Abstract: How to avoid taxpayers paying for bank failures and banking crises? This book provides a proposal and a critique by twelve independent experts. It is addressed particularly to the threat posed in Europe by having large international banks, a history of bailouts and limited means of resolving any future banking crises. It shows how political imperatives and legal constraints currently result in economic losses in many countries round the world

Casting a broad look across a variety of institutions, from missionary societies to guilds, from lawcourts to academics, and exploring institutions across western Europe and Britain, the volume as a whole invites a newly comparative understanding of the nature of formal institutions in the period. By envisaging disparate institutions as having, to some degree, similar self-perceptions, strategies, and rituals, these essays begin to build up a picture of how early modern institutions functioned overall. The book will appeal to anyone interested in the social and cultural history of early modern communities, as well as offering insights into the relationship of institutions and the developing state."--Jacket

Abstract: The international political and military-strategic importance of the Asian continent has dramatically increased in recent years and it is conceivable that world affairs in this century will be significantly influenced by developments in Asia. This volume examines, on the one hand, the strategic goals of the most influential powers in the Eurasian region - in particular India, Pakistan, China, Russia and Japan, but also the USA that is strongly involved in the region, and on the other, the relations that these states have with each other. Special attention is paid to the subjective perceptions and thought patterns of the different players, for the perception that international political players have of the outside world is an important element that is frequently neglected in political and military analyses

Abstract: Launch activities performed by private entities deal with a complex legal environment. The Space Treaties provide a general liability framework. Launch participants are subject to regulatory or institutional control, and to domestic liability laws. Specific contractual practice has developed due to insurance limitations, the inter-participants' waivers of liability and claims. This book synthesizes information on the norms of play, to allow the grasp of their relative weight and interactions in the assessment of liability risk for launch activities. It reveals a legal framework presently lacking sufficient predictability for an efficient liability risk management: the waivers of liability suffer weaknesses as do all such clauses, and lack uniformity and reliability; and the Space Treaties contain ambiguous terms preventing predictable determination of the States responsible for authorizing and supervising launch activities and for damage compensation, and do not reflect the liability of launch operators. This book offers suggestions of new approaches for: harmonizing waivers of liability to improve their consistency, validity and flow-down; and improving the Space Treaties for their implementation to non-governmental launch activities. In the launch community, the need for lawmaking is less compelling than in fields such as aviation. Nevertheless, adjustments to the present framework are proposed through model clauses and an international instrument, for further thinking and contribution by those sharing the opinion that creative lawmaking is needed now to prepare for tomorrow's endeavors.

Abstract: This volume represents the first attempt to systematically compare organised crime concepts, as well as historical and contemporary patterns and control policies in thirteen European countries. These include seven ‘old’ EU Member States (Denmark, France, Germany, Italy, The Netherlands, Spain and the United Kingdom), two ‘new’ members (the Czech Republic and Poland), a candidate country (Turkey), and three non-EU countries (Albania, Russia and Switzerland). Based on a standardised research protocol, thirty-three experts from different legal and social disciplines provide insight through detailed country reports. On this basis, the editors compare organised crime patterns and policies in Europe and assess EU initiatives against organised crime. Its informed analyses and unprejudiced assessments will make Organised Crime in Europe an indispensable resource for scholars, students, practitioners, and policy-makers interested in understanding the complex phenomenon of organised crime and its related control policies in Europe.

Abstract: In the West we frequently pay lip service to universal notions of human rights. But do we ever consider how these work in local contexts and across diverse cultural and ethical structures? Do human rights agendas address the problems many people face, or are they more often the imposition of Western values onto largely non-Western communities? Human Rights in a Global Perspective develops a social critique of rights agendas. It provides an understanding of how rights discussions and institutions can construct certain types of subjects such as victims and perpetrators, and certain types of act, such as common crimes and crimes against humanity. Using examples from the United States, Europe, India and South Africa, the authors restore the social dimension to rights processes and suggest some ethical alternatives to current practice.

