. The book attempts to prove that, as much these factors are a reality, they do not account for the dynamics of the movement, its proliferation and stability. Rather these congregations are carried by strong cultural and theological forces, which molded the spiritual experience of the African diaspora. They carry a living faith, sound contextual theologies, and a form of organization, which presents a model for other ethnic minorities. Author Biography: Roswith Gerloff is Founding Director of the Centre for Black and White Christian Partnership, Birmingham, UK, and former Senior Research Fellow at the University of Leeds, UK.

Critical legal and socio-legal scholarship tends to assume that registration is a textually mediated act of statecraft which governs through the technology of writing.     Kurzfassung: In recounting their migration journey, references to nationality pervade the narratives of Zimbabweans in South Africa. Given the challenges many migrants confront based on their nationality, this presents a seeming paradox. This qualitative interview study, conducted with Zimbabwean migrants in two areas of Cape Town—Observatory and Dunoon—aims to elucidate the nuances of national self-descriptions in a demanding environment. Identifying as Zimbabwean serves as a sanctuary and a retreat, where alternative identifications often prove transient; embracing Zimbabweanness fosters an affirmative and positive self-perception, surpassing the limitations of other collective self-descriptions. Rather than pre-emptively characterizing a nationalist demeanour, the articulation of national self-description emerges as a strategic tool to navigate experiences of hostility and discrimination, while also asserting legitimate claims to equal opportunities. In this way, nationality takes a trajectory that diverges from conventional notions of nationality (and the ones of the nation-state or citizenship) as per Northern theory, contributing to alternative conceptualizations within the framework of the Global South. About the author Johannes Kögel studied philosophy and sociology in Munich and Cape Town. He currently works as a research associate at the University of Munich (LMU München). He has conducted social research on diverse topics such as brain-computer interfaces, xenotransplantation, and migration in South Africa. .

    Kurzfassung: In 2015 many camps were opened to accommodate newly arriving migrants in Berlin. Christian Sowa studies this form of accommodation. Moving beyond an exclusive focus on borders and migration, he argues that camp accommodation must be thought of and studied as part of the urban context and as a specific form of housing. The study provides an in-depth case study, discusses policy alternatives, argues for »housing for all instead of camps«, and contributes to bringing urban and migration studies into public discussion. In times of new waves of migration, the topic of migrant accommodation within urban environments remains highly relevant today.

    Kurzfassung: This book critically analyzes the criminalization of incitement to terrorism under the fundamental principles of legality, necessity, and proportionality with the aim of striking a fair balance between security and liberty on this complicated issue. The criminalization of incitement to terrorism has gained momentum, but no exact or generally accepted definition of this offense exists at the international level. What’s more, given that the criminalization of incitement to terrorism results in restrictions on the exercise of citizens’ freedom of expression, there should be certain limitations on those criminal measures to avoid unnecessary or disproportionate infringement of this fundamental human right. Nevertheless, there has not been a precise standard by which to determine how to draw the line between anti-terrorism and the protection of freedom of expression. Hence, it could be concluded that the criminalization of incitement to terrorism concerns how to balance security and liberty, and the safeguarding principles of legality, necessity, and proportionality should be fully observed in considering this issue. This book studies definitions of “incitement”, “terrorism”, and “incitement to terrorism” under the relevant international and national legislation, and points out the existing absence, ambiguousness, or substantive divergence in defining actus reus and mens rea regarding incitement to terrorism. It carefully considers the current need for and essential limitations on criminal measures against incitement to terrorism in accordance with the principles of necessity and proportionality, and particularly focuses on how to balance the protection of freedom of expression with the criminalization of incitement to terrorism. In considering how to draw a line between the two, the book formulates precise requirements for objective and subjective elements of this offense in accordance with the principle of legality. Given its scope, it will be of interest not only to academics, human rights lawyers and practitioners, but also to policymakers, as it offers an extensive evaluation of the effects and counter-effects of existing criminal measures.

The crime of aggression was also omitted in the rich debate held among German scholars in the early 2000s regarding the legislative implementation of other ICC Statute crimes. The current inability of the International Criminal Court to respond to the Russian aggression towards Ukraine invites the continuation of these academic debates without neglecting the particularities of the crime of aggression. The fundamental issues discussed in this volume include the obligation to criminalize aggression, the core wrong of the crime, the normative gaps under domestic law and the jurisdictional gaps under the ICC Statute. To facilitate the operationalization of domestic implementation, the book explores the technical options for incorporating the definition into domestic law, the geographical ambit of domestic jurisdiction—most notably universal jurisdiction—as well as legal challenges such as immunities. The book is aimed primarily at researchers and States with an interest in the domestic implementation of international criminal law but those already working in the field should also find much of interest contained within it. Dr. Annegret Hartig is Program Director of the Global Institute for the Prevention of Aggression and worked as a researcher at the University of Hamburg where she obtained her doctoral degree in international criminal law.

