    Abstract: This book examines the development of Chinese translation practice in relation to the rise of ideas of modern selfhood in China from the 1890s to the 1920s. The key translations produced by late Qing and early Republican Chinese intellectuals over the three decades in question reflect a preoccupation with new personality ideals informed by foreign models and the healthy development of modern individuality, in the face of crises compounded by feelings of cultural inadequacy. The book clarifies how these translated works supplied the meanings for new terms and concepts that signify modern human experience, and sheds light on the ways in which they taught readers to internalize the idea of the modern as personal experience. Through their selection of source texts and their adoption of different translation strategies, the translators chosen as case studies championed a progressive view of the world: one that was open-minded and humanistic. The late Qing construction of modern Chinese identity, instigated under the imperative of national salvation in the aftermath of the First Sino-Japanese War, wielded a far-reaching influence on the New Culture discourse. This book argues that the New Culture translations, being largely explorations of modern self-consciousness, helped to produce an egalitarian cosmopolitan view of modern being. This was a view favoured by the majority of mainland intellectuals in the post-Maoist 1980s and which has since become an important topic in mainland scholarship

    Abstract: This monograph examines how higher education(HE) institutions construct ‘professional identities’ in the classroom, specifically how dominant discourses in institutions frame the social role, requisite skills and character required to practice a profession, and how students navigate these along their academic trajectories. This book is based on a longitudinal case study of a prestigious HE institution specialising in training professional interpreters. Adopting an innovative research approach, it investigates a community of aspiring professionals in a HE context by drawing on small story narrative analysis from an ethnographic perspective to provide emic insights into the student community and the development of their social identities. The findings (contextualised by examining the curricula of similar institutions worldwide) suggest that interpreter institutions might not be providing students with a clear and comprehensive picture of the interpreter profession, and not responding to its increasingly complex role in today’s society

    Abstract: Adopting a multi-perspective ontological approach to language in social life, this book investigates the concept of journalistic stance, defining it as a nexus of social practice rather than simply linguistic realizations. It focuses on the discursive aspect of journalistic stance in news texts to analyse the ways journalistic stances are enacted in Chinese and Australian print-media, hard-news reporting.     Abstract: The Kam language of China possesses fifteen tones - more than any other language. Yet it has long been neglected as an area of research, especially from the perspective of discourse analysis.     Abstract: This book presents the state-of-art research in ETS by illustrating useful corpus methodologies in the study of important translational genres such as political texts, literature and media translations. Empirical Translation Studies (ETS) represents one of the most exciting fields of research. It gives emphasis and priority to the exploration and identification of new textual and linguistic patterns in large amounts of translation data gathered in the form of translation data bases. A distinct feature of current ETS is the testing and development of useful quantitative methods in the study of translational corpora. In this book, Hannu Kemppanen explores the distribution of ideologically loaded keywords in early Finnish translation of Russian political genres which yielded insights into the complex political relation between Finland and Russia in the post-Soviet era. Adriana Pagano uses multivariate analysis in the study of a large-scale corpus of Brazilian fiction translations produced between 1930s-1950s which is known as the golden age of Latin American translation. The statistical analysis detected a number of translation strategies in Brazilian Portuguese fictional translations which point to deliberate efforts made by translators to re-frame original English texts within the Brazilian social and political context in the first three decades under investigation. Meng Ji uses exploratory statistical techniques in the study of recent Chinese media translation by focusing three important media genres, i.e. reportage, editorial and review. The statistical analysis effectively detected important variations among three news genres which are analysed in light of the social and communicative functions of these news genres in informing and mobilising the audience in specific periods of time in Mainland China

    Abstract: This book addresses why, whether and how the existing legal framework on water management in China could make climate change adaptation a mainstream issue. The new water-planning processes and EIA are also illustrated in the form of figures showing the differences after factoring in adaptation considerations. Interviews with water managers to obtain their perception and attitudes towards climate change adaptation offer new perspectives for readers. The adaptation- mainstreaming approach, which finds a way to balance various interests and tasks, will arouse the interests of those readers who argue that climate change is only one of the issues challenging water management, and that poverty reduction, environmental protection and living standard improvement are even more important.     Abstract: This book examines good faith in non-marine insurance and takaful (Islamic insurance) contracts in Malaysia, and proposes holistic law reform of the same. The book evaluates whether the duty of utmost good faith (the cornerstone of insurance and takaful contracts) is effectively regulated and, in turn, observed by insurers (and takaful operators) and insureds alike in Malaysia. The adequacy of the Insurance Act 1996 (Malaysia), the Takaful Act 1984 (Malaysia), the Financial Services Act 2013 (Malaysia) and the Islamic Financial Services Act 2013 (Malaysia) is evaluated, along with the supporting infrastructure and oversight measures introduced by the Malaysian government. In doing so, The book examines the duty of utmost good faith from both a doctrinal and a social science perspective, in order to propose suitable legal reform.

