    Abstract: Mit dem Betreuungsrecht soll die Selbstbestimmung rechtlich betreuter Menschen gestärkt und deren Entmachtung auf das erforderliche Maß beschränkt werden. Inwieweit diese Zielsetzung realisierbar ist, wird hier anhand der Rollen von Macht und Pädagogik untersucht. Die an Michel Foucault angelehnte Machtanalyse ergibt ein hohes Machtpotenzial rechtlicher Betreuer, eine geringe staatliche Kontrolle sowie ein Risiko von unbewussten und bewussten Machtmissbrauch. Zudem wird die Notwendigkeit einer pädagogisch geprägten Professionalisierung der rechtlichen Betreuung diskutiert. Diese sollte darauf abzielen, dass Betreute aktiv dabei unterstützt werden, die teils weitreichenden Sachverhalte nach ihren Möglichkeiten zu erfassen und so ihren eigenen Willen bilden zu können. Dieser Handlungsbedarf erlangt vor dem Hintergrund des zu erwartenden starken Anstiegs der Betreuungszahlen besondere Relevanz.

    Abstract: In her groundbreaking investigation from the perspective of the aesthetics of religion, Isabel Laack explores the religion and art of writing of the pre-Hispanic Aztecs of Mexico. Inspired by postcolonial approaches, she reveals Eurocentric biases in academic representations of Aztec cosmovision, ontology, epistemology, ritual, aesthetics, and the writing system to provide a powerful interpretation of the Nahua sense of reality. Laack transcends the concept of “sacred scripture” traditionally employed in religions studies in order to reconstruct the Indigenous semiotic theory and to reveal how Aztec pictography can express complex aspects of embodied meaning.     Abstract: This book delves deep into the Social Construction of Theory, comparative epistemology and intellectual history to stress the interrelationship between diverse cultures during the colonial period and bring forth convincing evidence of how the 19th century was shaped. It approaches an interesting relation between the linguistic studies of 19th century's scientific world and subsequent widespread acceptance of the empirically weak theory of the Aryan invasion. To show entangled history in a globalized world, the book draws on the Aryan Invasion Theory to highlight how different socio-religious parties commonly shape a new theory.     Abstract: When Rape was Legal is the first book to solely focus on the widespread rape perpetrated against enslaved black women by white men in the United States. The routine practice of sexual violence against enslaved black women by white men, the motivations for this rape, and the legal context that enabled this violence are all explored and scrutinized. Enlightening analysis found that rape was not merely a result of sexual desire and opportunity, or simply a form of punishment and racial domination, but instead encompassed all of these dimensions as part of the identity of white masculinity. This provocative text highlights the significant role that white women played in enabling sexual violence against enslaved black women through a variety of responses and, at times, through their lack of response to the actions of the white men in their lives. Significantly, this book finds that sexual violence against enslaved black women was a widespread form of oppression used to perform white masculinity and reinforce an intersectional hierarchy. Additionally, white women played a vital role by enabling this sexual violence and perpetuating the subordination of themselves and those subordinate to them

    Abstract: Roberta Pergher transforms our understanding of Fascist rule. Examining Fascist Italy's efforts to control the antipodes of its realm - the regions annexed in northern Italy after the First World War, and Italy's North African colonies - she shows how the regime struggled to imagine and implement Italian sovereignty over alien territories and peoples. Contrary to the claims of existing scholarship, Fascist settlement policy in these regions was not designed to solve an overpopulation problem, but to bolster Italian claims to rule in an era that prized self-determination and no longer saw imperial claims as self-evident. Professor Pergher explores the character and impact of Fascist settlement policy and the degree to which ordinary Italians participated in and challenged the regime's efforts to Italianize contested territory.     Abstract: Just what is a right? Jakob Weissinger approaches this central problem of jurisprudence by critically examining the purpose of such normative concepts and carefully analysing the fundamental elements of normative practice like actions, decisions, the logic of norms and values as well as the plurality of normative practice. Interlinking the insights won, he outlines a stand-alone theory of rights which emphasises the empowering dimension of rights in the process of justifying (legal) rules. Not only does he question well-established theories, such as Hohfeld's famous analysis of legal conceptions, but aspires to set future debates in legal theory, especially those surrounding rights such as the long-standing dispute between interest and choice theories of rights, on new and more solid meta-theoretical ground.