Crossing the boundaries between theology and philosophy, the notion of virtus formativa, or formative power, was central in explaining genetic inheritance and the configuration of the embryo. By adopting an interdisciplinary approach, this book reconstructs how Albert the Great, motivated by theological open issues, reorganised the natural-philosophical and medical theories on embryonic development, creatively drawing upon Greek, Patristic, and Arabic sources. A valuable contribution to research, this book offers essential insights for those studying the history of embryology, medicine, and science in the medieval and renaissance periods. Amalia Cerrito is an Associate Member of the Centre for the Studies of Medicine and the Body in the Renaissance (CSMBR) of Pisa, Italy. Having studied the history of medieval philosophy at the Universities of Pisa and Florence, she has published journal articles on the interaction between natural philosophy and the biblical exegesis of Albert the Great.     Kurzfassung: This book explores the early evangelical quest for enlightenment by the Spirit and the Word. While the pursuit originated in the Protestant Reformation, it assumed new forms in the long eighteenth-century context of the early Enlightenment and transatlantic awakened Protestant reform. This work illuminates these transformations by focusing on the dynamic intersection of experimental philosophy and experimental religion in the biblical practices of early America’s most influential Protestant theologians, Cotton Mather (1663-1728) and Jonathan Edwards (1703-1758). As the first book-length project to treat Mather and Edwards together, this study makes an important contribution to the extensive scholarship on these figures, opening new perspectives on the continuities and complexities of colonial New England religion. It also provides new insights and interpretive interventions concerning the history of the Bible, early modern intellectual history, and evangelicalism’s complex relationship to the Enlightenment. Ryan P. Hoselton is Associate Pastor at Munich International Community Church and Visiting Scholar at Heidelberg University in Germany, where he taught religious history and historical theology from 2016-2023. He co-edited The Bible in Early Transatlantic Pietism and Evangelicalism (2022), and he is editing vol. 7 of the Biblia Americana (Matthew-Luke).

It focuses on a digital version of sovereignly created money that is accessible to the broad public. This central bank digital currency (CBDC) raises several questions. Will CBDC lead to public surveillance of the citizens? What is digital money in the legal sense? And what is the difference to already existing forms of digital money?     Kurzfassung: This study aims for a wider understanding of the redevelopment processes that emerged several decades ago in downtown San Diego and now gradually spread over the downtown edges into the inner ring. Perspectively situated in the fields of urban landscape and urban border studies, the research project outlines how the eastward ‘redevelopment wave’ in San Diego contests socialized neighborhood (boundary) perceptions by transforming the former first-tier suburbs from disinvested communities into ‘urban villages’ and trendy places to be. The study shows how the redevelopment perforates, dissolves, and shifts socialized, linear neighborhood boundaries into areas that are simultaneously part of the one and the other neighborhood. In the present work, the resulting, rather undefined or stretched border areas have been referred to as hybrid urban borderlands. This notion is a novel conceptual approach that can be deemed a promising lens for future studies on neighborhood change, urban redevelopment, and socio-spatial re-interpretation beyond the context of San Diego. About the author Albert Rossmeier studied Landscape Architecture and Urban Planning at the University of Applied-Sciences in Weihenstephan and Human Geography/Global Studies at the University of Tübingen, where he completed his dissertation in Geography. His research interests include energy transition and wind power expansion, landscape change and theories, urban borderlands as well as urban and regional development in Europe and North America.

    Kurzfassung: This book offers a socio-spatial analysis of a refugee camp in southwestern Uganda. Based on qualitative research with a multi-method approach the author shows how refugees are central actors in the operation and becoming of a camp. Not only do they crucially contribute to its social, micro-economic, and material realization but they also incrementally rearrange the camp space by acts of constant adaptation in order to make it work for its inhabitants. By means of social interaction, infrastructuring, translation, movement and material improvisation they navigate daily life in the semi-constricted and highly precarious space of the refugee protection regime and carve out its social and material landscape. Thus, this study challenges static understandings of camps and restricted conditions and puts forward theoretical implications for the rethinking and reassessment of agency in such contexts by calling for closer attention to ordinary practices. About the author Hannah Schmidt is a member of the Institute for Migration Research and Intercultural Studies (IMIS) at the University Osnabrück. Her research is on encampment and refugee regimes in the Global South, as well as social practices, agency and spatial production in the context of humanitarianism.

Through in-depth qualitative and photo-elicitation interviews, Cesraa Rumpf shows how formerly incarcerated women engaged recovery and faith-based discourses to craft rehabilitated identities, defined in opposition to past identities as "criminal-addicts." While these discourses made it possible for women to carve out spaces of personal protection, growth, and joy, they also promoted individualistic understandings of criminalization and the violence and dehumanization that followed. Honoring criminalized women's stories of personal transformation, Rumpf nevertheless strongly critiques institutions' promotion of narratives that impose lifelong moral judgment while detracting attention from the structural forces of racism, sexism, and poverty that contribute to women's vulnerability to violence.〈BR /〉

    Kurzfassung: This book explores how state-supported mental health initiatives made emotional intimacy both politically valued and personally desired during a crucial period of modern British psychiatric and cultural history. Focusing on the transformative decades following World War II, Teri Chettiar narrates the surprising story of how individual emotional wellbeing became conflated with inclusive democracy and subsequently prioritized in the eyes of scientists, politicians, and ordinary citizens. This new model of emotional health promoted nuclear families and monogamous marriage relationships as fundamental for individual and political stability and fostered unexpected collaborations between British mental health professionals and social reformers who sought to resolve the Cold War crisis in political and moral values. However, this model also generated backlash and resistance from communities who were excluded from its vision of idealized intimacy, including women, queer people, and adolescents. Ultimately, these communities would foster a new generation of activists who would turn the state agenda on its head by demanding political recognition for marginalized citizens on the basis of emotional health. Through new archival research, The Intimate State traces the rise of a modern psychiatric view of the importance of intimate relationships and the resultant political culture that continues to inform identity politics – and the politics of social equality – to this day.

