    Abstract: This first title in the “Law, Literature & Culture” series uses six legal disputes from the South Carolina courts to illuminate the complex legal history of race in the U.S. South from slavery through Jim Crow. The first two cases—one criminal, one civil—both illuminate the extreme oppressiveness of slavery. The third explores labor relations between newly emancipated Black agricultural workers and white landowners during Reconstruction. The remaining cases investigate three prominent features of the Jim Crow system: segregated schools, racially biased juries, and lynching, respectively. Throughout the century under consideration, South Carolina’s legal system obsessively drew racial lines, always to the detriment of non-white people, but it occasionally provided a public forum within which racial oppression could be challenged. The book emphasizes how dramatically the degree of legal oppressiveness experienced by Black South Carolinians varied during the century under study, based largely on the degree of Black access to political and legal power

    Abstract: In the late 1950s, Suzuki Seijun was an unknown, anxious low-ranking film director churning out so-called program pictures for Japan's most successful movie studio, Nikkatsu. In the early 1960s, he met with modest success in directing popular movies about yakuza gangsters and mild exploitation films featuring prostitutes and teenage rebels. In this book, Peter A. Yacavone argues that Suzuki became an unlikely cinematic rebel and, with hindsight, one of the most important voices in the global cinema of the 1960s. Working from within the studio system, Suzuki almost single-handedly rejected the restrictive filmmaking norms of the postwar period and expanded the form and language of popular cinema. This artistic rebellion proved costly when Suzuki was fired in 1967 and virtually blacklisted by the studios, but Suzuki returned triumphantly to the scene of world cinema in the 1980s and 1990s with a series of critically celebrated, avant-garde tales of the supernatural and the uncanny. This book provides a well-informed, philosophically oriented analysis of Suzuki's 49 feature films

In her study of visual culture, Ruth Sacks sets out to reinstate the compelling wonder of nationalist architecture from Kinshasa's post-independence era, such as the Tower of the Exchange (1974), Gécamines Tower (1977), and the artworks and exhibitions that accompanied them. While exploring post-independence nation-building, this book examines how the underlying ideology of Belgian Art Nouveau, a celebrated movement in Belgium, led to the dominating early colonial settler buildings of the ABC Hotels (circa 1908-13). Congo Style combines Sacks's practice as a visual artist and her academic scholarship to provide an original study of early colonial and independence-era modernist sites in their African context

    Abstract: Conventional notions of avant-garde art suggest innovative artists rebelling against artistic convention and social propriety, shocking unwilling audiences into new ways of seeing and living. Viewers in Distress tells a different story. Beginning in the tumultuous 1990s, after the fall of the Berlin Wall and in the wake of the Los Angeles riots, rebellious spectators in American and British theaters broke with theater decorum and voiced their radical interpretations of shows that were not meant to be radical. In doing so, audiences tried to understand the complex racial, gender, and religious politics of their times, while insisting that liberal societies fulfill their promise of dignity for all. Stefka Mihaylova argues that such non-conforming viewing amounts to an avant-garde of its own: a bold reimagining of how we live together and tell stories of our lives together, aimed to achieve liberalism's promise. In telling this story, she analyzes the production and reception politics of works by Susan-Lori Parks, Sarah Kane, Forced Entertainment, Gurpreet Kaur Bhatti, and Young Jean Lee, as well as non-theatrical controversies such as the conflict over Halloween costumes at Yale in 2015. At the core of spectators' discontent, this book suggests, is an effort to figure out how to get along with people different from ourselves in the diverse U.S. and British societies in which we live

