    Abstract: This book examines the role of The International Maritime Organization (IMO) in the prevention and control of pollution of the marine environment from vessels with a particular reference to the current north-south tensions regarding the strategy for combating climate change in the maritime sector as well as the prevention of marine pollution from the ship-breaking industry. The IMO, a United Nations specialized agency, has been entrusted with the duty to provide machinery for cooperation among governments for the prevention and control of pollution of the marine environment from vessels. The organization is responsible for drafting legal instruments as well as for facilitating technical cooperation for the protection of the marine environment. Although IMO legal instruments are mainly targeted at the prevention of pollution of the marine environment from vessels, there is a trend towards a liberal interpretation of this, and the organization has expanded its work to areas like shipbreaking, which is essentially a land-based industry

    Abstract: This thesis provides a new approach to the Ethiopian Land Law debate. The basic argument made in this thesis is that even if the Ethiopian Constitution provides and guarantees common ownership of land (together with the state) to the people, this right has not been fully realized whether in terms of land accessibility, enjoyability, and payment of fair compensation in the event of expropriation. Expropriation is an inherent power of the state to acquire land for public purpose activities. It is an important development tool in a country such as Ethiopia where expropriation remains the only method to acquire land. Furthermore, the two preconditions of payment of fair compensation and existence of public purpose justifications are not strictly followed in Ethiopia. The state remains the sole beneficiary of the process by capturing the full profit of land value, while paying inadequate compensation to those who cede their land by expropriation. Secondly, the broader public purpose power of the state in expropriating the land for unlimited activities puts the property owners under imminent risk of expropriation

    Abstract: How can the studio teacher teach a lesson so as to instill refined artistic sensibilities, ones often thought to elude language? How can the applied lesson be a form of aesthetic education? How can teaching performance be an artistic endeavor in its own right? These are some of the questions Teaching Performance attempts to answer, drawing on the author's several decades of experience as a studio teacher and music scholar. The architects of absolute music (Hanslick, Schopenhauer, and others) held that it is precisely because instrumental music lacks language and thus any overt connection to the non-musical world that it is able to expose essential elements of that world. More particularly, for these philosophers, it is the density of musical structure-the intricate interplay among purely musical elements-that allows music to capture the essences behind appearances. By analogy, the author contends that the more structurally intricate and aesthetically nuanced a pedagogical system is, the greater its ability to illuminate music and facilitate musical skills. The author terms this phenomenon relational autonomy. Eight chapters unfold a piano-pedagogical system pivoting on the principle of relational autonomy. In grounding piano pedagogy in the aesthetics of absolute music, each domain works on the other. On the one hand, Romantic aesthetics affords pedagogy a source of artistic value in its own right. On the other hand, pedagogy concretizes Romantic aesthetics, deflating its transcendental pretentions and showing the dichotomy of absolute/utilitarian to be specious.

    Abstract: This volume presents global and comparative perspectives on the perpetual pendular movement of family law between status and contract. It contributes to the topical academic debate on ‘family law exceptionalism’ by exploring the blurred lines between public law, private law and family law, and sheds light on the many shades of grey that exist. The contributions focus on both substantive and procedural family law on parents and children and on life partners, with particular attention for contractual arrangements of family formations and of conflict resolution. The hypothesis underlying all contributions was the trend towards contractualisation of family law. A convergent research outcome resulting from the comparison of national reports was the ambivalent position of family law in legal systems worldwide. That comparison shows that, whereas family law is clearly moving towards contract with regard to old family formations, the contrary is true for new family formations. The movement towards contract is rarely considered to be contractualisation pur sang, with civil effect. The movement towards status, finally, does not necessarily witness ‘family law exceptionalism’ vis-à-vis private law, in view of the increasing State interventionism in private law relations in general. In sum, as the volume shows, the high permeability of the demarcations between the State, the family and the market impedes a categorial approach. This volume is based on the general and selected national reports on the topic “Contractualisation of Family Law” that were presented at the XIXth International Congress of Comparative Law in Vienna in July 2014

