    Kurzfassung: Als "einen der interessantesten katholischen Missionare im Südlichen Afrika" bezeichnet die Historikerin Joy Brain den Tiroler Priester Franz Mayr in ihrem Vorwort zu dieser umfangreichen Quellenedition. Die gesammelten, aus zahlreichen Archiven im In- und Ausland stammenden Schriften Mayrs, umfassen Briefe, Tagebucheinträge, Auszüge aus Chroniken, seine in Missions- und ethnologischen Zeitschriften und Tageszeitungen erschienenen Artikel sowie zahlreiche zeitgenössische Photographien. Obwohl unser Land bzw. die Habsburger-Monarchie selbst keine Kolonien auf diesem Kontinent besaß, wirkte doch eine beträchtliche Anzahl von ihnen u. a. in katholischen Stationen. Ihre Rolle in der Interaktion mit der einheimischen Bevölkerung und die Wirkung ihrer Missionsartikel auf das Afrikabild ist bisher nahezu unerforscht geblieben. Mayr war nur einer jener Österreicher und Österreicherinnen, die im Zuge der katholischen Missionseuphorie des 19. und beginnenden 20. Jahrhunderts ausreisten, um Afrikaner und Afrikanerinnen zum Christentum zu "bekehren". Er wurde 1865 in der Osttiroler Gemeinde Nussdorf geboren und verbrachte seine Gymnasialzeit in Brixen, wo er auch das Priesterseminar absolvierte. Ab 1890 wirkte er in der ehemaligen britischen Kolonie Natal (Südafrika), in Südrhodesien (heutiges Zimbabwe) und in Swaziland, wo er 1914 einem Mordanschlag zum Opfer fiel. Unter seiner Leitung entstanden mehrere Missionsstationen u. a. das Projekt "Maryvale", ein Dorf für die einheimischen katholischen Zulus, heute ein Stadtteil von Pietermaritzburg. Über die vorhandenen Quellen erhält man Einblick in den Alltag des Missionars, Informationen über Hemmnisse seiner Arbeit und über Erfolgserlebnisse, seine Einstellung zur afrikanischen Bevölkerung, zur jeweiligen Kolonialregierung, zu anderen Religionsgemeinschaften oder über seinen persönlichen Gemütszustand. F. Mayr schrieb mehrere Bücher in afrikanischen Sprachen, hatte ein Faible für Musik und Photographie und sammelte leidenschaftlich ethnologische Gegenstände, die er teilweise afrikanischen Museen überließ, teilweise für Ausstellungen nach Europa sandte. Erst kürzlich entdeckte man im Herbarium der "Universität von Natal" eine Pflanzensammlung, die er angelegt hatte. Sie wird derzeit von einer Gruppe von Wissenschaftlern ausgewertet und stellt eine der frühesten Dokumentationen über den Gebrauch von Heilpflanzen der Zulus dar.     Kurzfassung: Franz Mayr was "one of the most interesting of catholic missionaries in Southern Africa" states Professor Joy Brain ("University of Durban") in the foreword she wrote for this first edition of his writings. Mayr was born in the Austrian province of Tyrol in 1865, educated as a priest in the diocese of Brixen and arrived in Natal (South Africa) at the beginning of May 1890, inspired by the work being done there by the Trappist-Monks led by Abbot Franz Pfanner. Mayr was physically handicapped and soon left the trappists but just to offer his services to the vicar apostolic of Natal, Bishop Charles Jolivet, who accepted him for work among the African population. He was sent to Pietermaritzburg then capital of the British colony to take over the care of the African parishioners to bring the "good news" to those who had never heard it. He founded several new mission-stations in Natal, Southern Rhodesia (present day Zimbabwe) and Swaziland where he was killed by a native robber in 1914. Mayr - a man of many talents - was a gifted linguist, studied and published books in several African languages. He was interested in cultural anthropology and collected information about African customs. It is now more than a hundred years since Franz Mayr began his work of evangelisation and scholarship in Southern Africa. Publishing his letters and articles - kept by several archives in Europe - should help to remember a man of the Habsburg-Monarchy who went to preach the gospel to the so called heathen of Africa. Although Austria or Austria-Hungary never owned colonies in Africa many of its inhabitants left their homes to work in catholic mission-stations around the continent. Several introductory chapters in this book explain the particular historical context which has to be put into consideration when reading Mayrs' writings. From there we learn about his life, his work, how he treated the native population, what he thought about other religious congregations around him, the colonialists and about troubles when trying to convince people to believe in the only - the "European God". The missionary deserves to be better known. The present edition of historical sources is to be seen as a most relevant step allowing us to interpret his personality adequately

