    Abstract: This book examines the deliberate and unintended spatial consequences of feminism's second wave, a social movement dedicated to reconfiguring power relations between women and men. Placing the women's movement of the 1970s in the context of other social movements that have changed the use of urban space, this book argues that reform feminists used the legal system to end the mandatory segregation of women and men in public institutions, while radical activists created small-scale places that gave women the confidence to claim their rights to the public sphere.

    Abstract: This book investigates how human rights law can be applied to corporate entities. To date there have been insufficient international legal mechanisms to bring corporations to justice for their misconduct abroad. The book argues that rather than trying to solve the problem locally, an international approach to corporate human rights compliance needs to be sought to prevent future corporate human rights abuses. Implementing effective and enforceable human rights compliance policies at corporate level allows businesses to prevent negative human rights impacts such as loss of revenue, high litigation costs and damage to reputation. By considering human rights to be an inherent part of their business strategy, corporations will be well equipped to meet national and regional business and human rights standards, which will inevitably be implemented in the next few years. This approach, in turn, also furthers the fundamental aim of international human rights law.

    Abstract: This book looks at the centerpiece of the international women’s rights discourse, the Convention on the Elimination of all Forms of Discrimination against Women (CEDAW), and asks to what extent it affects the lives of women worldwide. Rather than assuming a trickle-down effect, the author discusses specific methods which have made CEDAW resonate. These methods include attempts to influence the international level by clarifying the meaning of women’s rights and strengthening the Convention’s monitoring procedure, and building connections between international and domestic contexts that enable diverse actors to engage with CEDAW. This analysis shows that while the Convention has worldwide impact, this impact is fundamentally dependent on context-specific values and agency. Hence, rather than thinking of women’s rights exclusively as normative content, Zwingel suggests to see them as in process. This book will especially appeal to students and scholars interested in transnational feminism and gender and global governance

    Abstract: Das Werk beschäftigt sich mit der Frage, was genau unter indigenen Landrechten zu verstehen ist, wie sie im internationalen Vergleich realisiert werden, und ob der Schutz und die Durchsetzung indigener Landrechte in den einzelnen Ländern den völkerrechtlichen Mindestanforderungen entsprechen. Es bewegt sich hierbei auf der Schnittstelle zwischen öffentlichem Recht, Rechtsvergleichung und Völkerrecht. Im Ergebnis wird gezeigt, dass der Umgang der Staaten mit Landrechten indigener Völker den völkerrechtlichen Mindestanforderungen oftmals nicht entspricht. Ferner wird dargelegt, dass die Regierungen nicht auf die unterschiedlichen historischen Vorgehensweisen, durch die indigene Gebiete kolonisiert und indigene Völker in der Vergangenheit enteignet wurden, verweisen können, um eine Ungleichbehandlung indigener Völker in den unterschiedlichen Staaten oder in verschiedenen Regionen innerhalb ein und desselben Staates zu rechtfertigen. Stattdessen sind allein der politische Wille einer Regierung, die Einstellung der Mehrheitsgesellschaft gegenüber indigenen Völkern und das Auftreten und die Organisation der indigenen Völker ausschlaggebend dafür, ob und in welchem Umfang diese ihre Rechte an ihren traditionellen Gebieten durchsetzen können.

    Abstract: This book focuses on the most important implications of the "fair hearing" right for conducting civil proceedings. It provides a thorough and critical analysis of the case law of the European Court of Human Rights (the Strasbourg Court) regarding Article 6 of the European Convention on Human Rights. It puts forward a generally applicable framework for the analysis of the various procedural issues to which the "fair hearing" right may give rise, then applies that framework to discuss a selection of specific procedural issues. The book investigates several important questions of general scope in the context of ECHR Article 6, such as: What is the relevance of case law regarding criminal proceedings when the "fair hearing" right is applied to civil proceedings? How does the Strasbourg Court actually proceed when evaluating whether specific court proceedings have been "fair"? What are the roles of fundamental concepts such as the "margin of appreciation" and proportionality in this regard? In the subsequent discussion of specific procedural issues, the focus is on the balance that must be struck between procedural safeguards and the objectives of efficiency and economy. The book considers specific procedural issues such as: When must an oral hearing be held in order for civil proceedings to be "fair"? When will a refusal of specific evidence render civil proceedings unfair? When is a civil litigant entitled to l egal aid? As such, the book not only presents current case law; it also compares various strands of the case law regarding the "fair hearing" right, and argues that the Strasbourg Court's approach to various pertinent issues needs to become more consistent.     Abstract: Das Werk belegt die Vermutung der unmittelbaren Wirkung des Unionsrechts. Es propagiert hiermit eine Dogmatik, die der inhaltlichen Unklarheit der bisher in der Rechtsprechung und Wissenschaft gebräuchlichen Kriterien zur Bestimmung der unmittelbaren Wirkung, namentlich der hinreichenden Genauigkeit und Unbedingtheit, abhilft. Die Vermutung unmittelbarer Wirkung wird sowohl mit der Rechtsprechung des Gerichtshofs der Europäischen Union als auch dogmatisch begründet. Dabei zeigt sich, dass die Gründe, die im Hinblick auf das Völkerrecht eine Zurückhaltung bei dessen unmittelbarer Anwendbarkeit durch nationale Gerichte und Verwaltungsbehörden rechtfertigen, sich jedenfalls nicht auf das primäre und sekundäre Unionsrecht übertragen lassen.

