    Abstract: Clinics have dealt with a range of victims' rights issues in trial courts, including the rights to be present, to be consulted about plea offers, to make an impact statement, to be notified of changes in defendants' detention status, to restitution, and to privacy. However, the principal issue has been victims' standing before the court to enforce their rights. In some states, standing has been acknowledged, at least in limited ways. In other states, clinics have made or are making steps toward such recognition or have been successful in representing victims without the issue being directly confronted. In one state, attorneys' ability to represent victims in criminal court is currently in serious question. This book discusses how some clinics have won significant gains at the appellate and federal court levels concerning victim standing, the rights to be consulted and heard, and the right to privacy. The authors conclude that the state clinics are beginning to fulfill the intentions of their architects and funders. All of the clinics have pushed the envelope of victims' rights in their state courts. Some have won significant victories in gaining standing for victims and expanding the definition of particular rights. Others are enjoined in the battle. But all have raised awareness of victims' rights with prosecutors, judges, defense attorneys, and police officials

    Abstract: As Russia's economy has grown, so have the country's global involvement and influence, which often take forms that the United States neither expects nor likes, as the August 2008 conflict in Georgia demonstrated. Despite the two countries' many disagreements and the rising tension between them, the United States and Russia share some key interests and goals. In this monograph, the authors assess Russia's strategic interests and the factors that influence Russian foreign policy broadly. They examine Russia's domestic policies, economic development, and views of the world, as well as how these translate into security policies at home and abroad. They then consider the implications of Russia's evolving approaches for U.S. interests. The authors find that Russia's rising confidence will continue to create challenges for U.S. policymakers. The U.S. goal must therefore be to improve relations with Russia and build on shared views and shared interests, rather than to pursue coercive mechanisms that can easily backfire. Among other steps, the authors recommend that Washington vigorously pursue new arms control agreements with Moscow allay Russian fears about proposed U.S. missile defenses in Europe reevaluate its promotion of energy pipeline routes that circumvent Russia resume consistent, high-level consultations, including military-to-military contacts. If Russo-U.S. relations do not improve, the United States must find ways to keep poor relations with Russia from turning into adversarial ones. The Department of Defense and U.S. Air Force have important roles to play in either scenario

    Abstract: Exposure to community and interpersonal violence is a public health crisis that adversely affects many children in American communities. After witnessing or experiencing trauma, many children experience symptoms of Post-Traumatic Stress Disorder and depression, behavioral problems, substance abuse, and poor school performance. The Support for Students Exposed to Trauma (SSET) program is a series of ten lessons whose structured approach aims to reduce distress resulting from exposure to trauma. Designed to be implemented by teachers or school counselors in groups of 8-10 middle school students, the program includes a wide variety of skill-building techniques geared toward changing maladaptive thoughts and promoting positive behaviors. It is also intended to increase levels of peer and parent support for affected students. Designed for SSET group leaders, the Group Leader Training Manual introduces the SSET concept and provides detailed information on selecting student participants, scheduling lessons, assuring confidentiality, coordinating with clinical backup, managing difficult situations and issues, and conducting group meetings. The Lesson Plans section supplies group leader preparation information and in-depth plans for each lesson, including agendas, example scenarios, suggestions for troubleshooting specific problems, homework assignment instructions, and cross-references to other program documentation. Take-home worksheets, letters to parents, forms, and other program materials are supplied in the section entitled Lesson Worksheets and Materials

In thinking about emerging threats, security planners are confronted by a panoply of possible future scenarios coming from sources ranging from the terrorists themselves to red-team brainstorming efforts to explore ways adversaries might attack in the future. This paper explores an approach to assessing emerging and/or novel threats and deciding whether, or how much, they should concern security planners by asking two questions: (1) Are some of the novel threats 'niche threats' that should be addressed within existing security efforts? (2) Which of the remaining threats are attackers most likely to execute successfully and should therefore be of greater concern for security planners? If threats can reasonably be considered niche threats, they can be prudently addressed in the context of existing security activities. If threats are unusual enough, suggest significant new vulnerabilities, or their probability or consequences means they cannot be considered lesser included cases within other threats, prioritizing them based on their ease of execution provides a guide for which threats merit the greatest concern and most security attention. This preserves the opportunity to learn from new threats yet prevents security planners from being pulled in many directions simultaneously by attempting to respond to every threat at once."--Page 4 of cover