    Kurzfassung: Main description: In der jüngeren Forschung haben die beiden klassischen Hypothesen einer Aufstiegsgeschichte Davids und einer Thronfolgeerzählung an Überzeugungskraft verloren. Damit rücken die Texte in II Sam 1-5 verstärkt in den Blick, denen eine Schlüsselstellung für die literarische Genese der Davidüberlieferung zukommt. Die vorliegende Studie ermittelt einen ersten durchlaufenden und noch vorexilischen Darstellungszusammenhang, der im 7. Jh. v. Chr. entstanden ist. Entsprechend erklärt sie das Doppelkönigtum Davids über Israel und Juda als eine protodeuteronomistische Gründungsgeschichte der späten Königszeit. Die Untersuchung schließt mit einer redaktionsgeschichtlichen Skizze der Daviderzählungen im zweiten Samuelbuch und einer Revision der geschichtlichen Zeugnisse.
    Kurzfassung: Main description: Recent research has led to a weakening of the two classical hypotheses on the story of David's rise and a succession narrative. Instead, attention has focussed on the texts in II Samuel 1-5, which are seen as being of crucial importance for the literary genesis of the story of David. The present study reveals a first continuous account from before the time of exile, which was produced in the 7th century BC. Thus it explains David's double kingship of Israel and Juda as a proto-deuteronomistic foundation narrative from the late Age of Kings. The study closes with a sketch of the editorial history of the David narratives in II Samuel and a revision of the historical records.

    Kurzfassung: For two decades now, Stephen C. Headley has been one of the most original and systematic ethnographers of Javanese religion and cultural history. No one in contemporary Javanese ethnography has combed through the annals of nineteenth and twentieth century scholarship with as careful an eye for the variety of Javanese traditions. None combines this historical ethnography with as careful and unusual body of contemporary ethnography. Headley's new book brings these long-developed skills to bear on contemporary religious change in the Surakarta region of Central Java. In his analysis of the Durga ritual complex, Headley sheds light on one of the most unusual court traditions to have survived in an era of deepening Islamization. Headley's analysis of this ritual complex, and its implications for our understanding of popular Javanese religion, deserves to be read by all serious students of Java, as well as anyone interested in religion in Indonesia. However, Headley moves well beyond this unusual ritual complex, to take us through the twists and turns of religious culture and politics in what is one of the richest but also most troubled of cultural regions in Java.     Kurzfassung: Saints, their places, the rituals of their veneration - the heroes and martyrs they represent or to whom they are often connected with - and the beliefs in their powers have often been described as being counter-thematic to the constructive issues of modern society in our times. However, in the Middle East - and certainly this is true for many other world regions and other world religions - local saints, Jewish, Christian and Islamic, have gained a very ambiguous status in religious movements, political struggles and events of social re-construction. In the case of Islam, perhaps more openly, modernists and fundamentalists alike attempt to abolish or to re-formulate the agenda of venerating the saints. However, at the same time saints and their localities have become a sort of overcharged symbolic incidence in the modern presence of Islam, in politics, in the media and - perhaps on a more hidden ground - in the struggle of ideas. In this volume historians, islamologists, anthropologists and sociologists give a multiple description of the inherent issues of the unhampered continuity of Muslim saints and their significance. Damit rücken die Texte in II Sam 1-5 verstärkt in den Blick, denen eine Schlüsselstellung für die literarische Genese der Davidüberlieferung zukommt. Die vorliegende