    Abstract: This book gives a concise history of biophysics in contemporary China, from about 1949 to 1976. It outlines how a science specialty evolved from an ambiguous and amorphous field into a fully-fledged academic discipline in the socio-institutional contexts of contemporary China. The book relates how, while initially consisting of cell biologists, the Chinese biophysics community redirected their disciplinary priorities toward rocket science in the late 1950s to accommodate the national interests of the time. Biophysicists who had worked on biological sounding rockets were drawn to the military sector and continued to contribute to human spaceflight in post-Mao China. Besides the rocket-and-space missions which provided the material context for biophysics to expand in the late 1950s and early 1960s, Chinese biophysicists also created research and educational programs surrounding biophysics by exploiting the institutional opportunities afforded by the policy emphasis on science's role to drive modernization. The book explores and demonstrates the collective achievements and struggles of Chinese biophysicists in building their scientific discipline

    Abstract: In recent years, funding agencies like the Institute of Educational Sciences and the National Science Foundation have increasingly emphasized large-scale studies with experimental and quasi-experimental designs looking for 'objective truths'. Educational researchers have recently begun to use large-scale studies to understand what really works, from developing interventions, to validation studies of the intervention, and then to efficacy studies and the final "scale-up" for large implementation of an intervention. Moreover, modeling student learning developmentally, taking into account cohort factors, issues of socioeconomics, local political context and the presence or absence of interventions requires the use of large data sets, wherein these variables can be sampled adequately and inferences made. Inroads in quantitative methods have been made in the psychometric and sociometric literatures, but these methods are not yet common knowledge in the mathematics education community. In fact, currently there is no volume devoted to discussion of issues related to large-scale studies and to report findings from them. This volume is unique as it directly discusses methodological issues in large-scale studies and reports empirical data from large-scale studies

    Abstract: This work deals with the temporal effect of judicial decisions, and more specifically, with the hardship caused by the retroactive operation of overruling decisions. By means of a jurisprudential and comparative analysis, the book explores several issues created by the overruling of earlier decisions. Overruling of earlier decisions, when it occurs, operates retrospectively with the effect that it infringes the principle of legal certainty through upsetting any previous arrangements made by a party to a case under long standing precedents established previously by the courts. On this account, in the recent past, a number of jurisdictions have had to deal with the prospect of introducing in their own systems the well-established US practice of prospective overruling whereby the court may announce in advance that it will change the relevant rule or interpretation of the rule but only for future cases. However, adopting prospective overruling raises a series of issues mainly related to the constitutional limits of the judicial function coupled with the practical difficulties attendant upon such a practice. This book answers a number of the questions raised by this practice. It makes use of the great reservoir of foreign legal experience that furnishes theoretical and practical ideas from which national judges may draw their knowledge and inspiration in order to be able to advise a rational method of dealing with time when they give their decisions

