This collection contains several insights and lessons learnt for scholars as well as practitioners of policing.” —Marleen Easton, Professor and head of the research group 'Governing and Policing Security' (GaPS) at the Department of Public Governance and Management at Ghent University, Belgium This book critically examines how countries across Europe have dealt with the COVID crisis from a policing and security perspective. Across the chapters, contributors from different countries examine the data, press coverage, and provide professional observations on how policing, law enforcement, police powers and community relations were managed. They focus on how security and governmental actors often failed to align with the formal scripts that were specifically designed for crisis-management, resulting in the wavering application of professional discretion and coercive powers. Their different approaches were evident: in some regions police were less dominantly visible compared to other regions, where the police used a top-down visible and repressive stance vis-à-vis public alignment with COVID rules, including the imposition of lockdown and curfews. Some contributors draw on data from the COROPOL (Corona Policing) Monitor which collated data on crime, plural policing and public order in Europe and around the world during the early phases of the COVID crisis. Overall, this book seeks to provide comparative critical insights and commentary as well as a practical and operational understanding of security governance during the COVID-19 crisis and the lessons learned to improve future preparedness. Monica den Boer is Professor of Military Policing Operations at the Netherlands Defence Academy. Her primary research focus is on the evolution of military policing, as well as border policing, international policing, urban policing and the policing of organised crime and terrorism. She served as member of the Dutch national parliament from 2017 to 2020. Prior to this she worked in several academic and professional environments, including the Police Academy of the Netherlands and the VU University Amsterdam. Eric Bervoets is a police scientist and criminologist. He has been active as a researcher since 1997. After a master's degree in public administration at Rotterdam Erasmus University, the Netherlands, Bervoets obtained his PhD in 2006 with a dissertation on policing troubled neighbourhoods. In 2020, he was appointed Research Fellow at the Netherlands Defence Academy. Linda Hak obtained her BSc in Criminology at Erasmus University and a master’s degree in Legal Psychology at Maastricht University, the Netherlands. She served as a research intern at Bureau Bervoets and is employed as a detective assistant for the National Police of the Netherlands.

    Abstract: The regulation of civil society provides the framework under which those organisations can most effectively provide services in education, health, social services, housing, development aid and so on. Civil Society in Europe identifies common principles of civil society law in two ways. First, the approaches of the Council of Europe and the European Union are explored. Next civil society regulation in twelve domestic legal systems are investigated on a broad range of substantive areas of law including internal organisation, registration, external supervision, public benefit organisations and international activities. From these, the authors distill a set of minimum norms and optimal conditions under which civil society can deliver its aims most effectively. This book is essential reading for policymakers and legislators across Europe and beyond

    Abstract: Legal studies and consequently legal history focus on constitutional documents, believing in a nominalist autonomy of constitutional semantics.Reconsidering Constitutional Formation in the late 18th and 19th century, kept historic constitutions from being simply log-books for political experts through a functional approach to the interdependencies between constitution and public discourse. Sovereignty had to be ‘believed’ by the subjects and the political élites. Such a communicative orientation of constitutional processesbecame palpable in the ‘religious’ affinities of the constitutional preambles. They were held as ‘creeds’ of a new order, not only due to their occasional recourse to divine authority, but rather due to the claim for eternal validity contexts of constitutional guarantees. The communication dependency of constitutions was of less concern in terms of the preamble than the constituents’ big worries about government organisation. Their indecisiveness between monarchical and popular sovereignty was established through the discrediting of the Republic in the Jacobean reign of terror and the ‘renaissance’ of the monarchy in the military resistance against the French revolutionary and later Napoleonic campaigns. The constitutional formation as a legal act of constituting could therefore defend the monarchy from the threat of the people (Albertine Statute 1848), could be a legal decision of a national constituent assembly (Belgian Constitution 1831), could borrow from the old liberties (Polish May Constitution 1791) or try to remain in between by referring to the Nation as sovereign (French September Constitution 1791, Cádiz Constitution 1812). Common to all contexts is the use of national sovereignty as a legal starting point. The consequent differentiation between constituent and constituted power manages to justify the self-commitment of political power in legal terms. National sovereignty is the synonym for the juridification of sovereignty by means of the constitution. The novelty of the constitutions of the late 18th and 19th century is the normativity, the positivity of the constitutional law as one unified law, to be the measure for the legality of all other law.     Abstract: This anthology provides an in-depth analysis and discusses the issues surrounding nudging and its use in legislation, regulation, and policy making more generally. The 17 essays in this anthology provide startling insights into the multifaceted debate surrounding the use of nudges in European Law and Economics. Nudging is a tool aimed at altering people’s behaviour in a predictable way without forbidding any option or significantly changing economic incentives. It can be used to help people make better decisions to influence human behaviour without forcing them because they can opt out. Its use has sparked lively debates in academia as well as in the public sphere. This book explores who decides which behaviour is desired. It looks at whether or not the state has sufficient information for debiasing, and if there are clear-cut boundaries between paternalism, manipulation and indoctrination. The first part of this anthology discusses the foundations of nudging theory and the problems associated, as well as outlining possible solutions to the problems raised. The second part is devoted to the wide scope of applications of nudges from contract law, tax law and health claim regulations, among others. This volume is a result of the flourishing annual Law and Economics Conference held at the law faculty of the University of Lucerne. The conferences have been instrumental in establishing a strong and ever-growing Law and Economics movement in Europe, providing unique insights in the challenges faced by Law and Economics when applied in European legal traditions.