    Abstract: This work focuses on a specific aspect of the enforcement of maritime claims, namely judicial sales of ships, a procedure creditors typically resort to in the event of an irreversible default situation. A substantial part of the book approaches the topic from a comparative perspective, the goal being to assess the similarities and differences of the judicial sale procedure between three specific jurisdictions: Belgium, the Netherlands, and England & Wales. In this study, the comparison is used to further analyse the impacts of these differences on the effectiveness and reliability of the judicial sale procedure in each jurisdiction and also forms the basis for assessing the feasibility of harmonising judicial sale procedures and fostering their acceptance. Considering the international character typical of judicial sales of ships, conflict-of-law questions are very likely to arise during these procedures. Accordingly, the comparative study, where appropriate, is viewed against a private international law background.

    Abstract: Der Band beleuchtet das Internationale Kooperationsrecht der Europäischen Union aus drei unterschiedlichen Perspektiven. Der erste Teil definiert das primäre Internationale Kooperationsrecht der EU als Abkommen der EU mit Drittstaaten, die eine bestimmte institutionelle Struktur schaffen und auf besondere Beziehungen zur Union abzielen und das sekundäre Kooperationsrecht als das auf dieser Basis erlassene Recht. Der zweite Teil nimmt eine empirisch-statistische Perspektive ein und beantwortet die Frage, ob das untersuchte Phänomen quantitativ bedeutsam ist. Der dritte Teil widmet sich einer typologisierenden Perspektive und schlägt zur Ordnung des Bereichs eine Typologisierung in Haupttypen vor. Der vierte Teil nimmt eine rechts-dogmatische Perspektive ein, entwickelt aus dem Unionsprimärrecht ein Handlungsformenregime und konturiert das Phänomen gleichzeitig als unionsgeprägte Ausübung internationaler öffentlicher Gewalt und als Handlungsform des Unionsrechts.

