    Abstract: Increasingly, international governmental networks and organisations make it necessary to master the legal principles of other jurisdictions. Since the advent of international criminal tribunals this need has fully reached criminal law. A large part of their work is based on comparative research. The legal systems which contribute most to this systemic discussion are common law and civil law, sometimes called continental law. So far this dialogue appears to have been dominated by the former. While there are many reasons for this, one stands out very clearly: Language. English has become the lingua franca of international legal research. The present book addresses this issue.     Abstract: The book was first published in 1997, and was awarded the first prize of scientific research by the Ministry of Justice during the ninth Five-Year Plan of China. In 2005, it was adopted the text book for the postgraduates of law majors. In 2009, it was awarded the second prize of the best books on law in China. The book discusses from different aspects the long legal tradition in China, and it not only helps us to have a further understanding of Chinese legal system but also combines theories and practice and illustrate the modern legal transition which probes the history of Chinese legal system. As is known to us all, China is a country with a long legal history, which can be traced back to more than three thousand year ago. So the legal tradition of China has been passed down from generation to generation without any interruptions. This feature is peculiar to Chinese legal history which is beyond all comparison with that of other countries such as ancient Egypt, ancient India, ancient Babylon and ancient Persia. Through the study of Chinese legal history we can have a deeper understanding of the histories, features, origins and the transition of Chinese legal tradition. The Chinese legal tradition originated from China, and it is the embodiment of the wisdom and creativity of Chinese civilization. The great many books, researching materials, legal constitutions, archives, files and records of different dynasties in China have provided us with rare, complete and systematic materials to research. The book has a complete, systematic and detailed research on Chinese legal tradition and its transition and it gives people a correct recognition of the process of the perfection of laws during its development and its position as well as its value in the social progress in order to grasp its regular patterns. It also has showed us the most valuable part and core of Chinese legal Tradition and it is a summary of Chinese legal tradition and its transition from different perspectives, different angles and different levels.     Abstract: Die Teilhabe am Herrschaftsprozess ist für demokratische Gesellschaften von zentraler Bedeutung. Staat und Gesellschaft müssen miteinander verknüpft sein, sonst gerät die Legitimation politischer Entscheidungen in Gefahr. Die politische Teilhabe – etwa in Wahlen und Parteien – ist in Deutschland aber eng an die Staatsbürgerschaft geknüpft. Ausländer im rechtlichen Sinne dürfen nicht an allen politischen Entscheidungen mitwirken. Unter den Bedingungen einer fortschreitenden europäischen Integration und einer empirisch evidenten Zuwanderungsgesellschaft stellt sich daher die Frage, wie es um die Legitimation politischer Entscheidungen und um die politisch-demokratische Repräsentation derjenigen bestellt ist, die zwar in Deutschland wohnen, aber de jure nur eingeschränkte Teilhaberechte haben.     Abstract: This is a study of law, wrongdoing and justice as conceived in the minds of the ordinary people of England and Wales from the later eighteenth century to the First World War. Official justice was to become increasingly centralised with declining traditional courts, emerging professional policing and a new prison estate. However, popular concepts of what was, or should be, contained within the law were often at variance with its formal written content. Communities continued to hold mock courts, stage shaming processions and burn effigies of wrongdoers. The author investigates those justice rituals, the actors, the victims and the offences that occasioned them. He also considers the role such practices played in resistive communities trying to preserve their identity and assert their independence. Finally, whilst documenting the decline of popular justice traditions this book demonstrates that they were nevertheless important in bequeathing a powerful set of symbols and practices to the nascent labour movement. This book will be of interest to scholars and students of legal history and criminal justice as well as social and cultural history in what could be considered a very long nineteenth century.     Abstract: "This volume analyses the social and political forces that influence constitutions and the process of constitution making. It combines theoretical perspectives on the social and political foundations of constitutions with a range of detailed case studies of constitution making in nineteen different countries.     Abstract: Pacifism is popular. Many hold that war is unnecessary, since peaceful means of resolving conflict are always available, if only we had the will to look for them. Or they believe that war is wicked, essentially involving hatred of the enemy and carelessness of human life. Or they posit the absolute right of innocent individuals not to be deliberately killed, making it impossible to justify war in practice. Peace, however, is not simple. Peace for some can leave others at peace to perpetrate mass atrocity. What was peace for the West in 1994 was not peace for the Tutsis of Rwanda. Therefore, against the virus of wishful thinking, anti-military caricature, and the domination of moral deliberation by rights-talk In Defence of War asserts that belligerency can be morally justified, even though tragic and morally flawed. Recovering the Christian tradition of reflection running from Augustine to Grotius, this book affirms aggressive war in punishment of grave injustice. Morally realistic in adhering to universal moral principles, it recognises that morality can trump legality, justifying military intervention even in transgression of positive international law-as in the case of Kosovo. Less cynical and more empirically realistic about human nature than Hobbes, it holds that nations desire to be morally virtuous and right, and not only to be safe and fat. And aspiring to practical realism, it argues that love and the doctrine of double effect can survive combat; and that the constraints of proportionality, while real, are nevertheless sufficiently permissive to encompass Britain`s belligerency in 1914-18. Finally, in a painstaking analysis of the Iraq invasion of 2003, In Defence of War culminates in an account of how the various criteria of just war should be thought together. It also concludes that, all things considered, the invasion was justified.