    Abstract: This book examines in detail both historical and current legal concepts of ‘religious cultural heritage’ within the context of the European continent. The latter group is primarily based on the variety of sacred cultural elements emanating from the different religious traditions of the peoples of Europe, which are deemed worthy of protection and preservation due to their outstanding value, in terms of their social, cultural and religious significance. In view of this, the study provides evidence of the European States’ active involvement with their sacred/cultural treasures, on the basis of the political and legal foundations of neutrality and pluralism. Furthermore, the book analyzes all relevant international legislative instruments (i.e. the plethora of EU, CoE and UNESCO norms), as well as all major European legislative patterns, in light of their significance for the aforementioned aspects of pluralism and neutrality. The interdisciplinary references listed at the end of each chapter provide an additional incentive for further reading on the subject matter. The most important finding to emerge from the study is that there is a shared legal ethos in Europe that imposes a duty of appropriate care concerning the vast variety of sacred cultural goods, and the religious cultural heritage in general, as an invaluable repository of European cultural capital. It also considers the sui generis nature of this capital: like any other type of asset, it may deteriorate or fade over time, necessitating investment in its preservation or refurbishment; nevertheless, like no other, this particular capital maintains a distinct cultural value, as it contains an additional characteristic of ‘sacredness’ expressed in the form of its ‘religious character,’ the latter being analyzed as a triptych of religious memory, religious aesthetics and religious beliefs

    Abstract: This research examines the role of prosecutors within the United States and in Switzerland and is completed by an overview of the prosecution institutions in France and Germany.     Abstract: This study provides an in-depth analysis of the Hong Kong Ship Recycling Convention as adopted in May 2009 and a thorough analysis of the overall status quo of ship recycling regulations. It investigates the lack of sufficient ratifications of the Convention from both a legal and an economic perspective. The first part of the study focuses on the history of the Convention’s entry-into-force provision and the rationale behind it. Due to the fact that this provision provides a considerable additional obstacle to the Convention’s becoming legally binding, in the second part the focus of the work shifts to unilateral action in this field. An overview of the legal environment of European ship recycling legislation is followed by an analysis and evaluation of a number of proposals by the European Commission attempting to tackle the problems of current ship recycling procedures. With a particular emphasis on (planned) European measures in this regard, the analysis’ overall message is one of cautious optimism

