    Abstract: This volume provides the first comprehensive analysis of international legal debates between 1955 and 1975 related to the formal decolonization process. It is during this era, couched between classic European imperialism and a new form of US-led Western hegemony, that fundamental legal debates took place over a new international legal order for a decolonised world. The book argues that this era presents in essence a battle, a battle that was fought out in particular over the premises and principles of international law by diplomats, lawyers, and scholars. In a moment of relative weakness of European powers, 'newly independent states' and international lawyers from the South fundamentally challenged traditional Western perceptions of international legal structures engaging in fundamental controversies over a new international law. The legal outcomes of this battle have shaped the world we live in today. Contributions from a global set of authors cover contemporary debates on concepts central to the time, such as self-determination, sources and concessions, non-intervention, wars of national liberation, multinational corporations, and the law of the sea. They also discuss influential institutions, such as the United Nations, International Court of Justice, and World Bank.     Abstract: This book reveals what happens to applications for post-conviction review when those in England, Wales, and Northern Ireland who believe they are wrongfully convicted apply to the Criminal Cases Review Commission, the only body that can refer a case back to the Court of Appeal once appellants opportunities for direct appeal are exhausted. While the Court is obliged to hear all such referrals, the Commission can only refer a case where it believes there is a real possibility that the Court will quash the conviction. The first empirical study of all stages of decision-making within the Commission, this book starts from the premise that the test applied by the Commission (the real possibility test) is not inflexible. Though created by statute and refined through case law, it must be determined on a case-by-case basis, drawing too on cultural and structural variables, alongside fresh evidence gathered by the Commission. Through in-depth analysis of case files and interviews, Hoyle and Sato scrutinize the Commissions operational practices, its working rules and assumptions, considering how these influence its understanding of the real possibility test. Situating their rich empirical data within a framework of the Commissions social, organizational, and legal contexts, this book demonstrates that in its open-ended investigations there is considerable scope for discretion; for thorough exploration of all possible avenues or for choosing a more superficial consideration of a case. It emerges that while structured internal guidance, drawing heavily on Court jurisprudence, shapes decision-making, creating consistency in approach, there remains some variability across cases, over time, that can be accounted for by the different professional backgrounds and personalities of Commission staff

    Abstract: Redeeming Anthropology lifts a veil on anthropology as a modern academic discipline, constituted by its secular sovereign reason and membership in the Enlightenment-bequeathed university. Mining anthropology's biographical corpus, Khaled Furani reveals ways theology has always existed in its recesses, despite perpetual efforts at immuring encroachment by this banished other. Anthropologists have alternatively spurned, disregarded, and followed forms of religiosity, transmuting their theistic engagement in their professional work. Centrally, if unwittingly, theology remains in anthropology's consummate rite of ethnographic immersion, defying precepts on the autonomy of reason and knowledge production by immersing the seeker in the sought-after. Nevertheless, anthropology ultimately commits idolatry by largely adoring the concept of Culture, and its constructs, and upholding itself as pre-eminently an ethical triumph. Furthermore, by limiting its horizons to finite categories of "human" and"natural," anthropology entangles itself in "worship" of the State and conclusively of the sovereignty principle that powers modern reason. Recovery from idolatry might arrive should anthropological reason become attuned to its fragility, cease to fear theistic reason, and open pathways toward revitalization through revelation