Abstract: This substantially updated and revised edition offers a comprehensive overview of the challenges confronting the political system as well as the international politics of the European Union. It draws from a rich spectrum of regional integration theories to determine what the Union actually is and how it is developing. The book examines constitutional politics of the European Union, from the Single European Act to the Treaty of Nice and beyond. The ongoing debate on the future of Europe links together questions of democracy and legitimacy, competences and rights, and the prospects for European polity-building. The aim is to contribute to a better understanding of the emerging European polity and the questions that further treaty reform generate for the future of the regional system. The authors also assess the evolving European security architecture, the limits and possibilities of a genuine European foreign, security and defence policy, and the role of the European Union in the post-Cold War international system. Common themes involve debates about stability and instability, continuity and change, multipolarity and leadership, co-operation and discord, power capabilities and patterns of behaviour. The book traces the defining features of the 'new order' in Europe and incorporates an analysis of the post-September 11 context. This major new edition will be of particular interest to academics, policy-makers and students with an interest in the politics and governance of contemporary Europe, as well as to those pursuing a career in international affairs

Abstract: Limiting Institutions examines the security threats in Eurasia and the role of institutions in the post-Cold War international environment. It looks at both the crucial aspect of foreign policy as well as a theoretical area of security studies and its impact in the former Soviet States including Russia, Belarus, Armenia, the Ukraine and Moldova. The first section addresses the important and varied range of security threats to this area of the world, and examines the range of responses open to European countries and to the United States. Threats such as ethnic conflict, transnational crime, and environmental and energy security issues are examined in depth. The second section addresses an important theoretical issue, namely the role that international institutions can perhaps play as arbiters of conflict and facilitators of cooperation in a region abutting the European political space. The role of the OSCE, NATO, the European Union, the Commonwealth of Independent States and the Black Sea Economic Cooperation Council are consequently examined closely. The contributors are scholars with solid international reputations, and the book will be of benefit to students of international relations and conflict analysis

Abstract: In Indonesia, the world's largest Muslim-majority country, Muslims struggle to reconcile radically different sets of social norms and laws, including those derived from Islam, local social norms, and contemporary ideas about gender equality and rule of law. In this 2003 study, John Bowen explores this struggle, through archival and ethnographic research in villages and courtrooms of the Aceh Province, Sumatra, and through interviews with national religious and legal figures. He analyses the social frameworks for disputes about land, inheritance, marriage, divorce, Islamic History and, more broadly, about the relationships between the state and Islam, and between Muslims and non-Muslims. The book speaks to debates carried out in all societies about how people can live together with their deep differences in values and ways of life. It will be welcomed by scholars and students across the social sciences, particularly those interested in anthropology, cultural sociology and political theory

Abstract: This book provides a detailed introduction to how the Länder (the sixteen states of Germany) function not only within the country itself but also within the wider context of European political affairs. Some knowledge of the role of the Länder is essential to an understanding of the political system as well as of German federalism. This book traces the origin of the Länder. It looks at their place in the constitutional order of the country and the political and administrative system. Their organization and administration are fully covered, as is their financing. Parties and elections in the Länder and the controversial roles of parliaments and deputies are also examined. Because of their role in the Bundesrat, the second legislative chamber, the Länder are clearly an important part of the national legislative process. They participate in policy-making with regard to the European Union, and have limited influence on Germany's foreign affairs outside of Europe. This is the first English language book that considers the Länder in this depth