    Abstract: This book addresses issues concerning the shifting contemporary meaning of legal certainty. The book focuses on exploring the emerging tensions that exist between the demand for legal certainty and the challenges of regulating complex, late modern societies. The book is divided into two parts: the first part focusing on debates around legal certainty at the national level, with a primary emphasis on criminal law; and the second part focusing on debates at the transnational level, with a primary emphasis on the regulation of transnational commercial transactions. In the context of legal modernity, the principle of legal certainty—the idea that the law must be sufficiently clear to provide those subject to legal norms with the means to regulate their own conduct and to protect against the arbitrary use of public power—has operated as a foundational rule of law value. Even though it has not always been fully realized, legal certainty has functioned as a core value and aspiration that has structured normative debates throughout political modernity, both at a national and international level. In recent decades, however, legal certainty has come under increasing pressure from a number of competing demands that are made of contemporary law, in particular the demand that the law be more flexible and responsive to a social environment characterized by rapid social and technological change. The expectation that the law operates in new transnational contexts and regulates every widening sphere of social life has created a new degree of uncertainty, and this change raises difficult questions regarding both the possibility and desirability of legal certainty. This book compiles, in one edited volume, research from a range of substantive areas of civil and criminal law that shares a common interest in understanding the multi-layered challenges of defining legal certainty in a late modern society. The book will be of interest both to lawyers interested in understanding the transformation of core rule of law values in the context of contemporary social change and to political scientists and social theorists.

    Abstract: The book considers the changes which national sovereignty has undergone through the supranational European integration. In various contributions by renowned academics and high judges demonstrate the serious impacts of supranationality on the EU member states and even on third countries which are connected with the EU by international treaties. It becomes clear that primacy of EU law, the most significant expression of supra-nationality, collides with national sovereignty as anchored in the national constitutions. The studies clearly show that most member states do not fully deny EU law primacy but are aware of the need to find an adequate balance between the supranational and the national orders. The result from the analyses of the authors from various European countries is that the upcoming constitutional paradigm is “constitutional identity”, a concept established by jurisprudence in Germany, France, Czech Republic (without being named so) and debated also in Poland which, herself, denies supranational impact on the national Constitution entirely. Studies on selected EU member states clarify the specific national approaches towards the limitations of their sovereignty as developed by the constitutional jurisprudence (Poland, Czech Republic, Hungary, Romania, Italy, Germany with comparative references to United Kingdom and France). It is illuminated that traditionally strong sovereignty concepts (UK, France) are considerably relativized and functionally opened towards the integration challenges. Basic issues are furthermore reflected, such as the supranational impact on the State’s power to reform its Constitution, the relation of national and constitutional identity and the national and supranational perspectives of identity. The book also includes Europe beyond the EU by research on the supranational character of association treaties (from a Ukrainian perspective) and on the Europeanization of a third country preparing EU membership (Albania).

    Abstract: This book investigates first language (L1) and second language (L2) use in Chinese university classrooms, focusing on the experiences of four Chinese EFL teachers who were teaching non-English major students at four different proficiency levels.     Abstract: This book focuses on how instruction affects English learners’ use of Theme and thematic progression (thematic organization). While thematic organization in learner English has been extensively studied, little research has been done to investigate the effects of instruction on the use of Theme and thematic progression. Adopting a Systemic Functional Grammar approach, this study explores how a ten-week instruction on thematic organization affects Chinese college students’ use of Theme and thematic progression by comparing their English essays before and after the instruction, with native-speaker essays as the research baseline. Second-language acquisition researchers, curriculum developers and foreign language teachers will find this book useful as it not only presents a clear and detailed report of how Chinese college students learn to make better thematic choices, but also provides a well-developed instructional package on Theme and thematic progression.

