Abstract: During the westward expansion of America, white middle-class ideals of home and domestic work were used to measure differences between white and Native American women. Yet the vision of America as "home" was more than a metaphor for women's stake in the process of conquest--it took deliberate work to create and uphold. Treating white and indigenous women's struggles as part of the same history, Jane E. Simonsen argues that as both cultural workers and domestic laborers insisted upon the value of their work to "civilization," they exposed the inequalities integral to both the nation and the household.Simonsen illuminates discussions about the value of women's work through analysis of texts and images created by writers, women's rights activists, reformers, anthropologists, photographers, field matrons, and Native American women. She argues that women such as Caroline Soule, Alice Fletcher, E. Jane Gay, Anna Dawson Wilde, and Angel DeCora called upon the rhetoric of sentimental domesticity, ethnographic science, public display, and indigenous knowledge as they sought to make the gendered and racial order of the nation visible through homes and the work performed in them. Focusing on the range of materials through which domesticity was produced in the West, Simonsen integrates new voices into the study of domesticity's imperial manifestations.

Abstract: "An outstanding contribution to our understanding of postcolonial theory and its engagement with significant changes within the contemporary world. Couze Venn forces us to rethink the very parameters of the post-colonial and suggests a new political economy for post-modern times. This critical engagement opens up the possibility to reimagine the world from its current narrow European strictures to a world full of alternative possibilities and modernities... This is a timely and ground breaking book that contributes to a much needed reconceptualisation of the postcolony".  - Professor Pal Ahluwalia, Goldsmiths, University of London What is postcolonial studies? What are its achievements, strengths and weaknesses? This ground breaking book offers an essential guide to one of the most important issues of our time, with special emphasis on neo-liberalism within world poverty and the 'third world'. It clarifies: The territory of postcolonial studies How identity and postcolonialism relate The ties between postcolonialism and modernity New perspectives in the light of recent geo-political events Potential future developments in the subject.

Abstract: Experiences of migration and dwelling-in-displacement impinge upon the lives of an ever increasing number of people worldwide, with business class comfort but more often with unrelenting violence. Since the early 1990s, the political and cultural realities of global migration have led to a growing interest in the different forms of "diasporic" existence and identities. The articles in this book do not focus on the external boundaries of diaspora - what is diasporic and what is not? - but on one of its most important internal boundaries, which is indicated by the second term in the title of this book: memory. It is not by chance that the right to remember, the responsibility to recall, are central issues of the debates in diasporic communities and their relation to their cultural and political surroundings. The relation of diaspora and memory contains important critical and maybe even subversive potentials. Memory can transcend the territorial logic of dispersal and return, and emerge as a competing source of diasporic identity. The articles in this volume explore how, shaped by the responsibilities of testimony as well as by the normalizing forces of amnesia and forgetting and political interests, memory is a performative, figurative process rather than a secure space of identity.

Abstract: Winner of the 2006 Thomas J. Lyon Book Award in Western American Literary Studies, presented by the Western Literature Association In The Emergence of Mexican America, John-Michael Rivera examines the cultural, political, and legal representations of Mexican Americans and the development of US capitalism and nationhood. Beginning with the Mexican-American War of 1846-1848 and continuing through the period of mass repatriation of US Mexican laborers in 1939, Rivera examines both Mexican-American and Anglo-American cultural production in order to tease out the complexities of the so-called "Mexican question." Using historical and archival materials, Rivera's wide-ranging objects of inquiry include fiction, non-fiction, essays, treaties, legal materials, political speeches, magazines, articles, cartoons, and advertisements created by both Mexicans and Anglo Americans. Engaging and methodologically venturesome, Rivera's study is a crucial contribution to Chicano/Latino Studies and fields of cultural studies, history, government, anthropology, and literary studies.