    Abstract: Sir Edward Evan Evans-Pritchard (1902-1973) is widely considered the most influential British anthropologist of the twentieth century, known to generations of students for his seminal works on South Sudanese ethnography Witchcraft, Oracles and Magic Among the Azande (OUP 1937) and The Nuer (OUP 1940). In these works, now classics in the anthropological literature, Evans-Pritchard broke new ground on questions of rationality, social accountability, kinship, social and political organization, and religion, as well as influentially moving the discipline in Britain away from the natural sciences and towards history. Yet despite much discussion about his theoretical contributions to anthropology, no study has yet explored his fieldwork in detail in order to get a better understanding of its historical contexts, local circumstances or the social encounters out of which it emerged. This book then is just such an exploration, of Evans-Pritchard the fieldworker through the lens of his fieldwork photography.     Abstract: An innovative, interdisciplinary and far-reaching examination of the actual reality of international courts, International Court Authority challenges fundamental preconceptions about when, why, and how international courts become important and authoritative actors in national, regional, and international politics. A stellar group of scholars investigate the challenges that international courts face in transforming the formal legal authority conferred by states into an actual authority in fact that is respected by potential litigants, national actors, legal communities, and publics. Alter, Helfer, and Madsen provide a novel framework for conceptualizing international court authority that focuses on the reactions and practices of these key audiences. Eighteen scholars from the disciplines of law, political science and sociology apply this framework to study thirteen international courts operating in Africa, Latin America, and Europe, as well as on a global level. Together the contributors document and explore important and interesting variations in whether the audiences that interact with international courts around the world embrace or reject the rulings of these judicial institutions. Alter, Helfer, and Madsen's authority framework recognizes that international judges can and often do everything they 'should' do to ensure that their rulings possess the gravitas and stature that national courts enjoy. Yet even when imbued with these characteristics, the parties to the dispute, potential future litigants, and the broader set of actors that monitor and respond to the court's activities may fail to acknowledge the rulings as binding or take meaningful steps to modify their behaviour in response to them. For both specific judicial institutions, and more generally, the book documents and explains why most international courts possess de facto authority that is partial, variable, and highly dependent on a range of different audiences and contexts - and thus is highly fragile.

    Abstract: This book offers a major new theory of global governance, explaining both its rise and what many see as its current crisis. The author suggests that world politics is now embedded in a normative and institutional structure dominated by hierarchies and power inequalities and therefore inherently creates contestation, resistance, and distributional struggles. Within an ambitious and systematic new conceptual framework, the theory makes four key contributions. Firstly, it reconstructs global governance as a political system which builds on normative principles and reflexive authorities. Second, it identifies the central legitimation problems of the global governance system with a constitutionalist setting in mind. Third, it explains the rise of state and societal contestation by identifying key endogenous dynamics and probing the causal mechanisms that produced them. Finally, it identifies the conditions under which struggles in the global governance system lead to decline or deepening. Rich with propositions, insights, and evidence, the book promises to be the most important and comprehensive theoretical argument about world politics of the 21st century.

    Abstract: The Oxford Handbook of the Ends of Empire offers the most comprehensive treatment of the causes, course, and consequences of the ends of empire in the twentieth century. The volume's contributors convey the global reach of decolonization, with chapters analysing the empires of Western Europe, Eastern Europe, China and Japan. The Handbook combines broad, regional treatments of decolonization with chapter contributions constructed around particular themes or social issues. It considers how the history of decolonization is being rethought as a result of the rise of the 'new' imperial history, and its emphasis on race, gender, and culture, as well as the more recent growth of interest in histories of globalization, transnational history, and histories of migration and diaspora, humanitarianism and development,0and human rights. Such organizations can be owned by their consumers, the producers, or the employees - whether through single-stakeholder or multi-stakeholder ownership. This complex set of organizations is named differently across countries: from 'mutual' in the UK, to 'solidarity cooperatives' in Latin America. In some countries, such organizations are not even officially recognized and thus lack a specific denomination.     Abstract: It is an unfortunate but unavoidable feature of even well-ordered democratic societies that governmental administrative agencies often create legitimate expectations (procedural or substantive) on the part of non-governmental agents (individual citizens, groups, businesses, organizations, institutions, and instrumentalities) but find themselves unable to fulfil those expectations for reasons of justice, the public interest, severe financial constraints, and sometimes harsh political realities. How governmental administrative agencies, operating on behalf of society, handle the creation and frustration of legitimate expectations implicates a whole host of values that we have reason to care about, including under non-ideal conditions-not least justice, fairness, autonomy, the rule of law, responsible uses of power, credible commitments, reliance interests, security of expectations, stability, democracy, parliamentary supremacy, and legitimate authority. This book develops a new theory of legitimate expectations for public administration drawing on normative arguments from political and legal theory. Brown begins by offering a new account of the legitimacy of legitimate expectations. He argues that it is the very responsibility of governmental administrative agencies for creating expectations that ought to ground legitimacy, as opposed to the justice or the legitimate authority of those agencies and expectations. He also clarifies some of the main ways in which agencies can be responsible for creating expectations. Moreover, he argues that governmental administrative agencies should be held liable for losses they directly cause by creating and then frustrating legitimate expectations on the part of non-governmental agents and, if liable, have an obligation to make adequate compensation payments in respect of those losses. --