The authors identify the primary and secondary civilian agencies that should be involved in strategic-level planning and implementation of SSTR operations. Then, relying on available information on Provincial Reconstruction Teams and using a variety of federal databases, the authors identify the skill sets needed for the envisioned Field Advance Civilian Teams and where these skills reside in the federal government. The authors then assess the capacity of the main civilian agencies to participate in SSTR operations and analyze the recurring structural problems that have plagued their attempts to do so. The authors suggest a series of options that are worth considering in order to improve the current situation. Even without much action at the national level, the Army can still improve the situation by improving Army Civil Affairs and by executing a well-thought-out strategy of liaison officers assigned to the civilian agencies most important for SSTR operations

    Abstract: The military operations in Iraq and Afghanistan have been the United States' longest military engagements since the Vietnam War and the most severe test of the all-volunteer force, with the possible exception of the Gulf War in 1991. More than 1.5 million service members were deployed between 2002 and 2007, many of them more than once, and the fast pace of deployment has been felt throughout the military. Soldiers and marines have faced a steady cycle of predeployment training and exercises, deployment itself, and postdeployment reassignment and unit regeneration. Service members not on deployment are nonetheless busy planning and supporting military operations, caring for injured service members, and attending to recruiting, training, and other responsibilities at home and abroad. Many service members are married, and deployments have disrupted their family routines and created stress from separation and reintegration. At the same time, the long hours, tension, uncertainty, and violence of deployments have stressed the service members sent to fight. Remarkably, despite the pressures from deployments on service members and their families, reenlistment rates have been stable since 2002.     Abstract: In 2007, on a net basis, the United States imported 58 percent of the oil it consumed. This book critically evaluates commonly suggested links between these oil imports and U.S. national security. The major risk to the United States posed by reliance on oil is the economic costs of a major disruption in global oil supplies. On the other hand, the study found no evidence that oil exporters have been able to use embargoes or threats of embargoes to achieve key political and foreign policy goals. Oil revenues are irrelevant for terrorist groups' ability to launch attacks. The study also assesses the economic, political, and military costs and benefits of potential policies to alleviate challenges to U.S. national security linked to imported oil. Of these measures, the adoption of the following energy policies by the U.S. government would most effectively reduce the costs to U.S. national security of importing oil: (1) Support well-functioning oil markets and refrain from imposing price controls or rationing during times of severe disruptions in supply. (2) Initiate a high-level review of prohibitions on exploring and developing new oil fields in restricted areas in order to provide policymakers and stakeholders with up-to-date and unbiased information on both economic benefits and environmental risks from relaxing those restrictions. (3) Ensure that licensing and permitting procedures and environmental standards for developing and producing oil and oil substitutes are clear, efficient, balanced in addressing both costs and benefits, and transparent. (4) Impose an excise tax on oil to increase fuel economy and soften growth in demand for oil. (5) Provide more U.S. government funding for research on improving the efficiency with which the U.S. economy uses oil and competing forms of energy.--Publisher description

    Abstract: Experiences from recent emergencies, such as Hurricanes Katrina and Rita, have shown that current emergency preparedness plans are inadequate to address the unique issues of special needs populations. This toolkit is meant to assist state and local public health agencies improve their emergency preparedness activities. It distills the most relevant strategies, practices, and resources from a variety of sources, including peer-reviewed research, government reports, the trade literature, and public health leaders, to identify priority populations and critical strategies. The contents include potential strategies for addressing special needs, summaries of promising practices implemented in communities across the country, information on how to select one or more practices that will work in a specific community, information on how to determine whether a practice is working, and a Web-based Geographic Information Systems (GIS) tool to identify and enumerate those with special needs in communities across the United States. Used together, this toolkit and the GIS tool are intended to provide a comprehensive resource to enable public health planners to account for special needs populations in their emergency preparedness efforts

    Abstract: If the Department of Defense (DoD) moves toward a more integrated employee health system, a foundation of information about the current system and requisite elements for such integration will be needed. The authors reviewed the research literature and DoD policy documents and interviewed DoD personnel to make several observations about the current state of safety and occupational health (SOH) arrangements in DoD. Currently, SOH policy cuts across several organizations at high levels in the Office of the Secretary of Defense, and SOH programs are implemented by each of the military services. Recently, leadership attention has focused on safety, mostly apart from occupational health, as a separate priority. DoD and the services have made efforts to increase coordination, including both high-level formal councils and through informal relationships among SOH practitioners. Health promotion and wellness have received considerable attention within DoD through periodic health assessments and educational programs, yet these areas have not benefited from the same increased coordination. As DoD contemplates a more integrated approach, the authors considered what DoD might learn from civilian experience with integrating employee health activities. To address this, the authors reviewed civilian models of integration to identify promising approaches and practices that might inform DoD efforts. The review of activities related to employee health in DoD -- including industrial hygiene, safety, health promotion and wellness, occupational health, and its relatively mature health information technology infrastructure -- indicates that there might be little need for DoD to introduce new programs but more need to make use of the information generated by the existing programs in a more coordinated, integrated manner