Beginning with the observation that talk is central to all genres of radio and television, Ian Hutchby examines the forms of speech used by broadcasters as their primary means of communicating with audiences. He looks at a range of media forms and genres, including televised audience debates, confrontational TV talk shows such as "Oprah Winfrey" and "Ricki Lake", open-line talk radio shows, advice-giving broadcasts, news interviews and political panel discussions. Hutchby argues that the study of talk provides insights into the very nature of mass communication, and invites the reader into further consideration of a range of important issues, such as the relationship between broadcasters and audiences, and the public role of media output. The book not only describes the role of media talk but also provides detailed examples of analytical tools. It is key reading for students on courses in language and the media, media discourse, communication and cultural studies

Abstract: With a Foreword by Vijay Prashad and an Afterword by Gary Okihiro How might we understand yellowface performances by African Americans in 1930s swing adaptations of Gilbert and Sullivan's The Mikado, Paul Robeson's support of Asian and Asian American struggles, or the absorption of hip hop by Asian American youth culture? AfroAsian Encounters is the first anthology to look at the mutual influence of and relationships between members of the African and Asian diasporas. While these two groups have often been thought of as occupying incommensurate, if not opposing, cultural and political positions, scholars from history, literature, media, and the visual arts here trace their interconnections and interactions, as well as the tensions between the two groups that sometimes arise. AfroAsian Encounters probes beyond popular culture to trace the historical lineage of these coalitions from the late nineteenth century to the present. A foreword by Vijay Prashad sets the volume in the context of the Bandung conference half a century ago, and an afterword by Gary Okihiro charts the contours of a "Black Pacific." From the history of Japanese jazz composers to the current popularity of black/Asian "buddy films" like Rush Hour, AfroAsian Encounters is a groundbreaking intervention into studies of race and ethnicity and a crucial look at the shifting meaning of race in the twenty-first century.

Yet state racism appears to be here to stay and, in

Abstract: The legal protection of the underwater cultural heritage is a field in which there is growing international interest. Shipwrecks and other underwater cultural remains in every maritime zone are threatened both by activities 'directed at' them, such as treasure hunting, and by activities 'incidentally affecting' them, such as mineral exploration and exploitation, pipeline and cable-laying, dredging, and fishing. Since the first edition of this collection (published in 1999), the urgent need for an international legal framework to regulate these activities has been formally recognised by the ado

This volume features essays which provide an account of the legal position in each jurisdiction, as well as considering the impact that the 2001 Convention is having

Abstract: The United Nations Security Council is meant to be the central international organ for maintaining international peace and security, and it has a profound impact on the rights and duties of states under international law. However, it has been severely criticized throughout its existence. This book examines the role of international law in its decisions and decision-making process since the end of the Cold War, with the principle of legality as theoretical framework. It explores the limits that international law places on the Security Council, i.e. what it is allowed to demand of and impose on

Abstract: The general international law regarding foreign merchant ships in internal waters has never been codified. The question of the breadth of the territorial sea was finally solved during the Third United Nations Conference on the Law of the Sea. But conflicts between coastal States and foreign merchant ships in internal waters and the territorial sea may arise. This comprehensive study analyses these issues and strives for reasonable and generally acceptable solutions.
Abstract: The general international law regarding foreign merchant ships in internal waters has never been codified. Despite the codification efforts made by the League of Nations and the Geneva Convention on the Territorial Sea and the Contiguous Zone of 1958, the question of the breadth of the territorial sea was finally solved during the Third United Nations Conference on the Law of the Sea. In addition, the right of innocent passage of foreign ships has been regulated in the 1982 Convention in greater detail than ever before, whilst the new regime on the prevention of marine pollution in the Convention has also considerable impact on this right. In practice, potential conflicts between coastal States and foreign merchant ships in internal waters and the territorial sea may well arise. This comprehensive study analyses these issues and cautiously strives for reasonable and generally acceptable solutions.

Abstract: This paper analyses institutional reforms and political participation, most notably indirect and direct elections of residential committees (RC), in China's urban neighbourhoods and communities (shequ). It shows that these elections at present are not meaningful to the majority of city dwellers as the RCs have little decision-making power and no revenues generated by a collective economy as in most of China's villages. RCs are primarily important to those weaker strata of society who depend on the state to be provided with social services and financial support - tasks that the RCs are forced to assume on behalf of higher government authorities. Nevertheless, the author finds that as limited the significance of - and knowledge about - RC elections in the daily lives of China's urban dwellers still are, they still have some influence on political awareness and participation. For instance, they make people voice more opinions in their shequ, which may be a good starting point for more direct interference in local political affairs soon to come. The paper emphasizes that RC elections have been introduced in order to enhance regime legitimacy but suggests that they may spur democratization by the rise of accountability as a conditioning factor of this legitimacy and by electoral 'habituation' as a transition to full democratic commitment. Whilst 'security first, participation second' seems to be the order of the day and the 'freedom of politics' is still more important than a concern for RC elections and shequ affairs, it remains to be seen if those elections may not soon trigger off a meaningful drive for political participation in China's cities.