Abstract: Andreas Wimmer argues that nationalist and ethnic politics have shaped modern societies to a far greater extent than has been acknowledged by social scientists. The modern state governs in the name of a people defined in ethnic and national terms. Democratic participation, equality before the law and protection from arbitrary violence were offered only to the ethnic group in a privileged relationship with the emerging nation-state. Depending on circumstances, the dynamics of exclusion took on different forms. Where nation building was 'successful', immigrants and 'ethnic minorities' are excluded from full participation; they risk being targets of xenophobia and racism. In weaker states, political closure proceeded along ethnic, rather than national lines and leads to corresponding forms of conflict and violence. In chapters on Mexico, Iraq and Switzerland, Wimmer provides extended case studies that support and contextualise this argument
Description / Table of Contents: Shadows of modernity -- I: Theoretical Explorations -- Compromise and closure: a theory of social dynamics -- The making of modern communities -- II: State-Building and Ethnic Conflict -- Who owns the state? Ethnic conflicts after the end of empires -- Nationalism and ethnic mobilisation in Mexico -- From empire to ethnocracy : Iraq since the Ottomans -- III: The Politics of Exclusion in Nationalised States -- Racism and xenophobia -- Nationalising multi-ethnic Switzerland

Abstract: If globalization is to be a benefit and not a burden to humankind, it must be governed by global institutions that are perceived by all people to be democratic and just. But before we can create such institutions, we must imagine them, and that requires a rethinking and extension of normative political theory. Global Justice and Transnational Politics encourages and advances that work. The book's first part, "Weak Universalism," contains essays by Amartya Sen and Leif Wenar that offer constructive developments of John Rawls's statement of the principles a liberal polity might reasonably propose to govern its relations with other peoples. The second part, "Strong Universalism and Transnational Commitments," contains essays by Jurgen Habermas, David Luban, Martha Nussbaum, and Thomas Pogge examining the normative sources and possible types of cross-border commitments. In the third part, "Transnational Politics and National Identities," Habermas discusses the possibility of a democratic political order developing within the institutional framework of the European Union; Thomas McCarthy draws on Kant to show how cosmopolitanism might be reconciled with the legacy of nationalism; and Craig Calhoun tries to retrieve a positive aspect of the tradition of nationalism, namely that it provides large populations with a powerful way of imagining political community across space and time.

Abstract: This book explores the lives and expectations of young women in the new Russia, looking at the enormous changes that the new social and economic environment have brought. The authors draw on the growing literature on gender and generation in the West which has arisen as a result of the recognition that the experience of youth is classed, raced and gendered and that the experience of gender is mediated by class, race, ethnicity, sexuality and age. They consider the role of the media, state and social institutions in shaping opportunities and experiences in the post-Soviet environment, focusing on the strategies employed by individual women to reforge social identities in a society in which they have been dislocated more acutely than in any other `postmodern' society.

Abstract: The displacement of 25 million ethnic Russians from the newly independent states is a major social and political consequence of the collapse of the former Soviet Union. Pilkington engages with the perspectives of officialdom, of those returning to their ethnic homeland, and of the receiving populations. She examines the policy and the practice of the Russian migration regime before looking at the social and cultural adaptation for refugees and forced migrants. Her work illuminates wider contemporary debates about identity and migration.

Abstract: Challenging the traditional treatment of human rights cast in purely legal frameworks, the authors argue that, in order to promote the notion of human rights, its geographies and spatialities must be investigated and be made explicit. A wealth of case studies examine the significance of these components in various countries with multi-cultured societies, and identify ways to integrate human rights issues in planning, development and policy making. The book uses case studies from UK, Israel, Canada, Singapore, USA, Peru, European Union, Australia and the Czech Republic.

Abstract: By joining the World Trade Organization China legitimizes its own brand of 'catch-up' industrialization. What has been learnt from the respective negotiations? What does China's entry mean for emerging Asia and the developing world at large? What implications will it have on the multilateral trading system? Abstract: Sexuality, motherhood and marriage were matters of public policy throughout the nineteenth and early twentieth centuries. They were prominent areas in the regulation of women, but the idea that the law merely reflected what was normal and natural obscured the extent of this regulation. Regulating Womanhood poses historically and culturally specific questions about the mechanisms that have controlled and restricted women. It shows not merely how laws and policies have set boundaries to the lives of women but also how the category of 'woman' has been constructed as a specific object for legal and social policy, and how women came to be seen as needing 'special' regulation. In addition, Regulating Womanhood explores how children and the organisation of reproduction and sexuality operated to normalise and make acceptable the degree of regulation to which women were subjected. Yet this is not a catalogue of the unmitigated subjection of women in history. The contributors focus on women's resistance and activity, and on the shift in modes of regulation, to challenge the idea of an unchanging history of the legal oppression of women

