    Abstract: Human trafficking is one of the most extreme forms of exploitation in the 21st century. It, therefore, is one of the most urgent political challenges of our global age. Christal Morehouse evaluates the anti-human trafficking policy in the United States of America and the Federal Republic of Germany. The author uncovers policy gaps and hidden policy agendas which weaken the German and American governments’ ability to combat human trafficking. She provides recommendations for policy and research which are designed to amend disparities in the anti-human trafficking policy in both countries. Finally, she examines the larger societal implications for the U.S. and German societies which could arise from failing to deal with this issue.

    Abstract: Substate nationalism, especially in the past fifteen years, has noticeably affected the political and territorial stability of many countries, both democratic and democratizing. Norms exist to limit the behavior of collective agents in relation to individuals, the set of universally accepted human rights provides a basic framework. There is a lacuna in international law, however, in the regulation of the behavior of groups toward other groups, with the exception of relations among states. The book offers a normative approach to moderate minority nationalism that treats minorities and majorities in multinational states justly and argues for the differentiation of group rights based on how group agents are constituted. It argues that group agency requires a shared set of beliefs concerning membership and the social ontology it offers ensures that group rights can be aligned with individual rights. It formulates a set of principles that, if adopted, would aid conflict resolution in multinational states. The book pays special attention to national self-determination in transitional societies. The book is intended for everyone in political philosophy and political science interested in global justice and international law and legal practitioners interested in normative issues and group rights

    Abstract: The book suggests that it is reasonable to ask why we should try to give a general description of law. It analyses the theories of Jeremy Bentham, John Austin, H.L.A. Hart, Joseph Raz and Ronald Dworkin. It then attempts to turn our attention away from general descriptions of the law, to the approach that has made us present and use such descriptions. This shift of attention is suggested by the difficulties encountered in our attempts to agree upon any of the proposed descriptions. The book presents an alternative approach to law. With the alternative approach we must question the use of assuming that law is something we can describe in general terms. The alternative approach is also supported by a critique of some widely spread conceptions of meaning, truth and reality. By showing how a pragmatic conception of truth and reality can be consistent and how it helps us focus on the most relevant matters, these arguments offer additional reasons for the change of approach. This change can liberate practise of law from the grip of theorists trying to force law into a mould more appropriate in natural science. The use of philosophy and theory of law in legal practice is strongly questioned and the frequent need for profoundly difficult judgements is acknowledged.

    Abstract: Located within wider debates about ‘security versus liberty’ in our post 9/11 world, the book analyses the new landscape of UK counter terrorism powers and offences and focuses upon the deleterious consequences of the so-called ‘war on terror’ on freedom of political expression and association. Questioning the compatibility of recent speech-limiting measures with liberalism’s established commitment to free speech and international human rights norms, the book takes a critical look at new powers to proscribe ‘extremist’ political parties, possession offences and other criminal controls (eg. Official Secrets Act prosecutions) as well as new offences such as ‘glorification’ of terrorism. Less visible, extra-legal forms of censorship are also evaluated. The monograph concludes by asking how a more vigorous defence of unorthodox and unpopular forms of expression might be safeguarded in the UK.

    Abstract: What changed in the United States with Hurricane Katrina was a feeling that we have entered a period of consequences. - Al Gore On February 05, 2007, the Intergovernmental Panel on Climate Change (IPCC) published the executive summary of its fourth assessment report (to be published April 06, 2007). In the summary, it not only acknowledged that climate change is happening at an accelerated rate, but also that its consequences would be dreary: changes in precipitation and in wind patterns, a rise of the sea levels, and desert- cation will globally impact the frequency of disasters and impair living standards. Whether or not we believe climate change is happening, over the past two years, we have witnessed a rise of the topic from oblivion to ubiquity and have experienced a growing emphasis on ?nding measures to prevent climate change. There is an unprecedented agreement among environmentalists, politicians, the public, and industry that we have to take effective action. Politicians are putting their creative plans to action unusually fast: Australia bans the light bulb, B- gium switches off lamps along lighted highways, and the US introduces daylight savings time two weeks earlier than in previous years. Industry, the most unlikely candidate for support, is rallying together in action groups like US-Cap or 2 Grad, and more and more consumers are offsetting their emissions through websites like myclimate. Merle Grobbel holds a PhD in Political Science (Public Policy) and works as a consultant for McKinsey Company.

    Abstract: This book deals with the early history of agriculture in a defined part of Western Europe: the loess belt west of the river Rhine. It is a well-illustrated book that integrates existing and new information starting with the first farmers and ending when food production was no longer the chief source of livelihood for the entire population. The long period, 5300 BC – AD 1000, is divided into six stages. Each stage has its own chapter with subchapters devoted to crops, crop cultivation, livestock and livestock handling, the farm and its yard, and the farm in connection with other farms and the outside world. Every chapter starts with a short outline of the cultural context. The crop plants and animals are described, together with their origin. The subchapters on crop cultivation deal with the operational chain from staking out fields to storage. The introduction of tools such as the plough, the wheel and wagon, and the scythe is discussed. Farm buildings, or at least their groundplans, are presented. The clustering of farms into hamlets or the absence of such aggregations is described. Two chapters deal with the impact of farming on the landscape. The eight chapters on farming and landscape are preceded by an introduction and a chapter on the sources of information. The book ends with a chapter ‘summarizing six millennia of agriculture’, a list of glossary terms and an index. Audience: This book will be of interest to researchers in archaeology, history and agriculture, and to landscape engineers.