    Abstract: There is a category of choreographic practice with a lineage stretching back to mid-20th century North America that has re-emerged since the early 1990s: dance as a contemporary art medium. Such work belongs as much to the gallery as does video art or sculpture and is distinct from both performance art and its history as well as from theater-based dance. The Persistence of Dance: Choreography as Concept and Material in Contemporary Art explores this history by looking at the continuities and differences between the second-wave dance avant-garde in the 1950s-1970s and the third-wave starting in the 1990s. Through close readings of key artists such as Maria Hassabi, Sarah Michelson, Boris Charmatz, Meg Stuart, Philip Gehmacher, Adam Linder, Agatha Gothe-Snape, Shelley Lasica and Latai Taumoepeau, The Persistence of Dance traces the relationship between the third-wave and gallery-based work. Looking at these artists highlights how the discussions and practices associated with 'conceptual dance' resonate with the categories of conceptual and post-conceptual art as well as with the critical work on the function of visual art categories. Brannigan concludes that within the current post-disciplinary context, there is a persistence of dance and that a model of post-dance exists that encompasses dance as a contemporary art medium

    Abstract: In recent years, the federal government's increasing inability to address major societal challenges has arguably hampered America's commitment to renewable energy initiatives. Individual U.S. states have stepped into this void and adopted their own policies, leading some to believe that the states can propel America's renewable energy industry forward. However, we know little about how legislative and regulatory dynamics within America's states might accelerate or hinder renewable energy policy creation. In Following in Footsteps or Marching Alone?, Srinivas Parinandi explores how states have devised their own novel policies, and how the political workings of legislatures and public utilities commissions have impacted state renewable energy policy design. Through the meticulous study of nearly three decades of state-level renewable energy policy-making, he finds that their creation is primarily driven by legislatures, and that ideologically liberal legislatures largely push the envelope. The book suggests that having a predominantly state-driven renewable energy effort can lead to uneven and patchwork-based policy development outcomes, and a possible solution is to try to more successfully federalize these issues. Parinandi urges readers, scholars, and policy practitioners to consider whether a state-led effort is adequate enough to handle the task of building momentum for renewable energy in one of the world's largest electricity markets

    Abstract: A brief stay in France was, for many Chinese workers and Chinese Communist Party leaders, a vital stepping stone for their careers during the cultural and political push to modernize China after World War I. For the Chinese students who went abroad specifically to study Western art and literature, these trips meant something else entirely. Set against the backdrop of interwar Paris, Paris and the Art of Transposition uncovers previously marginalized archives to reveal the artistic strategies employed by Chinese artists and writers in the early twentieth-century transnational imaginary and to explain why Paris played such a central role in the global reception of modern Chinese literature and art. While previous studies of Chinese modernism have focused on how Western modernist aesthetics were adapted or translated to the Chinese context, Angie Chau does the opposite by turning to Paris in the Chinese imaginary and discussing the literary and visual artwork of five artists who moved between France and China: the painter Chang Yu, the poet Li Jinfa, art critic Fu Lei, the painter Pan Yuliang, and the writer Xu Xu. Chau draws the idea of transposition from music theory where it refers to shifting music from one key or clef to another, or to adapting a song originally composed for one instrument to be played by another. Transposing transposition to the study of art and literature, Chau uses the term to describe a fluid and strategic art practice that depends on the tension between foreign and familiar, new and old, celebrating both novelty and recognition--a process that occurs when a text gets placed into a fresh context

    Abstract: Dr. Hu Shih (1891-1962) was one of China's top scholars and diplomats and served as the Republic of China's ambassador to the United States during World War II. As early as 1941, Hu Shih warned of the fundamental ideological conflict between dictatorial totalitarianism and democratic systems, a view that later became the foundation of the Cold War narrative. In the 1950s, after Mao's authoritarian regime was established, Hu Shih started to analyze the development and nature of Communism, delivering a series of lectures and addresses to reveal what he called Stalin's "grand strategy" for facilitating the International Communist Movement. For decades--and today to a certain extent--Hu Shih's political writings were considered sensitive and even dangerous. As a strident critic of the Chinese Communist Party's oligarchical practices, he was targeted by the CCP in a concerted national campaign to smear his reputation, cast aspersions on his writings, and generally destroy any possible influence he might have in China. This volume brings together a collection of Hu Shih's most important, mostly unpublished, English-language speeches, interviews, and commentaries on international politics, China-U.S. relations, and the International Communist Movement. Taken together, these works provide an insider's perspective on Sino-American relations and the development of the International Communist Movement over the course of the 20th century

