    Abstract: Located within wider debates about ‘security versus liberty’ in our post 9/11 world, the book analyses the new landscape of UK counter terrorism powers and offences and focuses upon the deleterious consequences of the so-called ‘war on terror’ on freedom of political expression and association. Questioning the compatibility of recent speech-limiting measures with liberalism’s established commitment to free speech and international human rights norms, the book takes a critical look at new powers to proscribe ‘extremist’ political parties, possession offences and other criminal controls (eg. Official Secrets Act prosecutions) as well as new offences such as ‘glorification’ of terrorism. Less visible, extra-legal forms of censorship are also evaluated. The monograph concludes by asking how a more vigorous defence of unorthodox and unpopular forms of expression might be safeguarded in the UK.

    Abstract: The historical development of tonnage, ship registration, classification societies and national and international law for flag State responsibility is recounted, along with the large increase in numbers of non-traditional flag States and classification societies over the past fifty years. The Law of the Sea Convention provides for a State to grant its nationality to ships, for those ships to be surveyed before registration, and for a flag State to effectively exercise its jurisdiction and control in administrative, technical and social matters over ships flying its flag. A State has the sovereign right to determine conditions for grant of its nationality and this can lead to derogation of flag State responsibility with implications for safety of ships. These issues are analysed and remedies proposed for effective flag State implementation of mandatory instruments.

    Abstract: Designations of large Particularly Sensitive Sea Areas (PSSAs) triggered a controversial debate within the International Maritime Organisation (IMO) concerning the legal basis of PSSAs, the relationship between the IMO’s PSSA guidelines and UNCLOS, as well as the competency of IMO to adopt mandatory protective measures in these areas. As a result, IMO conducted a review process which led to substantially updated guidelines adopted in late 2005. This book provides a detailed analysis of the PSSA guidelines and protective measures available in PSSAs. Emphasis is placed on their legal basis and the implications for coastal states' jurisdiction over vessel-source pollution.

    Abstract: The concept of individual criminal responsibility for core international crimes is, by now, a well-established principle in international criminal law. However, while the general principle behind the concept is by and large unproblematic, its practical application underscores its complexity. The aim of this book is to examine three pertinent issues relating to the concept of individual criminal responsibility for core international crimes: (i) The joint criminal enterprise doctrine, (ii) The defining criteria of international criminal courts, for the purposes of an evaluation of the lifting of state official immunity for core international crimes, in the light of the findings of the ICJ in the Arrest Warrant case, and (iii) The imposition of individual criminal responsibility for terrorism as a crime against humanity, both in international law and in relation to the ICC Statute.

    Abstract: When EU leaders signed the Lisbon Treaty in late 2007, it seemed that the constitutional process in Europe was finally close to fruition.     Abstract: The carriage of goods by sea mainly focuses on loss of or damage to goods. There are voluminous discussions and texts on this issue. By contrast, the issue of loss or damage from goods has been paid little attention. Ever-increasing numbers of dangerous goods are carried by sea today. This increase draws attention to explosions or fire on ships, spillages, pollution, accidents and potential danger. Worldwide concern with the risk posed by the increased frequency in the carriage of dangerous goods has led to the adoption of international technical standards to promote maritime safety and the insertion of special provisions in the carriage contracts. Moreover, growing environmental awareness and concern with the economic cost implications of maritime casualties have given rise to the regulation of liability and compensation in respect of damage caused by hazardous and noxious substances.

    Abstract: In the practice of modern international law, disputes as to the meaning of specific treaty provisions are a frequent occurrence. It is the assumption underlying any such dispute that in a process of interpretation a distinction has to be made between the legally correct and incorrect interpretation result. The legal correctness of an interpretation result is determined by reference to the relevant international law, as reflected in the 1969 Vienna Convention on the Law of Treaties (VCLT), Articles 31-33. The result of an interpretation process is correct when it can be successfully defended as being in accordance with the provisions of VCLT Articles 31-33. The result is incorrect when it cannot be so defended. Traditionally, the substance of Articles 31-33 has been described by reference to the various means of interpretation enumerated in said provisions, and little more than that. As argued in this book, more detail is required. On closer inspection, not only does the Vienna Convention provide information on the interpretation data (or means of interpretation) to be used by appliers when interpreting a treaty provision. It also instructs the appliers how, by using each datum, they shall argue to arrive at a conclusion about the meaning of the interpreted provision, and, to some extent, it determines the weight that different data of interpretation shall be afforded when appliers discover that, depending on the specific datum they bring to bear on the interpretation process, the conclusion arrived at will be different. Hence, the regime laid down in VCLT Articles 31-33 will have to be described as a system of rules. This book investigates the contents and structure of this system. By importing knowledge from linguistics, and pragmatics in particular, a model is established giving representation to the concept of a rule of interpretation. Drawing on this model, the book then proceeds to reconstruct the contents of the various rules of interpretation. To facilitate reference, the conclusions suggest a list of 44 rules, all of which can be invoked by appliers citing VCLT Articles 31-33.