Digital Library Federation, December 2002 , Literaturverzeichnis (Seite 231-250) und Index , Laura Nader investigates an issue of vital importance for our time: the role of the law in the struggle for social and economic justice. In this book she gives an overview of the history of legal anthropology and at the same time urges anthropologists, lawyers, and activists to recognize the centrality of law in social change. Nader traces the evolution of the plaintiff's role in the United States in the second half of the twentieth century and argues that the atrophy of the plaintiff's power during this period represents a profound challenge to justice and democracy. Taking into account the vast changes wrought in both anthropology and the law by globalization, Nader speaks to the increasing dominance of large business corporations and the prominence of neoliberal ideology and practice today. In her discussion of these trends, she considers the rise of the alternative dispute resolution movement, which since the 1960s has been part of a major overhaul of the U.S. judicial system. Nader links the increasing popularity of this movement with the erosion of the plaintiff's power and suggests that mediation as an approach to conflict resolution is structured to favor powerful--often corporate --interests

Abstract: "International business transactions are heavily influenced by culture, practice and rule. The pursuit of business relationships within nation-states can be subject to differences in the generation of norms and the processing of disputes, but these conflicts are magnified many times over in cross-border transactions where nation-state control and support is weak or absent. This book seeks different explanations of the ways in which business people and their legal advisers try to minimise the effect of these magnified difficulties. At the outset the editors suggest four sources through which the international business community might be considered to have supplemented nation-state conflict prevention and dispute resolution institutions - an international legal order; the development of a private normative order based on common business practices (denominated the lex mercatoria); through the efforts and work product of internationalised law firms, and by means of extensive, thick personal relationships often referred to by their Chinese term guanxi. Since most explanations are dominated by North American and European legal scholarship and practice, a second concern of this book is to open up the discussion to competing explanatory frameworks. Specifically, it develops the notion that global legal convergence may not be the immediate, inevitable result of increased global economic interaction. Rather, less formal mechanisms for achieving normative understanding and predictability in business dealings may also flourish."--Bloomsbury Publishing

Abstract: Netwar-like cyberwar-describes a new spectrum of conflict that is emerging in the wake of the information revolution. Netwar includes conflicts waged, on the one hand, by terrorists, criminals, gangs, and ethnic extremists; and by civil-society activists (such as cyber activists or WTO protestors) on the other. What distinguishes netwar is the networked organizational structure of its practitioners-with many groups actually being leaderless-and their quickness in coming together in swarming attacks. To confront this new type of conflict, it is crucial for governments, military, and law enforcement to begin networking themselves.

Abstract: If, as David Guss argues, culture is a contested terrain with constantly changing contours, then festivals are its battlegrounds, where people come to fight and dispute in large acts of public display. Festive behavior, long seen by anthropologists and folklorists as the "uniform expression of a collective consciousness, is contentious and often subversive," and The Festive State is an eye-opening guide to its workings.

Abstract: In this volume, Gregory Matoesian uses the notorious 1991 rape trial of William Kennedy Smith to provide an in-depth analysis of language use and its role in that specific trial as well as in the law in general. He draws on the fields of conversation analysis, ethnomethodology, linguistic anthropology and social theory to show how language practices shape--and are shaped by--culture and the law, particularly in the social construction of rape as a legal fact. This analysis examines linguistic strategies from both defense and prosecutorial viewpoints, and how they relate to issues of gender, sexual identity, and power.

Abstract: This book is the first to systematically introduce and apply a social constructivist perspective to the study of European integration. Social constructivism is carefully located in terms of its philosophical and methodological origins. The wider debates and contribution of constructivist approaches to international relations are reviewed, and the insights that might then be afforded to European studies fully explored. Highlights include: new theoretical contributions to the debate by Ernst B. Haas, Andrew Moravcsik and Steve Smith; research on key aspects of European integration and EU governance applying a variety of constructivist approaches. The Social Construction of Europe provides new and important in.

