    Abstract: Zur Bewältigung von Organisierter (Drogen)Kriminalität finden zeitlich und finanziell aufwändige, meist verdeckte Ermittlungen gegen eine Vielzahl von Akteuren statt. Um diese Hintergrundermittlungen nicht vorzeitig aufzudecken, wird die sog. ›Legendierte Kontrolle‹ eingesetzt, bei der die Ermittlungsbehörden eine Durchsuchung als allgemeine Verkehrskontrolle tarnen. Die Arbeit ordnet das Instrument in das bestehende System verdeckter und täuschender Ermittlungsmaßnahmen ein. Sie analysiert die verfassungs- und strafverfahrensrechtliche Zulässigkeit des staatlichen Vorgehens, das sich im Grenzbereich zwischen Gefahrenabwehr und Strafverfolgung bewegt. Ein besonderer Schwerpunkt liegt auf der Frage, ob entgegen dem Grundsatz der Aktenwahrheit eine legendierte, also unzutreffende oder unvollständige Aktenführung erlaubt sein kann.     Abstract: This study addresses the phenomenon of domestic burglary (§ 244 (1) No. 3, (4) German Criminal Code). Particular emphasis is placed on the realities of criminal sentencing for this offense. Based on a multi-perspective analysis of the various appearances of the phenomenon and its legal classification, the study examines the reform of § 244 GCC and the realities of sentencing in criminal courts for the offense. In particular, discrepancies in sentencing that cannot be adequately explained by differences in factual circumstances of the underlying cases, and deficits in the written reasons for sentencing decisions are highlighted. The study reveals a need for action in the field of criminal sentencing
    Abstract: Das Werk widmet sich dem (Privat-)Wohnungseinbruchdiebstahl nach § 244 Abs. 1 Nr. 3, Abs. 4 StGB. Ein besonderer Schwerpunkt liegt auf der Rechtswirklichkeit der Strafzumessung bei dem Delikt. Auf Grundlage einer multiperspektivischen Betrachtung der Erscheinungsformen des Phänomens und seiner rechtlichen Bewertung untersucht die Arbeit die Reform des Tatbestandes und die Praxis der tatgerichtlichen Strafzumessung bei dem Delikt. Insbesondere werden Unterschiede im Strafmaß, die nicht hinreichend durch Sachverhaltsunterschiede der zugrundeliegenden Fälle erklärt werden können, sowie Defizite in der Begründung der Strafzumessungsentscheidungen aufgezeigt.     Abstract: With the establishment of the European Public Prosecutor's Office (EPPO), a quantum leap in cross-border criminal prosecution in Europe has been achieved. One year after the start of operational activities, a conference took place at the University of Munich, which was dedicated to initial experiences, practical problems as well as unresolved scientific questions in connection with the EPPO. The contributions in the accompanying conference proceedings concern the practice of cross-border criminal proceedings, questions of jurisdiction in investigative proceedings, cooperation with national investigative authorities, gathering and utilisation of evidence, as well as the transnationality of criminal prosecution as a challenge for criminal defence.     Abstract: Mit der Gründung der Europäischen Staatsanwaltschaft (EUStA) ist ein Quantensprung in der grenzüberschreitenden Strafverfolgung in Europa gelungen. Ein Jahr nach Aufnahme der operativen Tätigkeit fand eine Tagung an der LMU München statt, die sich ersten Erfahrungen, praktischen Problemen sowie ungeklärten wissenschaftlichen Fragestellungen im Zusammenhang mit der EUStA widmete. It outlines the practical problems of accessing data generated by smart speakers, the degree to which such access can be reconciled with the case law already been handed down, and the constitutional law and criminal procedure aspects that have to be considered in the context of the usability of such data
    Abstract: Smart Speaker sind im Alltag von Millionen Bürger mittlerweile allgegenwärtig. Angesichts aktueller Überlegungen Smart Speaker auch im Rahmen der Strafverfolgung einzusetzen, dürfte es nur noch eine Frage der Zeit sein, bis diese auch die höchstrichterliche Rechtsprechung beschäftigen. Die Arbeit beantwortet, inwiefern Smart Speaker de lege lata zur Strafverfolgung genutzt werden können. Es wird dargestellt, welchen praktischen Problemen sich ein Zugriff auf die mittels Smart Speaker generierten Daten gegenübersieht, inwiefern sich ein solcher Zugriff mit der bereits ergangenen Rechtsprechung vereinbaren lässt und welche verfassungsrechtlichen und strafprozessualen Aspekte im Rahmen der Verwertbarkeit solcher Daten zu beachten sind