    Abstract: Because the liability of ship owners is limited, classification societies have been considered as exempt from liability. This book analyses which actions of classification societies may give rise to claims and whether or not the societies can be held liable under English, German or American maritime law. In addition, it develops the fundamental aspects of an international convention on the limitation of the liability of classification societies.
    Abstract: Classification societies are discharging various functions in the interest of flag States and shipowners. They are important actors in the system of maritime safety. Because the liability of shipowners is limited, classification societies have been considered as exempt from liability for a long time and in several jurisdictions this view still prevails. This study analyses which actions of classification societies may give rise to claims and whether or not the societies can be held liable under English, German or United States maritime law. Moreover, the fundamentalaspects of an international convention on the limitation of the liability of classification societies are developed.

    Abstract: Oil tankers are not solely to blame for pollution at sea. Non-tankers have released numerous spills. The International Convention on Civil Liability for Bunker Oil Pollution Damage has been adopted, but has not yet come into force. This timely and comprehensive book studies compulsory insurance, its main purpose of ensuring compensation and its interrelations with other features such as the rule of strict liability, the limitation of liability of that convention.
    Abstract: Oil tankers are not the only vessels that have caused oil pollution at sea. Numerous spills in the past have been of heavy fuel oil from non-tankers. However, the international liability and compensation regime covered only oil pollution damage caused by oil tankers. There was thus a need to bring the law on marine oil pollution responsive to oil pollution damage caused by non-tankers. In March 2001, the International Convention on Civil Liability for Bunker Oil Pollution Damage was adopted following a diplomatic conference at the International Maritime Organization. Though this convention has not yet come into force, its various aspects should already be considered as they will surely affect the maritime industry as a whole and the non-tanker sector, in particular. This book provides a timely and comprehensive study on the concept of compulsory insurance, its main purpose of ensuring compensation and its interrelations with other features such as the rule of strict liability and the limitation of liability under the convention.

    Abstract: An International Expert Workshop on the Right to Social Security was held in April 2005 at the German Institute for Human Rights, whose purpose was to highlight specific issues of the right to social security which should be addressed by the Committee when drafting a General Comment on article 9. The results of this workshop are published in this volume providing an insight into the current challenges on social security as a human right.
    Abstract: Article 9 of the International Covenant on Economic Social and Cultural Rights on the right to social security is the shortest article in the entire Covenant and for that reason alone highly abstract and vague. A comprehensive analysis of the article 9 is still lacking, not least because it is widely regarded as a Pandora's box better not to be opened. Experience has shown that the quality of the state reporting procedure is greatly improved once the Committee on Economic Social and Cultural Rights has adopted a General Comment. Thus, it seems very desirable to close this gap. For the reason, an International Expert Workshop on the Right to Social Security was held in April 2005 at the German Institute for Human Rights, whose purpose was to highlight specific issues of the right to social security which should be addressed by the Committee when drafting a General Comment on article 9. The results of this workshop are published in this volume providing an insight into the current challenges on social security as a human right.

    Abstract: The demand for accountability for human rights violations is heard throughout the world as never before. This volume explores current developments in the prosecution of human rights crimes on the national and international level. Experts from several countries discuss relevant topics from the academic debate, describe the practice in different countries, and analyze problems which have arisen in this new and exciting field of law. They strike a balance after the first years of the International Criminal Court and a growing universal jurisdiction practice and give the reader a present-day overview of attempts to bring to justice major figures like Augusto Pinochet and Donald Rumsfeld as well as lesser known ones. Emphasis is put on the emerging principle of universal jurisdiction and the effect of the `war on terror` on legal norms.     Abstract: This book features the contributions of a distinguished group of experts in the field of the law of armed conflicts that gathered in Berlin in June 2005. The goal of the colloquium, which marked the 70th birthday of Knut Ipsen, was to find operable solutions for problems and challenges that confront the contemporary law of armed conflict.
    Abstract: Recent armed conflicts, whether international or non-international in character, are in many respects characterized by a variety of asymmetries. These asymmetries may be overstressed, sometime even abused, and ultimately virtually meaningless. Still, either as such or in conjunction with other developments, they seem to challenge the law of armed conflicts or: international humanitarian law. These challenges may very well compromise the very function of that body of law, which is to mitigate as far as possible the calamities of war. Thus, the law of armed conflict may be deprived of its fundamental function as an order of necessity because its legally binding directives will increasingly be disregarded for the sake of allegedly superior values. In order to discuss these and other questions a most distinguished group of experts in the field of the law of armed conflicts gathered in Berlin in June 2005. The goal of that colloquium, which marked the 70th birthday of Knut Ipsen, was to find operable solutions for problems and challenges the contemporary law of armed conflict is confronted with. With contributions by Bill Boothby, Michael Bothe, Yoram Dinstein, Knut Dörmann, Charles J. Dunlap Jr., Volker Epping, Dieter Fleck, Steven Haines, Wolff Heintschel von Heinegg, Hans-Joachim Heintze, Rainer Hofmann, Frits Kalshoven, Stefan Oeter, W.     Abstract: With the global expansion of the maritime sector, marine insurance is on the forefront nowadays, more than ever before. Notwithstanding this growth, a vast number of legal disputes continues to emerge, with indemnity being, inter alia, amidst their focal points. Accordingly, the author discusses legal issues correlated to the principle of indemnity which is entailed in such contracts as well as in disputes that may arise there under, in a representative sample of common and continental law jurisdictions. In view of the ongoing attempt for unification, undertaken by the Comité Maritime Internationale (CMI) since 1998, it has been considered essential that the discussion encompasses an international and comparative aspect. Hence, this book comparatively examines Australian, English, Canadian, French, Greek, Norwegian and U.S. law, from the angle of indemnity in marine insurance contracts, the scope for a legal reform and the potential of harmonization, in terms of achieving a better, more flexible and modern indemnification regime in marine insurance.