Studie ermittelt einen ersten durchlaufenden und noch vorexilischen Darstellungszusammenhang, der im 7. Jh. v. Chr. entstanden ist. Entsprechend erklärt sie das Doppelkönigtum Davids über Israel und Juda als eine protodeuteronomistische Gründungsgeschichte der späten Königszeit. Die Untersuchung schließt mit einer redaktionsgeschichtlichen Skizze der Daviderzählungen im zweiten Samuelbuch und einer Revision der geschichtlichen Zeugnisse , Main description: Recent research has led to a weakening of the two classical hypotheses on the story of David's rise and a succession narrative. Instead, attention has focussed on the texts in II Samuel 1-5, which are seen as being of crucial importance for the literary genesis of the story of David. The present study reveals a first continuous account from before the time of exile, which was produced in the 7th century BC. Thus it explains David's double kingship of Israel and Juda as a proto-deuteronomistic foundation narrative from the late Age of Kings.     Kurzfassung: Launch activities performed by private entities deal with a complex legal environment. The Space Treaties provide a general liability framework. Launch participants are subject to regulatory or institutional control, and to domestic liability laws. Specific contractual practice has developed due to insurance limitations, the inter-participants' waivers of liability and claims. This book synthesizes information on the norms of play, to allow the grasp of their relative weight and interactions in the assessment of liability risk for launch activities. It reveals a legal framework presently lacking sufficient predictability for an efficient liability risk management: the waivers of liability suffer weaknesses as do all such clauses, and lack uniformity and reliability; and the Space Treaties contain ambiguous terms preventing predictable determination of the States responsible for authorizing and supervising launch activities and for damage compensation, and do not reflect the liability of launch operators. This book offers suggestions of new approaches for: harmonizing waivers of liability to improve their consistency, validity and flow-down; and improving the Space Treaties for their implementation to non-governmental launch activities. In the launch community, the need for lawmaking is less compelling than in fields such as aviation. Nevertheless, adjustments to the present framework are proposed through model clauses and an international instrument, for further thinking and contribution by those sharing the opinion that creative lawmaking is needed now to prepare for tomorrow's endeavors.

    Kurzfassung: Arnd Uhle untersucht das Verhältnis von freiheitlichem Verfassungsstaat und kultureller Identität, das bislang kaum – wenn, dann lediglich partiell – erforscht wurde. Der Autor beleuchtet die Relevanz der kulturellen Identität für Entstehung, Gestalt und Fortbestand des freiheitlichen Verfassungsstaates aus verfassungstheoretischer, aus verfassungsrechtlicher und schließlich aus europarechtlicher Perspektive.Bereits aus verfassungstheoretischer Sicht ergibt sich dabei, daß die kulturelle Identität gleichermaßen Entstehungs- wie auch Geltungsbedingung freiheitlicher Verfassungsstaatlichkeit ist, weil der freiheitliche Staat in vielfältiger Weise an die kulturelle Identität anknüpft. Eine Betrachtung aus verfassungsrechtlicher Perspektive unterstreicht diesen Befund und belegt, daß namentlich das deutsche Grundgesetz in einer prima facie zwar komplex und unüberschaubar erscheinenden, letztlich aber systematisch geordneten und differenzierenden Weise an die kulturelle Identität anknüpft – und diese angesichts ihrer Bedeutung für den dauerhaften Fortbestand des freiheitlichen Verfassungsstaates überdies durch das in der Habilitationsschrift erstmals entfaltete grundgesetzliche Staatsziel der Vitalität und Dauerhaftigkeit der freiheitlichen Verfassungsordnung mit verfassungsrechtlichem Schutz umhegt. In der Konsequenz dieses Staatsziels ist der grundgesetzgebundene Staat zur Pflege und zum Schutz der kulturellen Identität verpflichtet. Eine abschließende europarechtliche Betrachtung verdeutlicht, daß die grundgesetzliche Anknüpfung an die kulturelle Identität wie auch deren verfassungsrechtliche Sicherung den Schutz des Art. 6 Abs.3 EUV genießen, der die Achtung der nationalen Identität anordnet.