    Abstract: This book offers a comprehensive survey of the major parts of speech in Mandarin.     Abstract: This book shows six different realities of same-sex families. They range from full recognition of same-sex marriage to full invisibility of gay and lesbian individuals and their families. The broad spectrum of experiences presented in this book share some commonalities: in all of them legal scholars and civil society are moving legal boundaries or thinking of spaces within rigid legal systems for same-sex families to function. In all of them there have been legal claims to recognize the existence of same-sex families. The difference between them lies in the response of courts. Regardless of the type of legal system, when courts have viewed claims of same-sex couples and their families as problems of individual rights, they have responded with a constitutional narrative protecting same-sex couples and their families. When courts respond to these claims with rigid concepts of what a family is and what marriage is as if legal concepts where unmodifiable, same-sex couples have remained outside the protection of the law. Until forty years ago marriage was the only union considered legitimate to form a family. Today more than 30 countries have granted rights to same sex couples, including several that have opened up marriage to couples of the same sex. Every day there is a new bill being discussed or a new claim being brought to courts seeking formal recognition of same sex couples. Not all countries are open to changing their legal structures to accommodate same-sex couples, but even those with no visible changes are witnessing new voices in their communities challenging the status quo and envisioning more flexible legal systems

    Abstract: This book deals with the theoretical, methodological, and empirical implications of bounded rationality in the operation of institutions. It focuses on decisions made under uncertainty, and presents a reliable strategy of knowledge acquisition for the design and implementation of decision-support systems. Based on the distinction between the inner and outer environment of decisions, the book explores both the cognitive mechanisms at work when actors decide, and the institutional mechanisms existing among and within organizations that make decisions fairly predictable. While a great deal of work has been done on how organizations act as patterns of events for (boundedly) rational decisions, less effort has been devoted to study under which circumstances organizations cease to act as such reliable mechanisms. Through an empirical strategy on open-ended response data from a survey among junior judges, the work pursues two main goals. The first one is to explore the limits of “institutional rationality” of the Spanish lower courts on-call service, an optimal scenario to observe decision-making under uncertainty. The second aim is to achieve a better understanding of the kind of uncertainty under which inexperienced decision-makers work. This entails exploring the demands imposed by problems and the knowledge needed to deal with them, making this book also a study on expertise achievement in institutional environments. This book combines standard multivariate statistical methods with machine learning techniques such as multidimensional scaling and topic models, treating text as data. Doing so, the book contributes to the collaboration between empirical social scientific approaches and the community of scientists that provide the set of tools and methods to make sense of the fastest growing resource of our time: data

    Abstract: This volume provides a comprehensive analysis of why taxpayers behave the way they do. It reveals the motivations for why some taxpayers comply with the law while others choose not to comply. Given the current global financial climate there is a need for governments worldwide to increase their revenue collections via improving taxpayer compliance. Research into what shapes and influences taxpayer behavior is critical in that any marginal improvement in understanding and dealing with this behavior can potentially have a dramatic impact upon government revenue. Based on Australian data derived from the data bases of the Australian Taxation Office as an example, this book presents findings that provide lessons for tax systems around the world. Regardless of the type of tax system in place, taxpayers of all nationalities are concerned about how their tax authorities deal with non-compliance and in particular how the tax authorities go about encouraging compliance and ensuring a fair tax system for all. The book presents empirical evidence concerning taxpayer compliance behavior with particular attention being drawn to the moral values of taxpayers, the perceived fairness of the tax system and the deterrent measures undertaken by revenue authorities which influence that behavior. Other issues examined include the degree to which tax penalties operate as an effective deterrent to curbing behavior and how taxpayers' level of general tax knowledge and awareness also impacts upon their actions