    Abstract: South End Shout: Boston's Forgotten Music Scene in the Jazz Age details the power of music in the city's African American community. The focus is from the era of ragtime in the 1900s to the rise of big band swing in the 1930s. The story of jazz is embedded in the larger social condition of Black Bostonians. It covers the activities of jazz musicians, jazz bands, the places they played, the relationships between Black and white musicians, the segregated branches of the musicians' union, and the economics of the South End music industry. The account is brought to life by the addition of 20 line drawings of musicians, theaters, hotels, dance halls, and devices used to listen to music. South End Shout is part of an emerging field of studies that examine jazz culture outside of the major centers of music production. As such, the account helps to better understand how jazz emerged as a national art form in the first quarter of the 20th century

    Abstract: Before he became the father of cinematic special effects, George Méliès (1861-1938) was a maker of deluxe French footwear, an illusionist, and a caricaturist. Proceeding from these beginnings, Méliès Boots traces how the full trajectory of Georges Méliès' career during the late-nineteenth and early-twentieth centuries, along with the larger cultural and historical contexts in which Méliès operated, shaped his cinematic oeuvre. Solomon examines Méliès' unpublished drawings and published caricatures, the role of laughter in his magic theater productions, and the constituent elements of what Méliès called "the new profession of the cinéaste." The book also reveals Méliès' connections to the Incohérents, a group of ephemeral artists from the 1880s, demonstrating the group's relevance for Méliès, early cinema, and modernity. By positioning Méliès in relation to the material culture of his time, Solomon demonstrates that Méliès' work was expressive of a distinctly modern, and modernist, sensibility that appeared in France during the 1880s in the wake of the Second Industrial Revolution

He also posits the games as a cultural landmark from a moment when public policy attempted to intervene in both the remediation of cinematic aesthetics within interactive digital games and in the transition of public gaming spaces into the domestic sphere. Finally, the book explores how the franchise attempted to conquer other forms of media in the 1990s, lost ground to a new generation of 3D games in the 2000s, and has successfully rebooted itself in the 2010s to reclaim its legacy

    Abstract: "The Repoliticization of the Welfare State grapples with the evolving nature of political conflict over social spending after the Great Recession. While the severity of the economic crisis encouraged strong social spending responses to protect millions of individuals, governments have faced growing pressure to reduce budgets and make deep cuts to the welfare state. Whereas conservative parties have embraced fiscal discipline and welfare state cuts, left-wing parties have turned away from austerity in favor of higher social spending. These political differences represent a return of traditional left-right beliefs over social spending and economic governance. This book is one of the first to systematically compare welfare state politics before and after the Great Recession, arguing that a new and lasting post-crisis dynamic has emerged where political parties once again matter for social spending. At the heart of this repoliticization are intense ideological debates over market regulation, social inequality, redistribution, and the role of the state. The book analyzes social spending dynamics for 28 countries before and after the crisis. It also includes in-depth country case studies representing five distinct welfare state types: Germany, the United Kingdom, Sweden, Spain, and the Czech Republic"

    Abstract: Righteous Revolutionaries illustrates how states appeal to popular morality--shared understandings of right and wrong--to forge new group identities and mobilize violence against perceived threats to their authority. Jeffrey A. Javed examines the Chinese Communist Party's mass mobilization of violence during its land reform campaign in the early 1950s, one of the most violent and successful state-building efforts in history. Using an array of novel archival, documentary, and quantitative historical data, this book illustrates that China's land reform campaign was not just about economic redistribution but rather part of a larger, brutally violent state-building effort to delegitimize the new party-state's internal rivals and establish its moral authority. Righteous Revolutionaries argues that the Chinese Party-state simultaneously removed perceived threats to its authority at the grassroots and bolstered its legitimacy through a process called moral mobilization. This mobilization process created a moral boundary that designated a virtuous ingroup of "the masses" and a demonized outgroup of "class enemies," mobilized the masses to participate in violence against this broadly defined outgroup, and strengthened this symbolic boundary by making the masses complicit in state violence. Righteous Revolutionaries shows how we can find traces of moral mobilization in China today under Xi Jinping's rule. In an era where states and politicians regularly weaponize moral emotions to foment intergroup conflict and violence, understanding the dynamics of violent mobilization and state authority are more relevant than ever before

