    Abstract: “Can I choose to die?” As the number of requests for euthanasia and physician-assisted suicide continues to rise, human rights law faces a new conflict: the right to die vs. the right to life… The right to die or, in other words, ‘the right to choose the time and manner of one’s own death’ is a question of personal autonomy and its limits. This book provides a comprehensive understanding of the right to die and sheds light on its possible future under the European Convention on Human Rights. After setting a clear framework by defining the key terminology, the book takes a two-part approach to achieving its aim. The first part focuses on the right to die in practice by examining selected jurisdictions. Switzerland, which is famous for its assisted suicide organizations, and the Netherlands, which was the first country to legalize euthanasia, are examined in detail. Belgium, Germany, the United Kingdom, and -as an exception to the Convention perspective - Canada are also included. While this examination offers a better understanding of what the right to die looks like in practice, it also provides insights on the slippery slope argument, which serves as a counterweight to personal autonomy, without making a definitive statement on its validity. This part also illustrates the different paths that led or did not lead to the right to die in practice. The second part is an analysis of the European Court of Human Rights case law on the right to die. The Court has made important statements in only very cases, while its caution when approaching such a delicate and controversial topic among its 47 members is understandably emphasized. This analysis of the Court’s approach to the balancing of personal autonomy against other interests allows us to take a look back at the practice in more permissive jurisdictions through the lens of the Convention. Taken together, the book’s two parts provide valuable lessons for countries that decide to practice assisted dying, which are outlined in the conclusion. In addition, given that a purely legal approach can only offer a partial picture, the book argues that an interdisciplinary approach would be much more favorable in terms of providing the necessary basis for the right to die debate.

    Abstract: Kashmir as a Borderland: The Politics of Space and Belonging across the Line of Control examines the Kashmir dispute from both sides of the Line of Control (LoC) and within the theoretical frame of border studies. It draws on the experiences of those living in these territories such as divided families, traders, cultural and social activists. Kashmir is a borderland, that is, a context for spatial transformations, where the resulting interactions can be read as a process of ‘becoming’ rather than of ‘being’. The analysis of this borderland shows how the conflict is manifested in territory, in specific locations with a geopolitical meaning, evidencing the discrepancy between ‘representation’ and the ‘living’. The author puts forward the concept of belonging as a useful category for investigating more inclusive political spaces

    Abstract: "Should an employee be allowed to wear a religious symbol at work? Should a religious employer be allowed to impose constraints on employees' private lives for the sake of enforcing a religious work ethos? Should an employee or service provider be allowed, on religious grounds, to refuse to work with customers of the opposite sex or of a same-sex sexual orientation? This book explores how judges decide these issues and defends a democratic approach, which is conducive to a more democratic understanding of our vivre ensemble. The normative democratic approach proposed in this book is grounded on a sociological and historical analysis of two national stories of the relationships between law, religion, diversity and the State, the British (mainly English) and the French stories. The book then puts the democratic paradigm to the test, by looking at cases involving clashes between religious freedoms and competing rights in the workplace. Contrary to the current alternative between the "accommodationist view", which defers to religious requests, and the "analogous" view, which undermines the importance of religious freedom for pluralism, this book offers a third way. It fills a gap in the literature on the relationships between law and religious freedoms and provides guidelines for judges confronted with difficult cases"--

    Abstract: This book examines the Kashmir dispute from both sides of the Line of Control (LoC) and within the theoretical frame of border studies. It draws on the experiences of those living in these territories such as divided families, traders, cultural and social activists. Kashmir is a borderland, that is, a context for spatial transformations, where the resulting interactions can be read as a process of "becoming" rather than of "being". The analysis of this borderland shows how the conflict is manifested in territory, in specific locations with a geopolitical meaning, evidencing the discrepancy between "representation" and the "living". The author puts forward the concept of belonging as a useful category for investigating more inclusive political spaces.

    Abstract: Hardly known twenty years ago, exclusion from public space has today become a standard tool of state intervention. Every year, tens of thousands of homeless individuals, drug addicts, teenagers, protesters and others are banned from parts of public space. The rise of exclusion measures is characteristic of two broader developments that have profoundly transformed public space in recent years: the privatisation of public space, and its increased control in the 'security society'. Despite the fundamental problems it raises, exclusion from public space has received hardly any attention from legal scholars. This book addresses this gap and comprehensively explores the implications that this new form of intervention has for the constitutional essentials of liberal democracy: the rule of law, fundamental rights, and democracy. To do so, it analyses legal developments in three liberal democracies that have been at the forefront of promoting exclusion measures: the United Kingdom, the United States, and Switzerland.