    Abstract: Europe is currently experiencing a "refugee crisis", demonstrated by millions of displaced people unseen since World War II. This book examines the interface between the EU's response to irregular flows, in particular the main extraterritorial border and migration controls taken by the Member States, and the rights asylum seekers acquire from EU law. "Remote control" techniques, such as the imposition of visas, fines on carriers transporting unsatisfactorily documented third-country nationals, and interception at sea are investigated in detail in a bid to assess the impact these measures have on access to asylum in the EU. The book also thoroughly analyses the rights recognised by the EU Charter of Fundamental Rights to persons in need of international protection, inclusive of the principle of non-refoulement, the right to leave any country including one's own, the right to asylum, and the right to remedies and effective judicial protection. The fundamental focus of the book is the relationship between the aforementioned border and migration controls and the rights of asylum seekers and, most importantly, how these rights (should) limit the scope of such measures and the ways in which they are implemented. The ultimate goal is to conclude whether the current series of extraterritorial mechanisms of pre-entry vetting is compatible in EU law with the EU rights of forced migrants.--

    Abstract: Since the onset of the global economic crisis, activists, policy makers, and social scientists have been searching for alternative paradigms through which to re-imagine contemporary modes of thinking and writing about economic orders. These attempts have led to their re-engagement with fundamental anthropological categories of economic analysis, such as barter, debt, and the gift. Focusing on favours, and the paradoxes of action, meaning, and significance they engender, this volume advocates for their addition to this list of economic universals. It presents a critical re-interrogation of the conceptual relationships between gratuitous and instrumental behaviour, and raises novel questions about the intersection of economic actions with the ethical and expressive aspects of human life. Scholars of post-socialist politics and society have often used 'favour' as a by-word for corruption and clientelism. The contributors to this volume treat favours, and the doing of favours, as a distinct mode of acting, rather than as a form of 'masked' economic exchange or simply an expression of goodwill. Casting their comparative net from post-socialist Central, Eastern, and South Eastern Europe; to the former Soviet Union, Mongolia, and post-Maoist China, the contributors to this volume show how gratuitous behaviour shapes a plethora of different actions, practices, and judgements across religious and political life, imaginative practices, and local moral economies. They show that favours do not operate 'outside' or 'beyond' the economic sphere. Rather, they constitute a distinct mode of action which has economic consequences, without being fully explicable in terms of transactional cost-benefit analyses.

    Abstract: This book provides an account and explanation of a fundamental dilemma facing secular states: the "legitimacy gap" left by the withdrawal of religion as a source of legitimacy. Legitimacy represents a particular problem for the secular state. The "secular" in all its manifestations is very much linked to the historical rise of the modern state. It should not be seen as a category that separates culture and religion from politics, but rather as one that links these different dimensions. In the first part of the book, Depaigne explains how modern constitutional law has moved away from a "substantive" legitimacy, based in particular on natural law, towards a 'procedural' legitimacy based on popular sovereignty and human rights. Depaigne examines three case studies of constitutional responses to legitimacy challenges which articulate the three main sources of "procedural" legitimacy (people, rights, and culture) in different ways: the "neutral model" (constitutions based on the "displacement of culture"); the "multicultural model" (constitutions based on diversity and pluralism); and the "asymmetric model" (constitutions based on tradition). Even if secularization can be considered European in its origin, it is best seen today as a global phenomenon, which needs to be approached by taking into account the particular cultural dimension in which it is rooted. Depaigne's detailed study shows how secularization has moved either towards "nationalization" linked to a particular national identity (as in France and, to some extent, in India)-or towards "de-secularization", whereby secularism is displaced by particular cultural norms, as in Malaysia --Front flap of book