    Abstract: The concept of toleration plays a central role in pluralistic societies. It designates a stance which permits conflicts over beliefs and practices to persist while at the same time defusing them, because it is based on reasons for coexistence in conflict - that is, in continuing dissension. A critical examination of the concept makes clear, however, that its content and evaluation are profoundly contested matters and thus that the concept itself stands in conflict. For some, toleration was and is an expression of mutual respect in spite of far-reaching differences, for others, a condescending, potentially repressive attitude and practice. Rainer Forst analyses these conflicts by reconstructing the philosophical and political discourse of toleration since antiquity. He demonstrates the diversity of the justifications and practices of toleration from the Stoics and early Christians to the present day and develops a systematic theory which he tests in discussions of contemporary conflicts over toleration.

    Abstract: Der moderne Rechtsstaat beansprucht, seine Burger unterschiedslos als freie und gleiche Personen zu behandeln. Aufgrund dieses allgemeinen Anspruchs sind von der Legitimation staatlicher Normen partikulare ethische Konzeptionen ebenso ausgeschlossen wie Willkur und Privilegium. Eine besondere Frage entsteht aber im Verhaltnis zu den grossen Religionen, die einerseits selbst mit universalen Geltungsanspruchen auftreten, andererseits als Offenbarungsreligionen durch ihre Geschichtlichkeit aber auch partikular sind. Die aus dem Anspruch der Rechtsstaatlichkeit folgende Forderung nach weltanschaulich neutraler sakularer Normgebung fuhrt auf eine fur die neuzeitliche Philosophie, besonders fur die Rechtsphilosophie, zentrale Frage: Lassen sich grundlegende, allen gemeinsame Eigenschaften der Menschen (z.B. die Vernunft) ohne Rekurs auf besondere kulturelle Erfahrungen normativ wenden? Daran schliesst sich die Frage an, wie die so gewonnenen Normen sich zu den je partikular uberlieferten verhalten. Damit ist das Verhaltnis von Politik und Religion vor dem Hintergrund moderner Rechtsstaatlichkeit angesprochen, aus dem sich eine Reihe von philosophisch-historischen sowie von rechtssystematischen Problemen ergeben. Diese Probleme werden in diesem Buch von Philosophen und Rechtswissenschaftlern eingehend erortert und diskutiert. Dabei wird, ausgehend von der je eigenen Fachperspektive, eine interdisziplinare Diskussion eroffnet. Das Leitthema der Beitrage bildet dabei das Verhaltnis von naturrechtlichen, kulturellen und positivrechtlichen Elementen in der Legitimation staatlicher Normsetzung einerseits und in der Begrundung subjektiver Rechte, insbesondere der Menschenrecht.

    Abstract: The key question for the history of universal human rights is why it took so long for them to become established as law. The main theme of this book is that the attainment of universal human rights required heroic struggle, first by individuals and then by ever-increasing numbers of people who supported those views against the major historical trends. Universal human rights are won from a hostile majority by outsiders. The chapters in the book describe the milestones in that struggle. The history presented in this book shows that, in most places at most times, even today, for concrete material reasons a great many people oppose the notion that all individuals have equal rights. The dominant history since the 1600s has been that of a mass struggle for the national-democratic state. This book argues that this struggle for national rights has been practically and logically contradictory with the struggle for universal rights. It would only be otherwise if there were free migration and access to citizenship on demand by anybody. This has never been the case.