Abstract: The essays in Violence and Subjectivity, written by a distinguished international roster of contributors, consider the ways in which violence shapes subjectivity and acts upon people's capacity to engage everyday life. Like its predecessor volume, Social Suffering, which explored the different ways social force inflicts harm on individuals and groups, this collection ventures into many areas of ongoing violence, asking how people live with themselves and others when perpetrators, victims, and witnesses all come from the same social space. From civil wars and ethnic riots to governmental and medical interventions at a more bureaucratic level, the authors address not only those extreme situations guaranteed to occupy precious media minutes but also the more subtle violences of science and state. However particular and circumscribed the site of any fieldwork may be, today's ethnographer finds local identities and circumstances molded by state and transnational forces, including the media themselves. These authors contest a new political geography that divides the world into "violence-prone areas" and "peaceful areas" and suggest that such descriptions might themselves contribute to violence in the present global context.

Abstract: There is widespread concern that the growth of the Internet is exacerbating inequalities between the information rich and poor. Digital Divide examines access and use of the Internet in 179 nations world-wide. A global divide is evident between industrialized and developing societies. A social divide is apparent between rich and poor within each nation. Within the online community, evidence for a democratic divide is emerging between those who do and do not use Internet resources to engage and participate in public life. Part I outlines the theoretical debate between cyber-optimists who see the Internet as the great leveler. Part II examines the virtual political system and the way that representative institutions have responded to new opportunities on the Internet. Part III analyzes how the public has responded to these opportunities in Europe and the United States and develops the civic engagement model to explain patterns of participation via the Internet.

Abstract: How should governments tax e-commerce? What does e-commerce mean for existing international tax principles and systems? What are the administrative challenges of taxing e-commerce, and how can these be tackled? How can governments harness the new technology to improve taxpayer service and reduce compliance costs? These are just some of the pressing questions addressed in this book. This volume provides a comprehensive guide to the status of the OECD-led international work on these questions, and hence to emerging conclusions and recommendations across a wide span of tax policy and tax administration issues. It sets out the latest thinking of the OECD's Committee on Fiscal Affairs on the taxation aspects of electronic commerce, and on progress toward implementing the Ottawa Taxation Framework Conditions. It includes a number of documents for public review and comment, and details the outputs from the past two years' intensive dialogue with the international business community and with non-member economies. As such it is an invaluable reference for all those interested in how governments around the globe are responding to the taxation challenges presented by e-commerce.

Abstract: Against the backdrop of South Africa's transition from apartheid, this provocative book explores the role of late twentieth century constitutionalism in facilitating political change. Using South Africa as a case study, Klug's larger project is to investigate why there has been renewed faith in justiciable constitutions and democratic constitutionalism despite the widespread recognition that courts are institutionally weak, lack adequate resources and are largely inaccessible to most citizens. He places this question in a broader context, evaluating the appeal of different constitutional models and illustrating how globalized institutions can be adapted to serve local domestic needs. Incorporating constitutional law, politics and legal history, this examination of South Africa's constitution-making process provides important insights into the role of law in the transition to democracy

Abstract: Voluntary approaches are schemes whereby firms make commitments to improve their environmental performance. They cover arrangements such as public voluntary programmes, negotiated agreements or unilateral commitments. Until recently, voluntary approaches have not been subject to systematic analysis, inasmuch as, unlike taxes and tradable permits, they have not been prescribed by economic theory. Voluntary approaches were "invented" by those who devise and implement them: policy-makers, business associations, individual firms, non-governmental associations, etc. The use of voluntary ap