    Abstract: This book casts new light on the work of the German poet Friedrich Hölderlin (1770 - 1843), and his translations of Greek tragedy. It shows Hölderlin’s poetry is unique within Western literature (and art) as it retrieves the socio-politics of a Dionysiac space-time and language to challenge the estrangement of humans from nature and one other. In this book, author Lucas Murrey presents a new picture of ancient Greece, noting that money emerged and rapidly developed there in the sixth century B.C. This act of monetization brought with it a concept of tragedy: money-tyrants struggling against the forces of earth and community who succumb to individual isolation, blindness and death. As Murrey points out, Hölderlin (unconsciously) retrieves the battle between money, nature and community and creatively applies its lessons to our time. But Hölderlin’s poetry not only adapts tragedy to question the unlimited “machine process” of “a clever race” of money-tyrants. It also draws attention to Greece’s warnings about the mortal danger of the eyes in myth, cult and theatre.     Abstract: This well-illustrated book, by two established historians of school mathematics, documents Thomas Jefferson’s quest, after 1775, to introduce a form of decimal currency to the fledgling United States of America. The book describes a remarkable study showing how the United States’ decision to adopt a fully decimalized, carefully conceived national currency ultimately had a profound effect on U.S. school mathematics curricula. The book shows, by analyzing a large set of arithmetic textbooks and an even larger set of handwritten cyphering books, that although most eighteenth- and nineteenth-century authors of arithmetic textbooks included sections on vulgar and decimal fractions, most school students who prepared cyphering books did not study either vulgar or decimal fractions. In other words, author-intended school arithmetic curricula were not matched by teacher-implemented school arithmetic curricula. Amazingly, that state of affairs continued even after the U.S. Mint began minting dollars, cents and dimes in the 1790s. In U.S. schools between 1775 and 1810 it was often the case that Federal money was studied but decimal fractions were not. That gradually changed during the first century of the formal existence of the United States of America. By contrast, Chapter 6 reports a comparative analysis of data showing that in Great Britain only a minority of eighteenth- and nineteenth-century school students studied decimal fractions. Clements and Ellerton argue that Jefferson’s success in establishing a system of decimalized Federal money had educationally significant effects on implemented school arithmetic curricula in the United States of America. The lens through which Clements and Ellerton have analyzed their large data sets has been the lag-time theoretical position which they have developed. That theory posits that the time between when an important mathematical “discovery” is made (or a concept is “created”) and when that discovery (or concept) becomes an important part of school mathematics is dependent on mathematical, social, political and economic factors. Thus, lag time varies from region to region, and from nation to nation.     Abstract: This book identifies institutional mechanisms that can be used to promote consumer confidence in direct online sales with businesses (B2C e-commerce). It argues that enhancing the access to justice in a multidimensional sense can potentially offer an effective means of boosting consumer confidence. It introduces a conceptual framework for a multidimensional approach to access to justice in the context of consumer protection, describing the various reasonable criteria needed to satisfy consumer demands in B2C e-commerce. The framework, which reflects all essential aspects of consumers’ expectations when they engage in online transactions, provides a benchmark for the evaluation of various consumer protection mechanisms. Based on an analysis of different mechanisms and using the framework’s criteria, the practice of private ordering, which does not rely on the creation of rules of law but rather on the use of technology as a solution, appears to offer a meaningful way to enhance access to justice in B2C e-commerce. However, though private ordering holds considerable potential, certain weaknesses still need to be eliminated. This book demonstrates how private ordering can be successfully implemented with the help of an intermediary, a neutral third party that plays an integral part in the collaborative task of facilitating various aspects of private ordering, thus helping to limit the risks of failure and ensuring a fairer market setting. In order to move forward, it argues that the state, with its wealth of material resources and incentive options, is the institution best suited to acting as an intermediary in facilitating private ordering.     Abstract: This book proposes a new interpretative key for reading and overcoming the binary of idealism and realism. It explores the way human consciousness unfolds through the relationship between the I and the world-a field of phenomenological investigation that cannot and must not remain closed within the limits of its own disciplinary boundaries. The book focuses on the question of realism in contemporary debates, ultimately dismantling prejudices and automatisms that one finds therein. It shows that at the root of the controversy between realism and idealism there often lie equivocations of a semantic nature. By returning to the origins of modern phenomenology this study mines the Husserlian concept of transcendental idealism. Following this path, and neutralizing the extreme positions of an acritical idealism and a naïve realism, the book proposes a “transcendental realism”: the horizon of a dynamic unity that embraces the process of cognition and that grounds the relation, and not the subordination, of subject and object. The advocacy battles during the last few decades provide a number of short stories of the ethical battles regarding below-ground and above ground historic resources, and the eighth chapter attempts to explain why religion has been long held at arm’s length in publicly-supported preservation efforts, when in fact, it holds more potential to regenerate existing sites than any governmental program.