Across eras and global regions New Materials reflects circumstances not made clear when technological innovation is explained solely as a by-product of modernizing impulses or critiqued simply as a craving for profit. Whether establishing the efficacy of nano-scale pharmaceuticals or the tastiness of farmed catfish, proponents of new materials enact complex political ideologies.     Abstract: This collection offers a critical assessment of transcendentalism, the understanding of consciousness, absolutized as a system of a priori laws of the mind, that was advanced by Kant and Husserl. As these studies show, transcendentalism critically informed 20th Century phenomenological investigation into such issues as temporality, historicity, imagination, objectivity and subjectivity, freedom, ethical judgment, work, praxis. Advances in science have now provoked a questioning of the absolute prerogatives of consciousness. Transcendentalism is challenged by empirical reductionism. And recognition of the role the celestial sphere plays in life on planet earth suggests that a radical shift of philosophy's center of gravity be made away from absolute consciousness and toward the transcendental forces at play in the architectonics of the cosmos.

    Abstract: While the vital logos of beingness recollects for its constitutive use fragments from memory 's magazine, ensuring constructive continuity in accordance with its genetic patterns, the creative logos of the human mind also is indebted to the work of memory in creative imagination for the essential role it plays in the selective transformation, invention, projection that informs the felt and intelligible logos of human selfhood, personality, meaning, fullness, destiny... the world of life. As fragmentary and seemingly disjointed as it is in relation to concrete subjective experience, memory as it surges from the past, maintains an essential link to constituting reality. The creative imagination of the logos of human mind projects horizons for the past and the future is an encircling continuity of sense with the fulgurations of the sacral logos. In its innumerably differentiated role memory finds its unifying stream only upon the primogenital - ontopoietic - platform of the logos of life.

    Abstract: From Aristotle to the present, memory has been grasped as a trace or impression of lost reality - bridging physiological experience and consciousness. Philosophers have vainly sought the nature of this bridge. The present-day physiologizing/naturalizing of consciousness is not resolving their congenital continuity, in which the very existence and practice of life is rooted. We have to change our approach (Erwin Straus). The Aristotelian congenital ties between memory and temporality, acquire crucial significance in our primogenital ontopoiesis of life (Tymieniecka). It reveals memory to be the factor that carries this coalescence and the becoming of life itself. This can be the fruit only of the generative springs of life, first phenomenology/philosophy, the ontopoietic logos of life. In this collection we explore memory in the constitution of reality: rememorizing and interpretation, consciousness/action, facts/imagination, history/myths, self-realization/metamorphosis.

    Abstract: In medicine the understanding and interpretation of the complex reality of illness currently refers either to an organismic approach that focuses on the physical or to a 'holistic' approach that takes into account the patient's human sociocultural involvement. Yet as the papers of this collection show, the suffering human person refers ultimately to his/her existential sphere. Hence, praxis is supplemented by still other perspectives for valuation and interpretation: ethical, spiritual, and religious. Can medicine ignore these considerations or push them to the side as being subjective and arbitrary? Phenomenology/philosophy-of-life recognizes all of the above approaches to be essential facets of the Human Condition (Tymieniecka). This approach holds that all the facets of the Human Condition have equal objectivity and legitimacy. It completes the accepted medical outlook and points the way toward a new `medical humanism'

