The first one revolves around the broader aspects of current space law, such as intellectual property rights in outer space, the legal implications of contact with extra-terrestrial intelligence, legal considerations around the freedom of exploration and use, and the International Space Station agreement as a precedent for Mars. The second one focuses on the creation and management of a new society on Mars, and includes topics such as human reproduction and childbirth, the protection of human rights in privately-funded settlements, legal aspects of a Martian power grid, and criminal justice on the red planet.     Kurzfassung: This book explores how Europe is seeking to enlarge its launching capacities by building additional spaceports on the European continent. Various national initiatives are envisaged resulting in a “space race” in the field of constructing spaceports and building micro launchers. However, right from the beginning when choosing the launch site (land or sea based-rocket launches) there are various factors relating to international space law, European regulations and national rules that must be considered, as spaceports are rarely explicitly addressed in current legal and policy frameworks. While launching sites used to be operated by governments, private commercial initiatives are increasingly entering the field. This paradigm shift must be reflected within regulations relating to various aspects of space liability by enlarging the long-established terms of the United Nations space treaties to accommodate commercial space flights. Questions of permission, supervision and control require special liability regulations to avoid detrimental consequences stemming from the concept of “launching states” in view of the rise of private driven commercial space activities on a global level. Furthermore, not only do environmental aspects need to be thoroughly examined but also the concept of critical infrastructure requires special attention from a security perspective to anticipate, inter alia, cyber-attacks. For these reasons, several European and national regulations may need to be enlarged to apply to the entire space sector, using a harmonized approach that has direct implications for the regulations, programmes, and missions of the European Union and the European Space Agency, bearing in mind that the upcoming spaceports in Europe are an essential asset to substantially boost the European New Space.

    Kurzfassung: The book analyses a broad range of relevant aspects as the outer space and cyber space domain do not only present analogies but are also strongly interrelated. This may occur on various levels by technologies but also in regard to juridical approaches, each nevertheless keeping its particularities. Since modern societies rely increasingly on space applications that depend on cyber space, it is important to investigate how cyberspace and outer space are connected by their common challenges. Furthermore, this book discusses not only questions around their jurisdictions, but also whether the private space industry can escape jurisdiction by dematerializing the space resource commercial processes and assets thanks to cyber technology. In addition, space and cyberspace policies are analysed especially in view of cyber threats to space communications.     Kurzfassung: This book shares a range of new and diverse insights on On-Orbit Servicing (OOS), and examines its implications especially from political, legal, economic, and security perspectives. OSS has been evolving rapidly and presents both challenges and opportunities, such as in-space repairs, refuelling, refurbishment of spacecraft and servicing satellites, which could play a critical role in extending satellite lifecycles, while also representing a valuable next step in debris mitigation. At the same time, many legal questions have arisen in connection with OOS: the need to prevent hostile actions under the pretext of OSS; the distinction between governmental and non-governmental OOS operators; the status of re-worked and recycled space objects; the issue of control in terms of operations performed in orbit, i.e., in the international sphere; the status of objects manufactured in orbit and applicable law, including liability and registration; and the impacts on insurance law and risk management.     Kurzfassung: On the occasion of the 50th anniversary of the Outer Space Treaty this book gives a first insight into where the next generation considers room for further improvement of the Outer Space Treaty in order to cope with upcoming aspects such as providing solutions for the emerging commercial, economic, environmental and social questions. At the time of the adoption of the Outer Space Treaty in 1967 the purpose of this treaty was to avoid conflicting military situations in space.