    Kurzfassung: This book is about Mozambicans and Angolans who migrated in state-sponsored schemes to East Germany in the late 1970s and throughout the 1980s. They went to work and to be trained as a vanguard labor force for the intended African industrial revolutions. While they were there, they contributed their labor power to the East German economy. This book draws on more than 260 life history interviews and uncovers complex and contradictory experiences and transnational encounters. What emerges is a series of dualities that exist side by side in the memories of the former migrants: the state and the individual, work and consumption, integration and exclusion, loss and gain, and the past in the past and the past in the present and future. By uncovering these dualities, the book explores the lives of African migrants moving between the Third and Second worlds.

The study reflects on the beginnings of the field and its past developments to answer the main research question: How did the scientific field of crisis communication become what it is today? About the author Janina Klingelhöfer is a researcher and practitioner focused on crisis communication and stakeholder management. She worked as a research associate at LMU Munich from 2017 to 2022. Since November 2022, she has been working on strategic health communication at the Bavarian State Ministry of Health and Care.

    Kurzfassung: This book analyses the relationship between assimilation and fertility intentions for migrants and minorities in Europe. Building upon assimilation theory, it is argued that both migrants and minorities assimilate in the process of intercultural encounters. Given that fertility is part of the cultural dimension of assimilation, it is likely to be influenced by assimilation. Therefore, theories on assimilation and fertility are merged theoretically as well as empirically. Using data from the Generations and Gender Survey, the empirical section builds upon a comparison of Turkish migrants in Germany and the Turkish minority in Bulgaria. Building upon cluster analyses, six clusters within Germany as well as five clusters in Bulgaria are developed to account for heterogeneity of groups. Comparing these clusters in terms of assimilation and fertility intentions it becomes clear that the Turkish minority does not differ in their fertility intentions from the majority. For Germany, Turkish migrants differ from German natives regarding their fertility intentions, but differences are explained by assimilation, especially structural characteristics. When comparing migrant and minority, differences in fertility exist and are accounted for by cultural dissimilarity.     Kurzfassung: This open access book empirically analyses the competences (input), moderators (process), and disclosure (output) of board chair succession practices for publicly listed organisations in Switzerland. As primus inter pares (Latin for first among equals), the chair of the board of directors holds a unique organisational position. For fulfilling the non-transferable duties pursuant to Article 716a revCO, it is essential that the chair is a person who has rational economic and socio-emotional skills. To date, however, it is unclear how organisations structure the search for a chairperson. On the one hand, this ambiguity arises from a legal perspective, as succession-related formal regulations (hard law) or best-governance principles (soft law) are rare and often lack specificity, and, on the other hand, from a business perspective, as there is a lack of sufficient attention and diligence. Previous research on board governance has primarily focused on the dyadic relationship between board composition and organisational performance (board effectiveness research). However, as board succession is a dynamic process, the research focus should go beyond a pure output/performance paradigm. About the author: Cornel Germann is a Senior Research Senior Research Fellow and PostDoc at the Institute of Law and Law & Economics, University of St. Gallen (HSG). His research focuses on behavioral aspects of board of directors with a special emphasis on board chair and director selection, board committees, and board strategic leadership.     Kurzfassung: After the break-up of the Soviet Union, the escalating rivalry between the EU and Russia in their shared neighbourhood created major economic, political and security challenges for the two states that border them: Belarus and Ukraine. Both countries were made integration offers by the EU and Russia. Their responses, and the consequences of these choices, were driven by a complex range of domestic and foreign policy factors. Drawing widely on extensive empirical research, Dr Leukavets shows how the EU’s and Russia’s rival integration projects challenged the leaders of Belarus and Ukraine to make major strategic choices while aiming to ensure the independence and sovereignty of their countries. The study sheds important light on the genesis of the 2020 Belarus crisis and the 2022 Russia-Ukraine war.

    Kurzfassung: How and why did students at Kabul University engage in political activism or refrained from it between 1964 and 1992? Based on oral history interviews with former students, this book reveals how they - as many others around the world at the same time - were galvanized by and disappointed with promises of progress dominating local and international politics. During the 1960s, the international influences on campus encouraged students' engagement with competing political ideologies. Collective student protest against the monarchy turned into hostilities between opposing political groups within the student body claiming to lead Afghanistan towards independence and prosperity. After the coup d'état by the People's Democratic Party of Afghanistan (PDPA) in 1978, none of the ideologies which had previously incited students provided hope for a better future anymore. Many students who had fought for the PDPA earlier were repelled by the government's violence and those who stood up against the regime were persecuted and fled the country. Overall, the dynamics of political activism at Kabul University reflect the deep intertwinement of the Global Cold War and local struggles for inclusion and independence

    Kurzfassung: This Open-Access-book questions the relationship between institutionalized images and understandings of policing – the monolithic ideas common to most, if not all, Western law enforcement agencies – and contextual, situative, and local interactions where the human representatives of policing – street-level officers – come into contact with residents. The political and theoretical association of specific forms of “Western” policing with democratic society can be illustrated in the case of German integration: narratives of reform and essentially forging new democratic police agencies in the “new German states” stand at odds with much of the experience and statements of officers who continued to serve following (Re)Unification. Officers who present their works primarily in terms of their local responsibilities, expectations and more specifically to their unique and individual relationship and connection to their communities downplay the relevance of high-level policing policy. Based on a two-year ethnographic study of policing in a rural county in the German state of Brandenburg, this book explores the local nature of policing both in terms of how police officers imagine their communities to be and with reference to broader societal expectations and assumptions of what police, essentially, are, can effectively do, and should effectively do. About the author Aaron Bielejewski is a research associate at the Centre for Criminological Research Saxony. He studies cultural and interactionist aspects of police work and prison.

