Die Arbeit ordnet das Instrument in das bestehende System verdeckter und täuschender Ermittlungsmaßnahmen ein. Sie analysiert die verfassungs- und strafverfahrensrechtliche Zulässigkeit des staatlichen Vorgehens, das sich im Grenzbereich zwischen Gefahrenabwehr und Strafverfolgung bewegt.     Abstract: Zu Partnerschaftsgewalt gegen Männer in Deutschland liegen nur wenige wissenschaftlich ermittelte Daten vor. Die Autor:innen präsentieren Befunde einer quantitativen, deutschlandweit repräsentativen Online-Befragung von 1.200 Männern im Alter von 18 bis 69 Jahren zu Prävalenzen von Partnerschaftsgewalt und ihren Folgen.     Abstract: This Open access book is a collection of essays and offers an in-depth analysis of silence as an aesthetic practice and a textual strategy which paradoxically speaks of the unspoken nature of many inconvenient hidden truths of Irish society in the work of contemporary fiction writers. The study acknowledges Ireland’s history of damaging silences and considers its legacies, but it also underscores how silence can serve as a valuable, even productive, means of expression. From a wide range of critical perspectives, the individual essays address, among other issues, the conspiracies of silence in Catholic Ireland, the silenced structural oppression of Celtic Tiger Ireland, the recovery of silenced stories/voices of the past and their examination in the present, as well as millennial disaffection and the silencing of vulnerability in today’s neoliberal Ireland. The book ’s attention to silence provides a rich vocabulary for understanding what unfolds in the quiet interstices of Irish writing from recent decades. This study also invokes the past to understand the present and, thus, demonstrates the continuities and discontinuities that define how silence operates in Irish culture.     Abstract: This study addresses the phenomenon of domestic burglary (§ 244 (1) No. 3, (4) German Criminal Code). Particular emphasis is placed on the realities of criminal sentencing for this offense. Based on a multi-perspective analysis of the various appearances of the phenomenon and its legal classification, the study examines the reform of § 244 GCC and the realities of sentencing in criminal courts for the offense. In particular, discrepancies in sentencing that cannot be adequately explained by differences in factual circumstances of the underlying cases, and deficits in the written reasons for sentencing decisions are highlighted. The study reveals a need for action in the field of criminal sentencing
    Abstract: Das Werk widmet sich dem (Privat-)Wohnungseinbruchdiebstahl nach § 244 Abs. 1 Nr. 3, Abs. 4 StGB. Ein besonderer Schwerpunkt liegt auf der Rechtswirklichkeit der Strafzumessung bei dem Delikt. Auf Grundlage einer multiperspektivischen Betrachtung der Erscheinungsformen des Phänomens und seiner rechtlichen Bewertung untersucht die Arbeit die Reform des Tatbestandes und die Praxis der tatgerichtlichen Strafzumessung bei dem Delikt. Insbesondere werden Unterschiede im Strafmaß, die nicht hinreichend durch Sachverhaltsunterschiede der zugrundeliegenden Fälle erklärt werden können, sowie Defizite in der Begründung der Strafzumessungsentscheidungen aufgezeigt. Diese Konsequenz kann jedoch akzeptiert werden. Denn aus dem nicht-reduktiven Physikalismus folgt keineswegs, dass es keine mentale Verursachung im Sinne von kausaler Abhängigkeit gibt.     Abstract: Bonaventure’s metaphysical thought and his interpretation of Aristotle Contemporary scholarship on Bonaventure has characterized him as the Neo-platonic foil to the Aristotelianism of his day. The present book, however, shows a Bonaventure who is highly enthusiastic about utilizing the philosophy of Aristotle and who centers much of his philosophical project around interpreting and understanding the texts of Aristotle. Two goals are central to this book. The first is to shed light on Bonaventure’s greatly understudied ontology and theory of forms, demonstrating how his philosophical system is an important and unique alternative to other medieval Aristotelian systems. The second is to establish, more broadly, how Bonaventure’s interpretation of Aristotle is a resource which should be mined for contemporary efforts in thinking about and reading Aristotle himself.     Abstract: Dieses Open-Access-Buch behandelt die Frage, wie und warum es dazu kommt, dass Menschen schwere islamistische Gewalttaten, etwa in Form terroristischer Anschläge oder gewaltsamer Hasskriminalität, in Westeuropa begehen wollen. Das im Rahmen des Buches entwickelte Erklärungsmodell nähert sich der Beantwortung dieser Frage in zwei Schritten: erstens wird erklärt, wie und warum Menschen überhaupt bereit werden, im Namen einer Ideologie zu töten. Die allermeisten Menschen, die sich hin zu einer solchen Gewaltbereitschaft radikalisieren, begehen allerdings keine Gewalttat. Daher wird zweitens dargelegt, unter welchen Bedingungen diese ideologiebasierte Gewaltbereitschaft in einer konkreten Gewalthandlung in Westeuropa gipfelt. Das entwickelte Erklärungsmodell wird im Anschluss empirisch überprüft. Der Fokus richtet sich dabei insbesondere auf die theoretisch formulierten Bedingungen der Tatbegehung. Diese Annahmen werden am Beispiel realisierter oder geplanter islamistischer Gewaltstraftaten in Westeuropa zwischen 2000-2013 getestet