    Abstract: This volume addresses the role of the judge and the parties in civil litigation in mainland China, Hong Kong and various European jurisdictions. It provides an overview and an analysis of how these respective roles have been changed in order to cope with growing caseloads and quality demands. It also shows the different approaches chosen in the jurisdictions covered. Mainland China is introducing far-reaching reforms in its system of civil litigation. From an inquisitorial procedure, in which the parties play a relatively minor role, the country is changing to a more adversarial system with increased powers for the parties. At the same time, case management and the role of the judge as it is understood in mainland China remains different from case management and the role of the judge in Western countries, mainly as regards the limited powers of individual Chinese judges in this respect. Changes in China are justified by the ever-increasing case load of the Chinese courts and the consequent inability to deal with cases in an adequate manner, even though generally speaking Chinese courts still adjudicate civil cases within a relatively short time frame (this may, however, be problematic when viewed from the perspective of the quality of adjudication). Growing caseloads and quality concerns may also be observed in various European states and Hong Kong. In these jurisdictions the civil procedural systems have a relatively adversarial character and it is some of the adversarial features of the existing systems of procedure which are felt to be problematic. Therefore, the lawmakers have opted for increasing the powers of the judge, often making the judge and the parties mutually responsible for the proper conduct of civil cases. Starting from opposite directions, mainland China and the various European states and Hong Kong could meet half way in their reform attempts. This is, however, only possible if a proper understanding is fostered of the developments in these different parts of the World. Even though in both China and Europe the academic community and lawmakers are showing a keen interest in the relevant developments abroad, a study addressing the role of the judge and the parties in civil litigation in both China and Europe is still missing.     Abstract: This book discusses all critical privacy and data protection aspects of biometric systems from a legal perspective. It contains a systematic and complete analysis of the many issues raised by these systems based on examples worldwide and provides several recommendations for a transnational regulatory framework. An appropriate legal framework is in most countries not yet in place. Biometric systems use facial images, fingerprints, iris and/or voice in an automated way to identify or to verify (identity) claims of persons. The treatise which has an interdisciplinary approach starts with explaining the functioning of biometric systems in general terms for non-specialists. It continues with a description of the legal nature of biometric data and makes a comparison with DNA and biological material and the regulation thereof. After describing the risks, the work further reviews the opinions of data protection authorities in relation to biometric systems and current and future (EU) law. A detailed legal comparative analysis is made of the situation in Belgium, France and the Netherlands. The author concludes with an evaluation of the proportionality principle and the application of data protection law to biometric data processing operations, mainly in the private sector. Pleading for more safeguards in legislation, the author makes several suggestions for a regulatory framework aiming at reducing the risks of biometric systems. They include limitations to the collection and storage of biometric data as well as technical measures, which could influence the proportionality of the processing. The text is supported by several figures and tables providing a summary of particular points of the discussion. The book also uses the 2012 biometric vocabulary adopted by ISO and contains an extensive bibliography and literature sources

    Abstract: This monograph addresses the legal and policy issues relating to the commercial exploitation of natural resources in outer space. It begins by establishing the economic necessity and technical feasibility of space mining today, an estimate of the financial commitments required, followed by a risk analysis of a commercial mining venture in space, identifying the economic and legal risks. This leads to the recognition that the legal risks must be minimised to enable such projects to be financed. This is followed by a discussion of the principles of international space law, particularly dealing with state responsibility and international liability, as well as some of the issues arising from space mining activities. Much detail is devoted to the analysis of the content of the common heritage of mankind doctrine. The monograph then attempts to balance such interests in creating a legal and policy compromise to create a new regulatory regime.

    Abstract: This volume explores the interpretation of indefinites and the constraints on their distribution by paying particular attention to key issues in the interface between syntax and semantics: the relation between the semantic properties of indefinite determiners and the denotation of indefinite DPs, their scope, and their behaviour in generic and conditional sentences. Examples come from French, other Romance languages and English. Central to the proposed analyses is a distinction between two types of entities, individualized entities and amounts. Weak indefinites are analyzed as existential generalized quantifiers over amounts and strong indefinites as either Skolem terms or generalized quantifiers over individualized entities. The up-to-date review of the literature and the new falsifiable proposals contained in this book will be of particular interest to linguistics students and scholars interested in the cross-linguistic semantics of indefinites.

    Abstract: This comprehensive treatment of several phenomena in Distributed Morphology explores a number of topics of high relevance to current linguistic theory. It examines the structure of the syntactic and postsyntactic components of word formation, and the role of hierarchical, featural, and linear restrictions within the auxiliary systems of several varieties of Basque. The postsyntactic component is modeled as a highly articulated system that accounts for what is shared and what exhibits variation across Basque dialects. The emphasis is on a principled ordering of postsyntactic operations based on their intrinsic properties, and on the relationship between representations in the Spellout component of grammar with other grammatical modules. The analyses in the book treat related phenomena in other languages and thereby have much to offer for a general morphology readership, as well as those interested in the syntax-morphology interface, the theory of Distributed Morphology, and Basque.