    Abstract: "In a dispute, governments weigh up their options when selecting between various dispute settlement mechanisms. By scrutinising the interaction of institutional design with state interests, Forum Shopping in International Disputes analyses why particular forums are selected in maritime boundary disputes. The act of forum shopping, it argues, is more than the identification of the forum most likely to award a favourable decision. Rather, other interests come into play, such as concerns about domestic standing and the wish to draw international attention to a case. In other words, the best forum in a given dispute is the one that conforms most closely to a government's overarching policy. This book is especially notable for its use of qualitative case studies, a much-needed contribution to the growing body of research on forum selection, and for its detailed actor-centred approach, which comparatively assesses the merits of available forums.     Abstract: Since the historic Nuremberg Trial of 1945 an international customary law principle has developed that commission of a core crime under international law - war crimes, genocide, crimes against humanity and aggression - should not go unpunished. History shows, that when in Africa such violations occurred, especially as a result of election disputes, national and regional actors, including the African Union, resorted to political rather than legal responses. However, when crimes against humanity were alleged to have been committed in Kenya during the 2007-2008 post-election violence, a promising road map for criminal accountability was agreed upon alongside a political solution. In the spirit of this road map, the author analyzes the post-election violence in Kenya from a legal point of view. He extensively examines legal options for domestic criminal accountability and discusses both retributive (prosecutions) and restorative justice (mainly truth commission) mechanisms, being the main legal responses to the gross violations of human rights. Furthermore, he thoroughly investigates the Kenya situation before the ICC and the legal-cum-political responses to the ICC intervention in Kenya. Practitioners and academics in the field of international criminal law and related disciplines, as well as political sciences and (legal) history will find in this book highly relevant information about alternative legal approaches of the fight against and punishment of crimes against humanity, as defined under the ICC Statute. Sosteness Francis Materu is a lecturer in the Faculty of Law of the University of Dar es Salaam (Tanzania). He obtained his Bachelors Laws Degree (LL.B) from the same University in 2008, a Master of Laws Degree (LL.M) from the University of the Western Cape (South Africa) in 2010, and a Doctorate in Law from Humboldt-Universität zu Berlin (Germany) in 2014.     Abstract: With a current population inflow into cities of 200,000 people per day, UN Habitat expects that up to 75% of the global population will live in cities by 2050. Influenced by forces of globalization and global change, cities and urban life are transforming rapidly, impacting human welfare, economic development and urban-regional landscapes. This poses new challenges to urban governance, while emerging city networks, advancing geo-technologies and increasing production of continuous data streams require governance actors to re-think and re-work conventional work processes and practices. This book has been written to enhance our understanding of how governance can contribute to the development of just and resilient cities in a context of rapid urban transformations. It examines current governance patterns from a geographical and inclusive development perspective, emphasizing the importance of place, space, scale and human-environment interactions, and paying attention to contemporary processes of participation, networking, and spatialized digitization. The challenge we are facing is to turn future cities into inclusive cities that are diverse but just and within their ecological limits.     Abstract: The book provides in depth studies of two epistemological aspects of Jewish Law (Halakhah) as the?Word of God?? the question of legal reasoning and the problem of knowing and remembering. - How different are the epistemological concerns of religious-law in comparison to other legal systems? - In what ways are jurisprudential attitudes prescribed and dependent on theological presumptions? - What specifies legal reasoning and legal knowledge in a religious framework? The author outlines the rabbinic jurisprudential thought rooted in Talmudic literature which underwent systemization and enhancement by the Babylonian Geonim and the Andalusian Rabbis up until the twelfth century. The book develops a synoptic view on the growth of rabbinic legal thought against the background of Christian theological motifs on the one hand, and Karaite and Islamic systemized jurisprudence on the other hand. It advances a perspective of legal-theology that combines analysis of jurisprudential reflections and theological views within a broad historical and intellectual framework. The book advocates two approaches to the study of the legal history of the Halakhah: comparative jurisprudence and legal-theology, based on the understanding that jurisprudence and theology are indispensable and inseparable pillars of legal praxis

    Abstract: Language and the Right to Fair Hearing in International Criminal Trials explores the influence of the dynamic factor of language on trial fairness in international criminal proceedings. By means of empirical research and jurisprudential analysis, this book explores the implications that conducting a trial in more than one language can have for the right to fair trial. It reveals that the language debate is as old as international criminal justice, but due to misrepresentation of the status of language fair trial rights in international law, the debate has not yielded concrete reforms. Language is the core foundation for justice. It is the means through which the rights of the accused are secured and exercised. Linguistic complexities such as misunderstandings, translation errors and cultural distance among participants in international criminal trials affect courtroom communication, the presentation and the perception of the evidence, hence jeopardizing the foundations of a fair trial. The author concludes that language fair trial rights are priority rights situated in the minimum guarantees of fair criminal trial; the obligation of the court to ensure fair trial or accord the accused person a fair hearing also includes the duty to ensure they can understand and be understood