    Kurzfassung: Bonaventure's metaphysical thought and his interpretation of Aristotle Contemporary scholarship on Bonaventure has characterized him as the Neo-platonic foil to the Aristotelianism of his day. The present book, however, shows a Bonaventure who is highly enthusiastic about utilizing the philosophy of Aristotle and who centers much of his philosophical project around interpreting and understanding the texts of Aristotle. Two goals are central to this book. The first is to shed light on Bonaventure's greatly understudied ontology and theory of forms, demonstrating how his philosophical system is an important and unique alternative to other medieval Aristotelian systems. The second is to establish, more broadly, how Bonaventure's interpretation of Aristotle is a resource which should be mined for contemporary efforts in thinking about and reading Aristotle himself.     Kurzfassung: This book explores the role of social space in American temperance discourse of the antebellum era. It specifically charts how, through engagements with space, temperance advocates located and expressed the existence of an ‘alcoholic order.’ Variously referred to as ‘King Alcohol’ or the ‘Rum System,’ this alcoholic order was portrayed as ubiquitous and threatening. Recording the machinations and ubiquity of this order would help temperance claims surrounding the threat of alcohol appear meaningful and true. Discursively engaging with social spaces, advocates could convey a world that was dominated and ordered by alcohol’s production and consumption. Each empirical chapter of this book explores a discrete space – the latter ranging in downward scale – and shows how, through these spaces, advocates went about identifying the lineages and historical linkages of alcoholic damage. First, advocates portrayed the American public sphere as being borne on and tainted by alcoholic connections; through such engagements with the public, the American present was condemned as a centrally alcoholic arrangement. Second, advocates frequently portrayed the Atlantic world as an alcoholic space, thus infusing temperance with critiques of global capitalism and slavery. Third, a focus on the United States as a country and its booze-soaked history helped advocates’ espousals of a temperance-led future for the country. Finally, the drunkard’s body served to support key temperance claims – especially surrounding health and hygiene – while also suffusing activism with critiques of a reigning false consciousness. Throughout the book, temperance advocates’ efforts of archiving the damages of drink – that is, of recording alcohol’s history and harm – are traced. In so doing, advocates could expound the existence of an alcoholic order, adversely impacting the world. By focussing on a discrete space, each chapter reveals novel angles of temperance; far from being merely an assault on drink, we come to appreciate temperance as a wide-ranging imaginary. Each space is connected to the other, in the writings of temperance advocates, through the reigning alcoholic order. Yet each space also brings up its own set of societal issues. In writing about the public, temperance comes to be a negotiation of issues surrounding individuality, gender, work, and capitalism. The Atlantic, on the other hand, carries forth such issues of capitalism and the market and has temperance advocates interrogate questions surrounding freedom, slavery, agency, and race. Similar questions surrounding freedom find echoes in advocates’ writings surrounding the country: temperance here comes to revolve around ideology, nationalism, and individualism. Lastly, writings surrounding the body brings forth issues of surrounding the individual and individualism, by focussing especially on workers’ alienation, on masculinity, and race.

    Kurzfassung: The welfare regime in Turkey has been undergoing a radical transformation since the early 2000s. Welfare provisions, especially poverty alleviation schemes, are increasingly framed as gifts, and select civil society organisations have assumed the state’s welfare provision functions through non-transparent public funding. Waqf, the Islamic institution of endowment, has played an important role in this transformation. It provides both the institutional frame of operations and the religious imaginary signification that interpellates subjects to take part as givers and receivers of gifts. This material exchange of care and money through newly configured gift-relations between the providers and beneficiaries constitutes not only a realm of politics but also a site of ethical negotiations with embodied consequences. This book is based on an extensive ethnographic study conducted between 2008-2009 among the charitable organizations of Kayseri, a central Anatolian city with booming industry and a majority conservative political orientation. A stronghold of the Justice and Development Party (AKP), which has been in power in Turkey since 2002, the city has showcased the tenets of the welfare transformation that is to come, even in the early stages of AKP rule. With a focus on the daily practices within the field of beneficence, the book investigates the gift circuits that bring together central state institutions, municipalities, local notables and business people, religious groups, volunteers and employers of charitable organisations, and the urban poor. In these gift circuits, objects, money, services, prayers, recognition, and political and social influence flow in various directions through formal and informal routes. The book illustrates the growing significance of these particular forms of gift-giving in the field of poverty alleviation and welfare provision in Turkey and their role in the drastic political transformation of the country.

    Kurzfassung: Aleksandr Prokhanov (born 1938) is a prize-winning novelist and also, as editor of the weekly newspaper Zavtra (Tomorrow), a leading figure in Russian ‘imperial patriotism’. Ever since 1991, when he signed (and reputedly wrote) the manifesto for the failed putsch against Mikhail Gorbachev, he has been an influential voice in Russian political culture – helping to turn the ‘irreconcilable opposition’ of the 1990s towards Empire, grappling with the difficult question of whether to endorse Vladimir Putin as a savior or expose him as a fraud, and promulgating a bewildering series of ‘conspiracy theories’ in which Russian and international affairs are explained in the most extravagant terms. He has also been a remarkably prolific writer; and the best of his novels are real works of literature, at once muck-raking and lyrical, with Moscow scandal interwoven so tightly with the mystical yearnings of ‘cosmism’ that the reader can hardly prise them apart. The same themes flow backwards and forwards between Prokhanov’s fiction and his non-fiction. World conspiracies, space exploration, the resurrection of the dead, Stalin as a supernatural redeemer – these and other preoccupations recur again and again in his leading articles as well as in his novels. This book, the first on Prokhanov, offers an account of his writing and of the Äred-brown' esotericism he expounds. It will be of interest to anyone concerned with modern Russian literature or politics, and also to students of 'conspiracy theories', esoteric belief systems, or the conspiracy novel.