    Abstract: During the last decades, legal theory has focused almost completely on norms, rules and arguments as the constitutive elements of law. Concepts were mostly neglected. The contributions to this volume try to remedy this neglect by elucidating the role concepts play in law from different perspectives. A main aim of this volume is to initiate a debate about concepts in law. Åke Frändberg gives an overview of the many different uses of concepts in law and shows amongst others that concepts in the law should not be confused with the role of concepts in descriptions of the law. Dietmar von der Pfordten criticizes the restriction to norms as parts of the law in contemporary legal theory by questioning what concepts are and what their function is, both in general and in legal conceptual schemes. Giovanni Sartor assumes the inferential analysis of meaning proposed by Alf Ross in his ground breaking paper Tû-tû and addresses the question how possession of a concept, including the rules defining it, is possible without endorsing these rules. Jaap Hage argues that 1. legal status words such as 'owner' have a meaning because they denote things or relations in institutional reality, 2. the meaning of these words consists in this denotation relation, 3. knowledge of this meaning presupposes knowledge of the rules governing these words. Torben Spaak contributes to this volume with an exemplary analysis of one of the most central concepts of the law, namely that of a legal power. Lorenz Kähler discusses the role of concepts in determining the scope of application of legal rules and raises from this perspective the question to what extent legal concept formation can be arbitrary. Ralf Poscher argues that as soon as a concept is used in stating the law, the precise scope of application of this concept has become a legal matter.

    Abstract: With the growing literature on the subject of punitive damages, the consensus is that it seems worthwhile and even necessary to discuss, thoroughly and on a comparative basis, the nature, role and suitability of such damages in tort law and private law in general. This book contains reports from selected jurisdictions that explicitly allow the award of punitive damages as well as from jurisdictions which purport (sometimes emphatically) to deny their existence (although a number covertly incorporate such damages into the framework of their tort systems). It benefits from an economic analysis of punitive damages, a report from a private international law perspective, one on their insurability and one on aggravated damages. The book's comparative report and conclusion critically evaluates the material in the above reports and advances a thorough analysis of the nature of punitive damages, the cases for and against them, and their suitability in the field of tort law. Alternative remedies in private and criminal law are also considered. The publication will appeal to students, academics, practitioners, judges, policy makers and those in the insurance industry.

    Abstract: This report covers a broad range of SME taxation issues, including possible effects of taxation on the creation and growth of SMEs, and considerations arising from a relatively high compliance burden. Differing income tax and social security contribution burdens of unincorporated and incorporated SMEs are considered in detail, with analysis of average statutory tax rates carried out to investigate possible tax distortions to business creation and business structure decisions of a single worker/owner of an SME. Various arguments are presented for and against the targeting of tax incentives at SMEs. Country examples of SME tax incentives and compliance cost reduction measures are provided in the report.

    Abstract: All societies must deal with the possibility of violence, and they do so in different ways. This book integrates the problem of violence into a larger social science and historical framework, showing how economic and political behavior are closely linked. Most societies, which we call natural states, limit violence by political manipulation of the economy to create privileged interests. These privileges limit the use of violence by powerful individuals, but doing so hinders both economic and political development. In contrast, modern societies create open access to economic and political organizations, fostering political and economic competition. The book provides a framework for understanding the two types of social orders, why open access societies are both politically and economically more developed, and how some 25 countries have made the transition between the two types

    Abstract: This book studies the normative intersection between integration, immigration and nationality in the European Union (EU). It examines the relationship between integration and the legal frameworks of admission, stay and access to nationality by third country nationals at national and European levels. Integration is being subject to multifaceted processes transforming its traditional policy and legal settings, as well as its classical theoretical premises and approaches. The Europeanisation of immigration policy has provoked the emergence of distinctive European approaches on integration. The legal elements of integration are being developed through two parallel settings: the EU Framework on Integration and European immigration law. These venues constitute two of the main pillars upon which the common EU immigration policy is being constructed, and their nexus raises several elements in need of reflection and study. This book examines the processes through which integration becomes a norm in nationality and immigration law and policy at the national and EU levels, and the implications of these processes for the legal status of third country nationals and the overall coherency of the common EU immigration policy