RAND's PortMan method enables the data-driven analysis of project portfolios and provides a means to monitor the progress of potentially high-value projects. It also allows portfolio managers to monitor the impact of any mitigation strategies they undertake, ensuring that the portfolio's highest potential value is achieved. For this project, RAND researchers first employed the Delphi method, a process for eliciting group opinion by a series of questionnaires with selective feedback from earlier responses, to collect expert opinion from the ISS Senior Leadership Group. This allowed for an estimation of value and risk for each project. RAND then used these estimates, together with cost information provided by ISS, to develop project rankings and to estimate the expected value-to-cost ratio for each project. RAND selected portfolios of projects that maximized the total expected value for the available program budget using a linear programming method and compared these results to ISS management's funding priorities

    Abstract: The vast size and highly unregulated nature of the world's waterways have made the maritime environment an attractive theater for perpetrators of transnational violence. Both piracy and sea-borne terrorism have become more common since 2000 due to the global proliferation of small arms as well as growing vulnerabilities in maritime shipping, surveillance, and coastal and port-side security. In addition to massive increases in maritime traffic, pirates have profited from increasingly congested maritime chokepoints, the lingering effects of the Asian financial crisis, and weakened judicial and governmental structures. Some analysts also fear that terrorists may soon exploit the carefully calibrated freight trading system to trigger a global economic crisis, or use the container supply chain to transport weapons of mass destruction. While speculation about an emerging tactical nexus between piracy and terrorism is complicating the maritime threat picture, credible evidence to support this presumed convergence has yet to emerge. Since 2002, the United States--one of the world's principal maritime trading states--has spearheaded several important initiatives to improve global and regional maritime security. Although an important contribution, the author urges policymakers to consider four additional measures to better safeguard the world's oceans: helping to further expand the post-9/11 maritime security regime; conducting regular and rigorous threat assessments; assisting with redefining mandates of existing multilateral security and defense arrangements; and encouraging the commercial maritime industry to make greater use of enabling communication and defensive technologies and accept a greater degree of transparency in its corporate structures

Such strategies depend on the involvement and education of adolescents, parents, law enforcement officials, merchants, and other stakeholders. This guide is designed to take communities through the process of planning, implementing, and evaluating strategies to prevent underage drinking and youth access to alcohol. The guide is structured according to the Substance Abuse and Mental Health Services Administration's (SAMHSA's) Strategic Prevention Framework, a five-step prevention approach. Within the five steps, the guide adopts the Getting To Outcomes model of empowerment evaluation, results-based accountability, and continuous quality improvement. The result is a comprehensive, step-by-step manual for developing, implementing, and evaluating a high-quality communitywide plan to prevent underage drinking and its related consequences. Recommendations include the development of educational strategies for parents, adolescents, and alcohol merchants; attracting the involvement of civic leaders; working to reform legislation governing underage access to alcohol; and training law enforcement officials to be vigilant but safe in their efforts to police underage drinking in the community

    Abstract: The relative roles of U.S. ground and air power have shifted since the end of the Cold War. At the level of major operations and campaigns, the Air Force has proved capable of and committed to performing deep strike operations, which the Army long had believed the Air Force could not reliably accomplish. If air power can largely supplant Army systems in deep operations, the implications for both joint doctrine and service capabilities would be significant. To assess the shift of these roles, the author of this report analyzed post-Cold War conflicts in Iraq (1991), Bosnia (1995), Kosovo (1999), Afghanistan (2001), and Iraq (2003). Because joint doctrine frequently reflects a consensus view rather than a truly integrated joint perspective, the author recommends that joint doctrine-and the processes by which it is derived and promulgated-be overhauled. The author also recommends reform for the services beyond major operations and campaigns to ensure that the United States attains its strategic objectives. Finally, to understand whether best practices alone make a company diversity-friendly, they compare a number of characteristics of best diversity companies, best HR companies, and other companies, using quantitative and qualitative methods. They find that firms recognized for diversity are distinguished by a core set of motives and practices that resemble those presented in the best-practices literature, but that best practices per se may not enable a company to achieve a high level of diversity.     Abstract: There has been ongoing concern that some regulations, rules, and government policies place a disproportionate burden on small businesses and entrepreneurs. For this reason, small businesses often receive special regulatory treatment, such as exemptions from legislation or extended deadlines for compliance. However, the desire to support small businesses can come into conflict with the interest in addressing the concerns that led to the regulation or policy in the first place. Moreover, it is often unclear whether special regulatory treatment for small businesses is having the intended effect. This book sheds light on these issues through analysis of the regulatory and public policy environment with regard to small businesses, including focused studies in four key areas: health insurance, workplace safety, corporate governance, and business organization. The authors offer support for the idea that the regulatory environment has a different effect on the behavior of small businesses than it has on that of large ones. However, they also demonstrate that policies designed specifically to help small businesses do not always have the intended effect. The lack of a consistent definition of small business confounds our understanding of these issues. The book suggests possible directions for future policy that achieves a better balance between the interest in restricting firm behavior through regulation and the desire to encourage small businesses and entrepreneurs