    Abstract: The book provides a comprehensive analysis of the advisory role of the International Court of Justice in light of its jurisprudence and overall contribution over a period of more than 55 years. The author highlights the `organic connection` between UN organs and the Court and the Courts contribution as one of the UNs principal organs to the Organisation. The basic argument of this study is that the advisory function should be understood as a two-sided process involving the interplay between UN organs and the ICJ. The request for and the giving of an advisory opinion is a collective coordinated process, involving more than one organ or part of the Organisation. The author concludes that the Courts role as a participant in the UNs work is circumscribed by its duty to act judicially. In practice, the Court has succeeded in establishing a balance between its role as a principal organ of the UN and its position as a judicial institution with a duty to administer justice impartially.

    Abstract: "The Politics of Adoption identifies and analyses the fundamental social and legal functions of adoption. It is a timely publication as across the world adoption law reform is now giving rise to contentious issues. The change process underway in England and Wales offers an opportunity and a perspective to explore areas of commonality and difference in the experience of other nations. It also provides a window through which to examine the presumption that within and between cultures there exists a common understanding of what is meant by adoption.     Abstract: "The accession of eight post-communist countries of Central and Eastern Europe (and also of Malta and Cyprus) to the European Union in 2004 has been heralded as perhaps the most important development in the history of European integration so far. While the impact of the enlargement on the constitutional structures and practices of the EU has already generated a rich scholarly literature, the influence of the accession on constitutionalism, democracy, human rights and the rule of law among the new member states has been largely ignored. This book fills this gap, and addresses the question of the consequences of the ""external force"" of European enlargement upon the understanding and practice of democracy and the rule of law and among both the main legal-political actors and the general public in the new member-states. A number of leading legal scholars, sociologists and political scientists, both from Central and Eastern Europe and from outside, address these issues in a systematic and critical way. Taken together, these essays help answer a fundamental question: does the European Union have the potential of promoting and consolidate democracy and human rights?"

    Abstract: The general international law regarding foreign merchant ships in internal waters has never been codified. The question of the breadth of the territorial sea was finally solved during the Third United Nations Conference on the Law of the Sea. But conflicts between coastal States and foreign merchant ships in internal waters and the territorial sea may arise. This comprehensive study analyses these issues and strives for reasonable and generally acceptable solutions.
    Abstract: The general international law regarding foreign merchant ships in internal waters has never been codified. Despite the codification efforts made by the League of Nations and the Geneva Convention on the Territorial Sea and the Contiguous Zone of 1958, the question of the breadth of the territorial sea was finally solved during the Third United Nations Conference on the Law of the Sea. In addition, the right of innocent passage of foreign ships has been regulated in the 1982 Convention in greater detail than ever before, whilst the new regime on the prevention of marine pollution in the Convention has also considerable impact on this right. In practice, potential conflicts between coastal States and foreign merchant ships in internal waters and the territorial sea may well arise. This comprehensive study analyses these issues and cautiously strives for reasonable and generally acceptable solutions.

In contrast to most other analysts and scholars he does not take for granted that they are a 'force for the good', but rather subjects them to critical scrutiny.
    Abstract: Challenging the conventional wisdom that constitutional courts are the best device that democratic systems have for the protection of individual rights, Wojciech Sadurski examines carefully the most recent wave of activist constitutional courts: those that have emerged after the fall of communism in Central and Eastern Europe. He shows that, in the region of Central and Eastern Europe, their record in protecting constitutional rights has been mixed, and their impact upon the vibrancy of democratic participation and public discourse about controversial issues often negative. Sadurski urges us to reconsider the frequently unthinking enthusiasm for the imposition of judicial limits upon constitutional democracy. In the end, his reflections go to the very heart of the fundamental dilemma of constitutionalism and political theory: how best to find the balance between constitutionalism and democracy? The lively, if imperfect, democracies in Central and Eastern Europe provide a fascinating terrain for raising this question, and testing traditional answers.