Der rasche und komplexe Wertewandel wirft die Frage nach dem Verhältnis zwischen Bewahrung des Eigenen und Anpassung bzw. Weiterentwicklung der Normen und Werte an die lebensrealen Bedingungen und Kontexte auf. Im Prozess dieser Auseinandersetzung zwischen Tradition und Moderne rückt die Frage nach theologischer Normensetzung bzw. Wertevorstellungen in den Fokus des Interesses muslimischen Lebensvollzugs. This book develops a synoptic conception of the significance of recognition in its many forms for human persons by means of a rational reconstruction and internal critique of classical and contemporary accounts. The book begins with a clarification of several fundamental questions concerning recognition.     Abstract: The complexities of speech production, perception, and comprehension are enormous. Theoretical approaches of these complexities most recently face the challenge of accounting for findings on subphonemic differences. The aim of the present dissertation is to establish a robust foundation of findings on such subphonemic differences. One rather popular case for differences in subphonemic detail is word-final /s/ and /z/ in English (henceforth S) as it constitutes a number of morphological functions. Using word-final S, three general issues are investigated. First, are there subphonemic durational differences between different types of word-final S? If there are such differences, how can they be accounted for? Second, can such subphonemic durational differences be perceived? Third, do such subphonemic durational differences influence the comprehension of S? These questions are investigated by five highly controlled studies: a production task, an implementation of Linear Discriminative Learning, a same-different task, and two number-decision tasks. Using not only real words but also pseudowords as target items, potentially confounding effects of lexical storage are controlled for. Concerning the first issue, the results show that there are indeed durational differences between different types of word-final S. Non-morphemic S is longest in duration, clitic S is shortest in duration, and plural S duration is in-between non-morphemic S and clitic S durations. It appears that the durational differences are connected to a word’s semantic activation diversity and its phonological certainty. Regarding the second issue, subphonemic durational differences in word-final S can be perceived, with higher levels of perceptibility for differences of 35 ms and higher. In regard to the third issue, subphonemic durational differences are found not to influence the speed of comprehension, but show a significant effect on the process of comprehension. The overall results give raise to a revision of various extant models of speech production, perception, and comprehension

    Abstract: This open access book identifies various forms of heritage destruction and analyses their causes. It proposes strategies for avoiding and solving conflicts, based on integrating heritage into the 2030 Agenda for Sustainable Development. It reflects on the identity-building role of heritage, on multidimensional conflicts and the destruction of heritage, and considers conflict-solving strategies and future perspectives. Furthermore, it engages theoretically and practically with the concepts of responsibility, reconciliation and sustainability, relating mainly to four Sustainable Development Goals, i.e. SDGs 4 (education), 11 (e.g. World Heritage), 13 (climate action) and 17 (partnerships for the goals). More than 160 countries have inscribed properties on the UNESCO World Heritage list since the World Heritage Convention came into force. Improvements in the implementation of the Convention, such as the Global Strategy for a Representative, Balanced and Credible World Heritage List, have occurred, but other conflicts have not been solved. The book advocates for a balanced distribution of properties and more effective strategies to represent the global diversity of cultural and natural heritage.     Abstract: The text Miq?at Ma?a?e Ha-Torah, Some of the Works of the Torah (4QMMT), is one of the most interesting texts among the famous Dead Sea Scrolls discovered near the settlement of Khirbet Qumran and its vicinity in the middle of the twentieth century and by now published in full. It is a writing in the form of a letter by an unknown author to an equally unknown addressee, written in second person singular and plural. This document is the earliest evidence of a proper interpretation of the Jewish Torah, the so-called Halakhah, from pre-Christian, Hellenistic times as it later became customary and widely attested in rabbinical Judaism. This volume - after a short introduction on the findings at the Dead Sea in general and the text Miq?at Ma?a?e Ha-Torah in particular - provides a new edition and translation as well as several contributions from renowned scholars on the manuscripts, the language and content plus literary and historical contexts of this writing

Doris Reisinger stellt die These auf: Der Begriff des Originals ist nicht nur nicht obsolet, er hat auch nicht notwendig mit Neuheit, Urheberschaft oder ästhetischem Wert zu tun - das Problem des Originalbegriffs besteht schlicht darin, dass seine komplexe Struktur verkannt wird. Vor diesem Ausgangspunkt erarbeitet sie einen Explikationsvorschlag, der die Beantwortung einer ganzen Reihe von Fragen dieser klassischen philosophischen Debatte erlaubt