Abstract: China's 1911-12 Revolution, which overthrew a two-thousand-year succession of dynasties, is thought of primarily as a change in governmental style, from imperial to republican, traditional to modern. But given that the dynasty that was overthrown - the Qing - was that of a minority ethnic group that had ruled China's Han majority for nearly three centuries, and that the revolutionaries were overwhelmingly Han, to what extent was the revolution not only anti-monarchical, but also anti-Manchu?Edward Rhoads explores this provocative and complicated question in Manchus and Han, analysing the evolution of the Manchus from a hereditary military caste (the "banner people") to a distinct ethnic group and then detailing the interplay and dialogue between the Manchu court and Han reformers that culminated in the dramatic changes of the early twentieth century. Manchus and Han is a pathbreaking study that will forever change the way historians of China view the events leading to the fall of the Qing dynasty. Likewise, it will clarify for ethnologists the unique origin of the Manchus as an

Abstract: Class action lawsuits--allowing one or a few plaintiffs to represent many who seek redress--have long been controversial. The current controversy, centered on lawsuits for money damages, is characterized by sharp disagreement among stakeholders about the kinds of suits being filed, whether plaintiffs' claims are meritorious, and whether resolutions to class actions are fair or socially desirable. Ultimately, these concerns lead many to wonder, "Are class actions worth their costs to society and to business? Do they do more harm than good?" To describe the landscape of current damage class action litigation, elucidate problems, and identify solutions, the RAND Institute for Civil Justice conducted a study using qualitative and quantitative research methods. The researchers concluded that the controversy over damage class actions has proven intractable because it implicates deeply held but sharply contested ideological views among stakeholders. Nevertheless, many of the political antagonists agree that class action practices merit improvement. The authors argue that both practices and outcomes could be substantially improved if more judges would supervise class action litigation more actively and scrutinize proposed settlements and fee awards more carefully. Educating and empowering judges to take more responsibility for case outcomes--and ensuring that they have the resources to do so--can help the civil justice system achieve a better balance between the public goals of class actions and the private interests that drive them

Abstract: In this book, Thomas Buoye examines the impact of large-scale economic change on social conflict in eighteenth-century China. He draws upon a large body of actual, documented homicide cases originating in property disputes to recreate the social tensions of rural China during the Qianlong reign (1736–1795). The development of property rights, a process that had begun in the Ming dynasty, was accompanied by other changes that fostered disruption and conflict, including an explosion in the population growth and the increasing strain on land and resources, and increasing commercialization in agriculture. Buoye challenges the 'markets' and 'moral economy' theories of economic behaviour. Applying the theories of Douglass North for the first time to this subject, he uses an institutional framework to explain seemingly irrational economic choices. Buoye examines demographic and technological factors, ideology, and political and economic institutions in rural China to understand the link between economic and social change

Abstract: The authors of Informal Politics in East Asia, first published in 2000, argue that political interaction within the informal dimension (behind-the-scenes politics) is at least as common and influential, though not always as transparent or coherent, as formal politics, and that this understudied category of social interaction merits more serious and methodical attention from social scientists. This book is a pioneering effort to delineate the various forms of informal politics within different East Asian political cultures and to develop some common theoretical principles for understanding how they work. Featured here are contributions by political scientists specializing in the regions of China, Taiwan, Japan, the Korean peninsula, and Vietnam. The authors apply to this dynamic region the classic core questions of politics: who gets what, when, how, and at whose expense?

Abstract: In order to distinguish between those who may and may not enter or leave, states everywhere have developed extensive systems of identification, central to which is the passport. This innovative book argues that documents such as passports, internal passports and related mechanisms have been crucial in making distinctions between citizens and non-citizens. It examines how the concept of citizenship has been used to delineate rights and penalties regarding property, liberty, taxes and welfare. It focuses on the US and Western Europe, moving from revolutionary France to the Napoleonic era, the American Civil War, the British industrial revolution, pre-World War I Italy, the reign of Germany's Third Reich and beyond. This innovative study combines theory and empirical data in questioning how and why states have established the exclusive right to authorize and regulate the movement of people

The use of voluntary approaches in environmental policy (e.g.negotiated agreements between Government and industry) is spreading and attracting growing interest in OECD countries. This book provides a systematic analysis of the different types of voluntary approaches, their economic characteristics, their role and effectiveness.