    Abstract: Archaeological evidence - i.e. presence of exogenous, foreign material objects (pottery, obsidian and so on) - is used to make inferences on ancient trade, while population movement can only be assessed when the biological component of an ancient community is analyzed (i.e. the human skeletal remains). But the exchange of goods or the presence of foreign architectural patterns does not necessarily imply genetic admixture between groups, while at the same time humans can migrate for reasons that may not be related only to trading. The Prehispanic Maya were a complex, highly stratified society. During the Classic period, city-states governed over large regions, establishing complex ties of alliance and commerce with the region’s minor centers and their allies, against other city-states within and outside the Maya realm. The fall of the political system during the Classic period (the Maya collapse) led to hypothetical invasions of leading groups from the Gulf of Mexico into the northern Maya lowland at the onset of the Postclassic. However, it is still unclear whether this collapse was already underway when this movement of people started. The whole picture of population dynamics in Maya Prehispanic times, during the Classic and the Postclassic, can slowly emerge only when all the pieces of the puzzle are put together in a holistic and multidisciplinary fashion. The contributions of this volume bring together contributions from archaeology, archaeometry, paleodemography and bioarchaeology. They provide an initial account of the dynamic qualities behind large-scale ancient population dynamics, and at the same time represent novel multidisciplinary points of departure towards an integrated reconstruction and understanding of Prehispanic population dynamics in the Maya region.

    Abstract: The spread of English as an international language along with the desire to maintain local languages lead us to consider multilingualism as the norm rather than the exception. Consequently, bi/multilingual education has bloomed over the last decades. This volume deals with one such type of education currently in the spotlight as an essentially European strategy to multilingualism, CLIL (Content and Language Integrated Learning), in which curricular content is taught through a foreign language. The book contributes new empirical evidence on its effects on linguistic and attitudinal outcomes focusing on bi/multilingual learners who acquire English as an additional language. Moreover, it presents critical analyses of factors influencing multilingual education, the effects of CLIL on both language and content learning, and the contrast between CLIL and other models of instruction. The research presented suggests that CLIL can greatly enhance language acquisition in multilingual settings

    Abstract: Common European Legal Thinking emanates from the existence of a shared European legal culture as especially reflected in the existence of a common European constitutional law. It denotes a body of individual constitutional principles - written and unwritten - that represent the common heritage of the constitutions of the Member States. Taking into account the two major European organisations, the Council of Europe and especially the European Union, the essays of this Festschrift discuss a range of constitutional principles, including the rule of law, democracy, and the exercise of political power in a multilevel system which recognises fundamental rights as directly applicable and supreme law.     Abstract: This book offers a detailed account of the recent Israeli-Greek rapprochement. For more than six decades, relations between Greece and Israel were characterized by suspicion, mutual recriminations and hostility. After Greece recognized the state of Israel in 1990, relations became somewhat more balanced and normalized but fell far short of any meaningful cooperation. It was only in 2009 that Greek policy was fundamentally and unexpectedly overturned. This volume examines this new relationship in detail and explores its theoretical and regional consequences. The Introduction provides a general framework of Greek foreign policy within which the rapprochement with Israel was pursued. Chapter I presents the book’s theoretical framework, focusing on balance of power theory and emphasizing the arguments of Hans Morgenthau, Kenneth Waltz, John Mearsheimer and Stephen Walt. Chapter II delineates the fraught relations between the Greeks and the Jews, despite their cultural and historical commonalities, and analyzes the reasoning behind decades of antagonistic foreign policy. Chapter III describes how the rise of Turkey during Greece’s economic crisis and the gradual deterioration of the strategic partnership between Israel and Turkey combined to create a climate open to Israeli-Greek cooperation. Chapter IV examines the beginning of the rapprochement between Israel and Greece, highlighting Netanyahu’s historic 2010 visit to Greece. Chapter V explores the intensification of Israeli-Greek cooperation. Chapter VI discusses energy cooperation in the Eastern Mediterranean, another key factor in the deterioration of Israeli-Turkish relations and the strengthening of ties between Greece and Israel. The book concludes with a return to theory, reiterating the Realist approach and using that framework to hypothesize about the future of the relationship between the two nations. This book is appropriate for graduate students and academics studying international relations and foreign policy in the Eastern Mediterranean, as well as policymakers, activists and journalists who want to have a clearer understanding of the Israeli-Greek rapprochement and other developments in the region