Abstract: Popular culture is invariably a vehicle for the dominant ideas of its age. Never was this more true than in the late-19th and early 20th centuries, when it reflected the nationalist and imperialist ideologies current throughout Europe. This text examines the various media through which nationalist ideas were conveyed in late-Victorian and Edwardian times - in the theatre, "ethnic" shows, juvenile literature, education and the iconography of popular art. Several chapters look beyond World War I, when the most popular media, cinema and broadcasting, continued to convey an essentially late-19th-century world view, while government agencies like the Empire Marketing Board sought to convince the public of the economic value of empire. Youth organizations, which had propagated imperialist and militarist attitudes before the war, struggled to adapt to the new internationalist climate

Note: Includes bibliographical references and index , "A Companion to American Immigration" is an authoritative collection of original essays by leading scholars on the major topics and themes underlying American immigration history. The book focuses on the two most important periods in American history when immigration had its greatest impact on American society: the Industrial Revolution and the Globalizing Era from the post-World War II decades to the present. It explores immigration from a global and interdisciplinary perspective to show the variety of methods that scholars have recently used to supply new insights. The volume's structure and approach provide in-depth treatment of central themes, including economic conditions, public policies, demography, social structure, group identity, communal institutions, and cultural life. The book also places a key question in the foreground of the book: how immigrants of the industrializing era and the globalizing era can be studied with respect to a host of collective and common experiences that bridge historical periods. The comparative dimension is a defining feature of this volume, capturing the essence of America, and its rich history of immigration

Abstract: "Demonstrating the centrality of gender relations, law, and Siam's Malay Muslims to the history of modern Thailand, Subject Siam examines the structures and social history of jurisprudence to gain insight into Siam's unique position within Southeast Asian history. Tamara Loos elaborates on the processes of modernity through an in-depth study of hundreds of court cases involving polygyny, marriage, divorce, rape, and inheritance adjudicated between the 1850s and 1930s. Most important, this study of Siam offers a novel approach to the question of modernity precisely because Siam was not colonized yet was subject to transnational discourses and symbols of modernity."--Jacket

Abstract: The popularity of his monumental and definitive works have established Shabtai Rosenne as the undisputed expert on the International Court of Justice’s law and practice. His broad exchange of correspondence and extensive conversations with members of the Court and its Registrars, as well as with other friends who know the Court and its practices well, and his experience in the Court and in the UN, especially the General Assembly and the Security Council, led him to undertake this major reconstruction of this work in the previous edition. Now divided into several substantive volumes, the work addresses: • The Court as one of the principal organs, and as the principal judicial organ of the United Nations. Diplomats and legal advisers who have to deal with matters relating to the Court on a political level, in different organs of the United Nations and in other offices will appreciate the full discussion of the diplomatic, political, and administrative aspects of the Court’s affairs. • Jurisdiction and the treatment of jurisdictional matters by the Court. This volume also includes the Court’s advisory jurisdiction; the advisory work has related to very difficult legal issues in matters of major political import. • The Court’s procedure. All of these arenas have undergone significant recent changes. The work’s practical features include the English text of the Charter of the United Nations, the Statute of the Court, the Practice Directions, and the 1978 Rules of the Court, together with a full set of indexes. The Fourth Edition (updated until 31 December 2005) of The Law and Practice of the International Court is an essential component of all international law libraries and an indispensable work for those practicing in the field, all of whom will appreciate access to the most recent work on the Court from this expert author

Abstract: This work makes clear what it means that the precautionary principle represents customary international law. Through the analysis of state practice regarding this principle of international environmental law, it answers crucial questions concerning the conditions triggering a right or duty to take precautionary action; the nature and content of such action; the issue areas to which the principle applies; the allocation of the burden of proof; and the role of socio-economic factors. Ultimately, it details what it takes to act in conformity with the precautionary principle under general internat
Abstract: Concluding that the precautionary principle embodies customary international law is one thing. Determining what this means is quite another. That challenge is met by this work, which resolves a number of crucial questions concerning the scope of this principle of international environmental law - the conditions triggering a right or duty to take precautionary action; the measures to be taken; the allocation of the burden of proof; and the role of socio-economic factors. These questions are dealt with one at a time through the charting and analysis of patterns and common denominators in the ext