    Abstract: Economic sanctions are increasingly being used to combat rogue states, international terrorists and economic criminals. This book offers a new assessment of economic sanctions as a public policy tool and identifies the key legal and regulatory issues in the design of economic sanctions policy in the post 9-11 environment. Kern Alexander places the use of economic sanctions in a broad international context to highlight the gaps in existing international sanctions programmes and the need to develop more effective and efficient multilateral institutions in this area. Moreover, this book identifies weaknesses of US unilateral and extraterritorial sanctions and the legal framework which supports their application. This perspective is especially important given the growing concern with states such as Iran and North Korea and the ongoing interest in how to combat weapons of mass destruction, transnational economic crime and terrorist financing. Kern suggests that although multilateral institutions have a role to play in monitoring the implementation of sanctions, the impetus for effective economic sanctions policy must come from national policymakers and regulators

    Abstract: The introduction of the 'Common Consolidated Corporate Tax Base' as a means for an efficient and equitable taxation of multinational enterprises in Europe represents the most important issue of European business taxation. Starting in 2001, the Commission and the Member States have cooperated in order to develop an innovative technique for the measurement and the allocation of business profits within the European Union. This venture is not only the most ambitious political project of the current European Commission, it also challenges traditional legal and economic concepts of business taxation. This book contains the proceedings of an International Tax Conference, organised under the auspices of the German Presidency in the European Union and designed in cooperation with the Centre for European Economic Research (Mannheim) and the Max Planck Institute for Intellectual Property, Competition and Tax Law (Munich) including presentations from European and American academics and tax practitioners.

    Abstract: Recent developments in the European integration process have raised, amongst many other things, the issue of linguistic diversity, for some a stumbling block to the creation of a European democratic polity and its legal and social institutions. The solution to the 'question of language', involves an understanding of the role played by natural languages and the consequent design of policies and institutional mechanisms to facilitate inter-linguistic and intercultural communication. This is not an exclusively European problem, and nor is it entirely new, for it is also the problem of linguistic majorities and minorities within unitary nation-states. However, the effects of globalization and the diffusion of multiculturalism within nation-states have given renewed emphasis to the question of language in diverse societies. Facing the question anew involves reconsidering traditional ideas about social communication and the public sphere, about opinion-formation and diffusion, about the protection of cultural and linguistic minorities, and about the role that language plays in the process of formation of political and legal cultures. This volume is intended as a multidisciplinary contribution towards studying and assessing the range of problems that form the 'language question' in Europe and diverse societies

    Abstract: Citizenship is frequently invoked both as an instrument and goal of immigrant integration. Yet, in migration contexts, citizenship also marks a distinction between members and outsiders based on their different relations to particular states. A migration perspective highlights the boundaries of citizenship and political control over entry and exit as well as the fact that foreign residents remain in most countries deprived of core rights of political participation. This book summarizes current theories and empirical research on the legal status and political participation of migrants in European democracies.

    Abstract: Limiting Institutions examines the security threats in Eurasia and the role of institutions in the post-Cold War international environment. It looks at both the crucial aspect of foreign policy as well as a theoretical area of security studies and its impact in the former Soviet States including Russia, Belarus, Armenia, the Ukraine and Moldova. The first section addresses the important and varied range of security threats to this area of the world, and examines the range of responses open to European countries and to the United States. Threats such as ethnic conflict, transnational crime, and environmental and energy security issues are examined in depth. The second section addresses an important theoretical issue, namely the role that international institutions can perhaps play as arbiters of conflict and facilitators of cooperation in a region abutting the European political space. The role of the OSCE, NATO, the European Union, the Commonwealth of Independent States and the Black Sea Economic Cooperation Council are consequently examined closely. The contributors are scholars with solid international reputations, and the book will be of benefit to students of international relations and conflict analysis

    Abstract: This book investigates the ways in which literacy was important in early mediaeval Europe, and examines the context of literacy, its uses, levels, and distribution, in a number of different early mediaeval societies between c. 400 and c. 1000. The studies, by leading scholars in the field, set out to provide the factual basis from which assessments of the significance of literacy in the early mediaeval world can be made, as well as analysing the significance of literacy, its implications, and its consequences for the societies in which we observe it. In all cases, the studies represent recent research and bring evidence such as the recent archaeological discoveries at San Vincenzo al Volturno to the subject. They provide fascinating insight into the attitudes of early mediaeval societies towards the written word and the degree to which these attitudes were formed. This period is shown as fundamental for the subsequent uses of literacy in mediaeval and modern Europe