Beyond addressing many fields in the academy, the book discusses learned individuals interested in the often puzzling spatial and cultural disparities of knowledge and clashes of knowledge.
    Abstract: 'Clashes of Knowledge'is the first volume in a book series called 'Knowledge and Space' dealing with spatial disparities of knowledge and the impact of the spatial context on the production and application of knowledge. The contributions in this book explore the conflicts between various types of knowledge, especially between orthodox and heterodox knowledge systems, which range from religious fundamentalism to heresies within the scientific community itself. Does the traditional distinction between 'belief' and 'knowledge' still make sense? How is the difference between knowledge and belief understood in different cultural contexts? How have the religious-based knowledge systems been displaced in their hegemonic role by 'scientific' knowledge? In which ways do the agents of hegemonic, orthodox knowledge interact with the representatives of deviating, heterodox knowledge? These and many other questions are addressed by scholars of geography, history of science, philosophy, psychology, religious studies, sociology, theology, etc. A number of articles describe how scientists attempt to systematically exclude implausible knowledge claims from their disciplines and how the boundaries of science are subject to historical change and to spatial and cultural contexts. Knowledge systems can also clash at the level of the individual. Why do people often ignore information that contradicts their personal 'knowledge'? Under what conditions are people prepared to give up firm beliefs and integrate new information that contradicts their prior knowledge? This book thus addresses many fields in the academy but also learned individuals who are interested in the often puzzling spatial and cultural disparities of knowledge and clashes of knowledge.

    Abstract: Of the over 33 million refugees and internally displaced people in the world today, a disproportionate percentage are found in Africa. Most have been driven from their homes by armed strife, displacing people into settings that fail to meet standards for even basic human dignity. Protection of the human rights of these people is highly uncertain and unpredictable. Many refugee service agencies agree advocacy on behalf of the displaced is a key aspect of their task. But those working in the field are so pressed by urgent crises that they can rarely analyze the requirements of advocacy systematically. Yet advocacy must go beyond international law to human rights as an ethical standard to prevent displaced people from falling through the cracks of our conflicted world.Refugee Rights: Ethics, Advocacy, and Africa draws upon David Hollenbach, SJ's work as founder and director of the Center for Human Rights and International Justice at Boston College to provide an analytical framework for vigorous advocacy on behalf of refugees and internally displaced people. Representing both religious and secular perspectives, the contributors are scholars, practitioners, and refugee advocatesùall of whom have spent time on the ground in Africa. The book begins with the poignant narrative of Abebe Feyissa, an Ethiopian refugee who has spent over fifteen years in a refugee camp from hell.     Abstract: This book discusses the impact of taxation on economic growth, employment, investment, consumption and the environment. The public finance literature commonly distinguishes between three major functions of taxation: the traditional function of raising revenue to finance government expenditure; the distributional function as an instrument to alter the distribution of income and wealth amongst households; and the regulatory function that uses taxation at the benefit of stabilization and other economic policies. Especially after the Second World War, OECD countries have increasingly used taxation to achieve a variety of economic and social objectives. Today many governments use the tax system to stimulate economic growth and employment. Fiscal measures also play a role in creating a favourable climate for business investment and to promote a long-term sustainable environmental policy. Currently, in the debate on global warming, the use of tax instruments to tackle climate change is on the top of the international agenda. The authors aim to provide the reader with the necessary empirical information, while at the same time presenting an overview of the latest theory and best practices. In doing so, many relevant policy issues are touched upon. Based on theoretical and empirical studies and practical experiences in OECD countries, the book establishes guidelines for effective tax policy. The book offers tools for tax design in a globalising economy and the world of the internet with increasing tax competition and a growing battle for companies and brains between countries. The book also presents a 'carrot and stick' model to promote clean technologies, reduce pollution and combat climate change. The message from the authors is straightforward: broad, low, simple, and a shift from income to consumption taxation. These principles are illustrated in a concept proposal for a so-called Second Life Tax system

    Abstract: This publication deals with the European dimension of tort law. It provides a critical analysis of the acquis communautaire, asking if and to what extent the provisions and case law in the field of tort law are based on a conclusive system and are in accord with the national legal systems. It thus evaluates whether the acquis communautaire form the beginning of a comprehensive and coherent EC tort law or if the single directives and regulations are contradictory and lack a general concept that is yet to be found. To gain an overview of 'EC Tort Law' certain provisions and decisions were analysed by a group of authors under thirteen elements that form the basis of tort law e.g. fault/strict liability, causation, damage, damages and limitation of actions. An analysis of these aspects was then undertaken by another group of authors each focusing on their respective legal families within the European Union. The publication also contains a section on terminological issues in EC tort law.

    Abstract: There is a veritable gold rush mentality in the life science world as scientists, entrepreneurs and multinationals are staking claims to the ‘code of life’ embodied in the world’s current stock of plants, animals, microbes and human populations. In response, the communities that see themselves as the custodians of both that traditional knowledge and specific genetic resources have demanded greater recognition of their role in creating and conserving this resource, access to any resulting improvements and a share of the benefits arising from their patrimony. This has precipitated a widespread effort-in local communities, in the marketplace, in many developing and developed countries and at the talks in the Doha Round of the WTO-to reconcile the interests and concerns of the two opposing groups. This edited volume explores the legal, economic and political context for the debate about intellectual property rights for traditional knowledge and genetic resources and critically analyses the theory and practice of access and benefits sharing efforts around the world.