Besides a detailed overview of the sources of Roman law, the book also includes sections on private and criminal law and procedure, with special attention given to those aspects of Roman law that have particular importance to today's lawyer. The last three chapters of the book offer an overview of the history of Roman law from the early Middle Ages to modern times and illustrate the way in which Roman law furnished the basis of contemporary civil law systems. In this part, special attention is given to the factors that warranted the revival and subsequent reception of Roman law as the ‘common law’ of Continental Europe. Combining the perspectives of legal history with those of social and political history, the book can be profitably read by students and scholars, as well as by general readers with an interest in ancient and early European legal history. The civil law tradition is the oldest legal tradition in the world today, embracing many legal systems currently in force in Continental Europe, Latin America and other parts of the world. Despite the considerable differences in the substantive laws of civil law countries, a fundamental unity exists between them. The most obvious element of unity is the fact that the civil law systems are all derived from the same sources and their legal institutions are classified in accordance with a commonly accepted scheme existing prior to their own development, which they adopted and adapted at some stage in their history.     Abstract: This Brief explores the role of social crime prevention as a crime reduction strategy in the developing world. "Social crime prevention" focuses on the social and economic factors that may contribute to violence and criminal behavior in a community. Particularly in the developing world, an understanding of the socioeconomic and political context holds long-term potential for crime reduction (rather than crime displacement); however, the strategies are complex and the results may be slow. Generally, police and law enforcement are relied upon to present quick results, where social crime prevention strategies can be viewed as being "soft on crime" or too slow. This Brief discusses the tension between the traditional role of police and proactive social crime prevention strategies in an international context, through a variety of case studies. It also provides recommendations for balancing or reshaping this role.     Abstract: Holocaust Archaeologies: Approaches and Future Directions aims to move archaeological research concerning the Holocaust forward through a discussion of the variety of the political, social, ethical and religious issues that surround investigations of this period and by considering how to address them. It considers the various reasons why archaeological investigations may take place and what issues will be brought to bear when fieldwork is suggested. It presents an interdisciplinary methodology in order to demonstrate how archaeology can (uniquely) contribute to the history of this period. Case examples are used throughout the book in order to contextualise prevalent themes and a variety of geographically and typologically diverse sites throughout Europe are discussed. This book challenges many of the widely held perceptions concerning the Holocaust, including the idea that it was solely an Eastern European phenomena centred on Auschwitz and the belief that other sites connected to it were largely destroyed or are well-known. The typologically , temporally and spatial diverse body of physical evidence pertaining to this period is presented and future possibilities for investigation of it are discussed. Finally, the volume concludes by discussing issues relating to the “re-presentation” of the Holocaust and the impact of this on commemoration, heritage management and education. This discussion is a timely one as we enter an age without survivors and questions are raised about how to educate future generations about these events in their absence

The question of legal liability arises when something goes wrong, e.g. the unmanned vehicle is involved in a car accident, the surgical system is involved in a surgical error or the trading algorithm is involved in fraud, etc. Who is to be held liable for these offenses: the manufacturer, the programmer, the user, or, perhaps, the artificial intelligence system itself? The concept of liability for crimes involving artificial intelligence systems has not yet been widely researched. Advanced technologies are forcing society to face new challenges, both technical and legal. The idea of liability in the specific context of artificial intelligence systems is one such challenge that should be thoroughly explored.

