    Abstract: Jakob Weissinger nähert sich der zentralen rechtstheoretischen Frage nach einem Begriff subjektiver Rechte, indem er fundamentale Strukturelemente normativer Praxis und deren Verflechtungen analysiert. Darauf aufbauend entwickelt er einen eigenen Begriff, der bewährte Ansätze grundlegend in Frage stellt.
    Abstract: Just what is a right? Jakob Weissinger approaches this central problem of jurisprudence by critically examining the purpose of such normative concepts and carefully analysing the fundamental elements of normative practice like actions, decisions, the logic of norms and values as well as the plurality of normative practice. Interlinking the insights won, he outlines a stand-alone theory of rights which emphasises the empowering dimension of rights in the process of justifying (legal) rules. Not only does he question well-established theories, such as Hohfeld's famous analysis of legal conceptions, but aspires to set future debates in legal theory, especially those surrounding rights such as the long-standing dispute between interest and choice theories of rights, on new and more solid meta-theoretical ground.

    Abstract: "The adoption of the Convention on the Rights of People with Disabilities (CPRD) by the United Nations in 2006 marked a major watershed. The CRPD is the first comprehensive and binding treaty on the rights of people with disabilities. It establishes the right of people with disabilities to equality, dignity, autonomy, full participation as well as specific rights including the right to live in the community, supported decision-making and inclusive education. Prior to the CRPD, international law had provided only limited protections to people with disabilities, although some countries had begun to incorporate rights protections into their respective domestic legislation.This book analyses the development of disability rights as an international human rights movement, in selected countries in Asia, Africa, and the Middle East as well as the United States. The book begins with an examination of the status of people with disabilities under international law prior to the adoption of the CPRD and follows the development of human rights protections through the drafting process of the CRPD. People with disabilities, like women and children before them, waged a battle to enforce their rights on the international stage against a backdrop of changing international norms. The book highlights four areas the right to legal capacity (article 12), the right to liberty and freedom from torture (articles 14 and 15), the right to live in the community (article 19), and the right to inclusive education, in order to the transformation from the charity/deficit/medical model of disability to the human rights mode. These areas are analyzed from a comparative perspective including a discussion of the laws, policies, and practices in selected countries in order to show the success of the CRPD in achieving protections depends on the extent to which individual countries begin to enforce domestic laws and policies and the extent to which various societies change their attitudes about people with disabilities"--

The book sets out a theoretical basis for the right to substantive equality before undertaking a careful analysis of the jurisprudence of both the European Court of Human Rights and the European Court of Justice in order to examine how the two Courts have approached the question through their case-law. The historical evolution of the prohibition of discrimination in the two legal orders is traced in order to demonstrate how the human interest safeguarded by a right to equality has developed and continues to develop within the jurisprudence of the Strasbourg and Luxembourg Courts. The book demonstrates how the right to substantive equality is becoming increasingly relevant. It shows how, despite the profound differences between the scope of ECHR and EU equality law, the two Courts have been willing to move beyond the apparent limitations of the written legal framework in several instances with a view to extending the personal and the material scope of what appears to be an emerging human right to equality"--

    Abstract: "The right of indigenous peoples to Free Prior and Informed Consent (FPIC) in relation to natural resource extraction in their territories is a principle that is increasingly recognised by intergovernmental organizations, international bodies, conventions and international human rights law as well as in the domestic law of some States. This book offers a comprehensive overview of the status of Free Prior and Informed Consent under international human rights law, considering the main controversies, obstacles and challenges associated with its recognition and implementation. The book examines the relationship between Free Prior and Informed Consent and territorial, resource and governance rights. The historical basis for FPIC is considered as well as the legitimacy of the dominant doctrines of exclusive State ownership of subsoil resources. The book argues that FPIC constitutes an emerging norm of international law with a tipping point having been reached in terms of the requirements recognition, both within and beyond the human rights regime. It draws on emerging jurisprudence from around the world, as well as evolving industry standards and policies, to illustrate the growing recognition of the fact that respect for the consent requirement is fundamental to securing indigenous peoples self-governance and territorial rights"--

This book provides an innovative rights-based approach to the issue of nomadism looking at issues including discrimination, segregation, freedom of movement, land rights, cultural and political rights, and effective management of natural resources. Jeremie Gilbert analyses the extent to which human rights law is able to provide protection for nomadic peoples to perpetuate their own way of life and culture, and asks why such protection should be granted. The book questions whether the current human rights regime is able to protect nomadic peoples, and highlights the lacuna that currently exists in international human rights law in relation to nomadic peoples.     Abstract: Der moderne Rechtsstaat beansprucht, seine Burger unterschiedslos als freie und gleiche Personen zu behandeln. Aufgrund dieses allgemeinen Anspruchs sind von der Legitimation staatlicher Normen partikulare ethische Konzeptionen ebenso ausgeschlossen wie Willkur und Privilegium. Eine besondere Frage entsteht aber im Verhaltnis zu den grossen Religionen, die einerseits selbst mit universalen Geltungsanspruchen auftreten, andererseits als Offenbarungsreligionen durch ihre Geschichtlichkeit aber auch partikular sind. Die aus dem Anspruch der Rechtsstaatlichkeit folgende Forderung nach weltanschaulich neutraler sakularer Normgebung fuhrt auf eine fur die neuzeitliche Philosophie, besonders fur die Rechtsphilosophie, zentrale Frage: Lassen sich grundlegende, allen gemeinsame Eigenschaften der Menschen (z.B. die Vernunft) ohne Rekurs auf besondere kulturelle Erfahrungen normativ wenden? Daran schliesst sich die Frage an, wie die so gewonnenen Normen sich zu den je partikular uberlieferten verhalten. Damit ist das Verhaltnis von Politik und Religion vor dem Hintergrund moderner Rechtsstaatlichkeit angesprochen, aus dem sich eine Reihe von philosophisch-historischen sowie von rechtssystematischen Problemen ergeben. Diese Probleme werden in diesem Buch von Philosophen und Rechtswissenschaftlern eingehend erortert und diskutiert. Dabei wird, ausgehend von der je eigenen Fachperspektive, eine interdisziplinare Diskussion eroffnet. Das Leitthema der Beitrage bildet dabei das Verhaltnis von naturrechtlichen, kulturellen und positivrechtlichen Elementen in der Legitimation staatlicher Normsetzung einerseits und in der Begrundung subjektiver Rechte, insbesondere der Menschenrecht.

    Abstract: Intellectual property law has been harmonized by EU law to a considerable extent. At the same time intellectual property rights have converged. The academic discussion has not kept pace with this development. European intellectual property law is often seen through the spectacles of national law; pan-European discussions about issues of Community law seem to be the exception rather than the rule. The contributors to this volume investigate if and to what extent European rules and principles applicable to all intellectual property rights already exist or whether they can be found on the basis of the acquis communautaire and comparative law. In particular, they discuss the merits and the methodology of common principles before turning to several areas of substantive intellectual property law such as grounds of protection, secondary liability and exceptions, to enforcement and finally to the relationship between intellectual property and neighbouring areas of EU law