    Abstract: The book investigates the role of law and legal experts in the organisational dynamics of a population, demonstrating that law is a stable practice among those who (in virtue of the special knowledge they master) are called upon to select the normative facts of a population, i.e. the interactional standards that are proclaimed as binding for the entire population by the publicly recognised legal experts (whose peremptory judgments can be only revised by peers). It proposes an integration of the recent research outcomes achieved in three different areas of study: legal positivism, legal institutionalism and legal pluralism and examines the notions of rule, coercion, institution, practice elaborated by significant theorists in the mentioned areas and illumine both their merits and flaws. But philosophers, sociologists and anthropologists still hold many debates on the nature of law and its function, which is that law represents an institution that characterizes any orderly social context of human beings, and this book plunges into the center of those debates. Self-sufficiency of Law: A Critical-institutional Theory of Social Order investigates the role of law and legal experts in the organizational dynamics of a population.     Abstract: Covering a strikingly diverse range of languages from 12 linguistic families, this handbook is based on responses to a questionnaire constructed by the editors. Focusing on the formation, distribution and semantic interpretation of quantificational expressions, the book explores 17 languages including German, Italian, Russian, Mandarin Chinese, Malagasy, Hebrew, Pima, Basque, and more. The language data sets enable detailed crosslinguistic comparison of numerous features. These include semantic classes of quantifiers (generalized existential, generalized universal, proportional, partitive), syntactically complex quantifiers (intensive modification, Boolean compounding, exception phrases) and several others such as quantifier scope ambiguities, quantifier float, and binary quantifiers. Its theory-independent content extends earlier work by Matthewson (2008) and Bach et al. (1995), making this handbook suitable for linguists, semanticians, philosophers of language and logicians alike. Edward L. Keenan is Distinguished Professor of linguistics at theUniversity of California at Los Angeles. He received his PhD in Formal Linguistics from The University of Pennsylvania in 1969 for a thesis on A Presupposition Logic for Natural Language. He is a member of the American Academy of Arts and Sciences as well as the American Association for the Advancement of Science. He has published in numerous areas of linguistics, including syntactic typology, formal semantics, theoretical syntax, historical syntax, and Austronesian linguistics. He has co-authored two books: Boolean Semantics for Natural Language (1985), with Leonard Faltz, and Bare Grammar: Lectures on Linguistic Invariants, with Edward P. Stabler (2003). Denis Paperno is a graduate of the Moscow State University andcurrently a PhD candidate at the University of California at Los Angeles. He has done fieldwork in the Komi Republic, the Udmurt Republic, the Caucasus, and W. Africa and has written a grammar of Beng (Mande; Cote d'Ivoire) (in Russian). In addition to African linguistics he has published in semantics and syntactic typology.

    Abstract: As computer technology develops, spoken dialogue is becoming ever-more important when interacting with a wide variety of technological devices, including Personal Digital Assistants, tablet PCs, and mobile phones. Using speech leads to more natural and user-friendly interfaces. More specifically, the authors of this volume contend that the experience of talking to our computerized gadgets may be greatly improved by dynamically adapting the system's dialogue interaction style to the user's profile and emotional status. In this book, a novel approach that combines speech-based emotion recognition with adaptive human-computer dialogue modeling is described. With the robust recognition of emotions from speech signals as their goal, the authors analyze the effectiveness of using a plain emotion recognizer, a speech-emotion recognizer combining speech and emotion recognition, and multiple speech-emotion recognizers at the same time. The semi-stochastic dialogue model employed relates user emotion management to the corresponding dialogue interaction history and allows the device to adapt itself to the context, including altering the stylistic realization of its speech. This comprehensive volume begins by introducing spoken language dialogue systems and providing an overview of human emotions, theories, categorization and emotional speech. It moves on to cover the adaptive semi-stochastic dialogue model and the basic concepts of speech-emotion recognition. Finally, the authors show how speech-emotion recognizers can be optimized, and how an adaptive dialogue manager can be implemented. The book, with its novel methods to perform robust speech-based emotion recognition at low complexity, will be of interest to a variety of readers involved in human-computer interaction.