    Abstract: The one-third cut in active-duty manpower at the end of the Cold War, from 2.1 million to 1.4 million in uniform, combined with a shift in the national security environment, has today resulted in the need for longer and repeated deployments, especially for the Army and the Marine Corps, and these deployments have posed challenges for active-duty service members and for their families. The authors undertook the preparation of this monograph with the objective of offering insights into the challenges faced by active-duty service members deployed to Iraq and Afghanistan, the resiliency they and their families have shown in coping with these challenges, and the adequacy of defense manpower policy in assisting members and families. The monograph draws on the perspectives of economics, sociology, and psychology; provides a formal model of deployment and retention; reviews published work; reports on the results of focus groups conducted in each of the services; and presents findings from an analysis of survey data. The focus groups and survey data relate to the period from 2003 to early 2004. Family separation, long work hours both during and preceding deployments, and uncertainty surrounding deployments were some of the more significant stresses associated with deployments that were reported in focus groups. Furthermore, according to focus-group and survey data, even personnel who did not deploy experienced work stress as a result of long hours supporting deployments. The authors use these findings to suggest ways to improve quality of life for deployed and nondeployed personnel and their families, including improved communication home, more effectively structured deployment pays, and, when possible, greater certainty in the timing and length of the deployment cycle. The findings also underscore the importance of individual and unit preparation prior to deployment and the role of unit cohesion during deployment.     Abstract: Improving the ability to respond to bioterrorism and other emergencies is an important challenge facing the U.S. public health system. Despite having a knowledgeable workforce, practice and experience, capacity, and partnerships with other responders in the community, the system₂s ability to respond may depend largely on its structure. This study examines a key question: Are state and local public health agencies related to one another in a way that facilitates emergency response? Specific objectives of this study are to explain the factors influencing the particular ways in which state and local public health systems are organized, how the various types of relationships that exist between state and local public health departments have been arrived at, and, most important, the consequences of such structures and relationships for emergency preparedness. We also examine alternative structures from several different types of service industries (public education, banking, the welfare system, and port authorities). Finally, we recommend concrete strategies to improve public health preparedness. This report will be of interest to policymakers and to public health professionals at the state and local levels who are involved in bioterrorism response and emergency preparedness, as well as to other agencies involved in emergency response