    Abstract: This book seeks to communicate to both a global and local audience, the key attributes of pre-industrial African metallurgy such as technological variation across space and time, methods of mining and extractive metallurgy and the fabrication of metal objects. These processes were transformative in a physical and metaphoric sense, which made them total social facts. Because the production and use of metals was an accretion of various categories of practice, a chaine operatoire conceptual and theoretical framework that simultaneously considers the embedded technological and anthropological factors was used. The book focuses on Africa’s different regions as roughly defined by cultural geography. On the one hand there is North Africa, Egypt, the Egyptian Sudan, and the Horn of Africa which share cultural inheritances with the Middle East and on the other is Africa south of the Sahara and the Sudan which despite interacting with the former is remarkably different in terms of technological practice. For example, not only is the timing of metallurgy different but so is the infrastructure for working metals and the associated symbolic and sociological factors. The cultural valuation of metals and the social positions of metal workers were different too although there is evidence of some values transfer and multi-directional technological cross borrowing. The multitude of permutations associated with metals production and use amply demonstrates that metals participated in the production and reproduction of society. Despite huge temporal and spatial differences there are so many common factors between African metallurgy and that of other regions of the world. For example, the role of magic and ritual in metal working is almost universal be it in Bolivia, Nepal, Malawi, Timna, Togo or Zimbabwe. Similarly, techniques of mining were constrained by the underlying geology but this should not in any way suggest that Africa’s metallurgy was derivative or that the continent had no initiative. Rather it demonstrates that when confronted with similar challenges, humanity in different regions of the world responded to identical challenges in predictable ways mediated as mediated by the prevailing cultural context. The success of the use of historical and ethnographic data in understanding variation and improvisation in African metallurgical practices flags the potential utility of these sources in Asia, Latin America and Europe. It examines multifarious theories relating not only to conflicting and opposing interests, but also to parties to whom the shipping industry should be accountable. The unique aspect of this book is the Corporate Social responsibility analysis pertaining to the Arctic and alternatives that strike a balance between the increased commercialization of the shipping industry and the laws and concepts of ocean governance. The book relevantly puts forward the concept of “ocean governance” and to what extent it can be addressed in terms of the Arctic. What distinguishes this book from others is the fact that it is not limited to examining the effects of climate change and how it is reshaping the way scholars assume the Arctic will be in the near future. Rather it creates a transparent nexus between opposing claims and increasing commercial interests and proceeds to scrutinize the efforts of the Arctic Council and individual Arctic coastal states. In this context, the book follows a given equation based on initial theories and how the opposing claims and increasing commercialization side of the equation can be balanced with the appropriate legal norm. It also reflects on the critical aspects of “hard law and soft law” which are two opposite ends of the legal pole and core elements of any legal spectrum. Readers will discover that this abyss is of concern for our everyday experience because it leads to a rupture in our understanding of the world: between the world of our living and its scientific construct. We see that Patočka continually emphasised the relevance of Husserl’s work to existential questions relating to human responsibility and the life-world, which he admits is left largely implicit in Husserl’s work.     Abstract: This book provides a “context” of discussion for researchers and educational experts in order to rethink the relationship between actors, practices and borders within the educational contexts. The research in educational psychology has often challenged the concept of “educational context”. According to the different theoretical frameworks, the construct of contexts, their borders, and the dimensions to be taken into account have all been defined in different ways. The book offers a reflection that goes from theory to practice and backward from practice to theory. The main research questions the book addresses are how actors, i.e. teachers, parents and students, educators, and professionals, with their own identity and social representations, build their educational practices, or, their shared cultural spaces where knowledge is generated, defining the borders of the educational contexts. The book proposes that a border is a type of membrane within and outside the educational setting bringing together different actors, groups and cultures. The book presents the perspectives of scholars and educational experts from various parts of the world, including Brazil, Argentina, Italy, Japan, and the United Kingdom. They shed light on what happens at the border in different cultural contexts, and what the relationship is between the educational setting and the other life contexts or micro-cultures.