    Abstract: Addressing an issue that has puzzled the linguistics community for many years, this book offers a novel approach to the exceptional wide scope behaviour of indefinites. It is the first book explicitly dedicated to exceptional wide scope phenomena. Its unique approach offers an explanation for the fact that it is only a proper subset of the indefinites that shows this exceptional wide scope behaviour. The author draws a careful distinction between genuine and apparent scope readings, a distinction that is usually not taken care of and has thus led to certain confusions. In particular, it is argued that functional readings have to be kept strictly apart from non-functional ones and that all proposals that use functional mechanisms to explain the phenomena at hand face severe problems. The existing body of literature on the main issues of the book is thoroughly reviewed. This makes the book well suited as background literature for graduate seminars on those topics.

    Abstract: Carlota S. Smith was a key figure in linguistic research and a pioneering woman in generative linguistics. This selection of papers focuses on the research into tense, aspect, and discourse that Smith completed while Professor of Linguistics at the University of Texas at Austin. Smith's early work in English syntax is still cited today, and her early career also yielded key research on language acquisition by young children. Starting in the mid-1970s, after her move to UT, she embarked on her most important line of research. In numerous papers - the first of which was published in 1975 - and in a very important 1991 book (The Parameter of Aspect), Smith analyzed how languages encode time and how they encode the ways events and situations occur over time. Smith's work on the expression of time in language is notable because of its careful analyses of a number of quite different languages, including not only English and French, but also Russian, Mandarin, and Navajo. Inspired by a year in France in the early 1970s, Smith began to analyze the differing ways in which languages encode time and how they encode the ways events and situations occur over time. In doing so, she developed her signature 'two-component' theory of aspect. This model of temporal aspect provided an excellent framework for graduate students seeking to analyze the temporal systems of an array of languages, including under-described languages that are so much the focus of research in UT's Linguistics Department. Selected by Carlota Smith herself and by her longtime friends and colleagues, this book contains her 1980 piece on temporal structures in discourse, her 1986 comparison of the English and French aspectual systems, a 1996 paper on the aspect system in Navajo (an increasingly-endangered language which Smith worked to preserve), and her 1980 and 1993 papers on the child's acquisition of tense and aspect. Smith, who died in 2007, was a trailblazer in her field whose broad interests fed into her scholarly research. She was an avid reader who sought to bring the analytic tools of linguistics to the humanistic study of literature, by examining the syntactic and pragmatic principles which underlie literary effects. Her research on rhetorical and temporal effects in context was integrated into her last book, Modes of Discourse (2003). The current volume of articles covers much of her most fruitful work on the way in which language is used to express time, and will be essential reading for many working and studying in linguistics generally and in semantics particularly.

    Abstract: During the last decades, legal theory has focused almost completely on norms, rules and arguments as the constitutive elements of law. Concepts were mostly neglected. The contributions to this volume try to remedy this neglect by elucidating the role concepts play in law from different perspectives. A main aim of this volume is to initiate a debate about concepts in law. Åke Frändberg gives an overview of the many different uses of concepts in law and shows amongst others that concepts in the law should not be confused with the role of concepts in descriptions of the law. Dietmar von der Pfordten criticizes the restriction to norms as parts of the law in contemporary legal theory by questioning what concepts are and what their function is, both in general and in legal conceptual schemes. Giovanni Sartor assumes the inferential analysis of meaning proposed by Alf Ross in his ground breaking paper Tû-tû and addresses the question how possession of a concept, including the rules defining it, is possible without endorsing these rules. Jaap Hage argues that 1. legal status words such as 'owner' have a meaning because they denote things or relations in institutional reality, 2. the meaning of these words consists in this denotation relation, 3. knowledge of this meaning presupposes knowledge of the rules governing these words. Torben Spaak contributes to this volume with an exemplary analysis of one of the most central concepts of the law, namely that of a legal power. Lorenz Kähler discusses the role of concepts in determining the scope of application of legal rules and raises from this perspective the question to what extent legal concept formation can be arbitrary. Ralf Poscher argues that as soon as a concept is used in stating the law, the precise scope of application of this concept has become a legal matter.