    Abstract: Urbanization in sub-Saharan Africa has historic roots, and though it has accelerated in recent decades, it retains distinctive forms. This book explores sub-Saharan urbanism through a detailed and wide-ranging study of Maputo, Mozambique, covering physical and socio-economic factors as well as an ethnographic inquiry into cultural attitudes, Sub-Saharan Africa is often considered to be the last global macro-region in the world to go through a rapid urbanization process, leading to the majority of the population living in cities and towns. Despite common misunderstandings to the contrary, the urbanization process in this region has historic roots, and although this has accelerated in the post-colonial era, it continues to display distinctive spaces and forms due to particular political, economic, social, and cultural contexts. This book explores the features of recent urbanization in sub-Saharan Africa through a remarkably detailed and wide-ranging case study of Mozambique's capital city Maputo, including longitudinal physical and socio-economic factors as well as an ethnographic inquiry into cultural attitudes. The findings of this study reflect not only the weakness of state capacity in the region in urban intervention, but also the continued basis for urban development activity by residents, in social and economic terms as well as the importance of culturally constructed identities and social relations.     Abstract: How do we accommodate a growing urban population in a way that is sustainable, equitable, and inviting? This question is becoming increasingly urgent to answer as we face diminishing fossil-fuel resources and the effects of a changing climate while global cities continue to compete to be the most vibrant centers of culture, knowledge, and finance. Jan Gehl has been examining this question since the 1960s, when few urban designers or planners were thinking about designing cities for people. But given the unpredictable, complex and ephemeral nature of life in cities, how can we best design public infrastructurevital to cities for getting from place to place, or staying in placefor human use? Studying city life and understanding the factors that encourage or discourage use is the key to designing inviting public space. In How to Study Public Life Jan Gehl and Birgitte Svarre draw from their combined experience of over 50 years to provide a history of public-life study as well as methods and tools necessary to recapture city life as an important planning dimension. This type of systematic study began in earnest in the 1960s, when several researchers and journalists on different continents criticized urban planning for having forgotten life in the city.     Abstract: Trading Places is about urban land markets in African cities. It explores how local practice, land governance and markets interact to shape the ways that people at society's margins access land to build their livelihoods. The authors argue that the problem is not with markets per se, but in the unequal ways in which market access is structured. They make the case for more equal access to urban land markets, not only for ethical reasons, but because it makes economic sense for growing cities and towns. If we are to have any chance of understanding and intervening in predominantly poor and very unequal African cities, we need to see land and markets differently. New migrants to the city and communities living in slums are as much a part of the real estate market as anyone else; they're just not registered or officially recognised. This book highlights the land practices of those living on the city's margins, and explores the nature and character of their participation in the urban land market. It details how the urban poor access, hold and trade land in the city, and how local practices shape the city, and reconfigures how we understand land markets in rapidly urbanising contexts. Rather than developing new policies which aim to supply land and housing formally but with little effect on the scale of the need, it advocates an alternative approach which recognises the local practices that already exist in land access and management. In this way, the agency of the poor is strengthened, and households and communities are better able to integrate into urban economies.

    Abstract: This book discusses all critical privacy and data protection aspects of biometric systems from a legal perspective. It contains a systematic and complete analysis of the many issues raised by these systems based on examples worldwide and provides several recommendations for a transnational regulatory framework. An appropriate legal framework is in most countries not yet in place. Biometric systems use facial images, fingerprints, iris and/or voice in an automated way to identify or to verify (identity) claims of persons. The treatise which has an interdisciplinary approach starts with explaining the functioning of biometric systems in general terms for non-specialists. It continues with a description of the legal nature of biometric data and makes a comparison with DNA and biological material and the regulation thereof. After describing the risks, the work further reviews the opinions of data protection authorities in relation to biometric systems and current and future (EU) law. A detailed legal comparative analysis is made of the situation in Belgium, France and the Netherlands. The author concludes with an evaluation of the proportionality principle and the application of data protection law to biometric data processing operations, mainly in the private sector. Pleading for more safeguards in legislation, the author makes several suggestions for a regulatory framework aiming at reducing the risks of biometric systems. They include limitations to the collection and storage of biometric data as well as technical measures, which could influence the proportionality of the processing. The text is supported by several figures and tables providing a summary of particular points of the discussion. The book also uses the 2012 biometric vocabulary adopted by ISO and contains an extensive bibliography and literature sources

    Abstract: Metropolen definieren sich durch ihre Wandlungsfähigkeit. Ausdrucksform ihrer transformierenden Kraft ist die Differenz von Selbst- und Fremdinszenierungen, die Ökonomie von gesellschaftlichen und gemeinschaftlichen Beziehungen ihrer Bewohner. Zu ihrer Selbstdarstellung bedürfen Metropolen der Anerkennung von außen. Angesichts der zunehmenden Bedeutung attraktiver Stadtbilder wenden sich immer mehr Stadtplaner, Marketingexperten und Politiker an Auftritts-Experten, die Architektur und Atmosphäre szenografisch zu vermitteln wissen. Welche Reibungen ergeben sich zwischen Eventmarketing und Stadtfunktionalität, zwischen »Hirn, Hand und Herz« - wie Fritz Langs programmatische Formel für die Inszenierung Metropolis lautete? Ob Darstellung und Selbstdarstellung den eigenen Bürgern oder Touristen zukommen, Inszenierungen von unten oder oben, Medienfassaden oder Street-Art das reale oder imaginierte Bild der Stadt bestimmen und von den Bewohnern akzeptiert, idealisiert oder verworfen werden - solchen Fragen gehen die Aufsätze auf allen Ebenen urbaner Ausdrucksform nach. Die Beiträge sind unter dem Eindruck des Kulturhauptstadtjahres RUHR.2010 entstanden. Aber nicht alle Aufsätze beziehen sich explizit auf dieses Event. Aus unterschiedlicher Perspektive, von Gestaltung und Architektur, Urbanistik, Kunst, Wissenschaft, Philosophie, werfen die Beiträge ein Schlaglicht auf die aktuellen szenografischen Strategien und Techniken der Inszenierung des urbanen Raums und tragen zur szenologischen Reflexion der Stadt als Ereignis bei.

