Abstract: A new edition of a seminal text in Critical Race TheorySince the publication of the third edition of Critical Race Theory: An Introduction in 2017, the United States has experienced a dramatic increase in racially motivated mass shootings and a pandemic that revealed how deeply entrenched medical racism is and how public disasters disproportionately affect minority communities. We have also seen a sharp backlash against Critical Race Theory, and a president who deemed racism a thing of the past while he fanned the flames of racial intolerance and promoted nativist sentiments among his followers. Now more than ever, the racial disparities in all aspects ofpublic life are glaringly obvious. Taking note of all these developments, this fourth edition covers a range of new topics and events and addresses the rise of a fierce wave of criticism from right-wing websites, think tanks, and foundations, some of which insist that America is now colorblind and has little use for racial analysis and study. Award-winning authors Richard Delgado and Jean Stefancic also address the rise in legislative efforts to curtail K-12 teaching of racial history. Critical Race Theory, Fourth Edition, is essential for understanding developments in this burgeoning field, which has spread to other disciplines and countries. The new edition also covers the ways in which other societies and disciplines adapt its teachings and, for readers wanting to advance a progressive race agenda, includes new readings and questions for discussion aimed at outlining practical steps to achieve this objective

Abstract: This book presents the results of an international comparative study on the causes of rule deviation in business and medical organizations. Based on document and interview analyses as well as experiments, the discrepancy between (state) regulations and organizational practice is elaborated and discussed in an interdisciplinary perspective. On the basis of the distinction between organizational and individual deviance, it could be shown across national boundaries that the unwritten rules of the organization make a decisive contribution in explaining organizational wrongdoing, as well as their containment. Implications for effective prevention derived from this are also pointed out. Abstract: "Twenty-five years after his prescient Democracy's Discontent, Michael Sandel updates his classic work for our more fractious age. He shows how, since the 1990s, Democrats and Republicans embraced a market faith that led to the toxic politics of our time. To rescue democracy, he argues, we must reimagine the economy and revitalize the civic project"--

Abstract: This book examines the contemporary rise in community violence across the United States and globally from sociological and criminological perspectives. It comprehensively investigates police response to criminal incidents, engagements with criminal suspects, use of force by law enforcement, and crime control measures implemented or recommended to initiate effective crime control measures so that the unwanted rise of violence and serious crime can again be contained. The primary audience for the book will be upper level undergraduate and graduate level students, criminal justice and law enforcement practitioners, government policy makers, community advocates, and researchers in sociology, criminology, homeland security, criminal justice, public administration, and political science.

Abstract: The Civil Rights Act of 1964 provides protections against discrimination based on race, color, religion, sex and national origin. Sexual orientation and gender identity, however, are excluded and LGBTQ citizens can be legally discriminated against in many fundamental areas that others take for granted as a legal right. The LGBTQ community in America comprises approximately 3.4 percent of the US population, or roughly 9 million citizens. Regardless of the size of the population, this book argues, all US citizens deserve the same rights granted under the US constitution - i.e. in addition to marriage equality, LGBTQ citizens deserve equal protection in employment, housing, medical decisions, military service, and adoption - to name but a few. Using social equity theory and intersectionality but written in an accessible style, this book demonstrates some of the ways in which LGBTQ citizens have been marginalized for their identity, and argues that the field of public administration has a unique responsibility to prioritize social equity. Discrete categories utilized by the US Census Bureau (male or female, heterosexual or homosexual), for example, must shift to a continuum to accurately capture demographic characteristics and citizen behavior. Evidenced based outcomes and disparities between heterosexual and LGBTQ populations are carefully delineated to provide a legal rationale for a compelling governmental interest, and policy recommendations are provided - including overdue federal legislation to prohibit discrimination based on sexual orientation. Abstract: "The Civil Rights Act of 1964 provides protections against discrimination based on race, color, religion, sex and national origin. Sexual orientation and gender identity, however, are excluded and LGBTQ citizens can be legally discriminated against in many fundamental areas that others take for granted as a legal right. Abstract: "One of the most far-reaching transformations in our era is the wave of digital technologies rolling over-and upending-nearly every aspect of life. Work and leisure, family and friendship, community and citizenship-all transformed by now-ubiquitous digital tools and platforms. Digital Technology and Democratic Theory explores a particularly unsettling and rapidly evolving facet of our new digital lives: transformations that affect our lives as citizens and participants in democratic governments. To understand these transformations, scholars from multiple disciplines (computer science, philosophy, political science, economics, history, and media and communications/journalism) wrestle with the question of how digital technologies shape, reshape, and affect fundamental questions about democracy and democratic theory. The contributors consider what democratic theory-broadly defined as normative theorizing about the values and institutional design of democracy-can bring to the practice of digital technologies. From the connectivity and transmission of information that has inspired positive change through movements such as the Arab Spring and #MeToo to the nefarious spread of distrust and outright disruption in democratic processes, this volume broaches the most pressing technological changes and issues facing not just individual states, but democracy as a philosophy and institution"--