Volume 9: A History of the Philosophy of Law in the Civil Law World, 1600-1900 edited by Damiano Canale, Paolo Grossi and Hasso Hofmann Provides an in-depth study of the different ways of understanding law which were developed from the mid-17th century to the end of the 19th century by jurists and legal philosophers working in the civil-law tradition. In particular, the book collects chapters offering a systematic history of the basic legal concepts and of the disciplines that systematized them in a set form in the legal thought of Continental Europe. The first two chapters discuss the way the scientific method elaborated and firmed up by modern natural-law theory was received into European legal science in the period leading to the French Revolution, with Chapter 1 focusing on the Germanic area, and Chapter 2 instead on the French area. Chapter 3 is devoted to the European legal Enlightenment, and to the reverberations this movement had on the culture as well as on the politics of law. Chapter 4 discusses the codification of law, describing in what ways and to what degree codification shaped the structure of Europe's legal systems and the organization of its society through law. Chapter 5 traces out the development of German legal science through the crisis of modern natural-law theory and the birth of the great European codes, considering in particular the birth of the Historical School of law and its later development with Puchta. Chapter 6 reconstructs the birth and evolution of the modern science of administration, which played a central role in helping the institutions of the modern state become woven into the social and economic fabric. Chapter 7 is dedicated to the history of European constitutionalism. Chapter 8 discusses the crisis of conceptual jurisprudence, the voluntarist and vitalistic conceptions this crisis led to, and the birth of neo-idealist movements in the late 19th and early 20th centuries. The volume editors and contributors are international leading specialists from Italy, France, Spain, and Germany. Volume 10: The Philosophers' Philosophy of Law from the Seventeenth Century to Our Days by Patrick Riley Offers a comprehensive and original treatment of the philosophers' philosophy of law from Grotius to the ""left Kantianism"" of Rawls and Habermas. The volume also discusses some ""philosophers of law"" who are not philosophers in a broader sense, but who cannot be omitted because certain far greater ""real"" philosophers would then become unintelligible. The philosophy of law is viewed in this work as a final outgrowth of a more general moral philosophy, and that moral philosophy in turn as an outgrowth of ""first philosophy"" (metaphysics, epistemology, theology). Special prominence is given to Leibniz, Malebranche, and Kantianism. Leibniz combines philosophical and jurisprudential greatness in a way achieved by no other. Since Leibniz has never been rendered his jurisprudential ""due"" in English, the present volume offers an occasion for that rectification. On the other hand, without Malebranche's contribution, the jurisprudence of Montesquieu and of Rousseau would not exist. Finally, Kantianism is crucial not only because of its influence on early Marx, Rawls, and Habermas, but also because the central Kantian practical notions seem to be the best moral-legal principles for a contemporary, non-theocratic, non-utilitarian world. Though the volume begins mainly with the ""17th century,"" the author nonetheless offers a ""Prologue on Machiavelli."" This is simply because certain later figures are hard to make intelligible without a knowledge of ""Machiavelism""-this applies above all to Hobbes, Leibniz, Rousseau, Hegel, and Nietzsche. The author is an outstanding legal and political philosopher. Pupil of Michael Oakeshott, John Rawls, Judith Shklar, Carl J.     Abstract: Number is a major research domain in semantics, syntax and morphology. However, no current theory of number is applicable to all three fields. In this work, Harbour argues that a unified theory is not only possible, but necessary for the study of Universal Grammar. Through insightful analysis of unfamiliar data, he shows that one and the same feature set is implicated in semantic and morphological number phenomena alike, with syntax acting as the conduit between the two. At the heart of the study is an original treatment of Kiowa, a North American language with a remarkable constellation of characteristics, including semantically based noun classification and complex agreement morphology.     Abstract: This book is based on publications from the ISCA Tutorial and Research Workshop on Multi-Modal Dialogue in Mobile Environments held at Kloster Irsee, Germany, in 2002. The workshop covered various aspects of devel- ment and evaluation of spoken multimodal dialogue systems and components with particular emphasis on mobile environments, and discussed the state-- the-art within this area. On the development side the major aspects addressed include speech recognition, dialogue management, multimodal output gene- tion, system architectures, full applications, and user interface issues. On the evaluation side primarily usability evaluation was addressed. A number of high quality papers from the workshop were selected to form the basis of this book. Whereas existing journals provide space to medium - and large sized articles, they neglect the small but poignant contributions, which may be as important as the extended, detailed study. The yearbook Zutot serves as a platform for small but incisive contributions, and provides them with a distinct context.