We also examine alternative structures from several different types of service industries (public education, banking, the welfare system, and port authorities). Finally, we recommend concrete strategies to improve public health preparedness.     Abstract: A number of important steps have been taken in recent years to improve the planning and management of Army International Activities (AIA). Still, a need remains, and is widely recognized, for a high-level assessment mechanism to allocate AIA resources more efficiently, execute AIA programs more effectively, and highlight the contributions of AIA to the National Military Strategy, the DoD Security Cooperation Guidance, and The Army Plan. This report presents a framework for assessing the value of the Army's non-combat interactions with other militaries. It provides an overview of AIA programs and establishes their connection to the U.S. government's current strategy for security cooperation. It also provides a matrix of eight AIA "ends," derived from top-level national and Army guidance, and eight AIA "ways," which summarize the various capabilities inherent in AIA programs. Next, the report presents a method for linking AIA "ends" and "ways" that involves a theoretical rationale for security cooperation, selection criteria for AIA "output" and "outcome" indicators, and related measures of performance and effectiveness.     Abstract: U.S. Army Recruiting Command (USAREC) is faced with the challenge of ensuring that the flow of qualified volunteers is adequate to meet future active-duty accession requirements. This report documents research methods, findings, and policy conclusions from a project analyzing human resource management options for improving recruiting production. It details research designed to develop new insights to help guide future recruiter management policies. The research involves econometric analyses of three large and rich datasets. The first analysis compares the career paths of enlisted personnel, including recruiters. The second analyzes individual recruiter characteristics and links those characteristics with their productivity, controlling for a variety of independent factors. Finally, the research focuses on station-level recruiting outcomes, paying close attention to the management options that can affect recruiter production and effort. These empirical analyses demonstrate that various types of human resource management policies can be very helpful in meeting the Army's ambitious recruiting requirements. For example, the findings have implications for human resource policies in the areas of selecting soldiers for recruiting duty, assigning recruiters to stations, missioning to promote equity across recruiters, missioning to increase recruiter productivity, using promotions to motivate and reward recruiters, and screening out recruiters who are under-producing. Although the gains from any individual policy appear to be modest, the cumulative benefits of implementing multiple policies can save the Army hundreds of millions of dollars annually.     Abstract: The global community has suffered recently from newly emerged infectious diseases and from diseases once thought to be in decline. It now faces the threat of a human influenza pandemic arising from the recently emerged avian influenza H5N1 virus. The pace of global travel, migration, and commerce has increased dramatically in recent decades, elevating the risk of a global infectious disease outbreak. The spread of infectious disease can have significant effects on U.S. and world security, destabilizing nations and regions through direct mortality and morbidity, resulting in staggering economic and social loss. Collection and analysis of information about the worldwide incidence of infectious disease is imperative for the United States to understand and respond to disease threats. This study, conducted from July through October 2005, examines infectious disease within the context of national security and assesses the need for and adequacy of information that will enable U.S. policymakers to prevent and respond to such threats. At the center of this research is a review of the link between infectious disease and national security, as well as interviews with policymakers and other stakeholders to assess their information needs. This report includes a list of sources providing public health information and surveillance of infectious diseases worldwide

The evidence base for these exercises, however, remains sparse and the quality of many of these exercises is poor due to insufficient beta testing. Most exercises focus on training and few provide public health agencies (PHAs) with tools to assess exercise performance. This narrow focus limits the ability of PHAs to use tabletop exercises as part of an overall continuous quality improvement effort. In 2003, the U.S. Department of Health and Human Services Office of the Assistant Secretary for Public Health Emergency Preparedness contracted the RAND Corporation to develop and beta test a suite of tabletop exercises that focus on the response of local PHAs (LPHAs) to outbreaks caused by bioterrorism in the first few hours to days of the response. RAND developed the tabletop exercises described in this manual as templates that LPHAs can customize and use to train public health workers in how to detect and response to bioterrorism events and to assess LPHAs' levels of preparedness over time. They were beta tested and refined in 13 LPHAs across the United States over 10 months

Until DHS can know the effectiveness of available risk-reduction alternatives or determine reasonable minimum standards for community preparedness, allocating homeland security resources based on risk is the next best approach; areas at higher risk are likely to have more and larger opportunities for risk reduction than areas at lower risk. This monograph offers a method for constructing an estimate of city risk shares, designed to perform well across a wide range of threat scenarios and risk types. It also proposes and demonstrates a framework for comparing the performance of alternative risk estimates given uncertainty in measuring the elements of risk. Finally, it makes five recommendations for improving the allocation of homeland security resources: DHS should consistently define terrorism risk in terms of expected annual consequences; DHS should seek robust risk estimators that account for uncertainty about terrorism risk and variance in citizen values; DHS should develop event-based models of terrorism risk; until reliable event-based models are constructed, DHS should use density-weighted population rather than population as a simple risk indicator; and DHS should fund research to bridge the gap between terrorism risk assessment and resource allocation policies that are cost-effective
    Abstract: The Department of Homeland Security (DHS) is responsible for protecting the United States from terrorism. It achieves this goal partly through the Urban Areas Security Initiative, which allocates resources to states and urban areas. Until DHS can know the effectiveness of available risk-reduction alternatives or determine reasonable minimum standards for community preparedness, allocating homeland security resources based on risk is the next best approach; areas at higher risk are likely to have more and larger opportunities for risk reduction than areas at lower risk.     Abstract: In the late 1970s and early 1980s, when crude oil prices were high, government and private-sector energy experts took a hard look at the costs and benefits of extracting oil from the vast deposits of oil shale that lie beneath the western United States (much of it under government land). Oil prices soon subsided, and interest in the topic waned. With oil prices again spiking and global demand showing no signs of abating, it makes sense to reexamine the costs and benefits of oil shale development. In this report, the authors describe the oil shale resources (estimated at more than triple the proven oil reserves of Saudi Arabia); the suitability, cost, and performance of technologies for developing these resources; and the key energy, environmental, land-use, and socioeconomic policy issues that need to be addressed by government decisionmakers. The authors conclude by outlining both the challenges and opportunities for early action with regard to those policy issues
