    Abstract: This is the first extensive treatment of leading judicial institutions under Nazi rule in WWII. It focusses on all democratic countries under German occupation, and provides the details for answering questions like: how can law serve as an instrument of defence against an oppressive regime? Are the courts always the guardians of democracy and rule of law? What role was there for international law? How did the courts deal with dismissals, new appointees, new courts, forced German ordinances versus national law? How did judges justify their actions, help citizens, appease the enemy, protest against injustice? Experts from all democracies that were occupied by the Nazis paint vivid pictures of oppression, collaboration, and resistance. The results are interpreted in a socio-legal framework introducing the concept of 'moral hygiene' to explain the clash between normative and descriptive approaches in public opinion and scholarship concerning officials' behaviour in war-time

    Abstract: "This book explores the recent trend toward the transformation of religious symbols and practices into culture in Western democracies. Analyses of three legal cases involving religion in the public sphere are used to illuminate this trend: a municipal council chamber; a town hall; and town board meetings. Each case involves a different national context-Canada, France, and the United States-and each illustrates something interesting about the shape-shifting nature of religion, specifically its flexibility and dexterity in the face of the secular, the religious, and the plural. Despite the differences in national contexts, in each instance religion is transformed into culture or heritage by the courts to justify or excuse its presence and to distance the state from the possibility that it is violating legal norms of distance from religion. The cultural practice or symbol is represented as a shared national value or activity. Transforming the 'Other' into 'Us' through reconstitution is also possible. Finally, anxiety about the 'Other' becomes part of the story of rendering religion as culture, resulting in the impugning of anyone who dares to question the putative shared culture"--

    Abstract: The concept of madness as a challenge to communities lies at the core of legal sources. This book considers how communal networks, ranging from the locale to the realm, responded to people who were considered mad. The madness of individuals played a role in engaging communities with legal mechanisms and proto-national identity constructs, as petitioners sought the king's mercy as an alternative to local justice. The resulting narratives about the mentally ill in late medieval France constructed madness as an inability to live according to communal rules. Although such texts defined madness through acts that threatened social bonds, those ties were reaffirmed through the medium of the remission letter. The composers of the letters presented madness as a communal concern, situating the mad within the household, where care could be provided. These mad were usually not expelled but integrated, often through pilgrimage, surveillance, or chains, into their kin and communal relationships

    Abstract: "Many people want to understand what revolutions are and--especially--how they come about, from the academics who study them to the states that wish to prevent (or, in some cases, provoke) them. But it is arguably the US scholar Theda Skocpol who has done most to create a viable model of revolution, and States and Social Revolutions is the work in which she sets out her intellectual stall. Skocpol's magnum opus can be considered a classic product of the critical thinking skill of problem-solving. She assesses several different revolutions--those of France, Russia and China--and asks new, productive questions about their causes and outcomes. The answers, collectively, allow her to move beyond existing theories such as the 'voluntaris©t'; school (which suggests that revolutionaries have agency) and the Marxist school (which sees state institutions as nothing more than a front for class interests). Skocpol's model assumes that states are autonomous bureaucratic institutions, which act in their own interests--a fundamental re-imagining based on fresh interpretations of the evidence. Her analysis extends beyond the causes of revolution to their consequences, and her argument that the revolutionary state that survives is the one that successfully implements a far-reaching program of reform helps to explain not only why the three revolutions she studied have proved enduringly influential, but also why hundreds of others, less successful, are barely remembered today."--Provided by publisher

    Abstract: Following the decolonization movements that swept the globe after World War II, between four and six million people were 'returned' to Europe from the colonies. From an exporter of people, Europe turned to a site of immigration for the first time in the twentieth century. Until now, these migrations have been overlooked as scholars have highlighted instead the parallel migrations of former 'colonized' peoples. Europe's Invisible Migrants corrects this bias. This multidisciplinary volume presents essays by prominent sociologists, historians, and anthropologists on their research with these 'invisible' migrant communities. Their work highlights the experiences of colonists returning to France, Portugal and the Netherlands, the intersection of race, citizenship, and colonial ideologies, and the ways these migrations reflect the return of the 'colonial' to Europe. This volume offers fresh insights into immigration, racism and ethnic conflict in post-colonial Europe by presenting colonial repatriates as another 'immigrant' population.