    Kurzfassung: Das 20. Jahrhundert ist oft als das Jahrhundert der Gewalt bezeichnet worden. Daher mangelt es nicht an Gewaltphänomenen, die es genauer zu untersuchen gilt, als dies bislang geschehen ist. In diesem Band werden deswegen Gewalttaten aus neuen Perspektiven untersucht, neue Interpretationen ihrer Entstehung vorgestellt und neue Herausforderungen der sozialwissenschaftlichen Gewaltforschung debattiert. Folgende Fragen werden unter anderem in diesem gesellschaftspolitisch folgenreichen Buch behandelt: Kann der lange dominierende Begriff der physischen Gewalt überhaupt noch leitend sein, und muß die Gewaltanalyse sich nicht wieder stärker der strukturellen Gewalt zuwenden, da zunehmend eine »Gewalt ohne Gesicht« auftritt? Stecken die Ursachen im Gewalthandeln selbst, so daß Hinweise auf soziale Hintergründe etwa in die Irre führen? Verlieren sozialwissenschaftliche Forschungen aufgrund neuer biologischer Ansätze völlig an Relevanz? Biographische Informationen Wilhelm Heitmeyer, geboren 1945, war von 1996 bis 2013 Direktor des Instituts für interdisziplinäre Konflikt- und Gewaltforschung der Universität Bielefeld und arbeitet dort jetzt als Forschungsprofessor. Identifying popular music as an important site in this wider cultural endeavor, this book focuses on the three major popular music cultures that are proving instrumental in attempts to invent Israeliness: the invented folk song repertoire known as Shirei Eretz Israel; the contemporary, global-cosmopolitan Israeli rock; and the ethnic-oriental musica mizrahit. The result is the first ever comprehensive study of popular music in Israel. Motti Regev, a sociologist, and Edwin Seroussi, an ethnomusicologist, approach their subject from alternative perspectives, producing a truly interdisciplinary, sociocultural account of music as a feature and a force in the shaping of Israeliness.     Kurzfassung: Die Arbeit befasst sich mit dem mandatum iuris gentium und der völkerrechtlichen Treuhand. Im ersten historischen Teil werden die rechts- und ideengeschichtlichen Wurzeln beider Institute nachvollzogen. Im zweiten Teil werden problematische Fälle des modernen Völkerrechts dargestellt, in denen das Mandats- bzw. Treuhandrecht in völkerrechtlichen Streitfragen besondere Relevanz hatte und z. T noch hat, z.B. Südwestafrika/Namibia, Israel/Palästina und Nauru. Im dritten und letzten Teil wird die Zukunft der völkerrechtlichen Treuhand untersucht, insbesondere in besonders aktuellen Fällen wie Kosovo, Afghanistan und Ost-Timor, die de facto mit der völkerrechtlichen Treuhand vergleichbar sind. In diesem Teil werden auch Vorschläge zu Wiederbelebung des UN-Treuhandsystems, auch im Umweltvölkerrecht, und ähnliche Vorschläge aus der Völkerrechtslehre diskutiert. Insgesamt wird festgestellt, dass der Treuhandgedanke seit seiner Entstehung im Völkerrecht nicht an Aktualität eingebüßt hat.

    Kurzfassung: Im Jahr 2003 fand in der Göttinger Jakobikirche eine hochkarätige und deshalb zu Recht viel beachtete Vorlesungsreihe zur Wirkungsgeschichte der Bibel statt. Namhafte Vertreter bester Göttinger Philologie fanden hier ihr Publikum - interessiert, oft gelehrt, aber in seinem Interesse nicht auf eine fachwissenschaftliche Binnendiskussion beschränkt.     Kurzfassung: Annotation, Throughout the Middle East, Islamist charities and social welfare organizations play a major role in addressing the socioeconomic needs of Muslim societies, independently of the state. Through case studies of Islamic medical clinics in Egypt, the Islamic Center Charity Society in Jordan, and the Islah Women's Charitable Society in Yemen, Janine A. Clark examines the structure and dynamics of moderate Islamic institutions and their social and political impact. Questioning the widespread assumption that such organizations primarily serve the poorer classes, Clark argues that these organizations in fact are run by and for the middle class. Rather than the vertical recruitment or mobilization of the poor that they are often presumed to promote, Islamic social institutions play an important role in strengthening social networks that bind middle-class professionals, volunteers, and clients. Ties of solidarity that develop along these horizontal lines foster the development of new social networks and the diffusion of new ideas