Abstract: "Introduction Deepa das Acevedo This book, although it may appear to be a single book, is in fact two. On the one hand, this is a book about labor exchange in the gig economy masquerading as a book about the value of qualitative empirical data for law and policy development. On the other hand, this is also a book about the value of qualitative empirical data masquerading as a book about the buying, selling, and performance of labor via gig companies like Uber and Airbnb. Since a reader may find it difficult to tell which of these two she is reading at any given moment this introduction will sketch the contours and purpose of each book. Gig Work as a book about labor exchange in the gig economy this volume dives deeply into what is, in many ways, the hot-button work law issue of the day. The gig economy has generated immense popular interest in labor conditions - no mean feat in an era of decreasing unionization and growing corporate power - as much as it has commanded attention from policymakers and scholars. In many ways this appeal is unsurprising given the aura of innovation and entrepreneurship that surrounds the gig economy, the way it reflects broader trends toward micro- and on-demand transactions, and its incorporation of widely accessible technology."

Abstract: Free speech is an essential component to the operation of a representative government committed to equal rights and the general welfare of the people. The constitutional right to engage in open expression is designed to secure personal dignity, civic engagement, and flow of information. No generation of interpreters can claim to capture its full relevance to social cohesion. The broad statement found in the Constitution has long been the subject of evolving, sometimes inconsistent, constitutional meaning. Since the early twentieth century, the Supreme Court has been at the forefront of efforts to articulate the range of words, symbols, arts, and other objects or activities that the First Amendment protects. Interpretation takes into account a variety of constitutional contexts, principles, and discursive considerations. As Justice Sotomayor pointed in her dissent to Manhattan Community Access Corporation v. Halleck, the context within which a statement is said should be considered along with the actual words allegedly in violation of a law

Abstract: "Rodricus Crawford was convicted and sentenced to die for the murder by suffocation of his beautiful baby boy. After years on death row, evidence confirmed what Crawford had claimed all along: he was innocent, and his son had died from an undiagnosed illness. Crawford is not alone. A full one-third of all known exonerations stem from no-crime wrongful convictions. The first book to explore this common but previously undocumented type of wrongful conviction, Smoke but No Fire tells the heartbreaking stories of innocent people convicted of crimes that simply never happened. A suicide is mislabeled a homicide. An accidental fire is mislabeled an arson. Corrupt police plant drugs on an innocent suspect. A false allegation of assault is invented to resolve a custody dispute. With this book, former New York City public defender Jessica S. Henry sheds essential light on a deeply flawed criminal justice system that allows--even encourages--these convictions to regularly occur. Smoke but No Fire promises to be eye-opening reading for legal professionals, students, and activists alike as it grapples with the chilling reality that far too many innocent people spend real years behind bars for fictional crimes"--

Abstract: "Citizenship is a like the air we breathe; it's all around us but often goes unnoticed. That is not a historically ordinary situation. Citizenship was once an exceptional status, a kind of aristocracy of the ancient world in which freedom and political voice were not taken for granted. Even as the nation-state emerged as the primary form of human association, citizenship remained an anomalous status, reserved for the few who were privileged as such in republican democracies. More recently, it has been the individual marker of membership in all national communities. It is generic; almost everyone has it, hence the ubiquity that has made it sometimes unseen. Most people never change the citizenship that they are unthinkingly born into; they have no cause to consider it any more critically than their choice of parents. Insofar as citizenship during the twentieth century came to be aligned with national community on the ground and in the public imagination, there was even less reason to look at it searchingly"--

Abstract: "America's constitutional system evolves through the interplay between three cycles: the rise and fall of dominant political parties, the waxing and waning of political polarization, and alternating episodes of constitutional rot and constitutional renewal. America's politics seems especially fraught today because we are nearing the end of the Republican Party's long political dominance, at the height of a long cycle of political polarization, and suffering from an advanced case of "constitutional rot." Constitutional rot is the historical process through which republics become increasingly less representative and less devoted to the common good. Caused by increasing economic inequality and loss of trust, constitutional rot seriously threatens the constitutional system. But America has been through these cycles before, and will get through them again. America is in a Second Gilded Age slowly moving toward a second Progressive Era, during which polarization will eventually recede. The same cycles shape the work of the federal courts and theories about constitutional interpretation. They explain why political parties have switched sides on judicial review not once but twice in the twentieth century. Polarization and constitutional rot alter the political supports for judicial review, make fights over judicial appointments especially bitter, and encourage constitutional hardball. The Constitution ordinarily relies on the judiciary to protect democracy and to prevent political corruption and self-entrenching behavior. But when constitutional rot is advanced, the Supreme Court is likely to be ineffective and may even make matters worse. Courts cannot save the country from constitutional rot; only political mobilization can"--