    Abstract: This book deals with the question how communities across Europe during the later 3rd millennium BC adopt and transform the Bell Beaker phenomenon differently. By looking at these processes of change from the perspective of settlements and settlement material culture, an interpretation is given to the development of this phenomenon that is alternative to the currently prevailing migration models. Instead, the author uses social theories on the spread of innovations, the development and functioning of communication networks and the social technologies involved in the production of material culture in his arguments. For the first time, settlements from various regions of Europe are studied at the same level and compared using modern research methods such as aoristic frequency distributions, the Bayesian modelling of radiocarbon dates and network analyses. Temporal and spatial variability in the regional processes that lead to the adoption (and rejection!) of Bell Beaker innovations are described in detail. The regional variability in communication between settlements, and the exchange of ideas and objects and mobility of people are combined with sociological network theories on the spread and adoption of novel ideas. Regional differences in the production of pottery are reviewed by both quantitative and qualitative methods. Finally, a Bell Beaker network is described in which various processes of innovation adoption and subsequent re-invention, developing communication networks and different forms of mobility take part

    Abstract: Durch die Analyse der Beziehungen zwischen NGOs, dem UN-Sicherheitsrat und den Menschenrechten wird in diesem Buch argumentiert, dass sowohl NGOs als auch der UN-Sicherheitsrat die Menschenrechtssemantik selektiv in Bezug auf die Orte und Akteure, die sie betreffen, anwenden. Es beobachtet Wissen und Macht als Kräfte, die sich gegenseitig beeinflussen, was eine Erklärung dafür sein kann, wie Global Governance funktioniert. Darüber hinaus untersucht das Buch die Idee, dass Recht, abgesehen von der Durchdringung traditioneller Strukturen, von der Basis der Gesellschaft in Richtung institutioneller Bereiche aufsteigen kann. In diesem Zusammenhang schlägt der Autor vor, dass das Zusammenspiel zwischen nichtstaatlichen Akteuren und politischen Institutionen die Bottom-up-Prozesse im Zusammenhang mit der Gesetzgebung und der Gestaltung politischer Entscheidungen fördert. In Anbetracht der kritischen Probleme, die sowohl die NRO als auch der UN-Sicherheitsrat in Bezug auf Repräsentation und Reaktionsfähigkeit haben, stellt die Arbeit fest, dass die Beziehung zwischen ihnen auf eine ausschließende, technokratische und arkane Weise stattfindet.

    Abstract: In 1936, Nazi Germany and militarist Japan built a partnership which culminated in the Tokyo-Berlin Axis. This study of interwar German-Japanese relations is the first to employ sources in both languages. Transnational Nazism was an ideological and cultural outlook that attracted non-Germans to become adherents of Hitler and National Socialism, and convinced German Nazis to identify with certain non-Aryans. Because of the distance between Germany and Japan, mass media was instrumental in shaping mutual perceptions and spreading transnational Nazism. This work surveys the two national media to examine the impact of transnational Nazism. When Hitler and the Nazi movement gained prominence, Japanese newspapers, lectures and pamphlets, nonfiction, and language textbooks transformed to promote the man and his party. Meanwhile, the ascendancy of Hitler and his regime created a niche for Japan in the Nazi worldview and Nazified newspapers, films, nonfiction, and voluntary associations.

    Abstract: The apartheid era in South Africa lasted more than 40 years. It was marked by political repression and the attempt to create a homogeneous “white South Africa”, which meant excluding the non-white majority population. The establishment and maintenance of white supremacy in South Africa by colonialism and, since 1948, grand apartheid was not only the result of racist regulations and laws, but also followed a "scientific" logic to justify the resettlement and expulsion of South African blacks.The history of South Africa from 1948 to 1994 can also be seen as the history of a major society-spanning project; an attempt to build a “modern” state on the basis of racial segregation.This work investigates the factors that make it possible to stabilize a policy based on virtually impossible prerequisites over four decades: Ethnic categorization, territorial planning and "environmental protection measures".

    Abstract: "Based on the comprehensive study of the epigraphic and literary evidence, this book challenges the almost universally-held assumptions of modern scholarship on the date of origin, the function, and the purpose of the Athenian ephebeia. It offers a detailed reconstruction of the institution, which in the fourth century BCE was a state-organized and -funded system of mandatory national service for ephebes, citizens in their nineteenth and twentieth years, consisting of garrison duty, military training, and civic education. It concludes that the contribution of the ephebeia was vital for the security of Attica and that the ephebes' non-military activities were moulded by social, economic, and religious influences which reflect the preoccupations of Lycurgus' administration in the 330s and 320s BCE." -- Publisher's description

    Abstract: The nomads of Central Asia were already well accustomed to life under the power of a distant capital when the Bolsheviks fomented revolution on the streets of Petrograd. Yet after the fall of the Tsar, the nature, ambition and potency of that power would change dramatically, ultimately resulting in the near eradication of Central Asian nomadism. Based on extensive primary source work in Almaty, Bishkek and Moscow, Nomads and Soviet Rule charts the development of this volatile and brutal relationship and challenges the often repeated view that events followed a linear path of gradually escalating violence. Rather than the sedentarisation campaign being an inevitability born of deep-rooted Marxist hatred of the nomadic lifestyle, Thomas demonstrates the Soviet state's treatment of nomads to be far more complex and pragmatic. He shows how Soviet policy was informed by both an anti-colonial spirit and an imperialist impulse, by nationalism as well as communism, and above all by a lethal self-confidence in the Communist Party's ability to transform the lives of nomads and harness the agricultural potential of their landscape. This is the first book to look closely at the period between the revolution and the collectivisation drive, and offers fresh insight into a little-known aspect of early Soviet history. In doing so, the book offers a path to refining conceptions of the broader history and dynamics of the Soviet project in this key period