    Kurzfassung: The war in Ukraine did not start on 24 February 2022. It began eight years earlier in eastern Ukraine's Donbas region. In his new book, Jakob Hauter investigates the escalation of violence in the spring and summer of 2014. He demonstrates that, contrary to popular belief, the pre-2022 conflict was not a civil war. Ukraine has been fighting a Russian invasion since the armed conflict’s very beginning. Hauter arrives at this conclusion based on a thorough review of the digital open source information (DOSI) available on the Internet. He argues that social science research needs theoretical and methodological innovation to operate in the abundant but murky information environment surrounding the Donbas War and other conflicts of the social media age. To address this challenge, he develops an escalation sequence model which divides the formative phase of the Donbas War into six critical junctures. He then combines the social science methodology of process tracing with DOSI analysis to investigate the causes of these critical junctures. For each juncture, Hauter assesses the available evidence of domestic causes and Russian interference, reaching the conclusion that, in most cases, there is convincing evidence that Russian involvement was the primary cause of armed escalation.

    Kurzfassung: Digital tools and pedagogies in public higher education are unfolding their potential by providing large groups of students with automated, continuous learning and feedback opportunities. However, most of the existing studies are cross-sectional, unidirectional and focus on a limited selection of relevant target variables and instructional features. In a field study, Andreas Maur used longitudinal latent structural equation modelling with a large sample of students to analyse the interrelations between formative feedback from electronic quizzes and different facets of the control value theory of achievement emotions. The results suggest that regular quizzes most consistently improve self-efficacy, anxiety, effort, course enjoyment, and hopelessness over time. Only feedback effects related to intrinsic motivation were consistently less effective for female and less proficient students, and for students in traditional versus flipped classrooms. These findings highlight the need to scale up formative feedback in higher education and to cultivate feedback systems with higher levels of sophistication, adaptability, and gamification mechanics. To answer these questions, this book analyzes the evolution of the Ukrainian super-rich in 2006-2017, tracing the process of conversion of wealth into political influence through vote-buying in the Verkhovna Rada (the Ukrainian parliament) and of the transformation of political influence back into wealth via elite rent-extraction schemes within the Ukrainian gas sector. A key argument is that continuity in informal practices between the Yanukovych and Poroshenko presidencies, and of the networks that conduct them, meant a prolongation of the dominant political economy regime. The study conceptualizes the processes of the recreation of Ukrainian oligarchy as a “currency flow,” or circuit, of wealth and power. It adds to the literature on the dynamics of informally dominated post-communist political economy regimes a detailed, integrated, and internally comparative case study of Ukraine.

    Kurzfassung: "In World of Worldly Gods, Kelzang T. Tashi offers the first comprehensive examination of the tenacity of Shamanic Bon practices, as they are lived and contested, in the presence of the invalidating force-Buddhism. Through a rich ethnography of Goleng and nearby villages in central Bhutan, he investigates why people, despite shifting contexts, continue to practice and engage with Bon that has survived over a millennium of impatience from a dominant Buddhist religious structure. Against the backdrop of long-standing debates around practices unsystematically identified as 'Bon', and how they relate to what anthropologists refer to as syncretism, he reframes the often stale and scholastic debates by providing the most clear and succinct statement on how these practices should be conceived in the region. Kelzang T. Tashi argues that the reasons for the tenacity of Bon practices and beliefs amid censures by the Buddhists are manifold and complex. While a significant reason for the persistence of Bon is the recency of formal Buddhist institutions in Goleng, he demonstrates that Bon beliefs are so deeply embedded in village social life that some Buddhists paradoxically feel it necessary to reach a rather awkward accommodation with the Bon priests. Through an analysis of the relationship between Shamanistic Bon and Buddhism, and the contemporary dynamics of Bhutanese society, Kelzang T.     Kurzfassung: "In the last 20 years, the related phenomena of honour-based violence and forced marriages have received increasing attention at the international and European level. Punitive responses towards this type of violence have been adopted, including ad hoc criminalisation and legislation containing direct references to the concepts of honour, culture and tradition. However, criminal law-based responses present several shortcomings and have often disregarded the specific needs that victims of such crimes might encounter. This book examines the possibility of using alternative programmes to address cases of honour-based violence and forced marriages. After reviewing previous existing literature, it presents new empirical data. Introducing a case-study from the United Kingdom, the book recalls the debate on Sharia Councils and the Muslim Arbitration Tribunal but examines instead other community-based, secular, programmes. By comparison, a study from Norway on the work of the National Mediation Agency and the so-called Cross-Cultural Transformative Mediation model is investigated as part of a larger multi-agency approach. Ultimately, in an attempt to reconcile pluralism and the rule of law, the book proposes effective ways to tackle honour crimes based on cooperation and individualisation of the proceedings, and capable of improving women's access to justice and reducing secondary victimisation. It finds voice at the grassroots and filters up. It speaks through Belinda's 1783 petition to the Massachusetts legislature for an annual pension from the estate of her ex-captor. It underlies the thousands of signatures penned by previously enslaved persons on petitions demanding pensions for their years of unfree labour. It is written in André Rebouças' 1875 Democracia Rural Brazileira and in Brazil's 1884 Dantas Bill (No 48) calling for the granting of land to freed populations. It suffuses the continuing history of the transatlantic system of chattel enslavement from its inception. It is a persistent struggle championed by the subaltern against mainstream denials"--