Abstract: "Offering a comprehensive overview of the major issues that arise in the enforcement of competition laws, this book takes an interdisciplinary approach to the topic, reviewing the development of Korean competition laws and their enforcement with rigorous economic analysis. Chapters build on the Korean experience, providing guidance to the capacity-building efforts of developing countries that have recently introduced competition laws. In this exciting new book, an international team of experts compares market structures, in both global and Korean contexts, particularly focusing on the impact of foreign competition on market concentration and ways to improve market structure. It thoroughly investigates core competition problems, including international abuses of dominance, mergers and collusion, and vertical restraints. Contributions move beyond explaining the laws and practices of enforcement agencies, offering readers an insight into the trend of ever-increasing interdependence among national economies, complemented by analyses of recent developments in the US and Canada. The exploration of clear trends both in Korea and globally will prove valuable to scholars and students of industrial competition policy, and law and economics. It will also be useful to policy-makers, particularly those in developing countries, looking to better understand the issues surrounding competition law and designing future policies"--

Abstract: "Of Love and Papers explores how immigration policies are fundamentally reshaping Latino families. Drawing on two waves of interviews with undocumented young adults, Enriquez investigates how immigration status creeps into the most personal aspects of everyday life, intersecting with gender to constrain family formation. The imprint of illegality remains, even upon obtaining DACA or permanent residency. Interweaving the perspectives of US citizen romantic partners and children, Enriquez illustrates the multigenerational punishment that limits the upward mobility of Latino families. Of Love and Papers sparks an intimate understanding of contemporary US immigration policies and their enduring consequences for immigrant families"--

Abstract: "Colonial rule distorts a colony's economy and its society, and British rule was no exception. British policies led to a stratified American colonial society with slaves on the bottom and white settlers on top. The divided society functioned through laws that imposed rules and defined roles of the respective races. This occurred in other colonies too, often leading to strife that continues today. Especially since World War II the United States seems finally to have been able to remove many laws and practices that had created barriers between races in the divided society. Appeals to legitimacy, such as by abolitionists and the Civil Rights Movement, were essential to change laws from support of the divided society to instruments for disestablishing it. Thanks to the rule of law - another important British legacy -- the U.S. is much farther along than many former colonies in making progress. By highlighting the history of the interplay of two fundamental concepts, the divided society and the rule of law, and briefly contrasting the experiences of other former colonies, this book shows how the United States has made significant long-term progress, although incomplete, and ways for this to continue today"--

Abstract: "This book compares the rights and social inclusion of two racialized minority groups: Roma in Central and Southeast Europe ("CSEE") and African Americans in the United States ("U.S."), primarily in the American South. We couch those attempts loosely in the frameworks of Roma rights and civil rights, though we will focus primarily on Roma rights in post-Communist CSEE (from 1991 until the present) and civil rights during the U.S. Civil Rights Movement (roughly 1954-1968). Scholars have made fleeting comparisons between Roma and African Americans for years, and in the last decade, the Roma rights-Civil Rights comparison has recurred with increasing frequency. Despite the burgeoning recognition of the broader similarities between Roma and African Americans, including the systems that facilitate their marginalization and the barriers to their representation, no book-length work has sustained these comparisons"--

Abstract: In this comparative study, Ellermann examines the capacity of the liberal democratic state to coercively regulate individuals within its borders. Ellermann shows that the conditions underlying socially coercive state capacity systematically vary not only across institutional contexts but also across stages in the policy cycle.

Leigh H. Edwards explores the allure of this paradoxical image and its cultural significance. She argues that Cash embodies irresolvable contradictions of American identity that reflect foundational issues in the American experience, such as the tensions between freedom and patriotism, individual rights and nationalism, the sacred and the profane. She illustrates how this model of ambivalence is a vital paradigm for American popular music, and for American identity in general. Making use of sources such as Cash's autobiographies, lyrics, music, liner notes, and interviews, Edwards pays equal attention to depictions of Cash by others, such as Vivian Cash's publication of his letters to her, documentaries and music journalism about him, Walk the Line, and fan club materials found in the archives at the Country Music Foundation in Nashville, to create a complete, albeit fragmented, portrait of Cash and his significance as a cultural icon

Abstract: Human trafficking is one of the most extreme forms of exploitation in the 21st century. It, therefore, is one of the most urgent political challenges of our global age. Christal Morehouse evaluates the anti-human trafficking policy in the United States of America and the Federal Republic of Germany. The author uncovers policy gaps and hidden policy agendas which weaken the German and American governments’ ability to combat human trafficking. She provides recommendations for policy and research which are designed to amend disparities in the anti-human trafficking policy in both countries. Finally, she examines the larger societal implications for the U.S. and German societies which could arise from failing to deal with this issue.