    Abstract: This book argues that the «international community» created and managed the dysfunctional state of Bosnia and Herzegovina by effectively rewarding ethnic cleansing, drawing up a transitional constitution which, in turn, generated a complex ethnifying polity incapable of independent reform. This constitution, which was only added as an annex to the Dayton Peace Agreement, has continued to encourage ethnification, understood in this book as the reproduction of imagined communities of descent. While accepting that foreign interference was necessary to end the war in the late 1990s, the book offers a critical review of the actions of the Office of the High Representative of the International Community (OHR) and other foreign actors since that period. It includes meticulous examination of hundreds of OHR decisions, as well as secret diplomatic cables published by Wikileaks revealing how the US embassy intervened in the country's trade and foreign policy. Drawing on a process-sociological perspective, the book interrogates the notion of ethnicity and offers a radical new perspective on post-war state-building in Bosnia and Herzegovina.

    Abstract: Amicus curiae participation in international courts is steadily growing since the late 1990 despite lack of clarity on the concept's nature, function and utility in international dispute settlement. Does amicus curiae infuse international judicial proceedings with alternative views, including the public interest in a case, as often advocated by NGOs? Does it increase the legitimacy and transparency of international dispute settlement, or the coherence of international law? Or is it an unhelpful impostor that impedes negotiated solutions and derails the proceedings at the expense of the parties to advance its own agenda? By way of an empirical-comparative analysis of the laws and practices of the ICJ, the ITLOS, the ECtHR, the IACtHR, the IACtHPR, WTO panels and the Appellate Body, and investment arbitration the dissertation examines the status quo of amicus curiae before international courts and tribunals to determine if the current amicus curiae practice is of added value to international proceedings and international dispute settlement in general. The dissertation shows that there is no common concept of international amicus curiae, but that amicus curiae before the international courts examined share a few characteristics. A proposed functional systematization highlights overlaps and diverging uses of the concept before international courts and helps scholars and practitioners to assess the opportunities and limits of the concept. Analysis of the concept's current regulatory framework and its substantive effectiveness reveals a hesitation in particular by courts with a strong adversarial tradition to take into account the views of a non-party despite the positive experience with the concept in regional human rights courts. The dissertation concludes that neither the expectations nor the concerns attached to amicus curiae participation in international proceedings have materialized. It argues that the concept can contribute to improved decisions and decision-making in international dispute settlement if regulated and used properly

    Abstract: "Children make up half of the world's refugees and over 40 per cent of the world's asylum seekers. Yet, children are largely invisible in historical and contemporary refugee law. Furthermore, there has been very limited interaction between the burgeoning children's rights framework, in particular the Convention on the Rights of the Child (CRC), and the 1951 Convention relating to the Status of Refugees (Refugee Convention). This book explores the possibility of a children's rights approach to the interpretation of the Refugee Convention and within that what such an approach might look like. In order to construct a children's rights approach, the conceptualisations of children outside the legal discipline, within international children's rights law and then within refugee law and refugee discourse are analysed. The approach taken is socio-legal and comparative in nature and the suitability of the Refugee Convention as a framework for the interpretation of child claims is examined. The book analyses to what extent the Refugee Convention is capable of dealing with claims from children based on the modern conceptualisation of children which is underscored by two competing ideologies - the child as a vulnerable object in law to be protected and the child as subject with rights and the capacity to exercise their agency. The influence each regime has had on the other is also analysed. The work discusses how a children's rights approach might improve outcomes for child applicants. The book makes an original contribution to child refugee discourse and as such will be an invaluable resource for academics, researchers and policy-makers working in the areas of migration and asylum law, children's rights, and international human rights law' --

    Abstract: During the transition from Republic to Empire, the Roman aristocracy adapted traditional values to accommodate the advent of monarchy. Freed Slaves and Roman Imperial Culture examines the ways in which members of the elite appropriated strategies from freed slaves to negotiate their relationship to the princeps and to redefine measures of individual progress. Primarily through the medium of inscribed burial monuments, Roman freedmen entered a broader conversation about power, honor, virtue, memory, and the nature of the human life course. Through this process, former slaves exerted a profound influence on the transformation of aristocratic values at a critical moment in Roman history