    Abstract: This volume is an updated and expanded version of the authors original book, first published by Martinus Nijhoff Publishers and based on his cum laude doctoral dissertation. That volume discussed how the Five Principles of Peaceful Coexistence drowned in the first war between a communist and a non-aligned state. This new edition reproduces the original text, but supplements it considerably in light of subsequent developments and official records and reports only later released or leaked to the public. It places Sino-Indian relations in the wider, current context of the rise of China, the position of Tibet and the disorganised state of Asia. The border dispute did not prevent substantial economic relations developing between the two countries and visits taking place at the highest political level. But it still gives rise to almost daily incursions, and in the current climate, the risk of a clash is growing, as forces have been strengthened and most of the Line of Actual Control has not been demarcated. This thought-provoking volume sheds light on what is still a complex and uneasy relationship

    Abstract: Ever since the Second World War, a new constitutional model has emerged worldwide that gives a pivotal role to judges. Against the New Constitutionalism challenges this reigning paradigm and develops a distinctively liberal defence of political constitutionalism. The author concludes that, in consolidated democracies, strong constitutional review cannot be justified and argues for the primacy of the legislature primarily on epistemic - as opposed to procedural - grounds. The author also considers whether the minimalist judicial review of Nordic countries is more in line with the best justification of the institution than the Commonwealth model that occupies a central place in contemporary constitutional scholarship. This book will be of great interest to students and scholars of constitutional law. It will also be of use to constitutional and political theorists, as well as comparative and public lawyers, looking for a solution to the issues surrounding constitutional review.--Provided by publisher

    Abstract: The discourse on the human right to water presents deliberations on the concept, content and rationale for the right, with little attention to the practical question of translating the right into reality. This book aims to fill this void by focusing on ‘realization’ of the right by its holders, examining how effective the mechanisms are for ‘implementing’ the right in enabling its universal realization. In a quest to answer this question, the book draws a conceptual differentiation between ‘implementation’ and ‘realization’ of the right, arguing that unlike implementation - which is an objective process of creation - and implementation of measures such as legal frameworks, institutional structures or policy and action guidelines, realization of the right is a subjective process that extends much beyond. It takes shape within specific contextual settings which may include varied situations, yet remains neglected in the related academic and action forums. This book attempts to address this void by discussing some of the most significant contexts and the underlying problems and concerns that strongly influence realization of the human right to water. It contends that if the right is to be truly realized, these different contexts - which can be further classified as 'objective' and 'subjective' - must be understood, analysed and appropriately addressed before framing and implementing relevant action. The book further situates the human right to water discourse in a broader interdisciplinary perspective, expanding its scope beyond the narrower legal dimensions, linking it to the wider field of water resources management/governance. Through the novel ideas it proposes, the book makes an innovative and unique contribution in the field of human right to water which is of great scientific value

    Abstract: This book examines the two most populous nations on earth – India and China – in an effort to demystify the interaction between intellectual property rights (IPR) regimes, innovation and economic growth by critically looking at the economic and legal realities. In addition, it analyzes the question of how innovation can best be transformed into IPR, and how IPR can best be exploited to encourage innovation. Comparing and contrasting these two giant nations can be highly beneficial as China and India were the two fastest-growing economies in the last three decades, and together their populations make up one third of the world’s total population; as such, exploring how to sustain their growth via innovation and commercialization of IPR could have a tremendous positive impact on global well-being. While a study of these two mega countries with such diverse dimensions and magnitudes can never be truly comprehensive, this joint effort by scholars from law, business management and economics disciplines that pursues an empirical approach makes a valuable contribution. Divided into three parts, the first offers an in-depth doctrinal and empirical analysis. The second part exclusively focuses on India, while the last is dedicated to China.

In this ethnography of family courts and other crime and mediation settings in India, Srimati Basu reevaluates Indian feminist theories of marriage, gender violence, and the role of the state. Basu argues that alternative dispute resolutions, originally designed to empower women in a less adversarial legal environment, have created new subjectivities but have also reinforced oppressive socioeconomic norms that leave women no better off, individually or collectively.     Abstract: This book analyzes in detail differing interpretations of the rule of law in Western legal systems and in the People's Republic of China. As the rule of law is seen by many as a prerequisite for China's future development, politicians, activists and entrepreneurs from China and from the West alike have long been calling for adherence to this principle, which is constitutive of Western democracies. All these groups use the same words, but do they truly share the same idea?     Abstract: This Brief takes a provocative look at existing socio-legal literature with a comparative study of terrorism control orders, focusing on how the concept of pre-emption fits within a traditional criminological framework. This timely work examines how such measures might be conceived and interpreted within a situational crime prevention approach. Over the past decade, socio-legal scholars have identified a rise in pre-emptive control mechanisms to respond to terrorism and other threats in the post-9/11 world. Many have argued that this pre-emptive rationale has been used to justify the introduction of measures that transcend established legal and risk frameworks, to deal with individuals or groups thought to pose a threat to the state or its citizens.     Abstract: The more international law, taken as a global answer to global problems, intrudes into domestic legal systems, the more it takes on the role and function of domestic law. This raises a separation of powers question regarding law-making powers. In this book the author considers that specific issue.In contrast to other studies on domestic courts applying international law, the author’s constitutional orientation focusses on the presumptions concerning the distribution of state power. He collects and examines relevant decisions regarding treaties and customary international law from four leading legal systems, the US, the UK, France, and the Netherlands. Those decisions reveal that institutional and conceptual allegiances to constitutional structures render it difficult for courts to see their mandates and powers in terms other than exclusively national. What follows is a constitutional asymmetry between international law and national law generating an inevitable dualism which cannot necessarily be overcome by express constitutional provisions accommodating international law. The separation of powers thus frames the two principal horizons for any future, practicable attempts at integrating of the two legal orders. Either established concepts of constitutional law and constitutionalism will have to be revised, or what international law may do within a municipal legal system will have to be recalculated. This book offers new insight and new approaches in dealing with international law questions before domestic courts. It is an interesting work of reference and a basis for further debate on this topic among academics and practitioners in the fields of international and constitutional law.