    Abstract: This book examines the phenomenological anthropology of Edith Stein. It specifically focuses on the question which Stein addressed in her work Finite and Eternal Being: What is the foundational principle that makes the individual unique and unrepeatable within the human species? Traditional analyses of Edith Stein’s writings have tended to frame her views on this issue as being influenced by Aristotle and Thomas Aquinas, while neglecting her interest in the lesser-known figure of Duns Scotus. Yet, as this book shows, with regard to the question of individuality, Stein was critical of Aquinas’ approach, finding that of Duns Scotus to be more convincing. In order to get to the heart of Stein’s readings of Duns Scotus, this book looks at her published writings and her personal correspondence, in addition to conducting a meticulous analysis of the original codexes on which her sources were based. Written with diligence and flair, the book critically evaluates the authenticity of Stein’s sources and shows how the position of Scotus himself evolved. It highlights the originality of Stein’s contribution, which was to rediscover the relevance of Mediaeval scholastic thought and reinterpret it in the language of the Phenomenological school founded by Edmund Husserl

    Abstract: Historian Ramses Delafontaine presents an engaging examination of a controversial legal practice: the historian as an expert judicial witness. This book focuses on tobacco litigation in the U.S. wherein 50 historians have witnessed in 314 court cases from 1986 to 2014. The author examines the use of historical arguments in court and investigates how a legal context influences historical narratives and discourse in forensic history. Delafontaine asserts that the courtroom is a performative and fact-making theatre. Nonetheless, he argues that the civic responsibility of the historian should not end at the threshold of the courtroom where history and truth hang in the balance. The book is divided into three parts featuring an impressive range of European and American case studies. The first part provides a theoretical framework on the issues which arise when history and law interact. The second part gives a comparative overview of European and American examples of forensic history. This part also reviews U.S. legal rules and case law on expert evidence, as well as extralegal challenges historians face as experts. The third part covers a series of tobacco-related trials. With remunerations as high as hundreds of thousands of dollars and no peer-reviewed publications or communication on the part of the historians hired by the tobacco companies the question arises whether some historians are willing to trade their reputation and that of their university for the benefit of an interested party. The book further provides 50 expert profiles of the historians active in tobacco litigation, lists detailing the manner of the expert’s involvement, and West Law references to these cases. This book offers profound and thought-provoking insights on the post-war forensification of history from an interdisciplinary perspective. In this way, Delafontaine makes a stirring call for debate on the contemporary engagement of historians as expert judicial witnesses in U.S. tobacco litigation

    Abstract: Earth Stewardship implies a paradigm shift that links facts and values, multiple forms of ecological knowledge and practices, and broadens the mission of the ecological sciences. To confront global environmental change it is necessary, but not sufficient, to conduct long-term socio-ecological research. It is also necessary to act. Earth stewardship calls on ecologists to engage not only in the production of knowledge, but also in public discourse, decision making, education, and governance. As a means of engaging science and society in rapidly reducing current rates of anthropogenic damage to the biosphere, the Ecological Society of America (ESA) launched the Earth Stewardship Initiative in 2009. Since then, this call for action has been appealing not only to ecologists, but also to anthropologists, sociologists, engineers, economists, religion scholars, philosophers, conservation biologists, other professionals, decision makers, and citizens interested in environmental, economic, and social sustainability. This book advances the Stewardship Initiative toward a planetary scale, presenting a range of ecological worldviews, practices, and institutions in different parts of the world and to use them as the basis for considering what we could learn from one another, and what we could do together. Today, inter-hemispheric, intercultural, and transdisciplinary collaborations for Earth Stewardship are an imperative. Chapters document pathways that are being forged by socio-ecological research networks, religious alliances, policy actions, environmental citizenship and participation, and new forms of conservation, based on both traditional and contemporary ecological knowledge and values. “The Earth Stewardship Initiative of the ESA fosters practices to provide a stable basis for civilization in the future. It theorizes the concept of teacher agency from a sociocultural theory perspective and draws on a study conducted in a conservative and less developed area in China. The book uses Engeström's activity theory and Vygotsky's concept of the Zone of Proximal Development (ZPD) to understand the nature and extent of teacher agency in adapting one’s teaching with respect to beliefs, knowledge, and instructional practices. The study concludes that curriculum reform in China needs to shift from reliance on 'top-down' policies to 'bottom-up' implementation that mobilizes local understandings and practices. One of the implications of this study is that transformative teacher education programs aimed at developing teacher pedagogical agency require that teachers have ongoing opportunities to design, develop, and evaluate curriculum-based mediational means