    Abstract: Questions of authorship are central to the late thirteenth-century motet repertoire represented by the seventh section or fascicle of the Montpellier Codex (Montpellier, Bibliothèque interuniversitaire, Section de médecine, H. 196, hereafter Mo). Mo does not explicitly attribute any of its compositions, but theoretical sources name Petrus de Cruce as the composer of the two motets that open fascicle 7, and three later motets in this fascicle are elsewhere ascribed to Adam de la Halle. This monograph reveals a musical and textual quotation of Adam’s Aucun se sont loe incipit at the outset of Petrus’s Aucun ont trouve triplum, and it explores various invocations of Adam and Petrus – their works and techniques – within further anonymous compositions. Authorship is additionally considered from the perspective of two new types of motets especially prevalent in fascicle 7: motets that name musicians, as well as those based on vernacular song or instrumental melodies, some of which are identified by the names of their creators. This book offers new insights into the musical, poetic, and curatorial reception of thirteenth-century composers’ works in their own time.     Abstract: Drive the streets of Nairobi, and you are sure to see many matatus—colorful minibuses that transport huge numbers of people around the city. Once ramshackle affairs held together with duct tape and wire, matatus today are name-brand vehicles maxed out with aftermarket detailing. They can be stately black or extravagantly colored, sporting names, slogans, or entire tableaus, with airbrushed portraits of everyone from Kanye West to Barack Obama. In this richly interdisciplinary book, Kenda Mutongi explores the history of the matatu from the 1960s to the present. As Mutongi shows, matatus offer a window onto the socioeconomic and political conditions of late-twentieth-century Africa. In their diversity of idiosyncratic designs, they reflect multiple and divergent aspects of Kenyan life—including, for example, rapid urbanization, organized crime, entrepreneurship, social insecurity, the transition to democracy, and popular culture—at once embodying Kenya’s staggering social problems as well as the bright promises of its future. Offering a shining model of interdisciplinary analysis, Mutongi mixes historical, ethnographic, literary, linguistic, and economic approaches to tell the story of the matatu and explore the entrepreneurial aesthetics of the postcolonial world

Die Fragestellung war, ob ein Pauschalvergütungsansatz auf Breitbandanschlüsse ein Baustein für ein gerechteres, modernes Urheberrecht, für angemessene Vergütung für die UrheberInnen und einen gesellschaftlichen Interessensausgleich sein kann. Das umfassende und detailreiche Gutachten leistet einen wesentlichen Beitrag zur Diskussion um die Zukunft des Urheberrechts, die in Zeiten des globalen Internets in praktisch jedem Land geführt wird. Es wird vollumfänglich der Öffentlichkeit zugänglich gemacht, damit die Ergebnisse von allen Interessierten genutzt und weiterentwickelt werden können. Prof. Spindler zeigt in seinem Gutachten auf, dass ein Pauschalvergütungsansatz verfassungsrechtlich zulässig und ein attraktives Modell zur angemessenen Vergütung für Kreative sein kann. Für die Situation der NutzerInnen bietet er eine geeignete Alternative zu repressiven und gesellschaftlich höchst konfliktträchtigen Formen der Rechtsdurchsetzung. Gleichzeitig wird aber auch auf gewichtige Schwierigkeiten und Hürden bei der Umsetzung eines solchen Modells hingewiesen.     Abstract: The Internet and the proceeding digitalisation of content - such as music, videos and written texts - have led to profound and complex challenges in the field of Copyright Law, especially with regard to questions of enforcement as well as adequate compensation of right holders. In recent years, several alternative compensation schemes have been proposed, seeking to solve these issues. In Germany, the discussion still focuses on the so-called "cultural flatrate", that is, in a nutshell, a limitation to copyrights which would legalize sharing of content online. Every holder of a broadband connection to the Internet would have to pay a monthly fee which would be used to remunerate the right holders.This advisory opinion was compiled on behalf of the parliamentary group of the German political party "Bündnis 90/DIE GRÜNEN". The author comprehensively analyses the feasibility of the described alternative compensation scheme under German and European law, discussing both legal and economic obstacles and possible impacts based on a variety of different economic prerequisites

Kontrovers diskutiert wird, wie das Grundanliegen des Betäubungsmittelrechts — Schutz der Bevölkerung vor Abhängigkeit und Missbrauch sowie Sicherstellung der notwendigen medizinischen Versorgung — mit dem palliativmedizinischen Selbstverständnis der Gewährung einer bestmöglichen Behandlung von Schmerzpatienten in Einklang gebracht werden kann. In diesem Spannungsfeld fasst der Band die Beiträge eines Expertenworkshops zusammen, der 2012 von der Klinik für Palliativmedizin sowie dem Zentrum für Medizinrecht der Georg-August-Universität Göttingen veranstaltet wurde. Charting a historical narrative that stretches from the late-Ottoman period through the end of the second Palestinian intifada, McDonald examines the shifting politics of music in its capacity to both reflect and shape fundamental aspects of national identity.     Abstract: Der Gesetzgeber hat die Stellung des Verletzten im Strafverfahren in den letzten Jahrzehnten erheblich verändert. Die dem Verletzten nach und nach eingeräumten Informations-, Mitwirkungs- und Schutzrechte „stören“ das klassische Gegenüber von strafverfolgendem Staat und Angeklagten. In wichtigen Bereichen des Strafverfahrens muss daher eine neue Balance hergestellt werden. Das ist besonders prekär im vom Erziehungsgedanken beherrschten Jugendstrafverfahren. Die Arbeit untersucht, inwiefern die Besonderheiten des Jugendstrafverfahrens eine Berücksichtigung von Opferrechten zulassen. Im ersten Teil der Arbeit werden die dogmatischen Grundlagen einer Einbeziehung des Verletzten in das Jugendstrafverfahren dargestellt und die einzelnen Verletztenrechte ausführlich erörtert. Über die bloß theoretische Diskussion hinaus, wird im zweiten Teil der Arbeit der Konflikt zwischen den Verfahrensrechten des Verletzten und der erzieherischen Ausrichtung des Jugendstrafverfahrens empirisch beleuchtet. Zu diesem Zweck wurden Jugendrichter, Jugendstaatsanwälte und Strafverteidiger zu ihren Einstellungen, ihren Einschätzungen und ihrer praktischen Handhabung befragt