Die vorliegende Dissertation legt besonderes Augenmerk auf die Perspektiven von kleinen (Familien-)Unternehmen und untersucht die materiellen und nicht-materiellen Prozesse, die das Entstehen und die Reproduktion dieser Unternehmen im postsozialistischen Ungarn kennzeichnen. Der empirische Fokus auf der Arbeit und den wirtschaftlichen Praktiken in kleinen Unternehmen eröffnet neue Einsichten in die Verbindung zwischen der Formierung von Werten und politisch-ökonomischen Prozessen. Die Dissertation verfolgt einen holistischen Ansatz, in dem verschiedene Theorien aus zwei Bereichen – politische Ökonomie und Sozialtheorien der Moral und Werte – als analytische Basis für die empirische Forschung über Alltagserfahrungen mit Arbeit und wirtschaftlichem Handeln zusammengebracht werden.
    Kurzfassung: This PhD research was conducted as part of the project entitled ‘Realising Eurasia: Civilisation and Moral Economy in the 21st century’, which aimed to understand how morality and economy are entangled with each other from a new perspective.This dissertation focused on the perspectives of small (family) businesses in Szeged and examined both the material and non-material processes in which these businesses emerged and reproduced themselves in post-Socialist Hungary. The focus on work and economic practices in small businesses provided a unique angle on the study of the links between value formation and politico-economic processes both socially and empirically. In doing so, this PhD work utilized a holistic approach by bringing together various theories from two major domains: political economy, and social theories of morality and values that constituted the theoretical context for the dissertation’s empirical research into everyday experiences of work and economic activities.

    Kurzfassung: Die Dissertation ist eine Ethnographie des Staates im Flüchtlingslager Kakuma und in der Integrierten Siedlung Kalobeyei, Kenia. Basierend auf einer 12-monatigen Feldforschung in 2018-2019 wird die Vielfalt und Mobilität von Staaten im Lager analysiert. 2016 übernahm die kenianische Behörde RAS die Verantwortung für den Flüchtlingsschutz und die Kontrolle des Lagers vom UNHCR. In der bisherigen Forschung wurde die Anwesenheit des Staates oft übersehen; stattdessen wurden die Rolle des UNHCRS und des Agamben’schen „Ausnahmezustand“ im Flüchtlingslager hervorgehoben. Diese Studie zeigt, dass Flüchtlingslager höchst politische Räume sind, in denen eine Vielzahl mobiler nationaler und ausländischer staatlicher Akteure, Organisationen und Institutionen agiert. Das Konzept der „encamped states“ („eingelagerten Staaten“) wird entwickelt, um die multiplen und mobilen Staaten im Kontext von Kakuma und Kalobeyei darzustellen.
    Kurzfassung: This thesis is an ethnographic account of the state within Kakuma Refugee Camp and Kalobeyei Integrated Settlement, Kenya. Drawing from twelve months of in-depth ethnographic fieldwork between 2018 and 2019, the thesis explores the multiplicity and mobility of states within the camp. In 2016, the Kenyan state agency RAS assumed key camp managerial and refugee protection positions from the UNHCR. Previous research focusing on refugee camps has largely ignored the presence of the state, tending to overemphasise the governing role of the UNHCR and camps as Agambenian ‘state of exception’. This thesis addresses this imbalance and shifts our attention to how camps are highly political spaces, hosting an array of mobile national and foreign state actors, organisations, and institutions. The thesis utilises the concept of ‘encamped states’ to argue that, within the temporary encamped setting of Kakuma and Kalobeyei, states are both multiple and mobile.

    Kurzfassung: This ethnographic study focuses on inheritance and succession practices and sociopolitical stakes in present-day Marracuene in southern Mozambique. It explores how in contexts of rapid economic, social, cultural and political change, individuals, social actors and institutions deal with inheritance and succession rights, both when the property holders and incumbents are still alive and after they have passed away. Besides exploring legal processes, this study approaches inheritance and succession as social, cultural, economic and political processes. The study is based on twelve months of fieldwork, and, to a lesser extent, archival research. It focuses on inheritance and succession through five entry points. First, the study looks at how people deal with inheritance and succession rights pertaining to their own life situation. Second, it explores cultural understandings, as well as different strategies and arguments mobilized to secure and safeguard inheritance and succession rights. Third, the study investigates how individuals anticipate what is going to happen with inheritance and succession after their passing. Fourth, it explores how in global, national and local arenas rights and interests of traditionally weak social actors, such as widows and orphans, are defended and protected from disinheritance and dispossession. Fifth, the study analyses the extent to which local inheritance and succession practices relate to, and are influenced by, ongoing sociopolitical transformations, such as decentralization and urbanization, in Marracuene. Ethnographically, the study describes and analyzes actual inheritance and succession practices and strategies of individuals, kin groups and various sociopolitical institutions. The study furthermore describes and analyzes local politics, notably in relation to decentralization processes, so as to analyze the practical implications of the fact that chieftaincy and other community-based positions are nowadays defined as “community authorities,” according to the Mozambican state law. The findings show that there are general principles of inheritance and succession: a man is supposed to transfer inheritance to his wife and children and to be succeeded by his eldest child. However, such principles are often overruled, which can lead to disinheritance and dispossession of widows and orphans. The actual inheritance and succession practices result from a combination of factors. They include the economic and cultural values of the properties and positions in question (and the ways through which they were acquired), the power and authority of the actors, the power relations between different social actors involved in each case, the normative orders referred to and their interpretation and practical implementation, and the institutions involved in the process of decision-making. Overall, people have different understandings of inheritance and succession that furthermore more influence practices. In a local context of legal pluralism, individuals and groups tend to combine different normative orders and practices to claim and secure their rights, or to protect themselves whenever their rights are questioned. Through detailed ethnographic descriptions, the study demonstrates that inheritance and succession are complex processes and depend on economic, social, cultural and political factors at play in specific circumstances.