    Abstract: This is a comprehensive, integrated account of eighteenth and early nineteenth century German figurative aesthetics. The author focuses on the theologically-minded discourse on the visual arts that unfolded in Germany, circa 1754-1828, to critique the assumption that German romanticism and idealism pursued a formalist worship of beauty and of unbridled artistic autonomy. This book foregrounds what the author terms an “Aesthetics of Figurative Theo humanism”. It begins with the sculptural aesthetics of Johann Joachim Winckelmann and Gottfried Herder before moving on to Karl Philipp Moritz, Wilhelm Heinrich Wackenroder and Friedrich Schelling. The reader will discover how this aesthetic tradition, after an initial obsession with classical sculpture, chose painting as the medium more suited to the modern self’s exploration of transcendence. This paradigm-shift is traced in the aesthetic discourse of Friedrich Schlegel and Georg Wilhelm Friedrich Hegel. In this work, the widespread prejudice that such aesthetics initiated a so-called “Modern Grand Narrative of the Arts” is deconstructed. One accusation directed at 18th century aesthetics has been that it realised into “Art” what had previously been a living, rich tissue of meaning: this work shows how Figurative Theo humanism's attention to aesthetic values was never detached from deeper theological and humanistic considerations. Furthermore, it argues that this aesthetic discourse never forgot that it emerged from modern disenchantment-far from occluding the dimension of secularization, it draws poignant meaning from it. Anyone with an interest in the current debates about the scope and nature of aesthetics (philosophers of art, theology, or religion) will find this book of great interest and assistance

    Abstract: This volume explores the relation between legal reasoning and logic from both a historical and a systematic perspective. The topics addressed include, among others, conditional legal acts, disjunctions in legal acts, presumptions and conjectures, conflicts of values, Jørgensen´s Dilemma, the Rhetor´s Dilemma, the theory of legal fictions, and the categorization of contracts. The unifying problematic of these contributions concerns the conditional structures and, more particularly, the relationship between legal theory and legal reasoning in the context of conditions. The contributions in this work constitute the first results of the ANR-DFG joint research project “JuriLog” (Jurisprudence and Logic), which aims at fostering the cooperation between legal scholars and philosophers. On the one hand, lawyers and legal scholars have an interest in emphasizing the logical character of legal reasoning. In this respect, the present enquiry examines the question of how logic, especially newer forms of dialogical logic, can be made fruitful as a significant area of philosophy for jurisprudence and legal practice. On the other hand, logicians find in legal reasoning a striving towards clear definitions and inference-procedures that is relevant to their discipline. In order to fully understand such reciprocal relationships, it is necessary to bridge the gap between law, logic and philosophy in contemporary academic research. The essays collected in this volume all work towards this common goal. The book is divided in three sections. In the first part, the strong relation between Roman Law and logic is explored with respect to the analysis of disjunctive statements in legal acts. The second part focuses on Leibniz´s legal theory. The third part, finally, is dedicated to current interactions between law and logic