    Kurzfassung: In der andauernden Auseinandersetzung um die Bedingungen des Ausstiegs aus der Nutzung der Kernenergie zur Stromerzeugung sind auch die verfassungsrechtlichen und europarechtlichen Rahmendaten umstritten. Auf Seiten der Kernkraftwerks-Betreiber wird die geplante Stillegung der Anlagen als eine grundsätzlich entschädigungspflichtige Enteignung angesehen. Demgegenüber kommt Erhard Denninger in seiner Studie zu dem Ergebnis, daß ein »Ausstiegsgesetz«, das die gewerbliche Nutzung der Atomenergie für die Zukunft überhaupt untersagt, eine verfassungsrechtlich zulässige Inhalts- und Schrankenbestimmung des Eigentums darstellt. Allerdings muß das schutzwürdige Vertrauen der bisherigen Kraftwerksbetreiber nach dem Grundsatz der Verhältnismäßigkeit berücksichtigt werden. Dies kann durch entsprechende Gestaltung der »Restlaufzeiten« geschehen. Die Arbeit beruht auf einem Rechtsgutachten für das Bundesumweltministerium. Der Verfasser ist mehrfach mit Arbeiten zu Verfassungsrechtsfragen im Technikrecht hervorgetreten

    Kurzfassung: China's 1911-12 Revolution, which overthrew a two-thousand-year succession of dynasties, is thought of primarily as a change in governmental style, from imperial to republican, traditional to modern. But given that the dynasty that was overthrown - the Qing - was that of a minority ethnic group that had ruled China's Han majority for nearly three centuries, and that the revolutionaries were overwhelmingly Han, to what extent was the revolution not only anti-monarchical, but also anti-Manchu?Edward Rhoads explores this provocative and complicated question in Manchus and Han, analysing the evolution of the Manchus from a hereditary military caste (the "banner people") to a distinct ethnic group and then detailing the interplay and dialogue between the Manchu court and Han reformers that culminated in the dramatic changes of the early twentieth century.     Kurzfassung: Against the backdrop of South Africa's transition from apartheid, this provocative book explores the role of late twentieth century constitutionalism in facilitating political change. Using South Africa as a case study, Klug's larger project is to investigate why there has been renewed faith in justiciable constitutions and democratic constitutionalism despite the widespread recognition that courts are institutionally weak, lack adequate resources and are largely inaccessible to most citizens.     Kurzfassung: Class action lawsuits--allowing one or a few plaintiffs to represent many who seek redress--have long been controversial. The current controversy, centered on lawsuits for money damages, is characterized by sharp disagreement among stakeholders about the kinds of suits being filed, whether plaintiffs' claims are meritorious, and whether resolutions to class actions are fair or socially desirable. Ultimately, these concerns lead many to wonder, "Are class actions worth their costs to society and to business? Do they do more harm than good?" To describe the landscape of current damage class action litigation, elucidate problems, and identify solutions, the RAND Institute for Civil Justice conducted a study using qualitative and quantitative research methods. The researchers concluded that the controversy over damage class actions has proven intractable because it implicates deeply held but sharply contested ideological views among stakeholders. Nevertheless, many of the political antagonists agree that class action practices merit improvement. The authors argue that both practices and outcomes could be substantially improved if more judges would supervise class action litigation more actively and scrutinize proposed settlements and fee awards more carefully. Educating and empowering judges to take more responsibility for case outcomes--and ensuring that they have the resources to do so--can help the civil justice system achieve a better balance between the public goals of class actions and the private interests that drive them

    Kurzfassung: In January 1998 leading scholars from Europe, the United States, and Israel in the fields of medieval encyclopedias (Arabic, Latin and Hebrew) and medieval Jewish philosophy and science gathered together at Bar-Ilan University in Ramat-Gan, Israel, for an international conference on medieval Hebrew encyclopedias of science and philosophy. The primary purpose of the conference was to explore and define the structure, sources, nature, and characteristics of the medieval Hebrew encyclopedias of science and philosophy. This book, the first to devote itself to the medieval Hebrew encyclopedias of science and philosophy, contains revised versions of the papers that were prepared for this conference. This volume also includes an annotated translation of Moritz Steinschneider's groundbreaking discussion of this subject in his Die hebraeischen Übersetzungen. The Medieval Hebrew Encyclopedias of Science and Philosophy will be of particular interest to students of medieval philosophy and science, Jewish intellectual history, the history of ideas, and pre-modern Western encyclopedias