Abstract: Economic sanctions are increasingly being used to combat rogue states, international terrorists and economic criminals. This book offers a new assessment of economic sanctions as a public policy tool and identifies the key legal and regulatory issues in the design of economic sanctions policy in the post 9-11 environment. Kern Alexander places the use of economic sanctions in a broad international context to highlight the gaps in existing international sanctions programmes and the need to develop more effective and efficient multilateral institutions in this area. Moreover, this book identifies weaknesses of US unilateral and extraterritorial sanctions and the legal framework which supports their application. This perspective is especially important given the growing concern with states such as Iran and North Korea and the ongoing interest in how to combat weapons of mass destruction, transnational economic crime and terrorist financing. Kern suggests that although multilateral institutions have a role to play in monitoring the implementation of sanctions, the impetus for effective economic sanctions policy must come from national policymakers and regulators

Abstract: "What is the relationship between hip-hop and African American culture in the post-Civil Rights era? Does hip-hop share a criticism of American culture or stand as an isolated and unique phenomenon? How have African American texts responded to the increasing role intellectual property law plays in regulating images, sounds, words, and logos? Parodies of Ownership examines how contemporary African American writers, artists, and musicians have developed an artistic form that Schur terms "hip-hop aesthetics." This book offers an in-depth examination of a wide range of contemporary African American painters and writers, including Anna Deavere Smith, Toni Morrison, Adrian Piper, Colson Whitehead, Michael Ray Charles, Alice Randall, and Fred Wilson. Their absence from conversations about African American culture has caused a misunderstanding about the nature of contemporary cultural issues and resulted in neglect of their innovative responses to the post-Civil Rights era. By considering their work as a cross-disciplinary and specifically African American cultural movement, Schur shows how a new paradigm for artistic creation has developed."--Publisher's description

Abstract: Moot Court competitions constitute an alternative model of human rights training, giving students the skills to contribute to the development of international human rights law and thus make them qualified advocates for human rights change in their home countries and abroad. By focusing on the perfection of oral as well as written skills, participants are more likely to be successful not only in cases brought before their home courts, but in front of international tribunals and other organs. Such competitions have opened the doorway for more human rights classes in law schools, more clinical tr

Abstract: Klappentext: All representative democracies must balance democratic accountability against the competent implementation of complex statutes. Achieving this balance in administrative law will be aided by drawing on insights from economics and political economy. This important volume collects the best work in this area and is of significance for scholars of public law and economics around the world. The editor's authoritative selection of papers, anchored in the American system of administrative law, mixes theoretical, legal, and empirical studies by leading interdisciplinary scholars. It thus provides an up-to-date introduction to modern work in the economics of administrative law.

Abstract: In the past twenty-five years, no one has been more instrumental than Catherine MacKinnon in making equal rights real for women. As Peter Jennings once put it, more than anyone else in legal studies, she "has made it easier for other women to seek justice". This collection brings together previously uncollected and unpublished work in the national arena from 1980 to the present, defining her clear, coherent, consistent approach to reframing the law of men on the basis of the lives of women. Abstract: "In his social investigative writings on ""the serious crime community"" which describes the loose merger of corporate interests, organized crime and political crime, professor Alan A. Block of Penn State University has proven to be one of the most inspiring criminologists in the field. An international group of pupils and friends dedicate this book to him which contains original contributions on the troubled concept of organized crime, the social history of crime groups in the United States, corruption in the United Nations Oil-for-Food Program in Iraq, the struggle against identity fraud, the world of drugs and the adverse consequences of criminalization, the money-laundering control movement, International Tribunals against war crimes and a Jewish studies chapter on the role of bystanders during the Holocaust. The book opens with Alan Block's now classic study on the origins of the Iran Contra scandal. Alan A. Block has served for 17 years as the editor-in-chief of Crime, Law and Social Change, one of Springer's major criminology journals."

Abstract: Because the liability of ship owners is limited, classification societies have been considered as exempt from liability. This book analyses which actions of classification societies may give rise to claims and whether or not the societies can be held liable under English, German or American maritime law. In addition, it develops the fundamental aspects of an international convention on the limitation of the liability of classification societies.
Abstract: Classification societies are discharging various functions in the interest of flag States and shipowners. They are important actors in the system of maritime safety. Because the liability of shipowners is limited, classification societies have been considered as exempt from liability for a long time and in several jurisdictions this view still prevails. This study analyses which actions of classification societies may give rise to claims and whether or not the societies can be held liable under English, German or United States maritime law. Moreover, the fundamentalaspects of an international convention on the limitation of the liability of classification societies are developed.