    Abstract: When we think of segregation, what often comes to mind is apartheid South Africa, or the American South in the age of Jim Crow-two societies fundamentally premised on the concept of the separation of the races. But as Carl H. Nightingale shows us in this magisterial history, segregation is everywhere, deforming cities and societies worldwide. Starting with segregation's ancient roots, and what the archaeological evidence reveals about humanity's long-standing use of urban divisions to reinforce political and economic inequality, Nightingale then moves to the world of European colonialism. It was there, he shows, segregation based on color-and eventually on race-took hold; the British East India Company, for example, split Calcutta into "White Town" and "Black Town." As we follow Nightingale's story around the globe, we see that division replicated from Hong Kong to Nairobi, Baltimore to San Francisco, and more. The turn of the twentieth century saw the most aggressive segregation movements yet, as white communities almost everywhere set to rearranging whole cities along racial lines. Nightingale focuses closely on two striking examples: Johannesburg, with its state-sponsored separation, and Chicago, in which the goal of segregation was advanced by the more subtle methods of real estate markets and housing policy. For the first time ever, the majority of humans live in cities, and nearly all those cities bear the scars of segregation. This unprecedented, ambitious history lays bare our troubled past, and sets us on the path to imagining the better, more equal cities of the future.

    Abstract: In this book Nina Glick Schiller and Ayse Çaglar, along with a stellar group of contributing authors, examine the relationship between migrants and cities in a time of massive urban restructuring. They find that locality matters in migration research and migrants matter in the reconfiguration of contemporary cities. This book provides a new approach to the study of migrant settlement and transnational connection in which cities rather than nation-states, ethnic groups, or transnational communities serve as the starting point for comparative analysis.Neither negating nor privileging the nation-state, Locating Migration provides ethnographic insights into the various ways in which migrants and specific cities together mutually constitute and contest the local, national, and global. Cities are approached not as containers but as fluid and historically differentiated analytical entry points. Chapters explore migrants' relationship to the neoliberal rebranding, redevelopment, and rescaling of down-and-out, aspiring, and global cities in the United States and Europe. The various chapters document the pathways of incorporation and transnational connection of migrants from Asia, Africa, Latin America, and Europe.Migrants are approached not as a homogenous category but in terms of their range of experiences of class, racialization, gender, history, politics, and religion. Setting aside the migrant/native divide that haunts most migration studies, the authors of this book view migrants as residents of cities and actors within them, understanding that to be a resident of a city is to live within, contribute to, and contest globe-spanning processes that shape urban economy, politics, and culture

    Abstract: With the publication of The Rise of the Creative Class by Richard Florida in 2002, the "creative city" became the new hot topic among urban policymakers, planners and economists. Florida has developed one of three path-breaking theories about the relationship between creative individuals and urban environments. The economist Åke E. Andersson and the psychologist Dean Simonton are the other members of this "creative troika". In the Handbook of Creative Cities, Florida, Andersson and Simonton appear in the same volume for the first time. The expert contributors in this timely Handbook extend their insights with a varied set of theoretical and empirical tools. The diversity of the contributions reflect the multidisciplinary nature of creative city theorizing, which encompasses urban economics, economic geography, social psychology, urban sociology, and urban planning.     Abstract: In this book a theory of reasoning with evidence in the context of criminal cases is developed. The main subject of this study is not the law of evidence but rather the rational process of proof, which involves constructing, testing and justifying scenarios about what happened using evidence and commonsense knowledge. A central theme in the book is the analysis of ones reasoning, so that complex patterns are made more explicit and clear. This analysis uses stories about what happened and arguments to anchor these stories in evidence. Thus the argumentative and the narrative approaches from the research in legal philosophy and legal psychology are combined. Because the book describes its subjects in both an informal and a formal style, it is relevant for scholars in legal philosophy, AI, logic and argumentation theory. The book can also appeal to practitioners in the investigative and legal professions, who are interested in the ways in which they can and should reason with evidence.