    Abstract: It would seem that modern humanity has unthroned the human spirit, undercutting the very foundation of the validity of truth, moral values and principles. There appears to be no attempt to discern what is beautiful and true: it is functional and pragmatic usefulness that seem to dominate human evaluations and transactions with other humans and, indeed, animals. Humanity is becoming detached from the `higher' aesthetic, moral and intellectual works of the human spirit and thus the life of the spirit is often situated on the other side of a gulf, opposed to science with its rationality. Culture is in danger of becoming reduced to science. In other words, the great metaphysical questions - those of telos, of sense - often are answered in terms of scientific conceptions. But these are at least incomplete, if not fragmentary, and in principle hypothetical, which still leaves the questions unanswered. But it is culture that is the manifestation of the human spirit, being the historical process of human self-interpretation-in-existence. All manifestations of the creative forge of the human being find a role in the fabric of culture, which involves progressively widening circles of the human community, demanding an integration and attunement with others in their changing conditions of life. This consideration of culture involves all areas of philosophical reflection: moral, aesthetic, metaphysical, epistemological, semiological, cognitive, and more

    Abstract: There is a new rhythm permeating phenomenology, which is re-orienting towards the ontopoiesis of life.     Abstract: This collection is the final volume of a four book survey of the state of phenomenology fifty years after the death of Edmund Husserl.     Abstract: The following bibliography, arranged chronologically, permits the reader to follow the development of phenomenological studies in Italy in parallel with other, contemporary, cultural currents. From this list it can be seen that knowledge of Hussed's work begins in 1923 with the studies of A. Banfi. Phenomenology, however, did not immediately receive a warm welcome. It contrasted with the then dominant neo-idealism (as has been made clear by G. De Ruggiero), but for this very reason it also found adherents among the opponents of idealism. These were either distant heirs of positivism, who accepted Hussed on account of his scientific approach and rigor, or Christian­ oriented thinkers, who, following an initial period of diffidence toward the antimetaphysical attitude of phenomenological analysis, gradually began to use this method as an antiidealist instrument - even though the problem remained of Hussed's own transcendental idealism and the value to be attributed to it. Despite the difficulties encountered on the way, the numerous studies carried out in Italy prior to Wodd War II make it clear that the better known philosophers who have left a mark on Italian culture already had begun to take a discreet interest in phenomenology.

    Abstract: Studies on different aspects of Roman Ingarden's Philosophy have been published during the last thirty years. They were meant partly to in­ vestigate the contribution of that thinker to phenomenological philoso­ phy, which was then dominant in WestemEurope, partly to arouse interest in a philosopher who was, at that time, practically unknown. The publication by the present editor of For Roman Ingarden: Nine Essays in Phenomenology, a Festschrift for his 65th birthday, marked the beginning of an interest in his thought. Subsequently, Ingarden has lectured abroad, and a number of his hitherto inaccessible Polish works have been made available, some translated into German and some even into English. This has led to further studies of his thought. However, the majority of the papers published have until now been mainly introductory. This volume offers for the first time a series of systematic studies in Ingardenian philosophy, which, it is hoped, will supply a general framework as well as a foundation for future research in this wide and difficult field.

    Abstract: While following the probes of foreign individuals into various obscure parts of Southeast Asia over the centuries is a diverting and entertaining pastime, the purpose of this volume is to investigate this past with the mind, to question and postulate upon the historical patterns that have developed from earlier study of the area, and to bring concepts from other areas and disciplines to bear on the existing information. The product of this effort, as it is encompassed in this volume, is not an attempt at the definitive study of any of the topics. It is rather a series of speculations on the directions feasible for the further study of the Southeast Asian past. As such, the answers proposed in these essays are really questions. Are the ideas presented here true within the specific historical contexts for which they have been developed? If so, can we use these ideas, or variations of them, to interpret the history of other parts of Southeast Asia? If not, what other ideas may be brought to bear on these situations in order to understand them? The ultimate aim of this volume is thus a challenge to the profession at large not only to criticize what we have done, but also to go beyond our postulations and create new ones. [xi]