    Kurzfassung: “Can I choose to die?” As the number of requests for euthanasia and physician-assisted suicide continues to rise, human rights law faces a new conflict: the right to die vs. the right to life… The right to die or, in other words, ‘the right to choose the time and manner of one’s own death’ is a question of personal autonomy and its limits. This book provides a comprehensive understanding of the right to die and sheds light on its possible future under the European Convention on Human Rights. After setting a clear framework by defining the key terminology, the book takes a two-part approach to achieving its aim. The first part focuses on the right to die in practice by examining selected jurisdictions. Switzerland, which is famous for its assisted suicide organizations, and the Netherlands, which was the first country to legalize euthanasia, are examined in detail. Belgium, Germany, the United Kingdom, and -as an exception to the Convention perspective - Canada are also included. While this examination offers a better understanding of what the right to die looks like in practice, it also provides insights on the slippery slope argument, which serves as a counterweight to personal autonomy, without making a definitive statement on its validity. This part also illustrates the different paths that led or did not lead to the right to die in practice. The second part is an analysis of the European Court of Human Rights case law on the right to die. The Court has made important statements in only very cases, while its caution when approaching such a delicate and controversial topic among its 47 members is understandably emphasized. This analysis of the Court’s approach to the balancing of personal autonomy against other interests allows us to take a look back at the practice in more permissive jurisdictions through the lens of the Convention. Taken together, the book’s two parts provide valuable lessons for countries that decide to practice assisted dying, which are outlined in the conclusion. In addition, given that a purely legal approach can only offer a partial picture, the book argues that an interdisciplinary approach would be much more favorable in terms of providing the necessary basis for the right to die debate.

    Kurzfassung: This book focuses on the criminalization trend and process regarding the internal migration in contemporary China from the perspective Law-in-Action. In Chinese society today, internal migrants are commonly perceived as criminals. Crimmigration, a global term that communicated the convergence of the criminal legal system and the immigration enforcement system, manifest itself in China’s hukou-based (also known as the household registration system) criminal legal system. How hukou has been constructed into the concept of Crimmigration in China strikes at the core of the ultimate questions of this book: who is being criminalized, how does the political-economic-cultural institution known as ‘hukou’ shape the criminal justice process, and how has the role of hukou changed over time in the ever-changing process? Drawing on interviews with migrant leaders, police, prosecutors, criminal lawyers & judges, and prison staff in Yangtze River Delta, China, this book reflects on a historical development on hukou and its function in social control. Each chapter contributes to an extended analysis of pragmatic aspects of decision-making moments in the criminal justice system.     Kurzfassung: This timely book comprehensively examines whether the worst human rights violations directed specifically at sexual and gender minorities are punishable under international criminal law, as codified in the Rome Statute of the International Criminal Court. Drawing on general rules of interpretation, the development of human rights for sexual and gender minorities, and the social construction of gender, this monograph reveals that the worst crimes committed against persons because of their sexual orientation or gender identity can amount to crimes against humanity, particularly the crime of persecution under Article 7(1)(h). It also shows how legislators can be held individually criminally responsible for passing laws that criminalize consensual same-sex sexuality. The book not only makes a significant and original contribution to the literature but is also highly relevant for international criminal law practitioners, since, so far, no cases regarding this topic exist.     Kurzfassung: This book thoroughly discusses the concept of sovereign immunity in international law and how the problems normally associated with the said subject can be resolved in order to promote justice. In part one, the author shows through a careful analysis of the law that restrictive immunity does not have vox populi in developing countries and that it lacks usus. He also argues that forum law, i.e., the lex fori is a creature of sovereignty and between equals before the law, only what is understood and acknowledged as law among states must be applied in as much as the international legal system is horizontal. Furthermore, the state never acts as a juridical or natural person and, therefore, in logical terms, its functions cannot be divided into potere politico and persona civile as a prelude to determine jurisdiction. The said Italian doctrine, therefore, is ex-facie erroneous, and that a simple dichotomy between absolute immunity and restrictive immunity wholly predicated on the nature test alone would not be helpful in promoting justice. Hence the contextual approach, arbitration and comparative dominant theory are suggested as essential tools to supplement the UN Treaty on state immunity when it comes into force because some states are likely to stay out of the said treaty regime. In part two, of the book, the author provides a comprehensive analysis of international criminal justice i.e., the prosecution of heads of state before international tribunals and the means or tools available to defend these leaders. To that end, it is apposite that a distinction between immunity ratione personae and immunity ratione materiae be made clear, whereby emphasis must be placed on their differences and legal consequences in regard to the verticality of international tribunals and foreign criminal jurisdiction of states e.g., the ICC and SCLC. The author further argues forcefully that the law has not changed and that despite the reforming zeal of some important states to change the law, in reality however, the law remains almost intact wholly structured on the presumption of immunity subject to certain limited acknowledged exceptions duly supported by opinio juris, thus eclipsing the suggestion by some scholars, senior courts and international tribunals that the law be instead based on an acknowledged exception to a presumed jurisdiction. This is because international law is a decentralized public order system without a compulsory jurisdiction.

    Kurzfassung: This book describes the nature of trafficking in persons in West Africa, focusing on labor and sexual exploitation in the region, and recommends tailor-made solutions established by the Catholic Church in light of governmental authorities’ failure to effectively combat this scourge of humanity. While states’ efforts to fulfill their international obligations in developing anti-trafficking legislations are recognized, their failure to carry out prosecutions of offenders and ensure protection of the victims reveals that law alone is not a sufficient instrument for realizing human rights and improving people’s lives. Faced with the sobering background of less than successful efforts by governmental entities to end the trade in humans, this research study recommends adopting essential elements of Catholic social teaching, which rests on the inherent dignity of human beings allowing the development of political, socio-cultural, and religious reforms that will increase the effectiveness of existing legislation designed to combat trafficking. This faith-based approach highlights the role that religion may play in fulfilling the discretionary provisions of the Palermo Protocol by promoting the welfare and protecting the life and dignity of the victims. Additionally, religion is composed of sound moral ethics that determine people's behavior to refrain from the sinful conduct of trafficking. It also creates a sense of ethical responsibility that promotes supply chain transparency and ethical purchasing as well as advocating social reforms and anti-trafficking legislations initiatives. In fact, the author's approach, may be a model for other regions in the world and will be of interest to scholars, law and policy makers, human rights advocates and law enforcement agents working in the field of trafficking in persons. .

    Kurzfassung: When U.S. war resisters turned to Canada as refuge during the Vietnam War and the Afghanistan/Iraq Wars, they not only hoped to forestall deployment to a combat zone but also to build new lives and make a new home abroad. In her empirical study, Sarah J. Grünendahl explores and juxtaposes how well the two war resister 'generations' have been able to establish themselves after all and to what extent they partake in Canadian society. The comparison is instructive for migration and refugee studies altogether: The war resisters in the sample, unlike many other migrant populations, did not have to contend with language and cultural barriers in their destination country, given similarities between the United States and Canada. Sarah J. Grünendahl's research thus allows for an analysis of the effects of residency on migrants' adaptation and participation in the receiving society, isolated from these two common barriers. Further, the study sheds light on how refugees and non-citizens can employ civic engagement to claim a place for themselves and overcome societal exclusion. About the author Sarah J. Grünendahl is research assistant at the Faculty of Social Sciences and Cultural Studies at the University of Applied Sciences Düsseldorf and earned her doctorate in Political Science at the University of Siegen. Her research interests include migration and refugee studies, the effects of legal status on migrants' incorporation, and the nexus between societal participation, place (attachment) and identity.

    Kurzfassung: This book ties restorative justice into the exercise of patriarchal power. It is focused on the individual narratives of 15 girls and young women who have participated in a victim-offender restorative justice (RJ) conference and the perspectives of youth justice practitioners. Gender, Power and Restorative Justice expands feminist engagement with RJ by focusing critical attention on the importance of the social construction of gender, the exercise of power, shame, stigma, muting and resistance to girls’ experiences of RJ conferencing. Drawing upon recent developments to the sociology of stigma and feminist perspectives on shame, the book contends that RJ conferencing can produce harmful implications for girls and young women who participate. Ultimately it is argued that anti-carceral, social policy alternatives, underpinned by feminist praxis, should replace a youth justice jurisprudence for girls. This book will be of particular use and interest to those studying modules on criminology, youth justice, criminal justice and social work courses. Jodie Hodgson is a lecturer in Criminology at Manchester Metropolitan University, UK. Jodie has previously worked as a lecturer at Leeds Beckett University and the University of Liverpool. She completed her PhD at Liverpool John Moores University. Her research interests are situated within the areas of youth justice, feminism and critical criminology.

    Kurzfassung: In the last decades, violent non-state actors (VNSAs) such as rebel and terrorist organizations have proved their capacity to break international law. The international community, particularly the United Nations (UN), has reacted to this development by redirecting its conflict resolution efforts to these non-state entities. This has turned targeted sanctions into one of the most vital and indispensable foreign policy tools available to the UN Security Council in combating terrorism and contributing to the peaceful resolution of (intra-state) conflicts. Despite the UN Security Council’s growing tendency to sanction VNSAs, there has been little research analyzing the effects of UN targeted sanctions on these non-government actors. This book seeks to fill this gap and shifts the focus on non-state actors by ascertaining the general mechanisms through and conditions under which UN targeted sanctions imposed on VNSAs tend to be effective. The tripartite empirical analysis combining quantitative and qualitative research methods demonstrates that the state-centric understanding of how sanctions work is not simply applicable to the effective sanctioning of violent non-state actors such as rebel and terrorist movements. About the author Christopher Huber is a Research Fellow associated with the GIGA German Institute for Global and Area Studies in Hamburg. His research focuses on international sanctions, counterterrorism and religious conflicts.
